Former First Gentleman Jose Miguel Arroyo arrived in Manila on Monday after a medical check-up in Hong Kong last week, saying he is now ready to defend himself from accusations leveled against him by his detractors.

“To my detractors, I’m back. You should be ashamed for peddling lies to the public while I was away,” he said at a press conference at the airport.

He said he is ready to face all accusations hurled against him by what he called a “dictatorial” administration.

Arroyo said he would take legal action against the Aquino government for placing him on the immigration watch list, saying it violates his constitutional right to travel.


Arroyo said he will question the justice department order before the Supreme Court. The order prevents him from traveling without permission from authorities.

Arroyo also reiterated he would file a complaint of perjury against businessman Archibald Po, who accused him of owning and selling 2 second-hand helicopters to the Philippine National Police (PNP) passed off as brand new.

Arroyo begged off from answering questions from the press due to his heart condition, but asked his lawyers to speak on his behalf.

His lawyer, Inocencio Ferrer, said the issuance of a watch list order against Arroyo is illegal since no criminal case has been filed against him.

“There’s no case filed against him so why issue a watch list order? His family is here. In our petition, there is no basis for this. It is against the Bill of Rights. He should be allowed to enter and leave the country,” he told reporters.

Arroyo, who has been linked to the sale of pre-owned helicopters to the PNP, said he is convinced that the Aquino administration is coordinating efforts to harass the previous administration for “imagined transgressions.”

He claimed that the current administration is not averse to exonerating criminals with the end in view of punishing perceived political enemies.

“This administration is hell bent on making our lives miserable by resorting to trial by publicity,” he said.

Arroyo said he has no intention of avoiding accusations made by Po, president of Lion Air, who testified before the Senate that Arroyo owned 2 second-hand helicopters sold to the PNP.

“I have no intention of avoiding accusations coming from Mr. Archibald Po who seeks witness protection in the same way and manner that Zaldy Amaptuan seeks government protection as a state witness in an attempt to escape liability for criminal acts,” he said.

He said he has asked his lawyers to study the filing of perjury charges against Po.

“I do not own those helicopters sold to PNP. I did not purchase the choppers from Po. I will not allow him to use my name to extricate himself from the criminal acts he has done,” he said.

A Malacañang spokesman rebuffed Monday former First Gentleman Jose Miguel Arroyo for saying that the Aquino administration has become dictatorial.

In a press briefing, Presidential Spokesman Edwin Lacierda said: “We are way, way different from the previous administration of his wife.”

Lacierda denied that the Palace is being vengeful against the Arroyos after numerous corruption allegations cropped up against the former First Family. He said Arroyo should not be afraid if he has done nothing wrong.

“If he finds that it is something negative towards them, it is understandable. Because we have uncovered so many things under his wife’s administration. If there is nothing that they have done wrong, I’m certain that he will welcome all this forums to clear their names. This is not about being vengeful this is about making accountable all the taxpayers’ money,” he said.

He also denied that the Palace is forging a secret deal with suspended Autonomous Region in Muslim Mindanao (ARMM) Governor Zaldy Ampatuan to testify against former President Gloria Macapagal Arroyo. He said President Aquino has already stated that he is not interested in tapping Ampatuan as a state witness.

“[Arroyo] should be better informed of the situation there. We have already stated what happened in the discussions there. And so I think he should stop peddling lies,” he said.

Lacierda said the Palace is hoping Arroyo will appear and testify in the Senate Blue Ribbon Committee inquiry on the Philippine National Police’s purchase of pre-owned helicopters that were labeled as brand new. A local businessman earlier identified the former First Gentleman as the owner of the 2 choppers.

“We hope that he will be telling us the truth and not cloak himself under the right against self incrimination or to even invoke his health. I understand that he has already mentioned substantially his health condition in his statement in the airport. I hope that is not a prelude to invoking medical reasons for not appearing,” he said.

He also rejected Arroyo’s statement that the Department of Justice lied when it said there was no record of Arroyo’s departure to Hong Kong before the Senate inquiry. The Bureau of Immigration later admitted that the lack of Arroyo’s departure record was the result of human error, prompting Justice Secretary Leila de Lima to apologize to Mr. Arroyo.

“It was a mistake on the part of the Bureau of Immigration and she relied on the information provided to her. As soon as she discovered that there was a mistake, she immediately apologized,” he said.

The Malacañang spokesman asked Arroyo to hold off his comments on the suicide of Development Bank of the Philippines alwyer Benjamin Pinpin. He said the matter is covered by the DBP Board, and that Malacañang does not have a hand in the DBP Board’s decision making process.

    You think he skipped town to avoid the Senate probe? Bakit bumalik agad?

    Financial ang purpose ng biyahe; to pay somebody to shut up, or prevent somebody from corroborating Archibald Po, or, get money to pay more people.

    Ang problema, and source of delicious attorney’s fees (bwahahaha), is that all that is required to trigger a non-bailable offense prosecution is the finding of probable cause. Kung yan lang, sapat na yung affidavit ni Archibald Po. In fact, higit na sapat yang affidavit na yan kaysa sa affidavit ukol sa mga buto ng baka masquerading as Dacer’s bones, or even the trumped up charges against Danny Lim, Trillanes, et al.

    Tiba-tiba na naman ang mga consiglieri.

    Archibal Po testifies Piggy Arroyo owns the two choppers sold anomalously to PNP. He further avers that the two other helicopters now berthed at the hangars of LionAir are Piggy’s as well (and a third that crashed in 2007 as well). As usual, Piggy denied he owned any one of the five helicopters.
    Since nabuking na ang PNP deal and one is already crashed, expect IGGY ARROYO to come out of the blue and claim ownership of the choppers at LionAir hangars. Just like how he bacame an instant millionaire in the Jose Pidal case. Deja vu in the making??

    Mahina ang quantum of evidence required for probable cause. It does not have to be conclusive as the evidence needed to convict.

    He may not be considered among the tops and brilliants, but he is still a lawyer and knows the ins and outs of a case. So if it appears that he is so confident, arrogant and in a fighting mood, there’s only one explanation: he left no trail of illegal transactions that will incriminate him and his family. Ang sabi nga malinis magtrabaho.

    As yet, there’s no air tight case filed or to be filed aginst them in court. My worry is that nobody among the family of thieves will end up and serve time, which render all these diggings and announcements of all their sins as waste of times and resources and only as a cover up for their own incompetence.

    The cases against Erap, Trillanes, or Danny Lim were not airtight either. But when the charge is non-bailable, the accused stays in jail until the case is dismissed.

    Same is true for Michael Ray Aquino. The affidavit of Archibald Po certainly carries more persuasive evidence than Mancao’s. But Aquino is in jail, because the charge is non-bailable.

    Arrogance is not a sign of innocence. An innocent man would be indignant; or hurt. Arrogance is a sign that one thinks he can buy himself out of trouble. Perfect example is Al Capone, John Gotti or the Borjer. When you have the judge in your pockets no amount of evidence can nail you.

    Right, arrogance is not a sign of innocence, rather more of a psyche and posturing.

    What I am saying is being in jail while the case is being tried and decided upon is not serving time. They are in jail because the crime is non-bailable and it’s within the law.

    What I am hoping and looking forward is for them to serve the full force of the law. Without an airtight case, the possibility of being acquitted is always there.

    And of course, we can not discount the power of money.

Everytime the noose seems to tighten on Fat Mike he ups and goes abroad, does some spring cleaning of sorts and the money trail, bank accounts, and evidence vanish in thin air leaving the investigators looking silly. I’m getting tired of all this bad guys beating the good guys all the time movie, I don’t see any do or die characters or obsessively passionate people on the government’s side, no Eliot Ness types. Sigh.

    59 people dead! How many are in prison? Thieving politicians and high ranking military officer in broad daylight, how many are in prison?

    Judges, politicians, and crooks/thugs go to iron laced institutions in America, unlike Pinas where you go to some RestHouse when you are convicted of plunder, or don’t go to prison at all. King Pig and Queen Piggy, and their piglits will never see the inside of bilibid or any jail for that matter.

    If you find probable cause, that guy goes to jail. Bahala siyang pumunta sa CA to get a TRO. Meantime, you do your lawyerly and “very professional” motions for extension of time, because of pressure of other cases, etc.

    That is what they were trying to do to Ping, with the full-court press on Mancao at the Florida jail, with a USEC, an ASEC, Hazel Valdez, and an NBI director.

    Same thing was done to Enrile by Joker (then presidential legal adviser of Cory) Drilon was in favor of the Lansang doctrine, that there was no rebellion complexed with murder. Akyat si JPE sa Supreme Court, and he won. Pero nakatikim na ng rehas.

    So find probable cause, and let him have a heart attack in jail, waiting for the “judicious” exercise of review power by his wife’s Supreme Court. Tingnan ko lang kung hindi biglang bumalik sa HK yan, because some test still needs to be done.

    Unless, the HK trip was to talk to some emissary of De Lima. Until I see some decisive moves, the same moves she did on Aquino and Ping, I will still hold on to the belief that she is a trojan.

    Aroyo with one “r”? Kaya hindi nahanap sa bureau of immigration database? Give me a break.

    Kahit na hindi trojan, an election practitioner is an operator. I have little regard for the legal knowledge and litigation skills of these people.

    Brillantes? Watch him deliver next elections.

That was not a commentary on US courts, but the source of arrogance of some people and some swine.

    Erap? He was handled gingerly because the people might have risen up in arms. So that was for self-preservation, not because they struck a deal with Erap.

    Now about conviction in a trial court, and the US courts.

    Here, the Bail Reform Act would have allowed Erap to post bail while on appeal. The most they would have required was that he wear an electronic brace. In fact, even a convicted spy, was allowed to post bail pending appeal [TRUONG DINH HUNG v. U. S , 439 U.S. 1326 (1978)]

    That is the problem with our denial of bail to individuals who are alleged to have committed heinous crimes. More injustice is done on innocent people; it has proven less of a deterrent to the guilty. This was the ultimate tool of oppression – Trillanes, Danny Lim, that guy who gave away Erap DVDs. Or, locking up people in the Dacer case, so that they would be forced to mouth the script, and pin Ping. Di ba sabi sa Dumlao affidavit, “ayoko ng katotohanan. Gusto kong i pin-down mo si Ping.” (Victor Corpus).

    So I would advocate reforms along the lines of the US Bail Reform Act.

    But then again, before any reforms, I say, give the Pig a dose of his own medicine.

    apart from the affidavit and testimonial evidence vs mike arroyo, is there anything (paper trail or any physical evidence) to actually tie him to the choppers case? i saw part of the senate hearing with po and even po does not seem to have anything non-verbal and substantial except for his personal experience, as he recounts it.

    I have no Pinoy tv, so I can only go by what’s on the affidavit. Based on the affidavit, sapat na. There is more meat there than in Raquel Fortun’s testimony in the RTC, or Mancao’s stupid affidavit as dictated by Hazel Valdez.

    #28 sax, im not confronting you nor am i a lawyer. lets just relax it 🙂 im just asking if there is actually anything to finally make them as First Inmates for good. I’m only worried that even with temporary jail time, the arrovo’s will eventually get around it, make a mockery of our legal system and society in general, and once and for prove that our country is beyond salvation. Haay, I might just be getting old that im starting to lose any hope at all…

    There is no anger there, nor any intent at contention. I am sorry if that is how it came across.

    I am only pointing out previous court action, as yardstick for the evaluation of the affidavit of Archibald Po.

    It would be ideal to have a paper trail, but criminal transactions normally do not have any, unless it is a white collar crime. Thugs deal in cash.

    So we can only go by testimonial evidence, and some paper evidence to prove the case.

    1. I’m sure there is some voucher, whatever, asking for the funds for payment, in the PNP. Then, cash would have been withdrawn, to turn over to Po. Para yang operation ni Rabusa.

    2. If paid by check, a check with Po’s bank would reveal whether or not he received the check payment of the PNP, and when he deposited it in his private, or corporate account.

    3. If Po paid the fat slob in cash, then there should be some withdrawal by Po from his bank, of said cash, in order to be able to hand the cash to the swine.

    I agree, we need to convict him. We have not done so yet, in the case of Imelda. But to refuse to try is the ultimate defeat.

    Thanks for clarifying sax. We, more than most of us at ellenville, all hope to make life worth living. We are having an “ok” start to clean ourselves of the abomination that the arrovo reign has brought to our country, but much more needs to be done. arrovo is not the only problem. it is systemic. sabi nga ng isa sa mga paborito kong pilosopo, “we should beware of the fascists in all of us.”

    also, pasintabi kay arvin95, let me use the #33 reply to point something out (not a personal attack). sometimes i have problems with comments like that here in ellen’s blog. it assumes that the world is black and white and things are simple. as i said, malalim ang problemang ito natin, na saklaw ang ating socioeconomic condition, historical contingencies, etc. etc., at higit sa lahat ang ating kamalayan. if we have to start somewhere, we must start with changing our perspectives: that corruption is never ok no matter what; that the fight is complex, but not impossible to win; that it is never enough to settle for the lesser evil; that we are people of great honor, integrity, and talent and it is time to be proud as filipinos again.

    The real world doesn’t run like the TV series Law and Order, CSI, Bones, or the one with the Star Trek guy in it. Sax attacks the case not in a linear approach (meaning only one direction) but in a multidirectional one, if one doesn’t seem to work, he tries another, then another, with the same obssession as a pit bull, no let up. It may not look cinematic or dramatic, but thats real life.

    Both men and other goons surely bought some jurors, but both men were imprisoned and died there. With all your recitations of the law, none of these thugs will be imprisoned…resthouse maybe. The rich still protect the rich ala rightwingers/tea partiers and tax the middle class and the poor.

    Of course, the generals masterfully set up choke points in strategic locations so no critical mass can be achieved. Intelligence funds thrown around the AFP so those who rat on progressive thinkers are well rewarded, the SC, Ombudsman, congress, properly coopted and coordinated. Some members of the opposition promptly caved in with the threat of pork barrels being withheld, for the sake of their constituents daw. The defenses for the current admin was pumped up, there was even an “anti coup” force of some sorts.
    Everybody had money everybody happy (except for the Filipino people).

    Contrast that to the EDSA 3 during after Erap’s ouster, Gloria and her minions were shaking at the knees at the time. Why do you think she granted “pardon” to Erap out of the blue?
    All I can say is, it was masterful, bravo, state repression at its finest and sublest. Some even called it constitutional dicatorship.

  37. Don’t forget the CBCP was supporting Gloria and the military chain of command. Plus the opposition was splintered. The black and whites didn’t want to work with the pro erap, the civil society didn’t like this and that, the left, the right, add the apathy and internet caused diffusion of patriotic fervor (as many people were content in protesting anoymously in cyberspace rather than in the streets) looked to me that everyone of them was trying to be more patriotic than the other.
    There was unabated government spending making the economy look rosy, angry people are only a threat if they are hungry enough.

    Quite ornery? About the US economic woes? You misread my quote on that one. I’ve said it didn’t matter if the US defaulted on it’s debt, would there be effects on me, of course. But there would be millions also on the far right who would not have been paid their social security (like former poster at Ellenvile named dandaw, anti-Obama). THat’s what I was happy about, people like him and others here who subscribe to a rather selfish and racist idealogy BUT recipients of liberal entitlements. I’ve said it over and over, if socialism is not your cup of tea, refrain from ANY government handouts. I’ll pay taxes anytime to help those less fortunate than me, nothing more noble than that.

    Default didn’t happen, I’m also happy for that. Dandaw got his check, the military got paid as with the millions of veterans, and medicare/medicaid continue to help the poor and the elderly.

    And by the way, I’m a very happy camper and I don’t gamble on stocks, my wife does but not me.

    I pray he shows also the faces of NGOs, youth groups, civic organizations, foundations, or just well meaning people who go out of their way to feed the hungry, clothe the naked, give shelter to, care for the sick and dying, some people care, and that gives us hope.
