Finally, Comelec files electoral sabotage raps vs GMA; arrest looms

SC stands firm on TRO vs de Lima’s Watch List Order but it could be rendered moot and academic if Pasay RTC Judge issues warrant of arrest and hold departure order on Arroyo.

The lawyer of the Commission on Elections on Friday filed electoral sabotage charges against former President Gloria Macapagal Arroyo, former Maguindanao governor Andal Ampatuan Sr. and former Comelec election supervisor Lintang Bedol before the Pasay City Regional Trial Court.

Sen. Francis Escudero said once the judge issues a warrant of arrest all watchlist order and hold departure order in a separate on DOJ Memo circular 41 become moot and academic. Arroyo can be arrested. Electoral sabotage is non-bailable.

A photo by ABS-CBN correspondent Atom Araullo showed Comelec lawyer Efraim Bag-id filing the case before the Pasay RTC.

The case was raffled off to Pasay RTC 112 judge Jesus Mupas.

The Comelec also asked the court to issue a hold departure order for Arroyo.

For his part, Sen. Francis Escudero said Arroyo could go straight to jail if the court finds probable cause in the poll sabotage charges against her. He said electoral sabotage is a non-bailable offense.

In a separate but GMA-related case, the SC stood firm on its stand on the TRO vs the watch list order of Justice Secretary Leila de Lima.

SC keeps TRO on Arroyo watchlist order

Voting 8-5, the Supreme Court rejected the Solicitor General’s motion for reconsideration on the temporary restraining order (TRO) issued by the court on the watchlist order against former President Gloria Macapagal Arroyo.

The High Court also directed Justice Secretary Leila de Lima to show cause within 10 days why she should not be held in contempt of court on 2 grounds: for refusal to comply with the TRO issued by the Supreme Court and for disrespect towards the SC.

SC spokesman Jose Midas Marquez said lawyer Ferdinand Topacio is ordered to submit a supplemental compliance indicating his authority to receive court summons and other processes as legal representative of former President Arroyo.

Finally, he said the SC rejected the Arroyo camp’s motion to schedule earlier the oral arguments on the Arroyos’ petition to lift the watchlist order and declare as illegal Department of Justice Circular No. 41. “Therefore, oral arguments as scheduled on Tuesday will proceed,” he said.

Marquez said the Supreme Court took into considerations pronouncements made by de Lima in issuing the show cause order.

“The court thought there might be disrespect on that point,” he said.

He added that if found guilty of disrespecting the Court, de Lima could be fined not more than P30,000 or imprisonment of not more than 6 months or both.

    Doesn’t it sound exactly like when De Lima and the government also asked why the government side was not taken into consideration for the TRO?

    Mike, sorry. Its a numbers game. It sucks to see how your own tactic is used against you. Also, leave the country. I think GMA might actually admit who plan it all when you leave. No puppet master anymore.

    I would like to see pandak handcuffed! Kahit na isang araw lang coz on Tuesday, SC will again say it is not constitutional for the DOJ/Comelec to have filed the charges. You can read the Arroyo SC like a book. I do not think the justices even read the MR of the government. They just threw in the trash can maybe.

    Saan ka naman nakakita na may decision na bago oral arguments. Kaya kung si de Lima ay maghahain ng kaso kay pandak ng biglaan, the pandak and the fatso so deserve it too. An eye for an eye!

  4. Judge Mupas’ Warrant of Arrest has been transmitted to the Pasay Police, just some 30 meters away from the Pasay City Hall of Justice in the same complex which houses City Hall.

    Your move, Gloria. Will you proceed to the airport and risk being arrested today and spend the rest of the weekend in the decrepit Pasay City Jail where your “fans” are waiting for you? Or will you stay in that hospital and continue playing victim while your lawyer applies for some leeway and allow you to stay until your condition improves?

    What will be it?

  9. Wag natin kalimutan yung pambabastos na ginagawa nila noon sa batas at konstitusyon.

    Mag-oorder ng malasado, pag kinuwestiyon at sa oras magdedesisyon na ang korte, iwi-withdraw para Moot and Academic. Ginamit nila yan maraming beses, yung Martial Law sa Mindanao, MOA-AD, MC 108, EO464, State of Emergency, NBN-ZTE contract cancellation, State of Rebellion, State of Lawless Violence, Batasan 5, Magdalo/Tanay Boys, Jun Lozada at ibang Senate witness, at higit sa lahat kay Erap. Ang purpose lagi ay para may makulong at tumahimik ang kanilang mga kritiko ng walang kalaban-laban at walang due process.

    Wag silang iiyak-iyak ngayon na isa pa lang ang natitikman nila akala mo katapusan na ng mundo nila.

    Samantala, ibinasura ng SC ang Motion for Recon ng OSG at tuluyan nang pinayagang makaalis sila Arroyo. Dumating naman ang Taguig Police sa St. Luke’s, taranta ang media. Ano meron?

    Maya-maya’y nag-labas si Mupas ng Warrant of Arrest at agad na ipinadala sa Pasay Police HQ sa loob rin ng Compound ng City Hall. Alas kuwatro na ng hapon.

    4:30 ay nag-presscon si De Lima at ipinahayag nga na aarestuhin si Gloria. Sabi ng SC, puwede ng umalis, di naman sila pipigilan ni Honrado, may escort pa silang Pulis-Taguig, higit sa lahat, walang kaso si Mike Arroyo.

    Nahilo ang kampo ni Putot.

    Aalis ba sila sa St. Luke’s at didiretso sa Airport para tumakas? Will they call the bluff?

    Papaiwan na lang ba si Putot at si Mike na lang ang aalis? Si Mikey ay nakabiyahe na papuntang Amerika, mukhang mas mahalaga yung tatanggapin niyang donasyong lumang damit kesa sa kalagayan ng ina’t ama, hahaha. Ulul.

    What a day. A victory today for justice. But the battle has just started.

    While i could not agree more that the government should have progress faster, i also say haste makes waste. Besides, if they government did file the case at say the 100th day of the new government, baka sa 95th day pa lang what we saw today, we have seen it today.

    What i think is important to note is that a couple of things are for certain with this week’s exercise:

    (1) Things can definitely get done if they put their mind to it.

    (2) No amount of technicality will scare the government. GMA may have lost that big legal card her camp always love using.

    (3) The people’s sentiment is obvious, they don’t buy her BS. She doesn’t have the numbers when it comes to telling the people she is innocent.

    (4) Her well invested/infested court may have the numbers favoring GMA, but the reaction of the people and how the government will not take it down without a fight shows the decision should no longer be simply technicalities and bayad utang.

    I also agree, the authorities should continue to make this a winning case. Celebration is far from today.

    Tongue, nice catch. GMA then was given a good place to stay. That five star hotel in BGC.

  17. Ah, what a Friday! As always, Fridays are dreaded by criminals, no court people, judges and fixcals, to accept your motions, no officers to decide on your complaints. You are left powerless at the mercy of the bare skeletal lowest-level bureaucracy who do nothing but refer you to the next shift.

    Your weekend (maybe, your life, too) is screwed!

    And today, the timing was perfect. Working simultaneously, the Comelec, DOJ, Supreme Court, RTC, the Police, NBI, NAIA bosses threw everything on the enemy, including the kitchen sink and set them on a wild goose chase the whole day. Even Media cannot keep up with the pace.

    The events reaching climax barely before the offices close and that’s the only time you feel relieved.

    Mission accomplished. Congratulations to everybody, this battle is won.

    But the war has just began.

  18. They better shadow Mikey in the States. My Crap-o-meter says the donation thing is nothing but pure unadulterated manure.

    It makes no sense why he should leave his dying Mama and Porky Papa with a heart ailment to be devoured by their enemies back home just to personally receive donated used clothes for his Tricycle Drivers ans Sekyus. It doesn’t fit the script.

    Job well done Pnoy and de Lima! But knowing how putot and fatso work the “mob” way, dapat sige lang ng sige ang sampa ng mga kaso para hindi na makalabas sa St Loots yan! Kahit na anong kaso ang isasampa, putot can pay all the best lawyers and even pay the judges and also let us not forget that the Otso otso SC gang are very much a part of the pandak mob. Marami man daw ang kaso sa Supreme Court pa rin ang papupuntahan. Kelan ba mapapalitan ang isa o dalawa sa mga Otso otso gang?

    We have to remember too that this duo exploited the “rule of law” during their time as enumerated by Tongue above so they know how to manipulate the loop holes to make these lawa work to their advantage. Pnoy and de Lima should be prepared with the next case para kapag natalo sila sa SC, kulong pa rin si pandak. If she can not be jailed, at least we have the pleasure of seeing her squirm. Kung hindi man natin siya mapreso, baka mamatay na siya sa kunsumisyon!

    What happened has sent a message loud and clear to dirty politicians in the three branches of government: in the senate and lower house of Congress, in the finance-involved offices in the executive branch, even in the high and lower courts of the judiciary. As aptly said by Sen Escudero, what if it happens to you and me? These corrupt politicians, bureaucrats and big time businessmen are now afraid of the night, when the PNP secures their premises.

    Isip eskul bukol ito. Sa usapan dito sa Ellenville tila sabi ng mga eksperto sa batas , pinalabas at pinairal ang TRO ng korte suprema kahit hindi natutupad lahat ang kanilang requirements. Isang mababaw na requirement hindi raw Natupad, kaya hindi operative yung TRO. Matapos magngangalgal at magdadabog ang supreme court. Si Mike at Gloria ba may makakaligtaang requirement sa kanilang 10 taong galing magplano. Kahit natupad nila lahat ang requirement ng TRO, pero sabi ng korte ay HINDI. Kaya bang pumiyak, magreklamo sila Gloria at kanilang abogado laban sa Korte suprema? Sasabihin ba nilang ito ang mga papeles may tatak tinanggap ninyo?

    Alam naman nila Gloria hindi pa tapos ang mahabang laban, kailangan nila ang suporta ng korte suprema habang buhay at may kaso pa sila.

    Ito ba ang tunay na nangyari? SC Issued the TRO saying the requirements are met, then make a lot of noise when it was disobeyed by DOJ threatening contempt of court, then again say it is inoperative because one small requirement was not met by a former president and highly paid lawyers. Without the DOJ and OSG calling attention of the SC to such anomaly. Pakilinaw nga mga taga Ellenville.
