Ang paglilitis ni Gloria Arroyo

Sa wakas, nakapag file na ng kaso ang administrasyong Aquino laban kay Gloria Arroyo.

Kahapon bago magtanghalian, isinampa ng Commission on Elections ang kasong electoral sabotage laban kina Gloria Arroyo, dating gubernador ng Maguindanao na si Andal Ampatuan Sr. at datingformer Comelec election supervisor Lintang Bedol before the Pasay City RTC.

Ni-raffle at napunta ang kaso kay Judge Jesus Mupas na dati raw napagsabihan ng Supreme Court dahil may mga kasong hindi umuusad. Aba, noong Biyernes, ang bilis. Bago mag-alas singko na hapon, nagpalabas na ng warrant of arrest si Judge Mupas.

Mga 6:30 na ng gabi nang na-serve ang warrant of arrest kay Arroyo sa St. Luke’s Hospital sa Taguig.

Kaya walang epekto na ang temporary restraining order na inisyu noong Nob. 15 ng Supreme Court sa Watch List Order (WLO) ng Department of Justice sa mga Arroyo habang hindi pa sila nakapagsampa ng kaso.

Kwestyunable kasi ang legalidad ng WLO dahil ayun sa batas, korte lang ang pwedeng makapigil sa pagbiyahe ng isang tao. Kaya, ayan korte na ang pumigil kay Arroyo. Walang piyansa ang electoral sabotage kaya hidi siya maaring gumalaw na hindi pinahihintulutan ng korte.

Yan ang sinasabi ng may nagpapahalaga ng batas, na kasuhan na kasi si Arroyo para niya mapanagutan ang kanyang mga kasalanan sa taumbayan.

Sabi ni Comelec Chairman Sixto Brillantes, hindi raw nila minadali ang kaso. Sige na nga. Hindi pala minadali kaya hindi pa naisampa ang kaso laban kay dating Comelec Chairman Benjamin Abalos at isang dating military intelligence officer na si Capt. Peter Reyes.

Sa Lunes na raw nila i-file ang kaso kay Abalos at Reyes.

Hindi naisama si Mike Arroyo dahil mahina daw ang kaso.

Ayun sa impormasyun na isinampa ng Comelec, sabit daw si Arroyo dahil ilang araw daw bago Mayo 14, 2007, sa isalng salu-salu sa Malacanang, inutusan niya si Amapatuan Sr na siguraduhin dawn a 12-0 ang pabor sa mga kandidato ng Team Unity ng administrasyun.

Dahil sa utos na ito ni Arroyo, inutusan naman ni Ampatuan si Bedol na retukohin ang resulta ng eleksyun na ginawa naman ni Bedol.

Kayo na ang bahala magsabi kung malakas ang kaso ng pamahalaan dito. Kung madismis man balang araw, baka abutin ng anim na taon, hindi na bale yun para sa admistrasyong Aquino. Ang mahalaga ay nakakulong si Arroyo dahil yun ang pangako ni Aquino sa taumbayan noong eleksyun.

Ang tanong ng marami, bakit ang kaso ay sa 2007 na eleksyun? Bakit hindi 2004 na eleksyun kung saan klaro talaga talaga ang ginawang pandaraya ni Arroyo at ng kanyang asawang si Mike?

Ang problema kasi , ang batas na electoral sabotage ay noong 2007 lang naipasa. Ang magiging kaso lang ni Arroyo sa 2004 elections ay paglabag sa Anti-Graft and Corrupt Practices Act na pwede siya mag-piyansa. Kung makapag-piyansa siya, maari siyang tumakas ng bansa. Kaya halatang pinilit talagang isama si Arroyo dito sa 2007 elections na kaso ng electoral sabotage.

Tingnan natin kung paano gugulong ang hustisya sa panahon ni Aquino.Simulan na ang paglilitis ni Arroyo.

Huwag munang paspasan ang paglilitis ng kaso ni Gloria, buruhin muna siya sa kulungan kasi kung pagbabasehan lang ang utos niya kay Ampatuan na i zero ang kalaban -She Said, He Say” lang iyun.Maaring sabihin ni Gloria na nagbibiro lang siya at “I’m Sorry”. Ang palagay ko dito kaya nagsampa ng kaso sa Pasay RTC ng Electoral Sabotage para tablahin ang TRO ng SC. Na otso sila kay Mupas dahil warrant of Arrest ang ipinalabaas niya. Kung hindi sa TRO na iyun baka tulog pa si De Lima at Brillantes ngayon sa pagsampa ng kaso.

    Kung pagbabasehan nga naman na nag number one si Chavit doon may milagrong nangyari. Isa pa nag resign si Zubiri, baka nga alam ni Zubiri na dinaya talaga ang resulta.

    May kasabihan nga ang mga Kristiano na “Everything happened for a reason” –TRO of the Supreme Court, no matter the controversy it stirred became a blessing in disguise.

    now, only three things can happen here:

    1.the arroyos are too good for this case or the case will be once and for all exposed as a sham intended only to make people believe there is a semblance of justice. there will be a carnival, the public will be taken for a ride, and eventually, the arroyos go free. status quo. (yes the arroyo will have suffered, at least from public humiliation, but is insignificant compared to the political crisis that could have resulted if the people SEE abNoy’s government as truly incompetent)

    2. it is what it is, and arroyo hardlines and fights this to death. this is the least interesting scenario that could happen, and no one, except the lawyers who will observe the showdown and take notes, will “follow” this. the public will be there to watch it at first, but will promptly move on to the next telenovela as soon as the story becomes predictable.

    3. faced with horror of her finitude, witnessing the fickleness of power, and realizing that she is, after all, human, all too human, gloria experiences a change of heart and tells all. the atmosphere in the entire country will practically be that of the second coming of christ!

    since today is a sunday, i will start lighting candles on all churches i pass to pray for number 3 to happen. just imagine. i shudder at the thought… meanwhile, let us watch all the arroyo allies suddenly admitting themselves to St. Locos or flying abroad.

This 2007 election sabotage may even be the least of her crimes but this is where the “blind lady” peeked through and said “HULI KA”!

    Isn’t it therefore with malice and a conscious attempt at misleading the public, that marquez, i quote from memory, stating that “the judges decided that there is no need to lift the TRO because of lack of compliance since they (arroyo) complied in the first place and was merely given an ‘additional compliance'” or something like that.

    This is a vulgar and direct attempt at misinformation. Marquez should go!

    Sinabi daw sa kanya ni Mupas na kailangan pang mag-hearing kung HDO. Kaya nagulat daw ang lahat nung hindi lang HDO ang inisyu ni Mupas kundi Warrant of Arrest. Saka isinunod yung HDO.

    Maraming interesado sa dayaan noong 2004; that it also be prosecuted, so that the people can find closure.     But a second reading of the law appears to allow the prosecution of even the cheating in 2004. The law provides:

    Sec. 267. Prescription. – Election offenses shall prescribe after five years from the date of their commission. If the discovery of the offense be made in an election contest proceedings, the period of prescription shall commence on the date on which the judgment in such proceedings becomes final and executory.

    Loren Legarda filed an election protest, in which proceedings, she introduced evidence of dagdag-bawas in favor of Arroyo and De Castro.

    Legarda’s protest was dismissed by the Presidential Electoral Tribunal on January 18, 2008. So the decision became final fifteen days after, or on February 2, 2008.

    So five years from then is February 2, 2013.

    There is still time to file a criminal case for the cheating in 2004. This should be done now, so that in the event that the Supreme Court nullifies the order of Mupas, there will be another case on which to base a hold-departure order.

    True, the crime is not non-bailable, but one does not need a non-bailable offense to ask for a hold-departure order. It suffices that one prove that the accused is a flight risk. A good example of this is Ricardo Silverio v Court of Appeals

    The law expressly allows the COMELEC to avail of the assistance of other prosecuting arms of the government (DOJ). Walang basehan ang sinasabi ni One-ball.

    In fact, if four months have passed, the DOJ may take over.

    Ito ang mga batas na maaaring panghawakan ng gobyerno ukol sa Jurisdiction ng kaso ni gloria:

    POSITIVE

    1. Sec. 268 of BP 881 tells us that the RTC has jurisdiction to try and decide any election offense. This is an EXCLUSIVE ORIGINAL jurisdiction.

    2. Election offenses are enumerated in Sec. 261 and Sec. 262 of BP 881.

    3. Additional election offenses will be found in RA 6646 which amended sections 261 and 262 above.

    4. Electoral Sabotage (as a very special election offense to prevent a repeat of the “2004 electoral cheating”) will be found in Sec. 42 of RA 9369.

    5. RA 9369 is widely known as the poll automation law. It amends RA 8436 and BP 881.

    6. Sec. 4 of Article XI, Accountability of Public Officers, of the 1987 Constitution states:

    ”Section 4. The present anti-graft court known as the Sandiganbayan SHALL CONTINUE to function and exercise its jurisdiction as now or hereafter may be provided by law.”

    7. Sec. 5 of Article XIII, Accountability of Public Officers, of the 1973 Constitution states:

    ”Section 5. The National Assembly shall create a special court, to be known as Sandiganbayan, which shall have jurisdiction over criminal and civil cases involving graft and corrupt practices and such other offenses committed by public officers and employees, including those in government-owned or controlled corporations, IN RELATION to their office as may be determined by law.”

    (Emphasis mine.)

    NEGATIVE

    1. PD 1486 (creating the Sandiganbayan) refers to RA 3019 (Anti-Graft and Corrupt Practices Act) and RA 1379. Violations enumerated in both Republic Acts do not cover election-related offenses.

    2. PD 1606, a revision to PD 1486, did not say that the Sandiganbayan has jurisdiction to election offenses.

    3. RA 8249 further defined the jurisdiction of the Sandiganbayan. The Act did not cover election-related offenses.
