Inip na sa ending ang taumbayan

Kapag impeachment ni Chief Justice Renato Corona ang pinaguusapan, ang tanong ng karamihan ay, “Maku-convict ba si Corona?”

Inip na sa ending ang mga tao.

Sa aming baryo sa Guisijan sa Antique, marami ang sumusunod ng Corona impeachment trial.Sa mga nakita nilang lumabas na mga impormasyun sa trial, naniniwala silang guilty si Corona.Kaya kahit medyo palpak and prosecution, umu-ubra din ang kanilang stratehiya na lumilihis sa proseso.

Ngunit alam din ng taumbayan na malaki ang papel ng pulitika sa pinal na desisyun kaya medyo nag-alala sila.

Sabi nila may mga naparusahan na nagkamali na hindi naman masyadong malaki ang perwisyo sa taumbayan. Nalulula sila sa tagong milyunes ni Corona at kung hindi maparusahan, parang hindi nila yan mapagtagpi sa kanilang paniniwala sa hustisya.

Ganun din ang damdamin ng mga OFW na kahit malayo sila sa ating bayan ay tumututok sa impeachment trial.

Katulad ni Arnulfo Mayo na nasa Salerno, Afghanistan. Sabi niya: “I am really so disappointed on what is going on to our country, we OFW, we tried our best to help our country, but for some persons in the positions, like Corona, na kita na’t bisto na, nagbubuhat pa ng sariling bangko.

“ I don’t know why in our country, kapag madaming pera ang nasasakdal ang hirap mapatunayan.”

Sabi naman ni Jun Fontanilla na nasa Brunei Darussalam, “Nakakalungkot marinig at basahin ang mga action/reaction ng mga experts on legal matters how they twist things even though it is crystal clear that if you lie in your Sworn Statement you violate the Law and Constitution that you have sworn to uphold and defend.
Too much attention is being spend on legalities and technicalities.

“In my own opinion, nothing will come out to define these two words in a debate dahil sa pagalingan at talino, lahat ayaw patalo.

“ Just simple question :why do you have to deposit a big sum of money in your name and account if it is not yours?

“Bahala napo kayo sa kasagutan dahil minsan nakakaawa napo ang sambayanang Pilipino na dapat ay pagtuunan na lang sana kung paano tayo babangon muli sa kahirapan at hindi sa pagkakamali at pagkasala ng mangilan-ngilan na tao na walang inatupag kundi ang sariling kapakanan.

“We are wasting a lot of precious resources instead of giving a focus and attention to our country’s current problem and challenges.”

Ito naman ang sinabi ni MPRivera na nasa Saudi sa aking blog:

“Matanong ko la’ang: ano baga talaga tamang pagpapairal ng paglilitis?

“Ito baga ay ‘yung pagpapalabas ng katotohanan kahit mali ang ibang paraan ng paglalahad ng ebisensiya upang maigawad ang katarungan o ‘yung pagsunod (sa tamang presentasyon ng ebidensiya) kahit mangahulugang umabot sa pagtatago ng katotohanan?”

Dapat sagutin yan ng mga senator-judges.

    The Senator-Judges are supposed to be neutral. But since they are allowed to ask clarificatory questions, their questions and actuations may be misconstrued as being biased for either side sometimes. I have decided therefore to just play a game, for the heck of it..

    I have decided to group the Senator-Judges generally into four categories according to their questions and actuations so far:

    1) those who really want to dig out the truth
    2) those who want to block the digging
    3) those who are more concerned about the rules of digging
    4) and those who just want to watch the others dig.

    Who are the time wasters? I already have my list for each category. I intend to revise it depending on the weekly developments.

    Nakakainip talaga. Para sa akin, whoever will be running for another term in the senate would likely vote to impeach Corona othewise, he/she will get the wrath of the people.

    Personally, I do not care how the proof of his accounts came out. I am very glad these came out, knowing how tightly guarded these documents are. Pasalamat talaga tayo at may mga taong nag-leak. Para sa akin ang mga taong nag-leak ay kahangahanga. Sana malusutan ng prosecution ito na hindi itatapon ang mga dokumentong nakalap na otherwise, makakalusot na naman ang isang magnanakaw at sinungaling.

    Senator Grumpy was at it again today. Scaring the senator-judges na baka sila naman ang i-investigate ng AMLA. Is he saying many of them have foreign currency accounts that are being hidden?

    They want the trial to follow the rules of a trial court, but apparently the judges consumed more time yaking than expected of trial judges. Is that where the time goes? Like Judge Judy on TV?

    Can you Please Mr Phil Cruz share with us their names per category as you start and as the trial ends to find out who are consistent to their characters. I don’t watch the impeachment telenovela but can I guess from newspaper reports and columns. My guesses [in brackets] are as follows:

    1) those who really want to dig out the truth [No one; Serge Osmena, Frank Drilon may be candidates, still minuscule, guarded questions to dig the truth]

    2) those who want to block the digging [almost everybody from Senators Enrile, Joker, Mirriam, Escudero. Except for lack of capacity Lapid and Revilla; Reason: Suppose it happens to me later , I don’t want to help dig now my own future grave]

    3) those who are more concerned about the rules of digging [same as No. 2 the capacity differences will be in subtlety, ingenuity and insidiousness.]

    4) and those who just want to watch the others dig. [ the wise (no talk no mistake, enjoy the show) and unwise (nothing to say) among them; ]

    Senators are marked by their permanent character to be consistently inconsistent or to be inconsistently consistent on their political principles. Constancy is seldom a character trait in politics; the virtues of honesty and integrity are not far behind.

    Comment #1 is scientific because the first method in science is classification. The result of classifying the judges into four types after the trial based on their actuations and performance could be inconclusive because the judges by metaphor can only be butterflies flying, switching from flower to flower. But the result could be enlightening about the kind of senators we have; which validates the perception the public hold about them.

    Pinoy Senators lately are known by their common character to be always inconsistent on public problems or to be always consistent on their questionable political principles. Constancy like the number of minutes in one hour, or the everyday sunrise and sunset is hardly a character trait among our politicians; their not being honest and not honorable follow very closely their unfaithfulness to public needs.

    And how dare you people talk about the justice and the law and not apply it to everyone? Aquino is out there violating a whole bunch of laws as well as other politicians and yet you only focus on one? If you are so Machiavellian in philosophy, why are other heads not rolling? Why? Is the rule be Machiavellian for some but not all? And yet you exclaim that justice should be served to the guilty? How unjust is this justice of yours?

    Puyat na naman ako sa pagsubaybay ng impeachment trial. Mukhang ang tinutumbok ni JPE ay ang pagbabasuara ng mga ebidensiya dahil mali nga ang pagkuha ng mga ito. In short tuwang tuwa ang maka-Corona dahil sa development na ito. But wait, di ba nga si Miriam na rin ang nagsabing hindi purong “judicial” ang sistema ng court na ito ang yet they are adopting one. Ang gulo! Baka nga matatapos na ang taon nagbabangayan pa rin ang mga maka-pandak at maka-Pnoy sa senado.

    @ #10, Penoy violated the “Sub Judice Rule” (Sub judice means under judgment) when he discussed the case against Corona before the college students when he recently was the guest speaker in a college in Manila. In all civilized nations around the world, “Sub Judice Rule” is strictly observed… According to the Guide issued by UK with respect to “Sub Judice Rule and Contempt of Court,” written in January 2009, it is inappropriate to comment publicly on cases sub judice, which can be an offense in itself, leading to the contempt of court. There are two forms of contempt of Court: 1.) Statutory Contempt of Court under the Contempt of Court Act of 1981, which criminalizes the publication of material which creates a substantial risk that the course of justice in the relevant proceeding would be seriously impeded or prejudiced; and 2.) Common law contempt which targets any other action which is intended to interfere with the administration of justice, including interfering with pending or imminent court proceeding. The “Sub Judice Rule” is also observed in the Philippines…Iyong mga public pronouncement ni Penoy against Corona ang labag sa batas na ginagawa ni Penoy, to name one… No President with normal mental faculty would ever do that. (Now, I doubt Penoy’s sanity).He is the President of the Philippines, for God’s sake, not the President of the Quinta Market Vendors Association or Manila Barbers’ Association…In no time, when the yellow color fades, Penoy’s inappropriate and illegal acts will be exposed, kasama na ang paglobo ng kanyang kayamanan from P14 Million in 2009 to P50 Million in June 2010 to P55 Million in December 2010, by then his true color will come out.

    Hay juice ko pong pineapple. Sub judice? It only applies to the participants of the trial. Now, which category is the President? Lahat ng kolumnista sa Pilipinas may kanya-kanyang komento sa trial. Dapat ba silang icontempt? Di pa nga nacocontempt ang depensa sa paratang nila sa mga senador na tumanggap ng suhol sa Malacanang e, may sub judice pa kayong ibinabandera diyan. SALN ni Aquino? Ikaw na lang ata ang di nakakabasa ng paliwanag tungkol doon. Better still, magbayad ka ng minimum fee sa Ombudsman. Bibigyan ka nila ng kopya ng SALN ni Aquino at puede mong analisahin punto por punto. Di tulad ng sa idol mo. Kung di pa napilitan di pa mabuksan ang nakakandadong vault sa SC. Nabisto tuloy! 🙂

    This is really not about Corona. This is about the pandak. If Corona holds on to his post coz these sanator judges let him, lahat ng kasong isasampa kay pandak sa kahit na anong korte eh dadalhin lang ni pandak sa SC and Corona and his gang of 8 will decide in favor of pandak. It had been done again and again by pandak and Corona will we allow that to happen again and again? I am not a Pnoy fan either but I can see Pnoy’s desire to cleanse the government of corruption. Kahit na manalo si Corona and he keeps his position, he will be hounded by all the stuff that were uncovered in the impeachment trial. There are always ways to go after him. This war between Pnoy and Corona will be a long battle!

    Still about Con-Rona dahil hanggang kapit tuko siya sa puwesto ay walang pagbabago sa atin at Di mapapanagutan ang Reyna ng mga magnanakaw sa ating gobyerno at mga galamay nila. Kasama na si Con-Rona at 7 SC Judges.

    Sa mga maka Con-Rona ay lahat ng Tao ay may karapatan mag bigay ng opinion kahit isa pa siyang presidents or mag bobote. Ang mabuti pa na gawin ninyo ay pilitin ninyo si corona ilabas ang mga tagong yaman
    at huwag gamitin ang SC para itago ang mga milagro na ginagawa niya.

    @#13, Penoy is not exempted from the “Sub Judice Rule.” It applies to everybody, Penoy is not above the law. One of the main objectives of the sub judice rule is to prevent the back door entry of inadmissible evidence through exposure to mass media, which is exactly what is being employed by the triers of Corona. Penoy is the perfect example why the sub judice rule was created…Said the Supreme Court in April 2009 case of Romero v. Estrada: “The sub judice rule restricts comments and disclosures pertaining to judicial proceedings to avoid prejudging the issue, influencing the court or obstructing the administration of justice. A violation of the sub judice rule may render one liable for indirect contempt under Sec. 3(d) Rule 71 of the Rules of Court…” Ang sinasabi mong “It applies only to the participants of the trial” ay covered lang iyan ng Rule 13.02 of the Code of Professional Responsibility which particularly addesses lawyers about sub judice. But Rule 71 of the Rules of Court addresses everyone…In the US, the importance of the First Amendment free expression right has resulted in liberal implementation of the sub judice rule particularly when the media is involved, as in the case of Sheppard v. Maxwell…Iyan ang ginagaya ng members ng mass media sa Pilipinas which maybe acceptable to the Philippine justice system…Wala akong idol kahit sino. Gusto ko ngang ma-convict si Corona para wala nang excuses si Penoy para hindi umasenso ang Pilipinas. Ang sabi niya road block sa pag-asenso ng Pilipinas si Corona. Pag na convicted na si Corona, mahaharap na ni Penoy ang most pressing problems ng Pilipinas lalo na ang uncontrollable rising prices of everything. At kung wala ngang kinalaman ang Hacienda Luisita sa impeachment ni Corona, idi-distribute na ang lupa sa mga farmers-benificiary. Iyan ang inaabangan ko. But Corona should be convicted according to the gravity of the evidence (Not FAKE evidence) against him not according to the infuence of Penoy and his yellow mob.

    ilang dekada na si enrile sa gobyerno, meron ba siyang nagawang naging kapakipakinabang sa mamamayan?

    Today Cuevas complained of unfairness and once again threatened to call for a mistrial and Enrile’s knees buckled and turned to jelly.

    Visibly nervous he pounced on the prosecution and beat them black and blue. He snarled at them once again. Ridiculed them once again. Lectured them about his self-proclaimed legal mastery and experience once again.

    And disallowed two witnesses from being presented. Witnesses that could have given evidence for the prosecution.

    Enrile’s nervousness stems I think from his fear that the defense would walk out or call for a mistrial during his chairmanship of the impeachment court. That would be a big blow to whatever legacy he would like to leave behind. Maybe he genuinely fears a constitutional crisis.

    So poor prosecution, they get a series of slaps on the neck.

    I don’t agree with Enrile’s reasons, however, that the plane tickets and privileges given by PAL to the Coronas are irrelevant and has no connection to proving he does not have the character to be the Chief Justice.

    The other senator-judges just kept quiet during Enrile’s tirades and temper tantrum. Do they agree with him completely? Are we now left with no knights in that court?

    I think Enrile’s ego, temper and nervousness in handling this court will lead to unnecessary public agitation and nervousness. He is in the same mold as Miriam. Both should get a hold of themselves and stop all these bursts of tempers. They should also stop acting like scared cats in front of the wily Cuevas.

    It seems that the impeachment court is already gradually falling into Cuevas’ trap.

    what was Cuevas’ belly aching about? That the rules don’t allow him to object to a senator-judge.

    Enrile was quite apologetic.. practically saying he agrees but those are the rules but yes he will discuss it with the senator-judges.

    At the presscon, the defense spokesmen’s grins were ear to ear and jumping all around their Christmas tree celebrating their victory today.

    Enrile should have allowed the prosecutors today to express what was in their mind. But he kept cutting them off. They couldn’t even finish their sentences.

    I noticed a glint, a flicker of exasperation and anger in the eyes of the gentle Tupas. I was silently cheering for him to stand his ground. He did. For a while. But had to step back from the Enrile barrage after a while. It was too much for him.

    Enrile has been quite liberal to the prosecution in general. But I notice that whenever he is nudged hard by Cuevas and or the SC, he buckles..

    If Enrile and the senator-judges start allowing Cuevas to throw objections at them, this trial will last till kingdom come. Cuevas has a million and one objections up his ghostly suit.

    Dapat inilagay sa complaint ang “receiving perks” in exchange for a favourable ruling. On this one medyo masyadong lihis nga yung subject. I do agree with Enrile on this one but he should have allowed the testimonies of the witessess just the same para malaman naman ng mga judges kung anong klase itong si Corona na mahilig sa “perks”.

    Enrile was more than liberal in Article 2. So he seriously meant that he will not allow the same in the next articles, and he did. The prosecution should have adhered to their complaints and not introduced witnesess on unrelated matters. They just lost a golden opportunity to prove that this Chief Justice is milking everyone to fatten himself. Sayang talaga that they were not able to present the three witnesses but there’s no one to blame but themselves. I hope they learn.

    It is difficult So unfair to condemn entire groups of people; it is lighter to accuse a few individuals of similar bent and conviction like a traitor to one’s country is a traitor for all times, the military is harsher; they shoot deserters even when they only run and not point their guns to their own people. Treachery is the same but goes UNNOTICED in politics, once a traitor politician; despite recurrence might be few and far between, a traitor remains a traitor for all times.

    Kaya pala may balak ang mga prosecutors na paikliin ang 8 articles of impeachment na gawin na lang 3 articles of impeachment dahil alam nila na wala silang ebidensya na angkop sa articles 4 to 8. Kunyari lang na gusto nilang pabilisin na matapos agad ang trial….lol.

    Umpisa ng lumabas sa article 3 ang kawalan ng ebidensiya na angkop sa nasabing article. Kahit yong article 2 of impeachment ay peke ang ebidensya. Kahit yong article 1 ano ang nangyari doon…lol.

    Gusto lang paikliin ng prosecutors ang articles dahil di na ata nila kaya ang kahihiyang tinatanggap nila sa national tv….hahhahahaa

    Enrile’s impatient comments that the prosecution should have gathered the evidence before filing the impeachment case is illogical. The evidences are kept in bank records and bank vaults. These are not made available to anyone unless the account owner gives his permission or when there is an impeachment case related to it, etc.

    So how do you determine the other undeclared assets if you are prohibited by law? You file an impeachment case so that the law will allow you to do it. And that seems to be what the prosecution did. And Enrile berates them for this?

    But even when the prosecution tries to present the legally available PAL tickets of Corona to prove the nature of his character, this too is blocked by Enrile.

    I am not saying Enrile is biased for the defense. Not yet. I am only saying that Cuevas’ mistrial threats is taking a toll on Enrile’s emotional and rational ability to preside fairly and justly and in a manner that is courteous and respectful of the prosecutors.. as he is so very respectful and courteous to Cuevas.

    Sa palagay niyo kaya na kung hindi si Pnoy ang naging Pangulo niyo gagawin niya ito? Yong linisin ang mga basura na iniwan ni aling Glorya? Malamang hahayaan na lang at kung hahayaan lang e di lalong nagkalintik-lintik ang buhay ng mga Pinoy.
    Dapat nga magka-isa kayong linisin ang mga basura para naman malay niyo magbago ang buhay ng inyong pamumuhay sa inyong Bansa. Mayroon na kayong Pangulong sinserong ayusin ang takbo ng Gobyerno para umunlad naman ang inyong Bayan.

    Tedanz, I am with you on cleaning up the corrupt government. But the quetion here is, the prosecution should have exhausted all their legal minds to come up with an air tight case. Pareho tayo ng iniisip sa mga bank deposits. Sino nga naman ang magaakalang may mga tutulong sa prosecution sa pagkakadiskubre nila ng bilyones na pera ni Corona. Kaya nga pati yung mga senator-judges eh tumulong sa pag-ungkat ng mga ito. But for the rest of the other stuff, sana naman mas prepared naman sana ang prosecution. I do not have a law background kaya lang naiintindihan ko ang “sumasablay”.

    Kung hindi man sila kakandidato ngayong 2013 midterm election, doon natin sa ibaling sa kanilang mga anak na kakandidato sa pagka senador ang ating pag tutol sa kanilang desisyon na i acquit si Fake Justice Corona.

    The best case scenario which the true (uncorrupted) Filipinos all over the world are waiting for which can only happened in the Philippines is the resounding acquittal of CJ Corona by the Impeachment Court FOLLOWED days later which can only happen in South Korea, Singapore, Britain, USA, and Canada is the mass arrest of tax evaders from the members of the Impeachment Court, the Supreme Court and members of the defense and prosecution teams. The people who know will rejoice to see Corona, Enrile, Santiago, Escudero, Cuevas, Fr. Bernas and many more etcetera, lead by Police in handcuffs to the army trucks that will collect the tax evaders to take them to Muntinlupa. Let the people watch with their tomatoes, eggs and shoes as these rascals and scalawags marched with police escorts to attend their court trials and be given justice by the genuine rule of law.

    With great possibility and people’s eager anticipation this scenario will shock and awe the people of South Korea, Singapore, Britain, USA, and Canada on how the Phil President using the true rule of law led a revolution that halted the tide of corruption and smash to pieces the rock culture of impunity.

    Filipinos all over the world will be looked up with respect and reverence more than the first EDSA, more than the FBI efforts on the MAFIA, more than Guilliani’s bringing peace and order to the streets and homes in New York City.
