Carpio got the most votes in JBC’s list for Supreme Court Justice

The Judicial and Bar Council submitted the following names to President Aquino today from where he can choose the next Supreme Court Justice.

Acting Chief Justice Antonio T. Carpio – 7 votes
SC Associate Justice Roberto A. Abad – 6 votes
SC Associate Justice Arturo D. Brion – 6 votes
Solicitor-General Francis H. Jardeleza – 6 votes
SC Associate Justice Maria Lourdes A. Sereno -6 votes
Former Executive Secretary Ronaldo B. Zamora -6 votes
Law Professor Soledad Cagampang-De Castro – 5 votes
Former Ateneo Law Dean Cesar Villanueva – 5 votes

What we feared did not happen. Justice Secretary Leila de Lima, rumored to be President Aquino’s favorite, didn’t make it.

The President has up to Aug. 27, 2012 to fill up position vacated by the ousted Supreme Court Chief Justice Renato Corona.

    Doesn’t Jardeleza have also a pending case against him? Why was De Lima disqualified while he made it to the shortlist?

    Someone told me pinaglaruan lang ng Malacañang si De Lima. They still haven’t forgotten her recommendations on their bungling of the Rizal Park hostage incident.

    Wala akong kilala sa kanilang lahat except si Brion na lapdog ni Gloria.

    Better de Lima was not included in the shortlist masyadong controversial. Kung sya piliin ni Pnoy, problema pa na malaki ng Pangulo sa kasasangga lang ng mga pintas at puna kay Leila.

    Lahat sila may pintas, go with the highest vote na lang, Pnoy… hindi ka pa makakalbo ng tuluyan. Mas maiigi nga na si Carpio dahil alam nya ang buong nangyari kay Corona, careful siya sa salita at gawa.

    “De Lima’s reaction came in the wake of the inclusion in the voting of Jardeleza and fellow Aquino appointee, Securities and Exchange Commission (SEC) chairperson Teresita Herbosa.

    “Jardeleza was included in the voting because the administrative case against him before the high court was not yet acted upon.

    “Herbosa, for her part, was slapped with a disbarment case but the case was dismissed by the high court on Aug. 1. She only garnered 4 votes.”

    Sotto, who once headed the Dangerous Drugs Board, said that a previous DOJ circular dated January 5, 2009 mandated that drug-related respondents under detention shall remain in police or the custody of the Philippine Drug Enforcement Agency until their cases are resolved by the secretary of Justice.

    He said this was strengthened by Administrative Order No. 253 issued by former President Gloria Macapagal-Arroyo which provided that all decisions by the DOJ chief involving the dismissal of cases under RA 9165 be subjected to automatic review by the Office of the President (OP).

    He said pending this review by the OP, execution of the decision or resolution shall be stayed.

    “This is the reason why the accused in the so-called Alabang Boys drugs case were not released even when the case was ordered dismissed by the state prosecutor. The prevailing rule was that the suspects shall remain in police/PDEA custody,” he said.

    But Sotto noted that with the new department circular issued by DOJ Secretary Leila de Lima, these suspects may now be released pending case review by her office.

    De Lima said in February that the new order underscored the justice department’s commitment to improve the administration of justice by providing “a just, speedy and effective means to resolve drug cases” while respecting human rights.

    Abad was one of the two swing votes who required the condition on the TRO on Goyang, along with Villarama.

    Of course, when the main case was decided, he had to go with the majority, because there is no way you can twist the law to grant De Lima the power that belongs to the courts.

    it’s all in the making by those concerned that de lima was included in the shortlist so that PeNoy would appear no bias.

    Sereno penned the decision that upheld the acquittal of Musngi et al by the Court of Appeals. The justices in that division were Eubulo G. Verzola, Rodrigo V. Cosico and Eliezer R. de los Santos.

    Ang ganda naman. One who is tainted with having caused the accidental death of his prospective brother, determines the fitness of the Chief Justice to be.

    The Court of Appeals “set aside the finding of conspiracy by the trial court and modified the criminal liability of each of the accused according to individual participation.”

    No conspiracy in a frat initiation? No unity of purpose?

    My mistake.

    Sereno penned the decision that upheld the decision of the Court of Appeals, in the Lenny Villa case – this involved the other accused, not Musngi et al who were acquitted.

    The Court of Appeals had acquitted Musngi. So technically, that was no longer in issue at the Supreme Court; you cannot appeal an acquittal. What was on appeal was the finding of guilt on the other accused – Antonio Mariano Almeda, Junel Anthony Ama, Renato Bantug, Jr., and Vincent Tecson

  15. Ellen, dagdag ko, Antonio Mariano (Nani) Almeda was the NP candidate for congress in Caloocan in 2010. Buti na lang natalo. Mayayabang sa Sta. Ana/San Lazaro yang mga yan lalo na nung nakaupo pa si Gloria, miyembro rin yata ng Horseracing Mafia. Nakakuha rin ng kontrata yan sa Pagcor City yan at dati kong supplier ng power tools (Junna Industrial). Yung tatay, sikat na breeder ng kabayo.

    Kundi ba naman sinuswerte, yung homicide kay Leny Villa, na-downgrade sa serious physical injuries na may max hatol na 4 years+ lang. (Yung kaibigan kong si Jonas Karl Perez, kasama sa na-acquit.)

    Di pa nadeesisyunan, na-serve na agad yung prison term. Ang galing diba? Pagkatapos na-affirm yung guilt, sabay laya. Hayup ang hustisya diba?

    Siyempre naman, nanay ng barkada mo presidente ng Pilipinas.
