Run, PNoy, Run

????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????
I have lost track counting the number of somersaults that President Aquino and his spokesmen have performed on the issue of whether he wants to stay in Malacañang after his term ends on June 30, 2016.

To save myself further aggravation, I decided to “like” President Aquino’s Facebook Page which was brought to my attention by singer Leah Navarro.

Navarro, a certified PNoy loyalist, said: “ Have any of you visited the President’s Facebook page? It’s Noynoy Aquino P-Noy . It has over four million likes. You’ll see a clamor for the President to stay on for another term. It’s pretty awesome – thousands of people have posted, commented on, or just ‘liked’ this suggestion that he stay on for another six years.”

The Constitution provides only one six-year term without re-election for the President. For him to stay in Malacañang after 2016 would require Charter change or elections would have be cancelled in 2016.
Now I believe that “kung sakaling itutuloy ang 2016 elections (if elections in 2016 will push through)” statement by Press Secretary Edwin Lacierda three weeks ago was not a slip of the tongue nor inadequacy in Tagalog nor stupidity. It’s part of their game of taking people for a ride.

Last month when Interior Secretary Mar Roxas first suggested that Aquino run for another term in 2016, amplified by Aquino himself in his interview with TV5’s resident legal analyst Mel Sta. Maria, I gave five possible reasons why Aquino floated Cha-Cha to allow him a second term and clip the powers of the Supreme Court.

The five reasons were 1) he doesn’t want to be seen as a lameduck, 2) he has not gotten over the Supreme Court’s 13-0 decision on the DAP or Disbursement Accelerated Program ; 3) there is no one in his party, the Liberal Party, that can beat Vice President Jejomar Binay in the 2016 elections; 4) he is enjoying the Presidency and if he can get away with another six years, why not; 5) Type lang niya i-gudtime ang madlang pipol.

Now, I’m more convinced it’s number five: Type lang niya i-gudtime ang madlang pipol.

Why am I saying that?

Last Friday in a gathering of Aquino allies in Malacañang where he made another State-of-the Nation address (his second in less than three months), he said, “I know that the 2016 elections are already on the minds of some. Indeed, the time will soon come when the straight path will choose a new candidate. I hope it isn’t me.”

The audience laughed. Do you find it funny?

In an interview with the editors and reporters of the Philippine Daily Inquirer, Aquino said there is still time to amend the Constitution contrary to the opinion of some analysts. “, might do even better in a second term,” he was quoted by the Inquirer as having said.

In his Friday speech, Aquino said, “I still get told, or even get sent text messages: About how it is my duty to look for who will replace me, and to train him for the responsibility. That it is my duty to help further everything we’ve begun. There are even those who say that the surest way to secure the straight and righteous path is if I myself continue leading the country. I cannot disregard the suggestions of open-minded people, of people who have sincerest intentions to help their fellow man.”

In the Inquirer interview, Aquino was quoted to have said, “If many people come to Luneta (to persuade him to stay) I might find it hard to say No.”

In the count of Aquino’s FB Fan page, I was number 4,078,091.

Run, PNoy, run!

There is wisdom in Napoleon Bonaparte’s strategy “Not to interfere with the enemy while he is in the process of destroying himself.”

Firstly it would be illegal for Pres. Aquino to seek re-election without the amendment of the democratic rights in the charter.. And if there is the Amendment will disqualify him but would only qualify the next Presidents.. The idea being floated by the President in my belief is to EFFECT a Cha-Cha to which a wholesale Reform could be effected including limiting the Judicial Review Power of the SC which he Believes is not conducive to progress… Perhaps by my Persistent posting of Section 33 the most Controversial part of our charter, the over Ride power of the Parliament and or LegIslature may have rub into the President consciousness.. Well if it works so well in other Jurisdiction where it was never even Invoked by the Federal govt.. It could work anywhere .. (One time the parish priest of PM Paul Martin threatened him of ex I’ve does not overrule the SC desision on same sex union) he ignored his Church

  3. vic vic

Pls note that the case that brought about the legalization of Same Sex union has nothing to do with same sex marriage at all…
    Background…
Mr. Hislop a long time Gay activist, upon the death of his long time same sex partner Filed for Survival Pension from Pension Canada and was Denied under the law that Marriage under the Family law was defined as “union of man and woman at the Exclusion of all others”

Mr. Hislop filed a Class Suit against Pension Canada, a Govt Agency based on his Charter Right on Equal Benefit and Protection under the Law for Every Individual and the Trial Court Agreed and ordered Pension Canada to pay the Class suit…

The Govt on behalf of Pension Canada appealed the case to the Appelate Court and Lost..and to the Supreme the Federal Govt. Went…and lost…

And the SC ordered Pension Canada to pay the Survivor Pension Benefits of all Survivors under the Class retro active to the Filing of the suit which Took 10 years to reach the Final SC rulings…

Then the Catholic Church wanted the Govt. of Paul Martin to pass a Legislation to circumvent the Rulings and invoke the Section 33 and that will let the Law Operates for 5 years NOTWITHSTANDING the SC rulings and can be Reenacted indefinitely..But PM Paul Martin refused and instead asked the SC in Reference Question if a Legislation should be passed to Reflect the SC rulings and the SC gave its advisory opinion that since Many same sex couples went ahead and got WED based on the Rulings a new law is not necessarily needed…But subsequent govt. codified the law

Now all benefits enjoyed by traditional couples are also extended to same sex couple, like tax exemptions, Parental leave for child bearing and adoption and it is whopping maximum of one year divisible between parents..(les can have kids and men can adopt)…

Yes, I always believe that the power to over Ride is a good tool to check the over reaching SC and let the Electorate decide for the action of the Govt…Since l982, it was only invoked 2 or 3 by the provinces and it was not even necessary as the SC in all instances made sure that its power of Judicial Review is fair and Just…

nd also the SC earlier established a set of Test for the Govt and the Legislatures (Federal and provincials) to guide themselves as to what is within the Constitution and what is not in Compliance..the OAKES Test..

And it is very Prudent that the Govt and or legislature is not surrendering its power by seeking the Advisory Opinion of the SC in cases of DOUBT in a Question in Reference in Regards to a specific provision of the Constitution before Acting on a proposed Legislation or a Policy or resolution…That a Crisis can be avoided before it arises…Only the sun can not be stopped from rising in the East every morning…

Yes, I thought the remark was funny. I suppose one has to consider his context at the time, and not put it into an artificial intellectual framework that could find it unfunny. Many people thought George Carlin was unfunny, too, because they were prudes and he was not. He was not talking to prudes, and the president was probably not joking to political opponents.

@vic #3, very interesting reading. You make good sense.

  5. vic vic

Joe @ # 4..thanks..during the Kitchen Accord (that is where the First Ministers meeting was held to finalized the Charter) the Separatist Movement in Quebec was picking up speed and Trudeau an ardent Federalist was very wary that the Parti Quebecois will use the over Ride power to advance its Movement..But Justice Minister Chretien and the other 9 Provinces (7 provinces needed to get the Charter approved) wanted the “notwithstanding clause” including to Limit the Power of the SC Judicial Review…(until today, Quebec has not assented to the Charter and the last time the Separatist Party Quebecois was in Govt…it was a shorlived and was defeated last spring..it wanted to enact its own Charter)

Chretien convinced Trudeau to include the over Ride clause when he put a few question to the PM “what if the SC ruled that Child Pornography is Constitutional under the Freedom of Expression and what if the Hate Speech (hate speech is a crime under the criminal code) is ruled unconstitutional for the same Freedom of speech?

During the First 3 years, the Separatist Govt. of Quebec, invoked the Clause and had their Act exempted from Judicial Review and the Party paid the Consequence..they were outvoted less than the 5 years that is the maximum allowed before reenactment..The Electorate decided that the Government abuse its over Ride power…

The PQ was returned to power a few times after, but only invoked the Clause once in regards to Language Rights but let it lapsed…

The Federal Parliament never invoke the Clause…

  9. This is the latest from Aquino on his desire to be president after 2016:

Speaking with reporters on board a chartered Philippine Airlines flight from Madrid to Brussels, Aquino said he could still make a second run for the presidency even if that would require amending the Constitution with less than two years before the next elections.

“Don’t we have a saying that if one wants something, nothing is impossible, but if he doesn’t, nothing is possible?” he said.

“So, if the vast majority think that this is the route that has to be taken, then there will be a way based on the Constitution to afford that opportunity.”

Amending the Constitution takes a little while and it also needed to be approved in a Plebiscite. And the best time to submit the amendment for the People approval will be during the next Presidential Election. .. and whether it will get the nod or not, President Aquino just cannot run in the next election. ..I believe he is just trying to convince the electorate that he has changed his Stand against the Charter Change after encountering many obstacles with the SC Over Reach of Its Judicial Review Mandate and wanted to have it Constitutionally Restrained. . And if it can be done, then both Institutions can work together for Progress..And it is very Doable…Canada has proven it..without compromising the Integrity of each Institution. .

vic, canada is not philippines and philippines is not canada. politicians/leaders from both countries are galaxies apart when it comes to integrity in serving the country.

Cannot let go of power huh kuya Noynoy, nasasarapan?
    Absolute power corrupts absolutely.

  15. olan olan

True chi. He seems dreaming?! And I can’t believe he is actually toying with it! They think managing 100 million pinoys is all about dinky’s food packs that they want to hoard forever! Huh

  16. olan olan

If they can’t even put something concrete and new on the table why? Do they want us to continually live a life with unfair taxation policy, dinky’s food pack policy, riding in tandem policy, MRT breakdown policy, never ending traffic policy, joblessness export policy, slower than slow justice policy, etc. at least with nog2 something unexpected and new may surprise us…more likely for us to bitch about!!! Nog2 is their boy, favorite of mama Cory!

  17. MPRivera MPRivera

actually it is not da penoy who really wants another six years in power. they are his allies and cabinet members who had been intoxicated by his (penoy’s) defense whenever they find themselves caught with their pants and panties down.

  18. MPRivera MPRivera

but tell you, da penoy’s cabinet is composed of only one (kind of) person who really wants him to absolutely stay in power (not just another six years).

it was sorry for penoy to appoint a bad budget management secreatary who was accused of creating the unconstitutional DAP.

penoy got mistaken when he appointed a bad communications secretary in the person of ricky carandang who later resigned for some reasons they in malakanyang only knew.

so much was his mistake when penoy appointed a bad HR commisioner in e-ta rosales who is showing her bias for the left while closing her eyes on their crimes.

it is a nightmare for the electorate when penoy appointed a bad comelec head in sixto brillantes who now again wants to buy new hokus picos machine for the coming 2016 election.

and, penoy should hang himself for appointing a bad presidential spokesman in lacierda, a bad assistant in valte, a bad foreign affairs secretary who cannot express himself in his native tongue.

you see, everyone noynoy appointed is a bad influence to his bad judgment.

  19. MPRivera MPRivera

i’m sorry if i appear to be a bad citizen for criticizing a bad mannered president who always passes blame on a bad past administration when it is his and his cabinet’s bad performance that make us people feel bad about them.
