Mar forgot to tell PNoy about BOI request

Interior Secretary Mar Roxas forgot to tell President Aquino of the request Police Director Benjamin Magalong to interview him before the Board of Inquiry on the Mamasapaano tragedy released their report last March 13, ABS-CBN reported.

Magalong said he met with Aquino in Malacañang on Tuesday together with Roxas and Philippine National Police Officer-in-Charge Leonardo Espina.

He said Roxas also apologized for failing to inform the President about the BOI’s request to interview him regarding the Mamasapano mission.

“Binanggit din niya syempre yung issue na bakit hindi ko siya na-interview. At in-explain ko rin sa kanya na, inamin din naman ni Secretary [Roxas] na talagang sa dami ng trabaho nakalimutan na mabanggit kay Presidente at dapat na-remind ko sila,” he said.

It will be recalled that Presidential Spokesperson scored the BOI for not getting the side of the President before issuing the report.

It was reported here Monday that Magalong asked Roxas last March 9 to relay their request to Aquino for an interview.

Following is the report of ABS-CBN’s Jeff Canoy:

“President Aquino was hurt by the findings of the Philippine National Police Board of Inquiry on the Mamasapano incident, according to the BOI chairman who was summoned to Malacanang to meet with the President.
Police Director Benjamin Magalong, chairman of the BOI and head of the Criminal Investigation and Detection Group, said he met with President Aquino in Malacanang on Tuesday, just days after the PNP released the full BOI report on the Mamasapano incident.

Present during the meeting were Interior and Local Government Secretary Mar Roxas, Justice Secretary Leila de Lima and PNP Officer-in-Charge Leonardo Espina.

According to Magalong, the President was hurt by the BOI findings.

“Visibly nasaktan siya. President siya. Nasaktan siya sa naging report, makikita naman yun. Pero even then during that time talagang very calm siya, talagang cordial at maayos naman ang aming discussion,” he said.

The BOI report earlier said the chain of command of the PNP was violated after the President, suspended PNP chief Alan Purisima and Special Action Force commander Getulio Napenas deliberately failed to inform the PNP OIC about the Mamasapano mission by keeping the information to themselves.

It also said the President “gave the go-signal and allowed the execution of Oplan: Exodus after the concept of operations was presented to him by…Napenas.”

It said the President allowed Purisima to participate in the planning and execution of Oplan Exodus despite the latter’s suspension.

It also said the President exercised his prerogative to deal directly with Napenas instead of Espina. The report said the act of dealing with Napenas instead of PNP OIC Espina “bypassed the established PNP Chain of Command.”

Magalong said the President explained that he gave instructions to Purisima to coordinate the Mamasapano mission with PNP OIC Espina. This order was not followed.

He said the President also admitted that he expected full cooperation between the SAF and military forces in Mamasapano, not knowing that Napenas did not follow his order.

Magalong described the meeting as “no holds barred,” with all contentious issues discussed.

“Sa mga contentious issues na nabanggit ng Presidente, binanggit ko rin kay Presidente na we never mentioned that you violated the Chain of Command. We just said that you exercised your prerogative to talk directly to Gen. Napenas. Andun sa conclusion namin. Kung anong conclusion namin is statement of fact. That is a statement of fact,” he said.

Magalong said Secretary Roxas also apologized for failing to inform the President about the BOI’s request to interview him regarding the Mamasapano mission.

“Binanggit din niya syempre yung issue na bakit hindi ko siya na-interview. At in-explain ko rin sa kanya na, inamin din naman ni Secretary [Roxas] na talagang sa dami ng trabaho nakalimutan na mabanggit kay Presidente at dapat na-remind ko sila,” he said.

The BOI chairman said he regrets failing to interview President Aquino before issuing the final BOI report.
However, he also admitted that the results of the BOI investigation will not be changed much.

For now, Magalong said he is focused on going back to work as CIDG chief after finishing what he describes as the hardest investigation in his career.

“I’m glad it’s over. It’s time to move on, there are so many thing need to be done,” he said.

    better na hindi nagkaroon ng interview sa mahal na presidente dahil makakagulo lamang sa magiging o naging resulta ng BOI. kung ano ang sinabi niya kahapon ay magiging iba kaysa sasabihin niya ngayon, bukas at sa susunod na mga araw. may tendency pa ngang aawayin pa niya ang kakausap sa kanya at ipagpipilitang tanggapin ang anumang mali na gusto niyang isaksak sa utak ng interviewer.

    May problema na naman. It took about twenty attempts to log in, using different browsers.

    Pilit ni De Lima that the concept of “chain of command” applies only to the military, not the Police, which is a civilian organization.

    The Courts in the US, from which country we copied our Constitution, disagree. Below are some cases where the concept of chain of command was acknowledged.

  5. Another admission of stupidity. Omaygawd! You’re a police prober who wants to interview the highest official of the land and you ask your boss to get permission for you by word of mouth? Whatever happened to memos? I still can’t believe this is how we operate in the highest levels of government.

    Now it’s Roxas’ fault that he didn’t interview the President before he came out with his “comprehensive report”.

  6. Un-fucking-believable. The Board of Inquiry from Day One was expected to leave no stones unturned (the usual blahblah) and everybody’s number one suspect wasn’t even formally informed an interview was forthcoming. And the excuse? Roxas forgot.

    E di wow.

    Now everybody’s patting their own backs for a job well done when all they did was play to the gallery who wanted a bloody bald head on the plate before the probe even began. There’s no difference between the Senate Report and Magalong’s selective report. Both take credit for an issue already prejudged and preferred to adopt the lines coming from media and not at all based on new info of a supposed IN-DEPTH investigation.

    It’s like the rooster taking credit for the sunrise.

    Why do I say these? I am presently watching Sonny Trillanes on ANC. Like many here, I was first disgusted why he refused to sign the Senate majority report and sided with his buddy, Panot.

  7. Few revelations AT4 explained why he did not sign the Grace Poe’s report:

    1. It glossed over the fact that Napeñas fed everybody, not just Panot, the AFP, but all of us, false information. AT4 claimed that if you plotted the enemy coordinates he texted on a true military map, it was off by sevral hundred meters, at one point it would have killed the rest of the surviving 84th commandos because the coordinated were based on…wait for it…GOOGLE MAPS! Imagine if the AFP started aiming then firing their artillery on the coordinates. AT4 was laughing with TV host Pinky Webb because one of the coordinates in Napeñas’ text specified 365 degrees!

    2. It is now a known fact that only 80 SAF Commandos entered the barangay while the rest (about 220?)were lying by the roadside and the river, sleeping, texting, what-have-you even when fighting erupted less than a KM away. Who was really responsible for commanding this force is still muddy.

    3. Another revelation that caught me dumbfounded was that on the night of the assault, Police intelligence people in AT4’s own words “wined and dined” the AFP Commanders whose AOR directly covered Mamasapano. Hmmmm? Why would they do that if they needed them in the wee hours of the morning? Pinky Webb didn’t dig deep enough on this issue but I smell fish from a mile away.

    4. Napeñas rallied the whole police force and drove a wedge between them and the AFP when in fact the AFP didn’t want to reveal the several failures of the SAF leaders to the public awareness. This is why the AFP called for the Executive Session in the Senate. Yet AT4 says Napeñas continues to blame the AFP for the SAF 44.

    This and those I mentioned above (and a few others I cannot recall) cannot be found in Poe’s report.

    Yesterday 20 signed Poe’s report. Today, 10 senators claim they signed with reservations.

    Who hunted down Janjalani? The Philippine military. Who took down Bin Laden? The US military. Who hunts down the NPA? The military. Ask Magno.

    So why was this military operation outsourced to the police?

    That is the original sin. And you have nobody to blame but the Mamasapanot.

    There would have been greater coordination within the military – ground troops, air power if necessary. So they suspected moles in the command in Mindanao. Fine. They could have done an internal outsourcing. Get guys from Luzon; from the Scout Rangers.

    #7. tongue, I was tuning in to Trillanes yesterday and saw his significant points. Hindi ko narinig sa hearings na sinabi niya ito. He should have insisted on his findings/observations.

    Anyway, mabuti nga na lumabas una ang Poe report at ng nakita ang flaws. Poe must incorporate the Trillanes findings for a more substantive and unbias commitee report.

    With Trillanes findings, Mamasapano is not finish yet. Dig deeper and we shall find the truth.

    Baka magalit daw ang MILF. But as stated by a previous official, hunting down high value operations is an exception to the need to coordinate with the MILF.

    Besides, there is a work-around. Make the military wear police uniform.

    In this news item, the President claims that the warrant of
    arrest was issued in 2002.

    But the US indictment of Marwan (the indictment being bandied around by Cayetano) says Marwan only started residing in the Philippines in 2003. The US State Department announcement of the reward also states that Marwan was present in the Philippines, starting in August 2003. Oops.

    If the 2002 claim is true, then it was issued in the time of Goyang, under Nani Perez. So which judge issued the warrant of arrest? To issue one, there must have been an application, and a finding of probable cause. So can somebody dig up those records? Which fiscal of Goyang made the application? Where was it filed? In Manila? In Cotabato? What was the basis for charging him, when he was not here yet that year?

    Two things:

    1. The Police intel officers were feeling-up up to the last minute if the AFP were aware that Marwan’s arrest ops was ongoing or about to begin that night.

    2. The cops made sure the AFP decision-makers (commanders) will not be available in the morning in any case that the ops was a success or failure. They apparently planned to keep the AFP out of the loops. That explains the Time-on-target mode ofcoordination.

  15. Just watched the late night news (GMA7 this time). You’re right, chi, AT4 explained these new infos were brought up during the Senate executive session. He reiterated that the Senate report “wanted to conform” to the present mood of “glorifying the SAF44” thus it ignored these additional facts meanwhile, it generated more animosity between the two armed agencies of gov’t with one side being portrayed as victims of the other’s inaction – the army were the villains.

    Another issue in the ANC interview which escaped me earlier was at about 8:00am the 55th SAF was engaged in a shooting battle with about only 150 rebels, therefore no truth to what we know from media reports that the 52nd, 53rd. 51st were turned back by heavy gunfire because when the reinforcement Army soldiers arrived they were found “sleeping and texting by the roadside”. The remaining SAF cops easily outnumbered the rebels up to that point but they chose not to participate, instead, they were waiting for the Army resbak, which was difficult to pull at that point because the commanders were still sleeping after the previous night’s “party” with PNP Intel.

    As usual, I do not take the usual news reports as is – hook line and sinker – and would always go deeper into hidden motives. I have expressed doubts that this whole affair is a monkey wrench thrown into the peace process – a big headache to the military-industrial complex (wow, haven’t used the term since the 70s) and the big bucks that ought to be made in this perpetual moro-moro. I also reiterate my suspicion that this is a scenario of the tail wagging the dog.

    Nasabi na earlier, in some news reports, about advance info by the MILF of movements by the AFP. Gasino ba naman ang bayad sa civilian employee, to either sniff for info, or even to install listening devices. Barya lang yan, to the internationally funded MILF.

    This is what Tiglao says in his latest column.

While this may be a cruel accusation, I was told way back in 1996 by my MILF informants: “Don’t you notice that nearly every general gets to be assigned in Maguindanao before he retires?     The Tiglao claim is backed up by Marwan’s own email to his brother. On page 14 of the Indictment, Marwan talked about a soldier who was trying to sell a new .50 caliber for $5,000.

    You think that was the soldier’s independent move? Or was the soldier fronting for some general?

    Commander A. Wahid says that there is a soldiern who wants to sell a new .50 caliber for US $5000.

  17. sax, why the police? ‘Cuz the MILF and AFP have not been shooting at each other since the Malaysia talks started. Serving a warrant is the PNP’s job. Of course I don’t have to explain that to you atorni, hehe. But like you said, the soldiers in cop’s unforms would have been a very creative solution.

    I’m also seeing a scenario where idealistic police officers are out to prove that the BBL draft isn’t at all favorable for our purposes and intents. Nor that the MILF is trustworthy enough to be handling tens of billions of funds. Hence the white (benevolent not race) saboteurs found a very gullible Napeñas to do the dirty job and whole BBL going down with him. This is the optimists POV.

    The common pessimist view, which is easier to grasp even by the simpletons, of course is what we have in media today. Bad news is always viral.

    Who knows, few years from now we would even be thanking Napeñas (and Purisima!), okay, include Panot, for this major fuck-up.

    My point is, is there a warrant of arrest? There may be none. This was a raid – an assassination. So it is best left to elite forces in the military, not the police. Excuse lang yang warrant of arrest.

    Note the timeline. A warrant of arrest issued in 2002, a year before Marwan moved to the Philippines. So where is the probable cause? The indictment talks about bombings (in Mindanao) in 2006, so probable cause occurred in 2006, four years after the alleged issuance of the warrant of arrest.

    Again, which judge issued the warrant of arrest?

    Here is a curious fact from the indictment. In an email by Marwan, he states:

    XXX is the base commander of division 106. He has his left foot on the MILF, and his right foot on Datu Andal. When they have a battle with Amer Umra Kato from division 105, his (XXX) troops become Andal’s dogs (fighters).. merge with Andal’s troops, was shot by someone.

  19. The problem with Tiglao’s reports is that he blindsides issues only in the perspective favorable to his theory. Remember that the Ampatuan massacre, also in Maguindanao, several cops were indicted for abetting (and participating!) in the murders.

    The mayor of Mamasapano is also an Ampatuan. That is why they imported SAF members from other regions, mostly from Benguet and other northern provinces.

    I’m not even ready to believe that it is the AFP alone that sells arms to private armies and the rebels. That the police are clean in that aspect is such a wide stretch, if that is what is Tiglao is concluding.

    No such conclusion from Tiglao. He was talking about the military. No such conclusion on my part either.

    But who has the opportunity? The one/ones who are near the market. And the Marwan email confirms the AFP is selling.

  22. I agree with the Marwan email as far as the intricate connections of the different factions in Maguindanao is concerned. Ditto with the MNLF/Abu Sayyaf/Tausug overlap in Basilan and Sulu.

    As to the issue of the warrant, I know you will agree with me that it is basic and MUST form part to the lengthy BOI and Senate reports which I have no intention of dissecting in toto. But then again, I wouldn’t be surprised if both were silent on this important issue.

    Onga, matagal ko na iiisip ito. Everything happens for a reason. For one, kundi dito naipasa nang walang ingay ang BBL, lalong nagkaluko-luko ang tayo ng bansang sinilangan.

    chi, all the elements that would justify my conclusions ay sobrang sapat, bilang tumbok:

    1. the allegation involving a few american operatives in the execution of OPLAN EXODUS speaks so loud of the bounty the stooges are salivating.

    2. purisima on suspended status that if the operation was a success would be a ground for (his) reinstatement to his post to be recommended by mamangpanot that would outrightly accepted by the ombadsman and eventually might commute his string of cases.

    3. purisima is retiring this year and may have promised napenas to be recommended to mamangpanot as his next-in-line, as his reward in leading the operation, of course .
