Arroyo guilty of crimes against humanity

Tribunal Verdict to be transmitted to the UN, ICJ and European Parliament

THE HAGUE, Netherlands – In a 13-page verdict read before about 300 people inside a church in this city March 25, the Permanent Peoples’ Tribunal (PPT) found both Philippine President Gloria M. Arroyo and U.S. President George W. Bush, Jr. and their respective governments as responsible for gross and systematic violations of human rights, economic plunder and transgression of the Filipino people’s sovereignty.

The verdict, read at the conclusion of the five-day second session on the Philippines by François Houtart, Session President, described the extrajudicial killings, forced disappearances, massacres, torture and other atrocities allegedly committed by the Arroyo government as “crimes against humanity”. Such violations which the PPT said were in no way justified as “necessary measures against terrorism”, must be stopped immediately.

In a cultural program held right after the verdict was read, Senator Jamby Madrigal said the Tribunal’s judgment will dispel the claims of the Arroyo government that there is democracy in the Philippines. The senator, who spoke as a resource person during the tribunal proceedings, said that the country is now ruled by a military junta with Mrs. Arroyo acting only as a figurehead.

The concluding part of the Tribunal took place at the Pax Christikerk in The Hague. The Hague is the Netherlands’ seat of government and the world’s center of international law. It hosts the International Court of Justice (ICJ), the new International Criminal Court (ICC) of the Rome Statute of 1998, and the International Criminal Tribunal for the Former Yugoslavia (ICTFY) that tried Milosevic, the deposed president of Yugoslavia for war crimes.

The Tribunal, composed of six internationally-eminent persons, also named the Armed Forces of the Philippines (AFP), as having “a central role” in the atrocities, adding that the military is “a structural component and instrument of the policy of the ‘war on terror’ in the Philippines” declared by both Arroyo and Bush, Jr.

The verdict was rendered after three continuous session days that heard the testimonies of witnesses of political killings and abductions, expert testimonies and boxes of documents, and other evidences to support three major charges against the two governments. The charges were on: violations of the Filipino people’s civil and political rights; economic, political, and cultural rights; and violations of the people’s rights to national self-determination and national liberation.

The number of victims of extrajudicial killings in the Philippines has reached 839 this week. Hundreds of others were victims of frustrated murders and abductions, widely believed to be perpetrated by government security forces. This report has been confirmed by the UN Special Rapporteur on extrajudicial, involuntary or summary executions, and by the government-created Melo Commission.

In the Tribunal, several testimonies of eyewitnesses, experts and resource persons were heard live through tele-video conference with Manila, with questions tossed by members of the Tribunal’s jury.

Those who gave depositions and testimonies either in person or through video hook-up included Marie Hilao-Enriquez, secretary general of human rights alliance Karapatan; Dr. Constancio “Chandu” Claver, victim of frustrated murder; Dr. June P. Lopez, an expert in handling torture and trauma victims; Navy Capt. (ret.) Danilo Vizmanos; UP Faculty Regent Prof. Roland Simbulan; Bishop Elmer Bolocon of the UCCP and Ecumenical Bishops Forum (EBF); Elmer Labog, chair of Kilusang Mayo Uno (KMU); and Danilo Ramos of the Kilusang Magbubukid ng Pilipinas (KMP).

Senator Madrigal also appeared before the PPT as resource person on the environment.

‘Unacceptable’

The Tribunal jurors also denounced as “unacceptable” the inclusion of the Arroyo government in the UN Human Rights Council (UNHRC). The Philippine membership, the jurors said, undermines the credibility of the United Nations particularly in human rights, and is “an intolerable offense” to the victims.

Aside from Houtart, who is from Belgium and Director of the Centre Tricontinental (Cetri), the PPT jurors included Oda Makoto (Japan), well-known novelist and social activist; Ties Prakken (The Netherlands), professor in criminal law Maastricht University; Oystein Tveter (Norway), lawyer and former Director of the Karibu Foundation and former foreign ministry official in South Africa and Zambia; Irene Fernandez (Malaysia), lawyer, social development expert and head of Tenaganita; and Lilia Solano (Colombia), 2005 Right Livelihood Awardee (alternative Nobel) and Director of Project for Life and Peace.

Richard Falk (USA), professor emeritus of international law at Princeton University and Hans Köechler (Austria), president of the International Progress Organizations could not make it due to academic commitments.

Houtart and Makoto were also members of the jury during the first session on the Philippines in 1980 held in Antwerp, Belgium, which found the Marcos dictatorship guilty for gross and systematic violations of human rights, among others. That verdict became a major factor in the international isolation of the Marcos dictatorship that eventually led to its ouster six years later.

PPT General Secretary Gianni Tognoni served as moderator of the proceedings.
Houtart said that although the verdict may be legally non-binding, it is nevertheless “morally binding”. The judgment will be transmitted to the United Nations, the International Court of Justice, the European Parliament and various foreign governments. Tognoni said that the transmittal to these bodies will be a major step toward focusing world attention on the human rights crisis in the Philippines. World opinion, the PPT general secretary said, will add more pressure to the U.S.-supported Arroyo government to stop the killings.

  7. Compare the COWARDS of the soldiers of the AFP and the BRAVERY of NON-MILITARY people to give evidence to The Haque Tribunal jurors.
    There must be many soldiers who can actually identify the men that actually pulled the trigger to slaughter hundreds of innocent victims said to equate to one killing every three days.
    There is no doubt that soldiers who could testify against these killers are nothing but COWARDS! The amazing thing is that these soldiers who know the killers are also responsible for dragging down the AFP reputation worldwide. Whereas the BRAVE Senator Ana Maria Consuelo “Jamby” Madrigal, who, with others on Friday, sought and got on Sunday 25th March 2007 “a guilty verdict for failing to address the extra judicial killings against the regime of Gloria Macapagal-Arroyo and for the violations of the economic, social and cultural rights of the people including the violation of economic sovereignty and the national patrimony through iniquitous agreements and economic plunder by foreign and local exploiters.” The opposition senator presented a 15-page “Summary of Charges and Cases on the Continuing Displacement of the Indigenous Peoples and the Plunder of the Environment in the Philippines”. Among the accusations Madrigal hurled against the Arroyo administration was “a noticeable lack of interest” on the government’s part to implement laws protecting indigenous peoples’ rights. She also cited the issuance of Executive Order no. 364 in 2004, which “cut off the independence of the National Commission on Indigenous Peoples (NCIP),” the agency to protect and promote the rights of the indigenous peoples, by placing it under the Department of Agrarian Reform; the allegedly illegal grant of a logging concession in Samar to Senator Juan Ponce Enrile; and the alleged displacement of indigenous peoples in Zamboanga del Norte and Boracay island. Among those who have endorsed the tribunal’s session on the Philippines is Nobel Peace laureate Desmond Tutu, archbishop emeritus of Capetown, South Africa, who called on Arroyo to “stop the terror inflicted on those who seek justice in your land. Stop using the so-called war against terrorism to oppress and kill your own people.”

    ALL soldiers of the AFP are themselves also responsible for these extra judicial killings for being COWARDS for failing to refuse the illegal orders of their corrupt Generals and closing their eyes to what was actually happening. Shame on you.

No corruption in these European folk and now its possible for any and all countries to execute punishment such as to freeze their bank accounts worldwide. If there are bank accounts in Germany or usa we will soon know. They can refuse entries to their countries, she will be afraid to travel freely. Believe me this is a good result, its the beginning of the end for this administration.

  9. Tiyanak and Company should not be too sure that she cannot be censured finally. A lot many creeps like her have been convicted by this tribunal with a bang as a matter of fact.

    Those of us born after WWII may not be aware of it, but a Philippine Tribunal was convened to try collaborators, etc. criminals of the war, and a lot many people getting convicted by it before the US granted the Philippines independence in 1946 and prior to the establishment of a more reliable court of justice.

    With the absence of the rule of law in the Philippines under a bogus regime, it is just but sane and logical to convene such tribunal even in The Hague where they have the International Court of Justice to try first-class criminals like Mrs. Pidal and her generals, et al.

    It is a prelude to the more formal International Criminal Tribunal for the Philippines as in the cases of the International Criminal Tribunals for Rwanda, Kosovo and Serbia that the UN may eventually open to try Mrs. Pidals and make her legally responsible for the death of people they fondly named categorized as “communists and terrorists” even when they are not.

    Frankly, I cannot understand how the Philippines can be called a democracy when criminals run their government and wantonly run after ordinary citizens they eliminate one by one to keep their positions and inculcate fear and terror in the Filipinos who are being turned into puppets and donkeys as in Pinocchio’s “Enchanted Kingdom.”

Keep this Micky Mouse military of our in barracks where they belong and leave it to a reformed PNP to due their duty of keeping law & order. Its the only way forward, no excuses for the Military to patrol the slum areas.

    no due process was observed (i can already feel the “what about-the-victims-of-the-killings-they-were-not-given-due- process-also!”) the “accused” never had a chance to cross-examine the “witnesses” and confront their “accusers”

    that tribunal is already predisposed to pronounce a ‘guilty’ verdict. it was just looking for facts to support its predisposition. in essence, a “kangaroo” court notwithstanding the supposed “pedigree” of its jurors (umiral na naman ang colonial mentality ng mga Pinoy – mga foreigners kasi ang bumubuo ng “tribunal’ kaya they must be credible)

    For a people who’ve for DECADES tolerated people living, eating, and dying on mounds of rubbish, we seem to be so quick to point a finger at a sitting president for “crimes against humanity”.

    Hirap sa atin we are such a judgmental people e.

    Many of us need look no further than our immediate surroundings. For those who employ domestic helpers, how many times have we woken them up in the middle of the night to go out and buy us a stick of Marlboro? Do they have formal job descriptions so that they can actually object to being asked to being made to work more than 12 hours a day? Do we contribute to their SSS fund? Do we provide them descent well-ventilated and mosquito-free sleeping quarters?

    It’s too bad even lower middle class Pinoys can afford maids, because from what I’ve observed, lower class domestic help employers tend to be more cruel to their servants than rich employers.

    How often have we treated people with respect? Those who have lived in advanced Western societies have probably observed how people in these countries generally treat one another (whether they are CEOs or labourers) with respect, courtesy and dignity. Even my own boss occassionally cleans up our coffee cups after a meeting. Sounds bizarre of course to a people who are such primadonnas as a result of having so many cheap labourers available to clean up after them.

    It is often said that a society can be judged by observing how it treats the least of its citizens. How much public facilities have we seen in the Philippines that cater to the needs of the aged and disabled? How many times have you heard the words “negro”, “baluga”, “punggok”, “unano”, “bumbay”, etc, directed at a minority, handicapped, or physical-feature-challenged individual?

    Ang galing natin mag-malinis, yet our cities and even immediate surroundings are amongst the filthiest in the world.

    Whilst elections and petty political gossip like these make front page news and comment fodder in blogs every day, the Payatas landslides and even the 2006 mudslide that killed 1,300 Filipinos were off the front pages by Day 3. You’d think things like that would cause the most outrage and soul-searching in a people. But no. It is hollow-headed partisan gossip and speculation that really stirs up a lot of discussion.

    As you know, majority of EU member nations (even the new acceding nations who were once Communist states) consider the Philippines truly AT THE BOTTOM OF THE TOTEM POLE among Asean nations so that when sending envoys, most of the people they send to Pinas are usually guys who are considered at the end of their flagging, sagging political career or are clearly at the bottom of the totem pole in their own foreign service career rating.

    While I’m not saying that Dutch Ambassador Robert Vornis belongs to the breed of those lowly Dutch foreign service career envoys, I’m pretty sure, he would not qualify for the Dutch envoy post to, say Japan, Malaysia or Thailand, or even Vietnam.

    So, don’t take it against Vornis for being daft – I suspect The Netherlands don’t particularly believe that Gloria ain’t worth a first class envoy so they sent her someone ridiculously daft.

    PPT is only an international opinion tribunal, independent from any state authority. Members of that PPT acted like a jury and will decide whether there are sufficient grounds to press charge based on international laws. They have no comparison with the United Nations of International Tribunals. PPT are only composed of an opinionated ,They have is no legal basis to punish the guilty.
    It is like a court without no proper jurisdiction.

    COMMENT: for a start the Cardinal is comparing Ferdinand Marcos when it was a dicratorship and now under this evil woman when she has NOT declared Martial Law.
    Second where is the moral guidence of this Cardinal, has he abolished it, if so he should announce this to the Catholic followers which for this very reason is becoming smaller and smaller in followers.

    I learned about Bicolano politics and its skuldeggery on my faher’s knee, my parents being also from Bicol and father being a politician too. Met also some of the new generation politicians,e.g. Alfelor Escudero, etc. Although they are sons of older politicos and got to where they are because of their fathers, at least they were Bicolanos so I shrugged my shoulders and accepted it as a fait accompli but Dato Arroyo!!!! Sure the Arroyos are from Camarines Sur but obviously this one is not. How can we stop these dynasties?1?!!!!! It is destroying the country! After Marcos was overthrown, akala ko may pag-asa na ang bayan. Dumaan na si Cory, si FVR pero wala pa rin overhaul of the graft and corruption yun pala a new set of carpetbaggers replaced the old ones. Have you ever watched the movie “The Carpetbaggers”? it is an old Harold Robins novel made into a movie. History repeats itself. After more than 2 decades working for the government and keeping my nose clean, I threw up my hands and emigrated.
