Sa mga nagku-kwestyun ng legalidad ng Executive Order No. 1 na nagbubuo ng truth Commission, sinabi ni Pangulong Aquino na pumunta na lang sa Supreme Court.
Sabi ni Aquino,”Iyung sinasabi pong unconstitutional, iyun ang opiyun ng ilang kongresista.Kami po may opinion din. Ang huhusga kung sino ang tama ang opinion, Korte Suprema. Palagay namin ay tama iyung ginagawa namin.”
Hindi naman nakapagtataka na umalma kaagad ang mga kaalyado ni Gloria Arroyo sa pagbuo ng Truth Commission na siyang mag-iimbestiga ng mga corruption at ibang katiwalian na nangyari sa siyam na taon na administrasyon ni Arroyo.
Sinabi ni House Minority Leader Edcel Lagman na kukwestyunin nila sa korte ang legalidad ng Executive Order No. 1 dahil sabi niya, sa pamamagitan lamang ng batas, na ipapasa ng Kongreso, mabubuo ang isang Commission.
Sinabi na rin ito ni Sen. Joker Arroyo. Sabi pa nga niya kung gagawa si P-Noy ng Truth Commission, sayang lang daw ang oras at pera dahil walang ngipin ito. Hindi raw ito maaring mag-subpoena o magpilit ng isang tao na humarap sa imbestigasyon.
Ngunit ang pinirmahan na E.O ni P-Noy at nagsasaad na magkakaroon ng kaparusahan, administrative nga lang, ang sino man na tatanggi sa tawag ng truth Commission.
Siguro naman pinag-aralan ng mabuti nina Justice Secretary Leila de Lima at ng mga abogado ni P-Noy itong E.O No. 1 Kaya bahala sila magdepensa ng legalidad nun sa korte. Ang mahalaga sa akin ay masimulan ang imbestigasyon at mahanap ang katotohanan.
Dalawang taon at anim na buwan ang buhay ng Commission. Tamang-tama yun dahil sa Disyembre 2012 ang retirement ni Ombudsman Merceditas Gutierrez . Kapag matapos na ang imbestigasyun ng Truth Commission, at isasampa na nila sa Ombudsman ang mga kaso, iba na ang Ombudsman.
Ang inaala-ala ko lang talaga ay ang pagpili ni P-Noy kay dating Chief Justice Hilario Davide para mamuno ng Commission. Wala talaga kasi akong bilib kay Davide. Paano mo naman respetuhin ang isang taong nagpasumpa sa pekeng presendente. Hindi lang yun. Nang nag-retire na siya sa Supreme Court, nagiging tagapatanggol pa siya ni Arroyo sa United Nations.
Nang binabatikos ang pamahalaan ni Arroyo sa extra-judicial killings, si Davide ang kanyang tagapagtanggol kasama ang isa pang sipsip kay Arroyo na nasa gabinete ngayon ni P-Noy: si Foreign Affairs Secretary Alberto Romulo.
Nakalagay sa E.O na ang mga opisyal ng Commission ang magdesisyon kung anong kaso ang i-imbestigahan. Hindi kasama ang human rights violations. Corruption lang.
Isasama ba nila ang dayaan noong 2004 na eleksyun? Dapat. Ang mga Marines nga na siyang maraming alam sa dayaan noong 2004 dahil sila ang ginamit nina Arroyo at Comelec Commissioner Virgilio Garcillano sa kanilang pandaraya, ay atat na atat na magbigay ng pahayag sa kanilang nasaksihan.
Ang “Hello Garci” ang ugat ng maraming corruption na naganap sa administrasyon ni Arroyo. Ang fertilizer scam ay may connection sa Hello Garci kasi ang perang para sa abono na ninakaw nina Arroyo at Jocjoc Bolante ay ginamit para pambayad sa kanilang operasyun daya sa Autonomous Region for Muslim Mindanao.
Ang NBN-ZTE ay nangyari dahil kailangan bayaran ni Arroyo si Benjamin Abalos, dating Comelec chairman , ng kanyang serbisyo sa dayaan noong 2004.
Ngayon na naitatag na ang Truth Commission, bantayan natin ang mga susunod na hakbang.
Duda din ako kay Hilario(us) Davide. Baka pili lang yung mga kasong tututukan niya. Yung di masyadong madidiin yung dati nyang among si Gloria Engkantada. Dahil sa hindi niya pagpapabalik sa mga nag-walk-out nuong impeachement Kay Erap at pagpapasumpa kay Gloria ay nagpapatunay na hindi siya marunong magpatupad ng batas bagkus ay partial siya at bias kung saan siya makikinabang. Ang kunsuwelo ko na lang ay ang integridad ni DOJ Secretary Laila De Lima na pwedeng pagkatiwalan. I believe she is the best pick and the best for the DOJ Department, so far.
For long time now I got sick & tired with this ever-presumptous Senator. I don’t know why she got elected again in this 15th congress. She don’t deserve to be part of this 15th congress. Sen. Defensor talked much about the legality of this truth commission when in fact she don’t even talked about GMA assumption into office for the past 9 yrs.
Where was she, stupid Joker Arroyo, and another corrupt bicolano Edcel Lagman when we all cried of GMA legalities in all areas? At the time of GMA these people haven’t even talked about GMA tumultuous regime and here since day 1 of P.Noy administration they’re all trying to hold & questions the new govt capabilities.
What a shame to all these die-hard GMA cohorts! Inspite of the fact that we are now trying to un-cover the dark years of the past and yet these people are all drenched by this evil shadow of GMA.

A) The Supreme Court of the Philippines (Filipino: Kataas-taasang Hukuman ng Pilipinas or Korte Suprema) is the Philippines’ highest judicial court, as well as the court of last resort. The court consists of 14 Associate Justices and 1 Chief Justice. Pursuant to the Constitution, the Supreme Court has “administrative supervision over all courts and the personnel thereof”.
B) The Philippine Court of Appeals (Filipino: Hukumang Paghahabol ng Pilipinas) is the Philippines’ second highest judicial court, just after the Supreme Court. The court consists of 68 Associate Justices and 1 Presiding Justice. Pursuant to the Constitution, the Court of Appeals “reviews not only the decisions and orders of the Regional Trial Courts nationwide but also those of the Court of Tax Appeals, as well as the awards, judgments, final orders or resolutions of, or authorized by 21 Quasi-Judicial Agencies exercising quasi-judicial functions mentioned in Rule 43 of the 1997 Rules of Civil Procedure, plus the National Amnesty Commission (Pres. Proclamation No. 347 of 1994) and Office of the Ombudsman (Fabian v. Desierto, 295 SCRA 470).
3) The Office of the Ombudsman of the Philippines is empowered by the Constitution of the Philippines to safeguard the government and government-related institutions and corporations from corruption and dispense justice in the case of such offenses.
The Philippine Ombudsman (Fil: Tanodbayan) is an ombudsman responsible for investigating and prosecuting government officials in the Philippines who are allegedly guilty of crimes.
The Offices of the Ombudsman independently monitor the government and all three of its branches. The Ombudsman is also responsible for receiving complaints from citizens, organizations, corporations, etc from the country. The Ombudsman usually prosecutes officials who are allegedly involved in acts of graft and corruption.
The Offices of the Ombudsman includes the Ombudsman’s own office, along with offices for a team composed of a sheriff, the Ombudsman’s second in command, and 6 other deputies who lead the their respective divisions and/or bureaus.
Ngayon ito ang tanong…bakit kailangan pang magcreate ng isang Tooth Commission e mayroon namang legal institutions na dapat magtatabraho sa anumang bagay na may kinalaman sa paglabag sa mga batas na umiiral sa ating bansa?
Ibig sabihin walang kwenta ang Korte Suprema, Court of Appeal, and Ombudsama? At bakit kailangan pa ng isang ahensya na wala namang mandato mula sa Kongreso at Senado…ano ang ibig palabasin ni PeNOY and his Bulong Brigade, Kamag-Anak, Inc. and Clasmaytz, Inc.
Dapat pairalin ang batas once and for all…at kung sino ang may jurisdiction sa mga usapin ito ang siyang may pananagutan kung di nila ito magampanan.

Ito ba ang gusto nilang mangyari…so, dapat buwagin ang Ombudsman…court of appeal at alin pa?
Itong mga tuta ni Gloria Arroyo puro dakdak. Siguro nakinabang sila sa daming anomalya ng rehimeng Arroyo. Si Joker, protector ng Jose Pidal Mafia sa Senado at si Brenda ay palaging sabit sa mga junkets ni Gloria. Sige, ipagtangol ninyo si Pandak. Magsasama kayo sa impierno. May suspetya ako na si Hilario Davide ay isang trojan horse ng Jose Pidal Mafia. The point of contention is not the creation of the Truth Commission, but the powers that went into it. The pros and cons will continue to stand by their arguments and so to settle once and for all, let the court decides the legality of the “teeth” whether it has the power to bite or just like a rubber bullet.
I hope that the commission will not be the centerpiece of the government; better leave it to the justice dept and concentrate on serving the welfare of the people, like the problem of unemployment, affordable prices of basic prime commodities, increase in LRT fares, exorbitant cost of water and electricity, peace and order, flood control, education, housing, medicare, etc.
These are the realities that affect almost the daily life of every Filipino that needs immediate attention and action from the government.

Truth Commission is focused on gma’s corruption activities. Nation can’t move ahead while it remained chained to corruption. P.Noy was correct in saying that there were people who wants him to fail, so they could continue lying, cheating and stealing again.
Lagman, Arroyo and Miriam were known lapdogs of gma. Their corrupt boss push a button, and her lapdogs bark in chorus, so they could continue receiving the evil bounty of their evil labor. Their time is up, and their evil deeds now exposed to the whole world!
They could not even catch one big fish at Bureau of Customs and one big time tax evader. What makes you think that Noynoy can even do anything with gloria, pidal, garci….etc…?

I read, I think in the Inquirer, that the truth Commission will start conducting hearings next year?

Kailangan kayong mga journalists at media para buhayin ulit at ungkatin itong kaso ni Davide na hinilot lang para di matuloy ang imbistigasyon.
