SC decision should not be hindrance to make Arroyo accountable

I’m not surprised that the Supreme Court slammed President Aquino’s Truth Commission, 10-5.

I’m bothered, of course, that we have a Supreme Court, beholden to a person who held power illegally for nine years, plundered taxpayers money and destroyed democratic institutions.

But even if the Truth Commission were declared “constitutional”, I was not really optimistic that Gloria Arroyo would be held accountable because Aquino chose to head it former Supreme Court Hilario Davide, who is also beholden to Arroyo.

I also believe that even without the Truth Commission, Aquino can make Arroyo accountable for her crimes against the Filipino people. What is needed is political will and a brilliant and efficient team to implement that “will.”

The High Court’s decision on the Truth Commission should impel the people to make known their displeasure over their betrayal of the people’s trust in the law. People should mark their name: Renato Corona, Lucas Bersamin, Arturo Brion, Teresita de Castro, Mariano del Castillo, Jose Mendoza, Diosdado Peralta, Jose Perez, Presbitero Velasco, and Martin Villarama.

Maybe it’s high time to stage People Power against the degradation of the Supreme Court. When you meet any one of the 10 justices outside the court, make known your anger. Tell it to their faces. Boo them. Make them uncomfortable. Throw rotten tomatoes or eggs at them.

People should also support justices who keep us from losing our faith in the rule of law in this country: Antonio Carpio, Conchita Carpio-Morales, Roberto Abad, Antonio Nachura, Maria Lourdes Sereno.

Harry Roque of CenterLaw Philippines asks, “Why and how can the search for the truth be unconstitutional ?”

His statement: “Centerlaw expresses its utmost disappointment with the decision of the Supreme Court declaring EO 1 which created the Truth Commission as unconstitutional. While Centerlaw has always maintained that the power of the proposed Commission may be exercised by the Department of Justice and other branches of government while the current Ombudsman has proven itself oblivious to the sins of the past dispensation, still this recent decision declaring EO 1 as unconstitutional would bolster impunity in the country and render nugatory the constitutional precept of accountability of public officers.

“Even assuming that the powers of the Truth Commission would duplicate the powers of the Ombudsman, there is nothing in the constitution that says that the power to enforce the country’s laws on the accountability of public officers is a monopoly of the Ombudsman.

“Neither may it be said that EO 1 violates the equal protection clause. The power of the Commission is only investigatory in nature and hence, its activities could not affect the constitutional rights of anyone under investigation. As a purely investigative body, its powers are clearly executive in nature and hence, it is within the powers of the President to create such a commission and to fund its activities using resources previously allocated by Congress to the Office of the President.

“What is objectionable to this recent decision of the court is its implications. Amidst the failure of the criminal justice system to investigate anyone in the past dispensation, the decision can be read to mean a grant of impunity to the past dispensation. Certainly, it sends a very loud message that this Court cannot be counted upon to support PNoy’s declared promise of promoting honesty in government by taking effective steps to investigate, prosecute and punish those who may have violated our criminal laws on public officers. The ultimate question of course is why and how could the search for the truth be unconstitutional?”

Terry Rindon of the League of Filipino Students said “Unconstitutionality should not be an excuse by Aquino not to send Arroyo to jail. He should have known the legal infirmity of the TC from the start. We reject this kid glove treatment of GMA and demand that Pnoy do all means to send GMA to justice.”

    Thing is not to turn simple ways of going about it into costly and complicated, tortuous road to perdition.

    Gloria’s people are everywhere including one blogger here. This woman made sure everything was in order before she stepped down. How she was able to get a huge budget for her Pampanga District from the Congress must be checked. During her term, Pork Barrel was not given to the opposition lawmakers. Why was she given such a huge budget now?

    House Speaker Belmonte is still silently loyal to Gloria. So are the many solons who now switched to the administration party. Remember the Arroyos are still in Congress. Those who became rich under her administration are still very much around.

    From AFP, PNP, Judiciary including SC down to the smallest government agency, Gloria’s boys are still there. Gloria has used her stolen money to buy her immunity. There’s a report that she donated P500K to the Phil Gymnastic Association to lobby herself be made as its Chairperson.

  12. the president may have a lot on his plate right now, on the one hand there is the need to focus on the economy, job creation, wooing foreign and domestic investors – i really hoped from the start someone in his camp would take the cudgels for him in pursuing gloria, i really hoped Lacson or Trillanes had the chance, as it happens, naunahan na naman…
    now who can do this, what about rene saguisag? he can’t be in too many places at all at once…what can we in our capacity do to help?

    I don’t really know what so complicated about sending criminals for vacation in jails…just call in the National Police to investigate and let them do the job…(the PM or the Auditor General will just ask the RCMP to take over the investigation if crimes are suspected and that’s about it).

    Hmmm…I may have to agree with you this time. Institution was destroyed nine years ago with the blessing of Pnoy’s late mother. I can even say long before that…about 24 years ago when his mother grabbed power destroying the institution. The 1987 Constitution was hurriedly done with so many flaws that later affected the legal circle until this day. So, let’s not point finger at anyone. Let’s blame it to who and what groups first destroyed the institution. These people are still very much around today complaining about injustice and unconstitutional as if they forget the past.

    Former Rene Saguisag has not 100% fully recovered yet from that vehicle accident that claimed the life of his beloved wife. To be able to think well and make the right decision, one must be psychologically prepared which Rene is not. He still has lots of pain and emotion in his heart. Otherwise, he could be a very good prosecutor. There are many good lawyers around. One of them is Atty. Harry Roque. But Gloria also has a team of well paid good lawyers too. How can you question the competence of Atty. Estelito Mendoza?

    No. People voted because they want change for the better. Action of Gloria’s SC only shows their self-destructing self-centeredness without realizing the bad effect of it in the future. It’s too obvious for one not to see what they doing to favor Gloria. History will define them as such…Gloria’s lap dogs!

    One good point is that Davide and the other Ateneo “classmates” have been taken out of the equation.

    One bad point is that there won’t be any special funds dedicated to nailing the little bitch.

    It may take a longer, more circuitous route to get to the ultimate goal of justice, but this is De Lima’s litmus – how she can put the Pidals behind bars – if she really ever will. How she manages her department’s human as well as financial resources into proving that the people’s trust, per the latest SWS survey, aren’t at all misplaced.

    Of course, she can do that! If she can easily provide a P2M bounty for Lacson’s head as well as creating a task force just to monitor and capture Lacson and committing all of NBI’s resources just for one man, she can, and must, do the same for the Pidal mafia.

    Question is: will she do it?

    RCMP is a Federal police force and other than the Province of Ontario and Quebec and part of Newfoundland and Labrador, all othe Provinces and Terretories policing are contracted to the RCMP…Canada has uniform criminal law,and criminal justice is administered by the Province and Territories, and the RCMP is the highest heirarchy in Policing…

    14 out of 15 SC Justices were appointed by Gloria. What do we expect? Therefore, prosecuting or impeaching her would be close to impossible. Even the Ombudsman is her territory. As I said, Gloria made sure everything was in place and in order before she stepped down. She had prepared this for nine years. Sorry na lang. Kasalanan din nila na hinayaan tumagal sa puwesto ang babaeng iyan. It’s too late now. Mike Pidal continues to play golf and getting stronger each day. We don’t hear about his poor health and visiting the hospital anymore unlike when Gloria was still in Malacanang. I’m not saying Mike was faking at that time.

    by the way, I am against and don’t believe in an inquiry to be the source for evidence in prosecution of criminal acts…in fact in every Inquiry called by our government, be it by the Parliament, by Coroners or by the Ombudsman, it is always mandated by the rules that evidence heard and presented in the Inquiry should never and will not be used in any other Proceeding be it in Criminal or Civil…

    the reason for these are quite several and very important to that effect…firstly the inquiry is called because all other investigations have failed to dig out the facts expected that could be reasonably be uncovered in an all out inquest…that parties of interest will have no fear of telling the truth as their testimonies will not be used against them as against telling untruthful testimonies that will if found out to be, will be liable for Perjuries and other charges. That the result of the inquiries be used for aid of legislation, corrective measures, policy making or determine compensation in case of disaster or accident.

    Criminal acts, like corruption should be a police matter and court matter.

    I agree. What’s the use of forming a Commission when it could only recommend and not prosecute? Take the case of that Commission formed to investigate the Luneta hostage killing. Malacanang did not accept all the findings. And now, not even one major player has been charged and prosecuted to the fullest yet.

    To my mind, Commission or Investigative Body is sometimes being formed to manipulate and condition the mind of the public. And today, we even have the Facebook and Twitter. The Webb Family is currently actively posting and presenting Hubert’s defense on Facebook. The intention and motive may be good but it does give suspicion to many.

Arroyo, as she has done with Erap, will take this SC victory as a cue that she is untouchable, thus, she will now start the ball rolling, if she hasn’t yet(me thinks it’s ongoing), to undermine the present dispensation with the end in view of grabbing power(again).

    What she didn’t know was we already expected this would happen. We’ll just play along with them. If she thinks that all the advisers of PNoy are bumbling fools, she will regret it bigtime. If the long arm of the law won’t be able to catch up with her because of her henchmen in the judiciary, just give us the excuse to arrest her for some other reasons then. I assure her minions, they will have a fight in their hands. One that they will terribly regret. It will not be an acoustic war mind you. Gazmin will make sure of that. General David still hasn’t forgotten what GMA did to him in the aftermath of the Hello Garci scandal. Alam na namin na mangyayari ito. Subukan nyo lang gumalaw. Di na kayo makakarating sa korte. 🙂

    Gloria has long believed she and her family are untouchables. No need to prove it even today. As I said, she made sure everything was well placed and in order before she stepped down. Today is the proof. Unless we see her in the coffin, she would continue to be okay. Do you know that she gets to keep almost all her PSG security intact including that amazon looking female close-in? A former President is allowed only a few but she seems to have kept the whole battalion. And before even thinking of touching her, we need to give some lessons and samples to her corrupt people meaning we need to see the likes of Abalos be in jail first.

    In a way I am glad the “toothless comisyon” did not get the nod. Imagine putting more money into Davide’s pockets. Di ba sobra sobra na ang ginastos niya sa “make-over” kuno ng SC which until now he has not accounted for. Then, inspite of his age( by-passing every one else who are more trained for the position), he was made an ambassador and based in New York, the most expensive place to live in in the US (the prime areas). Siyempre, libre ang lahat. Kung hindi si Davide ang head ng “toothless comisyon” ok pa na “go” ang “comisyon”. Wala naman talagang magagawa ang Davide comisyon dahil galamay ni pandak yang Davideng yan. Yung ibibigay sa “comisyon” (note how I spelled it)na pera, ibigay na lang sa DOJ para may pambayad ng mga uusig sa midget at ng baboy niyang asawa. DOJ is barely able to pay the existing overworked personnel, how can DOJ ever get results from overworked and under paid staff?

    As to the Ombudsman, huwag na huwag sanang magsampa ng mga kaso laban kay midget at ng kanyang asawang baboy sa ngayon coz the cases will be cleared right away anyway. Antayin na lang na mawala muna sa pwesto and galamay nilang si Merceditas, baka may pagasa pa nag pag-uusig sa kanila. Isang taong mahigit na lang ang pagaantay.     Granting that indeed the sc decision was tainted with bad faith, the incompetent Aquino legal team provided the sc justification of their their actions and hid their bad faith. Right from the very beginning halos lahat ng mga eo’s ni aquino were faulty. Ochoa and co. should be sacked.

    “Hindi corrupt” is not enough. Dapat competent din.

Baka balik tayo sa revolutionary government uli na walang Congress at wala na ring SC muna? You might just get what you wish for. The odds are heavily stacked in favor of GMA and her ilk in the present composition of the SC. Don’t think for one minute that Aquino will hesitate when push comes to shove. He is his mother’s son. Enrile et al know that fully well.

    Now that the truth commission has been “de-commissioned”, what will Noynoy do with Gloria?

    Well, he’s the president. He has all the legal resources to go after the Pidals. Their truth commission was not the solution to the problem called Gloria. Since their commission has been questioned, they should have a really good back-up plan ready for execution just in this case; that is if they are that smart and pro-active, but if they are natutulog lang sa pansitan, pagtiisan na lang ninyo na pinagtatawanan kayo ni Gloria at kaniyang mga alipores.

    Diyos mio. Kaya nga fact-finding commission eh. Nasaan na ba ang mga ebidensya para maidiretso sa DOJ ang kaso? Di ba wala? Kahit nga imbestigasyon ng Senado ay bitin kasi di sinisipot ng mga alipores ni GMA. Kung ibibigay mo sa DOJ yan, aabutin ng siyam-siyam ang mga piskal na pagtagpi-tagpiin ang hawak na ebidensiya. Sabi nga ng Inquirer, bakit ang Feliciano Commission na nag imbestiga sa mga Magdalo ay legal. Remember na sila lang ang object of investigation doon. Tapos ang Truth Commission ay unconstitutional? Sus.

    It’s about gathering evidence first. Summoning witnesses for documentary/testimonial evidence. Do you really believe na kakayanin ng mga piskal ng DOJ lahat yan what with all the other cases, Ampatuan Massacre is an example, that are pending before the courts? The TC was evisioned to help the DOJ in that aspect. It would have encouraged other people in the know sa Garci, ZTE, etc to come out and corroborate testimonies made in the Senate investigations. Pag nag file naman nang kaso agad at kulang ang ebidensya, sasabihin na naman ng iba rito, sinadya para sabotahiin ang kaso. Ano ba yan. So, short cut na lang? Tutal mainipin naman tayo. Tingin naman natin guilty sila, di ba? Masakerin na lang din natin mga lintek na yan. Justice served? 😛

    Well, Igan…tanong ito ng sambayanang Pilipino but ang punto ng debate sa legalidad ng Tooth Commission e sang-ayon ba ito sa isinasaad sa ating Saligang Batas ( 1987 Constitution, Art XI: Accountability of Public Officers).

    To clarify matters, ibig sabihin legally speaking…dapat implement ng PeNOY gov’t ang isinasaad ng Art. XI na ang Sandigangbayan ang may jurisdiction sa mga nasabing usapin batay at ayon sa section 2 ng nasabing article.

    Ngayon…kung ang usapin e kaya bang gampanan ito ng Sandigangbayan…problema na yan ng PeNOY gov’t, but to the extend na magcreate pa siya ng another anti-graft court or commission, ibig sabihin wala silang tiwala sa existing court or commission?

    Ito ang problema sa Pinas…kung inept ang sinumang itinalaga o kumakatawan sa nabanggit na ahensya e dapat maging accountable sila kasi sila ang may responsibilidad na imbistigahan at litisin ang anumang usapin.

    Ngayong PeNOY na siya…e dapat kailang ng full exercise ng authority to be more active and humane ang bawat sangay ng gobyerno lalo na yang SC, Sandigangbayan, Ombudsman, DOJ at iba pa upang maging patas ang pagpataw ng batas ayon sa isinasaad nito.

    Paano magiging perfect ang isang batas o maging effective and efficient ang sinumang itinalagang opisyales kung di sila susunod sa itinadhana ng mga batas na umiiiral sa ating bansa.

    Kung di sila qualified to run their respective assignment…tanggalin at palitan ng tapat sa tungkulin e di tapos ang isyu di ba.

    Either pro or anti…kailangan ang maging guidelines nating lahat e ayon sa isinasaad ng Saligang Batas at iba pang mga batas na umiiral sa ating bansa upang maging maayos ang pagsunod at pagpapatupad dito.

    One reason I find ridiculous is that these stupid SC Justices pointed out that the Truth Commission was singling out one administration, Gloria only. Well, kung gusto ng mga iyan eh di isama nila si FVR. Mababaw ang dahilan. Pnoy threatened not to recognize SC Chief Corona pero kinausap din sa huli. If Pnoy stood his ground and not recognize Corona, baka hindi humantong sa ganyan.

    Ngayon e magmamalinis sila e sila din ang kasabwat sa 9years na ating paghihirap…buti na lamang di nila ngayon kakutsaba ang SC at kung nagkataon e hala bira sising-tuko ulit ang Kapinuyan.

    Atleast, kontra-fellow ngayon ang laban…dito ngayon magkakaroon ng check and balance upang mabantayan natin ang bawat isyu na may kinalaman sa kapalaran ng ating basta at lipunan.

    my two-cents worth on this issue is that bottom line, the problem lies on the palace’s “lightweight” legal team. Yung ating saligang batas is very clear on equal protection of the law clause. it is put there precisely para walang agrabyado sa batas. The palace legal team should circumvent this by strengthening their arguments. They cannot just singled out Arroyo. We know she is corrupt to the bones, but she is still bound by law and therefore, protected by it. The TC should have been better called TAGC..Truth about Gloria Commision.

    Corona was once Gloria’s Chief of Staff when she was VP. And appointed by his boss as SC Chief Justice. How much closer and more puppy dog loyal can anyone get than that?
