Detained officers dare Esperon on ‘Garci’

Tell truth on rigging of 2004 elections’

Military officers linked to last year’s supposed power grab attempt dared AFP chief Gen. Hermogenes Esperon Jr. to “tell the truth” about allegations that the military helped rig the May 2004 polls to ensure President Arroyo’s victory.

“Never in the history of the Armed Forces of the Philippines has one man and his criminal gang brought so much shame to our beloved organization,” said the officers in a statement distributed to media covering the court martial proceedings in Camp Capinpin in Tanay, Rizal.

The officers, led by Maj. Gen. Renato Miranda, former Marines commandant, and Brig. Gen. Danilo Lim, former commander of the Army Scout Rangers, said they would salute Esperon if he does the nation a favor by telling the truth.

The AFP said Esperon has already told the truth. He has been cleared by a military board which investigated allegations that three generals participated in the electoral fraud in 2004, said Lt. Col. Bartolome Bacarro, chief of the AFP Public Information Office.

Esperon has told the Mayuga Board that he had nothing to do with the alleged cheating operations by the Arroyo camp in the May 2004 elections.

The Mayuga report has never been made public.

Esperon was then AFP deputy chief of staff for operations and concurrent deputy chief of the AFP’s Task Force Honest, Orderly and Peaceful Elections.

“General Esperon is very, very willing to tell the truth in the right forum. So there is no need for prodding from these officers for General Esperon to tell the truth because General Esperon has been telling the truth,” Bacarro said.

Esperon and now retired Generals Gabriel Habacon and Roy Kyamko were named by former elections commissioner Virgilio Garcillano in the “Hello Garci” wiretapped conversations.

In the wiretapped operations allegedly conducted by military intelligence agents in 2004, President Arroyo was heard in the “Hello Garci” recordings asking Garcillano, alleged head of the cheating operations, to ensure she would get a lead of one million votes over Fernando Poe Jr.

A fourth military general named by Garcillano, now retired Brig. Gen. Francisco Gudani, supposedly supported Poe.

Gudani appeared before a Senate inquiry in September 2005, a month before he was due to retire, and testified on massive cheating in the elections in Lanao del Sur. He was relieved of his post at the Philippine Military Academy right after his testimony.

The detained officers said the allegations that “Esperon and a few criminal elements among the ranks of the AFP had allowed themselves to be used to subvert the Constitution and destroy the very essence of democracy” have become the “collective shame” of the Armed Forces.

“Nay, it is our collective shame that we failed to stop them. The thought of this failure reaffirms our resolve to bring them to justice. That is our covenant with the people and our sworn duty to protect the country,” they added.

On the tag “political destabilizers” that Esperon has given them, the officers said: “Who cried unabashedly in front of national viewers when his mentor announced that she will not covet the presidency again?”

They were referring to President Arroyo’s declaration in December 2003 in Baguio City that she would not seek the presidency in 2004. Esperon was then commander of the Presidential Security Group.

“Who stands accused of cheating in the elections in 2004? Who stands accused of lying? Who stands accused of stealing votes? Who was mentioned in the Garci tapes? Who debased the Armed Forces of the Philippines by being party to cheating, stealing and lying? Who hides behind EO 464 when given the opportunity to let the truth out?” they asked.

Executive Order 464 that prohibits key government officials from appearing before legislative inquiries without permission from President Arroyo.

The Senate started investigations into the “Hello Garci” recordings last month. No military officer has been allowed by Malacañang to appear.

“Who vigorously opposes the Mayuga report from being published? Who hides behind that little skirt to save his ass? Who invokes the words `state secret’ like a criminal who invokes the Fifth Amendment when caught? And since when has a criminal act become a state secret?” the officers asked.

The Mayuga report was the result of a military probe that cleared Esperon and the others named by Garcillano in the recordings.

“State secret” was among the justifications the military has been invoking in refusing to attend Senate inquiries.

They agreed with the military pronouncements that there are officers outside detention who are better than they are. They said their “sympathies” go to these good men who are placed in a position to “clean up” the mess Esperon made.

Citing examples of what they said were “acts of honorable men,” they said a Marine general offered his own blood to save the life of an enemy in skirmishes in Central Mindanao while another Marine general lobbied for humane treatment for Moro leader Nur Misuari who is under house arrest for rebellion.

“We have not given up on you, Mr. Esperon. There might still be some good left in you…Please do the nation and your family a favor. Tell the truth. You might still earn our salute. Every Navy man worth is salt knows why we call you Mister…We lost that on you,” they said.

An officer who spoke on condition of anonymity said addressing a military officer “mister” means displeasure over his superior.

“It has a negative connotation. In the Navy, an officer is called mister instead of his rank if you did something wrong or your superior officer is not satisfied with your performance,” he said.

As soon as the court martial proceedings started, defense lawyer Francisco Chaves asked the court to suspend the hearing because Miranda was not present.

Miranda was brought to the AFP Medical Center Thursday for a physical checkup.

Chaves said the health condition of Miranda was the end result of the military’s oppression of the accused. He said the proceedings have to be suspended because Miranda, as the principal accused, has the right to be present.

The court rejected the motion of Chavez and his corresponding motions for reconsideration, saying Miranda’s right would not be violated if the former Marine chief was not present.

Lawyer Homobono Adaza also asked the court to dissolve itself because Esperon, the court’s convening authority, has issued prejudicial statements by calling the accused as “destabilizers” and who do not deserve to be given medical attention.

Adaza said Esperon’s statements manifest “bias and prejudice.”

The court also rejected the motion of Adaza.

The members of the military tribunal, headed by Army Maj. Gen. Jogy Leo Fojas, assured the defense lawyers they are hearing the cases against the accused impartially.

We have been repeatedly called by Mr. Esperon as “political destabilizers” in almost every forum that affords him opportunity. We pose these questions to you Mr. Esperon:

Who cried unabashedly in front of national viewers when his mentor announced that she will not covet the presidency again?

“Who stands accused of cheating in the elections in 2004? Who stands accused of lying? Who stands accused of stealing votes? Who was mentioned in the Garci tapes? Who debased the Armed Forces of the Philippines by being party to cheating, stealing and lying? Who hides behind EO 464 when given the opportunity to let the truth out?”

Patriotism is not our monopoly, Mr. Esperon.

No! In fact, the mere mention of this word brings out inadequacies in us. However, our definition of patriotism does not include involving ourselves in the criminal act of subverting the will of the people. Neither does it include closing our eyes while the crime is being committed.

Incarceration is a very small price to pay for that definition.

There are “more good men outside”, you said. We agree, Mr. Esperon. Our sympathies go to those men who are placed in an unenviable position to clean up the mess that you made. Our sympathies go to those good men who try to rebuild the institution which you had destroyed. Our sympathies go to those good men who are left to pick up the pieces after being victims of a crime themselves.

Allow us to refresh your memory to recount events, Mr. Esperon. During the height of the fighting in Central Mindanao, a Marine general offered his own blood so than an enemy may live. Another marine general took it upon himself to lobby for a humane treatment for Nur Misuari whom we all had the opportunity to cross swords. Do we need to tell you who Nur Misuari is, Mr. Esperon?
Those, Mr. Esperon are acts of honorable men. Those acts distinguish men of courage. Those acts remind us that the AFP is an institution, upholds human dignity of life.

Yes Mr. Esperon, you may succeed in destroying our physical being but never shall you have the satisfaction of destroying our will and spirit, as well. NEVER!

We have not given up on you, Mr. Esperon. There might still be some good left in you. You will be leaving the service in a few months time. Please do the nation and your family a favor. Tell the truth. You might still earn our salute. Every Navy man worth is salt knows why we call you “Mister”…We lost that on you,”

In AFP’s history, Esperon is the worst, most cruel AFP General. Give me a gun and bring him to me, then I will shoot him between the eyes. Magsama na sila sa impiyerno ng amo niya.     A firing squad is an easy way out for this disgrace of a soldier (if ever he was ever one).

    Cuban doctors saved the sight of the executioner of Che Guevara, now that’s compassion for you. Esperon on the other hand would rather deprive medication to the very sick Miranda. This only shows that when Esperon’s time to account for his crimes come, let us not be merciful to this beast.

  19. Senator Madrigal, as a lawmaker, has all the right to correct faulty laws especially that give so much powers to crooks. Her being prevented to inspect the AFP facilities should be considered an infringement on her right to perform her duties and responsibilities to see to it that no one should be above the law. She should be supported by other lawmakers on this.

    I take my hats off for her guts. We should support her.

    To ask Esperon Jr. to “tell the truth” about allegations that the military helped rig the May 2004 polls to ensure President Arroyo’s victory. No way Paisano! Why should he reveal the truth? His stars will be in jeopardy. For those who exposed his crimes will answer to his kangaroo court, he can conceal evidence by citing national security, make up its own rules, find a defendant guilty even and execute them with no review by any civilian court.

    No longer does the judicial branch and an independent jury stand between the government and the accused. In lieu of those checks and balances central to our legal system, These destabilizer soldiers whom he defined in his so called dictionary face grave consequences because Esperon is an executive that is now investigator, prosecutor, judge, jury and jailer and executioner. In Esperon kangaroo court it calls this communist style abomination a full and fair trial.

    Don’t be too trustful of this Jamby Madrigal whose election victory was also in question. It was reported that she was also a Garci beneficiary. Hindi lang sa ginamit niya ang kasikatan ng isang celebrity, Judy Santos, gumastos talaga ng husto para manalo. She doesn’t treat her Senate staff well. Matapobre siya at kunwari maka-masa. I’ve tolerated all these things about Jamby only because she’s with the opposition and very anti-GMA.

    It occurred to me after reading the list by the First Post that we actually could adopt the same things, tactics to bring down Esperon (well, at least we can try) so I transposed the things to do listed The First Post on what Filipinos can do to help our incarcerated officers:

    PROTEST actions: international and local actions (am not suggesting physical rallies) to free our incarcerated officers, time and place or means –suggestions open, eg, wear a pin like “Free our officers” or post a page on our blog with “Mister Esperon, Free our Officers”, etc etc. to show solidarity with our incarcerated officers…

    PESTER THE EMBASSY: for those who are expats, pester your Philippine Defence Attache embassy by sending e-mails or faxes calling on Mister Esperon to free incarcerated officers (give names)

    TARGET GLORIA: by sending a fax or e-mail or letter to Malacanang, the DFA, DND or to the Ambassador in your region.

    SIGN A PETITION: Start a petition campaign on line

    SUPPORT A PRESSURE GROUP: The Senate, Congress, and human Rights Group to pressure Mr Esperon to free the incarcerated officers

    KNOW YOUR ENEMY: The AFP and the DND must have websites containing reports lies (sic). See if you can hack into them (websites).

In fact, in response to our petition, buti pa nga ang mga hapon, Japanese parliamentarians have been visiting the Philippines to gather facts and finally decide on what to do to help the freedom fighters in the Philippines get positive response to their call for truth and justice. Tignan natin.

    Desperate na talaga si Pandak. Look, sa India naman ngayon nagbabakasakaling makaloko just because she heard that the Indians have improved economy. However, I doubt if the Indians would want to share their wealth with Filipinos before they share it with their own nationals. Collateral na naman ng unano ang mga OFW!

    Mr Esperon, despite your stupid actions you have been given good simple advice to tell the Truth and give Justice to all. There is no doubt that you have been given and taking advice from the criminals close to your boss in covering up crimes in which they also took part in.
    It’s possible that your now too deep in the mire having already bought properties abroad through your unaccountable wealth.
    Mr Esperon history will remember your boss as a cheat, a liar among other things with having no respect from the people – whereas you will be remembered in history as a cheat, a liar among other things with no respect what-so-ever from the rank and file who will always refer to you as Mister only.
    Your dishonest ways will haunt you until your last breath.

    Why don’t we challenge these Fil-Ams to protest against this regime of criminals in front of the Philippine Embassy in Wash. D. C. and the consulate in SFO, LA, etc. if they really feel strongly for Philippine pride and dignity like what my Burmese friends do? That will be the day, I guess.

    I know some friends at the Bayan Muna USA have been doing these campaigns by they are supported more by foreigners than by fellow Filipinos even when there has been lots of publicity about the number of victims of extrajudicial killings now superseding the number of similar victims during the Martial Law years. Nakakalungkot? You bet!

    Best thing to do is not to send emails, kasi they just delete them. Bombard them with written petitions mailed via US post. Address mo sa ambassador cc furnished ang military attache. Kaya lang baka kung bumalik ka ng Pilipinas harangin ka sa airport during arrival and/or departure. Ganyan ang nangyari doon sa isang supporter ng Bayan Muna from the US, at saka iyong Moslem na kakilala ko from Mindanao. Ingat.

    Why don’t you lead the petition demanding the immediate arrest of the Fatso on suspicion of committing plunder, influence peddling, etc. re the ZTE/NBN deal and others na hindi pa binibisto? Tignan natin iyong ipinagmamalaking over 18,000 daw na pumirma versus the DH fiasco. Puede namang walang protocol iyan dahil hindi naman public official ang animal. In fact, kahit iyong ibang appointees ni unano na hindi confirmed puedeng kasuhan. Wala namang courtesy law para sa mga civilians committing crimes as a matter of fact kahit saan lupalop ng mundo except siguro doon sa mga bansang gaya ng Sudan ngayon.

    “Who stands accused of cheating in the elections in 2004? Who stands accused of lying? Who stands accused of stealing votes? Who was mentioned in the Garci tapes? Who debased the Armed Forces of the Philippines by being party to cheating, stealing and lying? Who hides behind EO 464 when given the opportunity to let the truth out?”

    “Who vigorously opposes the Mayuga report from being published? Who hides behind that little skirt to save his ass? Who invokes the words `state secret’ like a criminal who invokes the Fifth Amendment when caught? And since when has a criminal act become a state secret?” Pray tell, Mr. Esperon.

    Patriotism is not our monopoly, Mr. Esperon.

    No! In fact, the mere mention of this word brings out inadequacies in us. However, our definition of patriotism does not include involving ourselves in the criminal act of subverting the will of the people. Neither does it include closing our eyes while the crime is being committed.

    Incarceration is a very small price to pay for that definition.

    There are “more good men outside”, you said. We agree, Mr. Esperon. Our sympathies go to those men who are placed in an unenviable position to clean up the mess that you made. Our sympathies go to those good men who try to rebuild the institution which you had destroyed. Our sympathies go to those good men who are left to pick up the pieces after being victims of a crime themselves.

    Allow us to refresh your memory to recount events, Mr. Esperon. During the height of the fighting in Central Mindanao, a Marine general offered his own blood so than an enemy may live. Another marine general took it upon himself to lobby for a humane treatment for Nur Misuari whom we all had the opportunity to cross swords. Do we need to tell you who Nur Misuari is, Mr. Esperon?
    Those, Mr. Esperon are acts of honorable men. Those acts distinguish men of courage. Those acts remind us that the AFP is an institution, upholds human dignity of life.

    Yes Mr. Esperon, you may succeed in destroying our physical being but never shall you have the satisfaction of destroying our will and spirit, as well. NEVER!

    We have not given up on you, Mr. Esperon. There might still be some good left in you. You will be leaving the service in a few months time. Please do the nation and your family a favor. Tell the truth. You might still earn our salute. Every Navy man worth is salt knows why we call you “Mister”…We lost that on you,”

    Leading the Righteous Way

    The demands of the Honor System are simple. We are not to lie, to cheat, to steal and to take advantage of others.

    However, the Honor System is not only to govern our behavior as cadets in order to level the playing field in our academics. The Honor System and its Code is designed to inculcate in us the leadership qualities needed by our nation. The Honor System is to govern us even outside the limits of Fort Del Pilar and in our daily private and official lives.

    In the Academy, we are trained to be leaders. As cadets, we all aspired to eventually become deserving generals. That is to be expected. And to be one, we had to strive and improve in our profession in order to deserve our promotions. Expectedly, each one of us strove to excel in our respective fields of operations.

    We were then truly apolitical. The people had faith that the Armed Services can be neutral in the political exercises. There was then also the assurance that elections can be undertaken without fraud if the military kept watch over the process.

    I believe that every graduate of the Academy can rightfully aspire to become the Chief of Staff or Chief of the Philippine National Police but we must accept the fact that not all of us can attain that ambition. There was a time when promotions and assignments to important positions were primarily based on competence.

    Those days are obviously gone. Since the martial law days, the common perception is that the process involved in the promotions and assignments of officers, particularly among the higher ranks, has become politicized. I am truly aware as you are, that promotions and assignments obtained through political connections involve quid pro quos.

    Promotions to higher ranks and positions are perceived to be no longer necessarily dictated by competence and dedication to duty. The recent spate of restiveness among our junior officers is obviously caused by this perception and reality. The politicization of the military remains unabated these days. The term ‘an apolitical military’ has become fiction. A lie.

    There was the time when the word of an officer, especially of a PMA graduate, was taken at face value. There was integrity. PMA graduates were entrusted with positions of trust. We were truthful to our friends. Deception was reserved against our enemies.

    However, in these trying times, lying is pervasive and practiced even against our people who deserve to know the Truth. These days, those who hold positions of trust, especially those who handle financial matters, are no longer thought to be worthy of faith and trust. There will always be suspicion that something anomalous goes on, especially those whose lifestyles do not reasonably match the pay scales of their ranks. The temptations of ‘conversion’ have sapped the moral strength of some of our officers. Integrity in PMA graduates seems to have become another fiction.

    The recent exposes on the crimes of some of the alumni of the PMA who deviated from the Honor System alert us to the immoral virus contaminating our Armed Services. I am sure there are still others who will be uncovered and must be purged from our Association. We seem to be in a regime where stealing public funds, lying and cheating have become the acceptable norm for one to succeed. Mistrust is tearing our nation into small pieces.

    The real meaning of Loyalty in our PMA motto is lost. Loyalty is no longer given to the institution or to the country, but given to ambitious persons with doubtful motives and self-interest. Loyalty to principles among some PMA graduates has become fiction. Ostracism seems to be reserved against the idealists and not against those who stray from the Righteous Path.

    Are we to allow the degeneration of morals in our professional corps of officers to continue? We are now under the spotlight of shame. The point is reached that when a crime is unearthed in the Armed Services, the question is asked: ‘Is he a PMAyer?’

    You may be distressed by the dismal picture of our moral state of affairs I have given. Nevertheless, I consider it my duty to do so. I need to do it. As Rizal once said, the cancer of society must be presented to the public in order that appropriate cures may be obtained.

    What is to be done?

    Although we, who are already retired, can no longer directly take action in reforming the Armed Services, we must nevertheless, exercise our moral suasion to insist on the urgent and necessary institutional changes for the good of our society and of the nation. We owe our young and idealistic officers our moral effort, support and example.

    We must not disappoint them.

    Now is the time to breathe new life into the Honor System and restore the PMA alumni to the high esteem of society.

    Now is the time to revive and strengthen the righteous spirit of Courage, Loyalty and Integrity among all alumni and members of this Association. Otherwise, the future for those who will come after us will be in doubt. In the dark.

    Leading the Righteous Way is the imperative for all of us.

    If I’m not mistaken, the scuttlebutt was that Mayuga himself sat on the court martial proceedings against the Tanay officers. He also succeeded in keeping the Marines out of jail for as long as possible. This was part of the deal, Esperon was not to court martial any of the officers (especially the Marines) in exchange for a favorable finding. For so long as Mayuga was in charge of the Navy, he could protect the Marine officers who especially needed it. The Scout Rangers had less evidence against them, and most of them in fact could have had their charges dismissed immediately. Except for one thing: Esperon is, was and always will be a bloody traitor.

    In the early days after the alleged “coup plotters” were rounded up, there was little or no information on the extent daw of the “conspiracy.” Anybody could have alleged participation in the incident, and those falling under suspicion would have been jailed and subjected to trial, whether or not there was any evidence. This was done to the Scout Rangers in Tanay, many of whom have no evidence against them.
    The statute of limitations or the rule of prescription means that they could still be subjected to trial and prosecution during that period. Twelve to twenty years.

    Malacañang yesterday said there is no more room in the military for the 28 detained soldiers who have been engaging in partisan politics after they called on Armed Forces of the Philippines (AFP) Chief of Staff Gen. Hermogenes Esperon Jr. to speak up the truth on his participation in the fraud-marred 2004 presidential elections led to the victory of President Arroyo.

    “The fact that this officers were obviously engaging in partisan politics, it’s high time that they should quit and get out from the military service because their statement against Esperon shows that they’re no longer loyal to the Constitution. There’s already a lost of a military discipline on them. That breed of soldiers has no room within our AFP,” chief presidential legal counsel Sergio Apostol, during a phone interview, stressed.

    The Palace official maintained that the military organization should remain apolitical.

    He added they are not threatened with that kind of political noise in the AFP, saying Esperon is already conducting loyalty checks among the men in uniform.

    “It’s regularly being done, the loyalty check. General Esperon is already checking on that,” the Palace official said.

    Apostol also warned that the disrespectful detained soldiers may be denied of a general amnesty from the President.

    He said their attitude could backfire on them since Mrs. Arroyo might decide not to grant them a general amnesty in the future.

    “That’s why we’re watching them because the more they criticize this government, their being disrespectful to the chain of command is not healthy. It only shows that it’s not even healthy for our President to issue them a general amnesty. She might forego this plan and rather let the courts decide on their fate,” Apostol stressed.

    Mrs. Arroyo earlier issued a general amnesty for the Communist Party of the Philippines-New People’s Army-National Democratic Front, which was sent to the legislative body in both Houses of Congress for concurrence.

    Apostol reminded the detained soldiers to be grateful on the government treatment on them, saying they are in jail, not VIP (very important person).

    “It’s not true that our government has been neglecting them, that we’re not giving them their medical needs or attention, there are doctors who have been checking on their health conditions. We have to remind them that they are in detention but should not be treated as VIPs,” he said.

    The 28 military officers were charged with staging the foiled power grab on Feb. 24, 2006.

    Military lawyers are studying possible legal action against the 28 officers facing court martial over the alleged botched coup in February 2006 over their recent statements to media that are critical of the Armed Forces of the Philippines (AFP) Chief of Staff, Navy Chief Vice Admiral Rogelio Calunsag said Monday.

    At the same time, Calunsag said the detained officers should stop issuing such statements to media. Nine of the 28 detained officers are from the Philippine Marines, which is under the Navy.

    “Our legal [staff], the ones handling these cases would look into this, what legal action should be taken on statements they are doing,” Calunsag told reporters here, after he commissioned the Navy’s first-ever trainer helicopter during the 60th Naval Air Group.

    “Ako ay nayayamot lang sa ating bansa [I’m frustrated with our country]. We are on one ship… It’s hard to run a ship when some people are punching holes on it,” he added.

    Asked if the suspected coup plotters should refrain from making critical statements, Calunsag said: “Definitely, and I think our legal people pursuing the case would do something about it.”

    Calunsag’s legal staff may look into allegations by Esperon that there was a botched coup for all we care but MILITARILY, technically under military law, there was NO botched coup because a coup d’état DID NOT even start so how could it take place and said that it was botched?

    I would be prepared to believe him that there was restiveness but it’s not by imprisoning these gallant officers that could stop that restiveness.

    I understand why Calunsag is bellicose: because those 9 gallant naval officers would soon be calling him MISTER and he dreads the day when they say that to his face.

  89. And Mr Calunsag is wrong to say that these officers should stop issuing statement! Why, does he believe he should imprison these officers some more?

    While the military is known to be an institution that does not necessarily practice democracy, it does not stop elements suspected of creating restiveness within their ranks to expose the evil acts being perpetuated by the “powers that be” from speaking up!

    Last time I heard, the country’s Constitution still guarantees EVERY citizen’s right to freedom of speech! Or has that been deleted from the Constitution now?

    How could Esperon have achieved BGen rank if he did not do MNSA? That’s a prerequisite to be a candidate for a star position?

    Do those Intel officers courses that he undertook enough to get him GSC? GSC is also imperative for him to get to colonel rank…

    It would be the height of bastusan if Esperon achieved a 3-star status without an MNSA degree! That happens only in banana republics!!!!
