Suspicious impeachment complaint

There is something more than meets the eye in the impeachment complaint filed by Atty. Roel Pulido against Gloria Arroyo last Friday. Pulido was formerly the lawyer of Ltsg (now senator)Antonio Trillanes IV . More than a year ago, Trillanes terminated his services. Relations between the two are far from good. A few months ago, Pulido was in the Senate staff of Sen. Gregorio Honasan.

Parañaque Rep. Roilo Golez said:

The buzz last night in the session hall among majority and minority members was thatit’s a pre-emptive move to insulate PGMA rrom a real, hostile impeachment move.

“The filer is anti-JDV, the endorser is a known PGMA supporter. However, it is seen as possible prelude to oust JDV offensive.

“This Pulido impeachment would prevent JDV from countering with an impeachment move if threatened with ouster or actually ousted as speaker. However, it is believed that if JDV has enough loyalists (at least 80 congressmen), he can have them sign and endorse the Pulido impeach complaint, and that would trigger a gargantuan political cruisis taht could draw other political forces into fray.

“I repeat, ALL political forces.

“The group that concocted this plot must rethink this move befopre tjhings go out of control.”


Third impeach raps vs Arroyo filed; opposition nixes new case

Opposition congressmen on Saturday dismissed as a mere ploy the third impeachment complaint lodged by lawyer Roberto Pulido against President Arroyo which they said may be designed to pre-empt the filing of a more serious case against her.

The opposition warned that Pulido’s case is purportedly a disguise to thwart a more serious impeachment complaint against Mrs. Arroyo. If Pulido’s impeachment complaint pushes through, a new case to remove the President from office cannot be lodged within a year.

The opposition added that the complaint might also be a scheme to unseat Speaker Jose de Venecia Jr.

“The complaint is designed to fail and not even worth the paper it’s printed on. It’s a brazen move to insulate PGMA [President Gloria Macapagal Arroyo] from a serious impeachment and pit her vs JDV [House Speaker Jose de Venecia Jr.] in KAMPI’s [Kabalikat ng Malayang Pilipino] hope of ousting the speaker. But it may back fire and hit the President instead,” said Bayan Muna Rep. Teodoro Casiño in a text message.

Citizens’ Battle Against Corruption Rep. Emmanuel Joel Villanueva, on the other hand, said: “Kami sa minorya, una, titingnan namin mabuti kung ano ba ang motibo ng pagfi-file ng impeachment na ito. Ito ba ay para i-immune lang si GMA [Gloria Macapagal-Arroyo] for another year para hindi siya ma-file-an ng impeachment? Ito ba ay just to take out JDV? (We in the [House] minority will first look into the motive behind the filing of the impeachment. Is this meant to provide immunity to GMA for another year so that no impeachment case will be filed against her? Is this just to take out JDV?”

Pulido filed the impeachment on Friday in connection with the controversial national broadband network (NBN) deal.

The lawyer alleged that President Arroyo committed betrayal of public trust for her inaction after former socioeconomic planning secretary Romulo Neri informed her of an attempted bribery allegedly made by Benjamin Abalos Sr., resigned chairman of the Commission on Elections, for the approval of the broadband deal.

Pulido based his complaint on sworn statements at a Senate hearing on the NBN deal by Neri and NBN controversy whistleblower Jose “Joey” de Venecia III who is a son of the House Speaker.

Abalos has denied Neri’s allegation and has vowed to sue his accusers.

The impeachment complaint was endorsed by Laguna 4th District Rep. Edgar San Luis, reportedly an ally of the administration.

Pulido said he wonders why he is being criticized after he lodged the impeachment complaint against President Arroyo as he urged his critics to help him instead.

Pulido said he also filed a case against the Speaker before the House committee on ethics and privileges because the elder de Venecia has been implicated in the controversy. He said that he also plans to file charges against Abalos and First Gentleman Jose Miguel Arroyo in connection with the deal.

He added that he wants those involved in the issue to be held accountable.

“This is not about GMA or JDV or KAMPI or opposition, this is about public accountability. If JDV’s going to support me on the condition that I will withdraw my case against him, I’m sorry but I cannot give [in] to that condition,” he said.

Pulido was a lawyer of detained junior officers involved in the failed 2003 Oakwood mutiny who included former Navy officer Antonio Trillanes IV who is now a senator.

The lawyer also run unsuccessfully for the Las Piñas congressional seat in the 2004 elections.

    It’s indeed nothing but a ploy. His action is similar to what that Atty. Lozano did. Inunahan lang ang mga genuine complainants to sabotage whatever evidence people have against GMA and her government. Marami pang mangyayaring katakataka pero hindi na nakakagulat. Everything evil is possible under this evil government. There’s even a report that the reason why the ZTE hearing was postponed to cool it was one big businessman’s $2M gift to the Senate? Who received it? I don’t think Alan Cayetano? Manny Villar? He’s richer than that businessman? Biazon? Gordon? Or the Three Mask-eeters: Santiago, Joker and Enrile? Every Senator, heading or member of the three investigating committees is now a suspect.

    I agree that the timing is suspicious. It comes on the heels of Pulido’s complaint against JDV in the ethics committee. To make matters worse, the complaint is reportedly only three (3) pages long and was filed while the Senate probe on the NBN deal has not yet been concluded. Who knows what the Senate could have turned up if they had been allowed to continue questioning Neri under pain of a contempt citation? It is possible that the complaint was filed to remove JDV’s main weapon against GMA: the threat of impeachment. Once the complaint is dismissed for utter lack of substance, GMA can then unseat JDV.

    Roel Pulido’s record as a lawyer is spotty. As Magdalo lawyer, he was so cocky, he would not take advice from better and more experienced lawyers. The court martial panel’s refusal to recognize the prescription of the offenses, despite the lapse of two years from the alleged commission of the crime to the day of the arraignment, was attributed to Pulido’s incompetence in arguing the case. EVen worse, he was caught red-handed with Erap money that he allegedly failed to distribute to the families of the incarcerated soldiers. What do you expect from such a shady character?

    Maybe we could ask our attorney here to check the impeachment complaint file by this Atty. Pulido dahil baka palpak na naman tulad ng ginawa ni Lozano. Tingnan natin kung pulido ang paghain ng complaint. I think that by filing it first, it somehow blocks the other petitioners who would like to file. Legal strategy na naman iyan thought by those who benefit from it….sino pa kundi ang Malacanang. If this Atty. Pulido is now with Gringo Honasan’s staff; and if Gringo is identified with Enrile who is now with the administration, mahirap bang isipin na ang may utak ang Malacanang?

    While our attention is focused on this impeachment complaint filed by Atty. Pulido, we overlook the Big One…that Someone Big. He’s not attending the Senate hearing upon his cardiologist’s advice. The grilling in the Senate might be too hard for his heart. But wait…what about big boxing fight in Las Vegas. Check it out and you shall learn that this Mike has sneaked out of the country to join his buddy Chavit Singson in Las Vegas. Hindi ba nakakasama sa kanyang puso ang excitement at emotion sa laban ni Pacquiao not to mention the long flight from Manila to US? Lalo pa kung matalo si Pacquiao. I have a strong feeling that Manny would lose this time. The under the table money he would receive doubles than his winning prize if he loses. That’s how gambling syndicate plays. Ako bilang isang Pinoy gusto kong manalo siya pero sa arrogance ni Manny at connection niya sa mga Pidal, okay na din sa akin kung matalo siya. Manny needs money more than ever after spending so much last election. If it’s confirmed that Mike Arroyo has left the country to watch the fight; then this can be included in the future complaint to be filed against him. The Senate must ask him why he left the country again to watch the fight and not attend the hearing. I’m calling the attention of the Senate and the media on this.

    Then call a physician of known probity. Flavier, or even Philip Chua of Malaya, para ma-weigh ng peers ni cardiologist ang kanyang armchair diagnosis. Kung nagsisinungaling, i-contempt, both the cardiologist and the patient.

    Pulido is far from credible. I wouldn’t put much weight on this has-been lawyer. He had his shining moment – lawyering for the Magdalo group – however it seems that he blew it.

    Reflection ng pagkawala ng disciplina dahil sa mga palpak na mga batas na pinapairal para manatili ang mga ungas sa kanilang mga puwesto na alam na alam noong matabang abogago na kaya niyang paikutin para sa kanilang kapritso. Why have the lawmakers not attempted to make a law or laws to prevent these crooks from succeeding in stopping justice to prevail, and have the criminal, her husband, kin and friends sent to jail for plunder, abuse of power, etc.? Sabi nga, you name it, they have committed it! Bakit hindi iyan dakipin. Nothing is written in the Election Code about impeaching a cheater, but has provisions regarding disqualifying and prosecuting an offender or violator of any of the provisions of the said law.     Your other question, the Alpha Sigma angle, I think, has basis.

    On why he ran against Cynthia Villar. I don’t know if it was “for the funds of it” but i’m so disgusted later when I learned about his falling out with the Magdalos because I voted for him!

    I asked him about this last year on the sidelines of the preliminary investigation on the charges of rebellion , where he is one of the accused, at the Department of Justice and he said that it was good that he is out of the Magdalo case because he has also his own case to take care of. But I can sense he was trying to avoid me.

    Talaga. Kawawa nga talaga ang mga Magdalo. The injustice that they have suffered when all the accusations that they raised have been proven true.

    Despite Trillanes election to the Senate, Gloria Arroyo continues to desperately block him from serving the people. And there is no lack of people who will do Gloria’s bidding for their own selfish interest.

    I talked with Gen. Dolorfino last Friday in Camp Capinpin (he was one of the assigned alternates in case a member of the panel got challenged). Ia sked him why Sen. Biazon and Civil Service Commissioner Karina david were not allowed inside the Marine Brig for a hearing of Trillanes’ committee. I told him the court denied permission on three things only: attend sessions in the Senate, set up office in the Brig, grant media interviews. The court did not say that trillanes cannot conduct hearings in his detention quarters.

    Dolorfino said “that’s why he has to get permission from the court.” I asked, “And why would he have to get permission from the court when it didn’t forbid him from doing it? Sagot na naman niya, “that’s why he has to get permission from the court.”

    Umikot-ikot lang ang aming coversation around that. I find his pa- smile smile hypocritical. Lokohan lang.

    I wonder what JDV will do. He is being forced to take sides now. If he allows the dismissal of the complaint, he will be at GMA’s mercy. The Pulido case against JDV can also be used to oust him as a Congressman. I think JDV should order his allies to vote for the complaint, strengthen in at the Committee level and transmit it to the Senate. If GMA is behind the complaint, it appears to be a high stakes gamble, unless she has something over JDV’s head. At this point, I do not underestimate GMA’s abilities as a political operator and her survival instincts.

    More insider info on Pulido. Early in the Magdalo case, they had very strong defense and many lawyers willing to take up the cause. After only a few months, Pulido was left to defend over two hundred clients together with only one or two other lawyers not connected with his office. Some lawyers left because the publicity value was dying down. But others left in disgust over his mishandling of the case and because he refused to coordinate with them.

    The turning point came last year when five of the accused “escaped.” Pulido’s role in that incident was never clear. At any rate, after all had been returned to the detention centers, it was clear that Pulido was out of his element. He did not have enough experience, expertise or wits to defend the brave souls who chose to openly challenge GMA and her minions. Remember the audacity of Lt. San Juan and Capt. Faeldon? These men were tortured upon their return, and Pulido was less than useless. As a result, the schism between the Magdalos began.

    That is Pulido’s role again in the impeachment. He is the wedge that will divide GMA’s opponents, in her divide and conquer tactics.

    Madaling lusutan ang NBN impeachment. Somebody (Abalos)can “take the bullet for the president”, like Scooter Libby. Then, patatawarin, because of his long years of service to Glo, este to the nation pala.

    But the NBN impeachment will “innoculate” Glo from the impeachment based on Hello Garci. Yan ang mas delikado, dahil Garci cannot take the bullet for her. Sino ang kausap ni Garci? Isang impersonator?

    Rene Velasco used to be with the Presidential chief of Staff Rigoberto Tiglao. Remember he was the guy sent by Gloria to Oakwood in July 2003 to talk with Trillanes and company? Then he was transferred to the National Printing Office. Now, I understand he is with one of the lucrative agencies of PNOC.

    Rene Velasco’s brother, Reggie (a former diplomat; also with the Eki Cardenas during Estrada’s presidency) is with Sen. Honasan. Pulido is also with Honasan’s office.

    The Velasco brothers are Alpha Sigmans. Just like Honasan, Mike Defensor,and Roel Pulido.

    In the 70s, the Alpha Sigmans were considered activists – rabid anti-Macoys. What came to mind when the frat was mentioned was Professor Randy David.

    There was a student party called STRAW –student rights and welfare, with Alex Magno and Raul Pangalangan running for councilor. Ang second floor tambayans were all tibaks – Alpha Sigma, Sigma Kappa Pi, and Pi Sigma. The pro-Macs were below, Sigma Rho in the first floor, Upsilon in the basement.

    But now that they are in government, they seem to have forgotten the idealism of their youth. Sabi nga ni Bruce Springsteen, some things will never change; that’s just the way it is.

    The impeachment complaint filed by Atty. Roel Pulido against Gloria Arroyo last Friday was a big joke. First, the complaint was very week with lots of loopholes to ensure it will loose in a legal forum. Second, it was filed prematurely without consultation from concerned sectors/individuals who were already involved in the struggle for truth since 2005 (Such as the Church, business groups, political opposition, civil society, etc). Third, the word is out that Atty. Pulido had talks with Malacanang before he dropped out as counsel for the Magdalo officers . He is currently a staff of Sen Honasan.

    It is so obvious that they are trying to sabotage the possibility of any legitimate impeachment complaint being filed against GMA. This tactic is no different from the stunt of Atty Lozano last 2005 & 2006. This is a very suspicious impeachment complaint thus I call on all patriotic Filipinos to be watchful and remain vigilant.

    There is that Marine general mentioned, who donated his blood for the enemy. In contrast, Esperon needed to be pressured to allow medical attention for Miranda.

    If by Dodong you mean Dean Nemenzo, I did not know he was an alpha sigman. Akala ko bata pa ang Alpha sigma fraternity (1964 yata). Dean Nemenzo seems to have graduated in the late 50s.

    There was, however, a son by name of Leonid. Socialista si Dean, along with law Professor Magallona, kaya marahil Russian ang pangalan ng anak. Na-water cannon si young Nemenzo along with old man Tanada sa QC welcome, in one of the rallies in the early 80s. Maaring si Leonid ang alpha sigman.

    I know Imee Marcos took law but don’t know if she has graduated. Whatever criticism people have against her and the Marcos family, Imee is much smarter than any of the politicians we have today. Sayang lang hindi siya sinama sa senatorial ticket ng opposition.

Kaso ang mahirap sa mga congressmen na to e todo kapit din sa malancanang para sa kanilang pork barrel and other perks given them if they support the kapit tuko. What I do not understand is “Where is morality in government nowadays?” Nawala na mula noong may nandaya sa election noong 2004.

    If the purpose of the impeachment is to probe into his qualification for another political appointment, shouldn’t there be a basis first for the impeachment and to do that he must still be in service?

    Wala pa tayong experience. When that happens, we look to the source for guidance, on the principle that if we copied the law, it is presumed that we intend what the source country intends.

    Ganoon din, sa criminal and civil law, marami pa ring quote sa Spanish jurisprudence. Dahil kinopya natin ang batas nila, so the presumption is we intend the same things, and should interpret similarly.

    Kaya hari sa civil law ang magaling mag-Kastila, like JBL Reyes, Turing Tolentino et al. Ganoon din, sa criminal law, ang magaling mag-Spanish ang bida – Ramon Aquino, et al. In fact, ang unang “civilista” was an American Justice of the Commonwealth of the Philippines na nag-translate ng Spanish civil code to English; I forgot the name, parang Justice Thomas Street or Justice Sherman Moreland.

    Ellen, thanks for bringing up the Velascos again and how they figured in the Honasan-Magdalo-Oakwood-Pulido homerun. I heard Pulido and San Luis speak on the radio today, Pulido sounded genuine, or he is just a good actor. I’m keeping an open mind. After all, he had given JDV this opportunity to make his stand. He might be anti-JDV but in the process, he might destroy GMA too. If that happens, I’ll thank him for it.

    San Luis is a total asshole. He knows that one who endorses that impeachment complaint is fully convinced or fully believes, the subject of the complaint is guilty of the charge. When asked by the radio show anchor if he thinks so, he said, “Kaya ko nga inindorso para malaman kung may kasalanan nga si GMA.”

    Sorry, Imee was before my time in the College of Law. My professors were her contemporaries. What my teachers told me was that in spite of all her activities, Imee nevertheless managed to graduate with honors, and because of it, inadvertently created a record number of cum laudes in the College of Law, because she pushed up the grading curve.
    Back to topic. GMA must really be worried, nag-lalabas na uli ng pera to push Pulido’s complaint.

    The reason I brought up Dodong Nemenzo’s “brotherhood” with Raul Pangalangan was because the latter allegedly capitalized on it in order to become Dean of the College of Law, over Popo Lotilla, who won the vote in the faculty.

    One thing we did learn from UP is this: if you can’t help, get the hell out of the way. This forum is not the only place where concerns have been raised regarding the Pulido impeachment complaint. Serious issues are being raised about it, because if true, the Pulido-Lozano complaints trivialize and subvert the whole impeachment process. What is going on here is discussion that is replicated all over the country by like-minded and concerned citizens. If you cant stand the heat…
