They have rediscovered the word “granted.”

Yesterday, the panel hearing the court martial cases of mutiny and conduct unbecoming of an officer and gentleman against 28 officers allegedly involved in the plan to withdraw support from Gloria Arroyo in February 2006, granted the motion of the defense lawyers to adjourn the hearing because of the failure of the Trial Judge Advocate to notify all the accused officers and defense lawyers on the hearing yesterday.

The prosecution admitted that they sent only notices to five lawyers saying that the statement of law member Col. Marian Aleido after the Nov. 15 hearing was adjourned served as “implied knowledge” of the Nov.23 hearing.

Since the start of the court martial proceedings almost a year ago, this is the second time that we can recall that the panel granted the motion of the defense lawyers. The first one was when Brig. Gen. Danny Lim complained about Esperon “playing God” and not allowing Maj. Gen. Renato Miranda to be brought to the hospital after the latter fell in the bathroom.It had always been “denied, denied, denied”.

Atty. Vicente Verdadero, lawyer for Gen. Lim and Capt. Dante Langkit, said he was not notified about the hearing yesterday. He sensed “something amiss” so he came.

It was not only the selective notification that was not right in yesterday’s proceedings. The custodian said Capt. Langkit, who is detained in Fort Bonifacio, was on his way to Tanay and would only be late. We found out Capt. Langkit never left Fort Bonifacio. He and his custodian were never notified about yesterday’s hearing.

Something’s amiss indeed. I’ll write more about this on Monday.

    At ganun din itong si goria sa pagpapalaya sa isang akusadong pumatay kay Ninoy Aquino. Ang sabi ni Sergio Apostol, hindi raw umano alam ni goria na isa si Pablo Martinez, sa mga convicted killers ni Ninoy Aquino nang pirmahan ang pardon matapos ang 24-taong pagkakakulong. Talaga naman kapag pekeng prisidinti. Eh kung hindi ba naman, pirma lang ba siya nang pirma? Parang approved without thinking. Kaya yong pamimigay ng cash gifts, pwedeng may pirma rin si goria. Kung kaya nagkakandarapa at mukhang baliw ang mga alipores sa pagsasabing walang alam ang bosyang nila.

    The accused were telling Carlitos that he was their good luck charm. It was only when he was there that the panel said the word “granted.”

    Before the start of yesterday’s hearing, Atty. Verdadero approached to correct my entry here of what he said to Col Loy Friday last week:(During one of the many recesses, when tension was high, Atty. Vic Verdadero told Loy to his face: “Ang utak mo Loy kasing liit ng (male organ) mo.” He even made a hand gesture indicating an inch long.)

    He said what he told Loy was:”Bobo. Kasing liit ng (male organ) mo ang utak mo, kung mayroon ka.”

    the panel must’ve realized the more they pursue extra-legal measures to achieve their ends, the more likely it is for them to lose legal jurisdiction over these guys. the moment the higher courts order them to stop and release the accused, they shall have no choice but to employ dozens of intelligence operatives to monitor each of the 28 for the rest of Esperons term. it will be an intel nightmare for Fatso, who in the meantime, will be busy biting his nails in fear of retribution or probably karma, thinking he’s 15 minutes is almost over.

    ‘El Gordo’ will soon realize that he does not have that much power after all, and that he’s bound by the rules of our society. Can’t wait for the day when all these will fall flat on his ugly ferocious face. this diabolical freak will one day be wallowing in the gallows of tanay, along with his dogs, who at this time, are enjoying lavish travels with their wives abroad care of philippine money, of course.

    But yes, he is ugly. And that is made worse by his insecurity. I think all his instructions that violate human rights are actually attempts by him to show power thinking that he would gain respect for that.

    But he is wrong. Respect is won by doing what is moral and right. When he participated in subverting the will of the people to make Gloria Arroyo win, he earned the disrespect of the soldiers and the Filipino people.

    speaking of that notorious LtCol Loy. from the articles describing his rendezvous with the accused/defense lawyers in court, one would gather that he is a very provocative and irritating guy. I wonder how his colleagues survive his company.

    Funny how the members of the panel and the people in court have become such characters. In court, you have the panel President as Homer Simpson. LtCol Bacarro as Homer’s son, Bart. Marianne Aleido as the ‘Devil wears Prada’ or better yet, Mortisha Adams. Feliciano Loy as ‘Fester’ Adams.

    Atty Vic Verdadero, cos ur a good guy, you get to be Keanu Reeves in the ‘Devil’s Advocate’ or probably Tom Cruise in John Grisham’s ‘The Firm’.

    I think Loy is not the prosecutor on the case but,a member of a Convening Authority (CA).You don’t need to be a lawyer to be a member of CA .The Court-Member Panel.Similar to civilian juries,court-martial members are officers or enlisted persons from the same community or command “jury of peers” as the servicemember on trial. In civilian communities, serving on a jury is a duty of citizenship, and local court officials will summon citizens to serve as jurors.In the military,the commander assigns members to serve as jurors,and that becomes their primary military duty.

    Ellen, I am not at all surprised. This is asspweron’s way of making sure that the officers are not represented well. What if the lawyers did not come to the hearing? Then it would have been a field day for asspweron and burloLOY. Nothing this court does makes me believe that they are really for justice! It is more for getting even! The slip is more of a strategy for these villains! How can a court which is so gungho in trying these officers forget to serve the notice for the Friday’s hearing? Somethinbg is fishy!

    the guards are on the side of the accused. i mean, who wouldn’t, right? only the suck ups are pro esperon. but noting perhaps that esperon is to leave the service soon and they do not stand to benefit from him, and the potentials of the incarcerated are so much brighter given their courage, youth and competence, both for pragmatic and idealistic ends, the guards would have their sentiments in favor of the tanay 28.

    Azcarraga_times, to my recollection, asspweron was confirmed by the CA and his two stars were given to him as well.
    The media is prepping asspweron. From his AFP retirement, he will be given another juicy position like Angie Reyes and Ebdame. It will be another reward for a job well done in rigging the 2004 elections and in protecting the tiyanak by bribing his generals with money and promotions. Whoever will replace him may have undergone a criminal check: Have you ever cheated? Have you ever bribed anyone? Do you have the stomach for abduction and murder? Will you follow the chain of command no matter how rotten the chiefs may be? If the answers to all these questions are YES, one can become the next Cheat of Staff!

    yup parasabayan, there’s an interesting twist here. Esperon, to Gloria’s core group, is considered more of a liability cos his mere presence provokes conflict. Gloria wants to avoid conflict til she gracefully exits. Here’s the thing, conflict will now become so unavoidable.

    Esperon’s replacement is one of the reasons why. LtGen Yano is the most likely replacement, he is not the most senior, however. Yano actually by-passed a well respected Army General who’s retiring in two and a half years. Yano is retiring in two years. This bypassed general has more awards and citations, and has more degrees than Yano. Giving Yano Chief of Staff and giving this General something less would probably be an insult to military prefessionalism. Imagine a Chief of Staff addressing a lower ranking General, ‘Sir’ just to accomodate patronage ties.

    Next, the marines will sort of have a leadership vacuum. As of this time, it only has 6 Generals, two of which are no longer with the unit (Miranda under court martial, Allaga WestMinCom.) Another is retiring early 2008. So 3 Generals will be left to run the whole corps. Dolorfino (the muslim), John Martir (the suck up) and the other one who is the youngest General in the country.

    Martir is from class 79. the other general is from class 78. So senior ung 78. Definitely, after Dolorfino (term as marines chief is almost over), the class 78 general will succeed as chief. Martir has his eyes on the position cos he is retiring soon. It is the reason why Martir betrayed and lied about his mistah, Querubin and his former father in the marines, Miranda. So that he would have a chance at being commandant when he wipes out his career competition. If he will insist on being commandant ahead of his more competent and respected Senior, then expect a huge huge uproar in the ranks of the marines.

    Thats just one secanrio. There are many other scenarios. Several Generals in the armed forces are retiring in the next 6 months. since the political leadership cannot please everybody, they are upto some steps now to reconcile with their foes to avoid further disarray.

  50. Even Ret. Hello Garci General Roy Kiamco has been recalled by government to serve somewhere in National Security kuno. Of course we know that this was done so he too can invoke executive privilege if ever he is called to the Hello Garci hearings again.

    There is a big task ahead after Gloria steps down (if ever) in cleansing the whole gov’t of pigshit scattered all over the bureaucracy. The next leader has to come from true blue opposition, not from pseudo-critics, therefore.

    Ano saysay ng pakikipaglaban kung ang mga institusyong ipinaglalaban ay binababoy ng mga tulad ng mga nagtatanggol kay Arroyo?

    Mahahati ang Matatag na Republika ni Gloria Arroyo at kailangan niyang makipag-collaborate at manindigan na tama ang pandaraya at pambababoy ng mga demokratikong institusyon.

    Kunyari na nabuwag na ang Central Government pero ang totoo ay patuloy nitong pagpapasasaan ang mga totoo at tunay na yaman ng bansa – ang mga probinsya.

    Nandyan pa rin ang interes ng mga elitista dahil kailangan daw ito upang ma-preserved ang republika.

     

    Walang panalo , walang talo, ginawa lang tayong mga bobo
