‘Don’t let Trillanes attend session,’ SC asked

Government lawyers asked the Supreme Court not to allow Senator Antonio Trillanes IV to attend Senate sessions or be visited by his staff in detention because he “is more dangerous than a person accused of rape.”

“The information for coup d’etat contains allegations that petitioner led the seizing of Oakwood through violence, intimidation, threat and stealth for the purpose of seizing state power. This is definitely more dangerous than a person accused of rape,” Solicitor General Agnes Devanadera said in a 49-page comment.

Trillanes, a former Navy lieutenant who ran and won his Senate seat while detained, is facing the charges for his role in a short-lived mutiny by some 300 soldiers belonging to the Magdalo group, who occupied the Oakwood luxury apartments in Makati’s business district in 2003.

Last Thursday, the senator, along with a number of his co-accused and defense witness Army Brigadier General Danilo Lim walked out of a court hearing and marched to the Manila Peninsula hotel, near the site of their 2003 mutiny.

They occupied the hotel and called for a withdrawal of support from the government by the military and the public, surrendering six hours later when government forces stormed the Peninsula.

“Unlike the crime of rape, the crime of coup d’etat is an assault against the paramount right of the State to self preservation and against maintenance of its democratic system of government,” Devanadera said in the comment.

Trillanes went to the high court after the Makati City Regional Trial Court turned down his bid to compel the military to let him set up a working area in his detention cell at the Marine brig in Fort Bonifacio, Taguig City, and allow his staff and visitors access.

The lower court also dismissed Trillanes’ motion to attend all functions and services of the Senate, give interviews and comments, and attend organizational meetings at the Senate in Pasay City.

Devanadera said Trillanes erred when he asserted that his case is different from that of former lawmaker and convicted rapist Romeo Jalosjos.

“Any person indicted for the commission of a crime is detained by reason of public self defense. The law does not look into the status of the offender even for purposes of determining whether the accused should be entitled to provisional liberty, the law makes no distinction as to the classification of the offence charged, e.g. or a crime against public order [in Trillanes’ case] or against persons [like Jalosjos]. Especially considering that detention of the accused, is being resorted to as a means to prevent him from causing further injury to the public,” Devanadera said.

The government lawyer also echoed the view of the Makati court that granting Trillanes’ request would virtually make him a free man and be a “mockery of the purposes of the correction system.”

She added that the restrictions imposed on Trillanes did not violate his constitutional right since he has, in fact, been granted some privileges. Acceding to his request would endanger security at the detention facility.

“A detainee does not possess the full range of freedoms of a freeman. Detention imposes restrictions on the liberties, rights and privileges of the detainee. While detainees retain certain constitutional rights, it does not mean that those rights are not subject to restrictions and limitations,” Devanadera said.

“Notwithstanding the retained constitutional rights of a detainee, the government may subject him to the restrictions and conditions of the detention facility,” she added.

    I read the related story and the advices of the senior statesmen are logical. But I still like the Trillanes of Oakwood and Manila Pen standoff, mapusok sa pagtatanggol ng bayan, hindi iniinda ang sariling buhay. Ganyan si Andres Bonifacio at Heneral Goyong.

    Of course, I would like him to be always safe and secure for our sakes, pero nakakahawa ang kanyang katapangan. Kaya lang ay talagang hindi pa gising ang karamihan sa pinoy (o ginutom na ni Gloria ang mga pinoy) para suportahang pisikal ang kanyang laban.

    With Sen. Ping Lacson, I visited Sen. Sonny Trillanes at Camp Crame, his detention place, this morning at 10.

    The visit was facilitated by DILG Ronnie Puno and Undersecretaries Marius Corpuz and Austere Panadero for which I publicly thank them.

    I found Sonny to be in top shape in mind, body and soul. He deplores the rough treatment he met at the hands of the arresting officer in the aftermath of the Manila Peninsula Hotel affair on November 29. But he dismisses it as an inconvenience that comes with the cause he is espousing.

    I assured him that I will continue supporting his quest for justice in accordance with the rule of law. And on this matter, we are not asking for mercy for him. Not at all. Only that he be accorded the rights the Constitution grants to him and all those who are similarly situated as he is
    – and that is, among other things – to be considered innocent until proven guilty and treated with dignity as a human being even if he is restrained of his liberties for the moment.

    I verified from him that his accommodations are not 5-Star Hotel one but are not deplorable either.

    He and his companions including fr. Robert Reyes are allowed visits byfamily, lawyers and doctors.

    They complain against being deprived of their cell phones but as I explained to the local media afterwards, I am not too sure they have any basis tocomplain considering that the charges against them is rebellion.

    I am now preparing a report to the Senate about the visit.

    Together with two friends, I had the opportunity to talk to Trillanes for more than an hour in the Marine brig in Fort Bonifacio about five months ago. I tried to sense what it was in him that enticed 11 million Filipinos to vote for him last May, and frankly I am still not sure I know…

    What he had and has is youthful idealism and a sincere abhorrence of the moral bankruptcy of the present order, but which, however, are fatally tarnished by his lead role in the Oakwood Mutiny of 2003, which was meant (didn’t he know?) to restore to power the then accused (now convicted) plunderer Joseph Estrada.. If he did not know that he was being used then, has he grown any wiser since? How does he reconcile this moral dichotomy?

    Not having any original ideas of his own – other than generic ones about corruption and poverty and injustice – he would be totally dependent on his advisers in the highly unlikely event that he became head-of-state of this country. And who would these advisers be?

    Judging from the civilian company that he chose to keep during his Moment of Truth, this would include lawyers J. V. Bautista and Argee Guveara… And there is Dodong Nemenzo, former president of UP and former associate member of the Politburo of the Partido Komunista ng Pilipinas.

    Not only he lost the November 29 uprising, Senator Antonio Trillanes IV even found himself Thursday having one ally less.

    Sen. Maria Ana Consuelo “Jamby” Madrigal did not only junked plans to visit Trillanes at Camp Crame detention center but also burned her bridges with the rebellious former navy officer for leading the Manila Peninsula Hotel stunt.

    “Thank you, Sonny (Trillanes’s nickname). But let us just part ways,” a disappointed Madrigal told GMA News.

    Madrigal, who actively supported Trillanes in the last senatorial elections, said she rejected the neophyte senator’s idea of replacing the Arroyo administration through extra-constitutional means.

    “Nagpagamit lamang siya sa mga trapo na gumugustong kumuha ng poder sa lahat ng paraan (He allowed himself to be used by traditional politicians who would grab power what ever it takes),” she said.

    Madrigal did not join Thursday two opposition senators – Aquilino Pimentel Jr and Panfilo Lacson – who paid Trillanes a visit in jail.

    Pimentel said he acted like a good father to Trillanes, reminding the neophyte lawmaker to keep himself “out of trouble.”

    “I told him, Sonny, you got 11 million votes [in the last elections], and these are votes for your candidacy in the Senate not as a leader of an undertaking to oust the President,” Pimentel said.

    He added: “There is no love lost between me and Gloria. I want her out soonest
    possible. But I don’t want it done with the use of violence. That is
    another matter.”

    According to your clippings! Politics is a part of showbiz, ofcourse we need to understand their words and action. If those concerned politicians who acted and supported AT4 and co. for sure GMA will punish them and charge them with rebellion.

    This is a psywar game, we need to play according to their music. A tactical alliance between all parties involves must be confidential and secret coz’ the gov’t secret agents are like roaring lion to devour them.

    Who will be the looser, ofcourse the oppositions if they are not careful giving their side. But in reality, UNO are united and still intact, except those who pretended that they are oppositionist.

    Sen. Trillanes is a young and promising oppositionist, an idealistic Katipunero and future President to be of our Country. God’s willing!

    Never be confused by the gov’t psywar tactics, real Oppositionist still with ERAP and Masang Pilipino.

    If you really analyze their news or clipping(s), you will see them protecting either their boss GMA or her cohorts.
    For example, the PCIJ journalists, somebody finance them to sensationalize and dominized Erap in his wrong doing.

    But, still there are some good columnists and journalists who wrote or writes a balance and fair news or comments in their daily undertaking. One of them like; Madam Ellen Tordisillas, Nines Cacho-Olivares, Herman Tiu Laurel III, Bernard Taguinod, Nestor Mata, and others.

    You are right. If we take it at narrower perspective, not one of the 11 million will fight through petition against rebellion charges on Trillanes.

  36. Now is the turn of Senator Trillanes to be the target of the Pidal ire. He has taken over the place of Senator Lacson as the No. 1 threat to the planned ascendancy of the piglet Dorobo to still to be created United Kingdom of the Philippines.

    Now, we’ll see if the 11M voters who put him in the position of Senator will fight with and for him when the Supreme Court, controlled by the piglet’s appointees decides on whether or not to allow him to serve as Senator.

    They should actually insist on allowing him to serve his country and people as he has taken oath to do so, and they should fight for it because not to allow him to serve is short of telling them they do not actually care, and what matters is what the piglet Dorobo says.

    If that is not insulting the mentality of the electorates, what is?

    Unlike in Marcos time, today there is no martial law. There are no constitutional barriers. The opposition has the majority in the Senate and yet they knew how bad is the case of Trillanes. Like other senators, Sen Pimentel correctly mentioned that he can only secure that his rights are not violated. The only who can help Trillanes are his lawyers on his rebellion case. It is just a matter of time that the court will render the conviction.

They should actually try to learn the basic laws of their country, even perhaps memorize and recite the preamble of their Constitution so the crooks cannot claim that they alone have right to impose the law on the people. Problema kasi kahit iyong mga sinasabing marunong mag-ingles, I doubt that they understand 100 percent the English language, which is a foreign tongue.     I will give you an explanation. Joma has always been the enemy of the state. State enemies can be given amnesty to renounce violence for reconciliation. Trillanes is a different case, a military officer turned against the commander in chief. He has a chance of reconciliation since 11 million voted him for senator but he has to abide by the constitution. He blew it again. Hence, the disproportionate reactions.

    When Trillanes run for a seat in the senate, we never dreamed of winning because we lack the resources, we never expected that he’ll gain 11 million votes from the Filipino people..all those who rendered their support were unsolicited like the political ad courtesy of the lady senator..We did’nt even beg for any help from those trapos,no one can ever claim the victory of Sen. Trillanes in securing a seat in the Senate.. only the Filipino people.

    What the lady senator said on national television, we respect. But, we really wanted that Sen. Trillanes loyalty is only to the Filipino people.. Nobody can influence him just like what this bogus government keep on manufacturing evidences.. Had the November 29 incident succeeded, a lot of people would now be hailing l Trillanes especially the TRAPOS.

    Lots of people will claim their part in the success but since it was a failure, a lot of people wanted to part their ways with Sir Sonny. Accept it or not, after the Oakwood incident 4 yrs ago a lot of politicians wanted to ride with the name”magdalo” for their own benefits.Some had put colors in it.

    But since Trillanes and the Magdalo officers iare detained, they can’t refuse any unsolicited visits rendered by some”opportunist”.I can still remember how the lady senator hailed Sir Sonny for his principles and idealism.Oakwood and Manila Pen incident are quite similar.

    Maybe that’s how dirty our Philippine politics is.
