(This is the statement I read at the hearing of the Senate Committees on Justice and Human Rights and Public Order and Illegal Drugs on the warrantless arrest of members of media after the Manila Peninsula standoff.)

In the November 29 incident at the Manila Peninsula, I see two media -related concerns: The first pertains to the duty of a journalist to inform the public of the unfolding crisis as truthfully as he or she can. The second pertains to the constitutional right of a person—journalist or not—to liberty and due process.

When I decided to stay at the Manila Peninsula despite the evacuation order from authorities (Malaya was never officially informed about the warning from the PNP, but learned about it from TV news), it was in performance of my duty as a journalist, which is to inform the public as truthfully as I can of the unfolding events that I considered—and still consider—of national interest.

It is a duty that I must do to fulfill and fully avail of the constitutional guarantee of freedom of the press.

The public deserves complete and correct information. For the news media, that means all players in any event must be represented in the story.

In the Nov. 29 event, Malaya saw to it that reporters were assigned to not only the police, military and Malacañang but also to Sen. Antonio Trillanes, Brig. Gen. Danilo Lim and company who were at the Manila Peninsula. My assignment was to cover Trillanes, Lim and company, and the best way to do my job was to stay at the Manila Peninsula to gather firsthand accounts and not rely on anybody else outside the hotel.

I deplore the fascistic treatment by the police of members of media who stayed on to cover the unfolding crisis at the Manila Peninsula up to the end.

When we reached the stairs leading to the lobby of the Manila Pen from the Rizal Room on the second floor, we were prohibited by police officers from leaving the hotel because, they said, we were to be brought to some other place for “processing.” We raised a howl because we needed to go to our offices to complete our stories.

A police officer told us that it was “SOP” or standard operating procedure in a crime investigation that those present at the scene of the crime are “processed” either as witnesses or suspects. The officer brushed aside our protestations and started segregating all those inside the hotel, including journalists.

He asked, “Who are military officers in civilian clothes?” The two or three who stood up were taken away.

The officer then asked for those who were “ABB.” We were all puzzled. “ABB as in Alex Boncayao Brigade?” I asked, referring to the communist hit squad operating in Metro Manila. “Yes,” he replied.

Since I was nearest to him, I called out to the others who were at the top of the stairs and thus could not hear what were being said below. “Alex Boncayao Brigade daw,” I said, eliciting laughter from many who had found it rather ridiculous.

The officer glared and barked at me, “Hindi ka pa pinapayagan magsalita (You have not been permitted to speak).”

Shocked, I said, “Kailangan ko permission bago magsalita (Do I need
permission to speak)?” The officer ignored me.

NHK’s Charmaine Deogracias, who was standing beside me, wanted to sit down. She was moving toward the chairs in the lobby about three meters away when the officer said emphatically, “No!”

At this point, the officer noticed that one video camera was running. He barked at the lady reporter: “Itigil na yang camera na yan (Turn off that camera).” The camera was trained at the other end of the lobby where Magdalo officers were lying on the floor face down, stripped to their shorts, their hands tied at their backs.

The officer became angry. He snarled at the cameraman, “Niloloko mo ba ako? Sinabi ko nang patayin yan. Kapag hindi mo itigil, kukunin ko yan (Are you making a fool of me? I told you to stop rolling the camera. If you don’t, I’ll confiscate it).”

Then he addressed everybody: “Yung mga nagka-camera, kapag hindi nyo itigil, kukunin ko yan (To all those using their cameras, if you don’t stop what you’re doing, I’ll confiscate them).”

Melai Masecampo of ABS-CBN and another reporter asked the officer, “Pwede ba mag-CR (May we go to the toilet)?” He replied, “Hindi (No)!”

This prompted Melai to appeal to us, “Sige, sumama na tayo, para maka-alis na tayo. Para makaihi na tayo (Come one, let’s go with them so we can get out of here and use the toilet).”

We had no choice but to go with the police to Camp Bagong Diwa for “processing.” The police instructed all members of media to move to the right side of the stairs. We did as told. It made me remember movie scenes of Nazi concentration camps.

The policemen then took out plastic handcuffs from a plastic bag and started tying us. We protested, saying that only criminals and suspects are handcuffed and we had not committed a crime. We told them we have rights. The police answered they were just doing their job.

I asked if martial law had been declared during the standoff, and wondered aloud why our basic rights seemed to have been suspended. I did not get an answer.

Under the International Covenant on Civil and Political Rights (ICCPR), to which the Philippines is a party, basic freedoms cannot be denied citizens, including their right to be recognized under law, even during national emergencies. These rights are enshrined in our Constitution, under Article III on the Bill of Rights. There was no declaration of a
national emergency.

I noticed the presence of Police Superintendent Asher Dolina. Ces Drilon of ABS-CBN, Charmaine Deogracias of NHK and I protested the handcuffing to him. Dolina eventually agreed not to have us handcuffed.

But on the bus, I saw some journalists with their hands tied. When they put their handcuffed hands out of the window, the police tried to hit them with rattan truncheons.

That was deplorable. There is no justification for what the police did to us that night. Even in armed conflicts, under the Geneva Conventions, journalists enjoy the status of “protected persons” in recognition of the role they play in society.

No democratic country can properly function without a truly free press. Journalists serve the public’s right to know in matters that concern them because an enlightened citizenry is what democracy is all about.

    Nakakatawa na nakakangitngit ang mga senaryo dahil sa kalabisan ng mga pulis. Kaya pala nang-snub ang mga galamay na pulis at miembros de aparador ni Kwin Korap Glorilla, hindi sila makaharap ng may dignidad sa media!

Like everything else, this is also will be forgotten. The way it is, we’ve accepted it which is why Gloria the whore still inside the people’s house.

    Partikular sa kinuwestyon ni Tordesillas ay ang giit noon ni National Capital Region Police Office (NCRPO) Director Geary Barias na ialis sila sa loob ng hotel at ilipat sa ibang lugar upang doon ilatag ng pulisya ang mga detalye ng mga kaganapan.

    “Bakit kailangan pa kaming ialis sa hotel, e nandoon sina Trillanes and Gen. Lim? Pwede naming makuha nang direkta mula sa kanila ang mga impormasyon. Ibig bang sabihin kay (Director) Barias kami dapat kumuha ng information? Ng mga ibabalita namin sa tao? Unless ang gustong gawin ng gobyerno ay gawing idiot ang mga tao,” tuluy-tuloy na pahayag ni Tordesillas.

    I thought the Police had asked media to vacate the place — why then weren’t you allowed to leave when it was time to go?

    That’s the problem with our Police — they don’t know what they’re doing.

    Sa aking opinyon, kung hindi sa katapangan at pagiging buo ang loob ng mga print and media journalists lalong lalo na ang ating Ellen Tordesillas, hindi natin matutunghayan ang panig ng mga ikinulong na peryodista. At ganito ang marahil eksena after the Manila Pen siege:

    1. Patay lahat ang grupo ni Sen. Trillanes. Walang matitirang buhay at kesehodang maraming madamay na sibilyan. Wala kwenta ang buhay ng tao kay GMA basta manatili siya sa poder.
    2. Sapagkat walang mag-report nang tunay na nangyari, sasabihing lumaban ang kakarampot na tropa ni Sen. Trillanes at napilitang gumanti lang ang pwersa ni GMA na si Ronnie Puno ang nasa likod.
    3. Nag-deklara ng state of emergency o di kaya revolutionary government si GMA siempre, siya rin ang puno at aayudahan ni Ronnie Puno at Gen. Razon.
    4. Nawala noon sa eksena sina Esperon at ibang top brass ng AFP at tuluyan na ring mawawala.
    5. Huhulihin ang lahat na kontra sa pamahalaan, ipapapatay yong mga matinding kaaway at maraming ikukulong, parang martial law ni Marcos. Ang ibig sabihin ng lahat, kasama na ang mga kilalang bloggers na markado na noon pa.
    6. Sasakupin ang print at broadcast media kaya wala nang diaryo at television at tapos na rin ang pagkakaron ng madaliang kontak katulad ng telepono, internet at celphone.
    7. Ang pinaka masakit, wala nang blogging, mga kapatid.

    Ang pagsuko nina Sen. Trillanes ay isang tamang hakbang kahit sabihin pa (ng ibang matatapang at puro kantiyaw lang kasi nasa malayo) na karuwagan ang kanilang ginawa. Minarapat ni Sen. Trillanes na isuko ang sarili kaysa lumaban at mapahamak pati ang mga peryodista. Katulad nang sinasabi natin, habang may buhay, may pagasa. At sapagkat buhay pa siya at ang kanyang mga kasamahan, tuloy ang laban.

    Utak computer talaga. Kinumpara pa sa CPU and kanilang maliit na utak tungkol sa “processing.” Malay nila kung ano ang ibig sabihin noon. Pero tama din sila, kasi na programmed na ang utak CPU nila. Sunud-sunuran na lang – garbage in garbage out. Poolish talaga!

  7. “Processing” is a very very harsh word to be used on people today — it connotes the “processing” of Jews by the Nazis…

    You expect to use that to prisoners, convicts, etc but to use it on the media sounds out of place.

    Processing of papers is ok but of people? Animals, cattle to be slaughtered etc. undergo processing but memebers of media are not cattle.

    My friends at Xmas cocktail tonight laughed when I mentioned that they were lucky their IDs were only being verified but in the Philippines, national police do processing of people…

    Anna, on processing. Seems to me their brains lack the necessary nutrients to distinguish between “objects” (paper)and “people” (like animal meat) to be “processed.”

    Agree! That word, used outside of the Philippines, is really funny. Others who read our papers sometimes just scratch their tops with disbelief, seeing those “out-of-this world” words (SOP, processing, etc.).

  11. Ellen, I heard someone who sounded like Tony Lopez on the radio reading his statement which compared your “arrest” with those which happened right after martial law was declared.

    He said something like, what they had arrested that night was eight times the number of media men arrested in the first 30 days of martial law. He also said media then were invited and not handcuffed and forced into buses; and that it was high officers – colonels and generals – who invited them and not some snotty patola cops (not the exact words but you get the drift). When he mentioned that there are now two senators there who in 1986, used media as human shields, Enrile immediately cut in knowing he was one of those alluded to. But at that point the coverage was cut.

    Mr. Tony Lopez’s testimony was something to ponder. According to him, the whole Manila Pen was a drama. He seemed to imply that Trillanes and his group were part of the whole drama episode. First, bakit wala ang mga matataas na opisyales na militar tulad ni Esperon? They were out of town. Kung may intelligence report na may mangyayari that week, bakit sila wala? Tony further said that PMAers don’t shoot one another. Mistahs take care of one another no matter how much they differ politically. That’s how they were trained to be and this brotherhood is being uphold for many years now. As Tony was saying this, Honasan was seen on TV nodding his head. Lacson and Biazon were also quiet. So, Tony said that those military officers who are PMAers who entered the Pen were just participants of the entire drama. Siguro daw ang sabi “Brods, wala na ang CNN, puwede na kayong sumuko”. At sumuko nga sa bandang huli.
    Who was and were the producers and director of the show….GMA?

  13. Tongue, Tony Lopez recalled what happened in Feb. 22, 1986 to conclude his statement. He recalled how they were called by FVR and Enrile to cover them. As Marcos was preparing to shell them out of Camp Aguinaldo,FVR warned that they had with them representatives of international organizations.

    Without saying it, Tony Lopez was insinuating that FVR and Enrile used them as shields to protect them.

    Tony said the journalists with FVR and Enrile saved them. That’s what Enrile resented.

    He said it’s a “canard” and he said that he and FVR asked them to leave.

    Tony admitted that , “yes” you asked us to leave but we still saved you. Enrile didn’t agree to it.

  14. Brownberry, what Tony Lopez related was his impression of things. I don’t share all his impressions.

    In the Peninsula incident, I was there. The impression that I relate is based on first hand facts that I gathered. Tony Lopez wasn’t there.

  15. Tony Lopez is not the most credible newspaperman you have on the planet…He hee-haws his way through many of his writings and most of the time they are like Alex Magno’s — full of holes. Objectivity? Lopez lacks barrels of it.

    He would do better to be a professional PR man — he’s good at that.

    Totoo yan! Since Marcos era eh tainted na ng kabulukan ang ating kapulisan (a.k.a. pulis-patola at today eh kabiskawtz).

    Nang ako eh nag-aaral pa sa Manila ang bukang bibig ng tao noon eh buti pa wag na lang lalapit at hihingi ng help sa kapulisan kasi baka mahulidap eh.

    E ‘yang karamihan sa pulis Pinas, lalo na yang mga OA na sangkot sa Pen ay walang promise na ganito. Ang promise lang nila ay kay Gloria para sa promosyon at pera!

    Remember, Erap in his last visits in some selected areas such as in Tondo, Taguig, Laguna and Nueva Eciya were very sucessful… grabe ang suporta ng mga tao.

    Masang Pinoy still love him very much unlike GMA at Tabako, isinusuka na sila ng taong-Bayan. Ofcourse di natin maiaalis na mayroon parin silang taga-suporta puro Balimbing na Trapo at boyskawtz/kabiskawtz under Tabako junta supporters.

    At this point in time, nag re-realign pa ang civil society groups at naglilinis pa sila ng kanilang hanay. But ang Masang Pilipino who supported Erap still solid and intack.

    Agree ako, malamang na kung makalabas si AT4 at mag-town/province hopping ay pagkakaguluhan rin ng mga supporters. Iyan ang iniiwasan ng babaeng hudas, ang magkaroon ng isa pang personalidad na mamahalin ng mamamayan, na magpapabagsak sa kanyang kaunanuhan.

    Chi and Balweg, the comment I posted was not my opinion but taken from Mr. Tony Lopez when he testified during the Senate hearing. I myself don’t buy that theory. But let’s keep an open mind…baka may kaunting katotohanan din. Tony has been in the business longer than anyone. He might not be as credible as Ellen and those we like; but this guy knows a lot back to the days of Marcos.

    Marami na silang General problems (e.g. Esperon, Barrias at may nadagdag pa si Col. Martir (di holy yan ha).

    May junta leader sila si TABAKO and retired Generals.

    Thanks Balweg and Chi. Rest assured that I’m with you and the group. Sa tutoo lang, medyo may pagka-bias si Tony Lopez. Parang maka-Marcos at maka-Erap. But he knows what he’s talking because he’s a veteran journalist in and out of the country. He mentioned that during the 1986 Edsa Revolt, Enrile and Ramos were begging the media to stay so that the two would be shielded from the bombs. Tapos ngayon sasabihin ng mga ipokritong iyan na mali ang media sa Manila Pen at tama ang PNP. Si Enrile, Santiago, Joker at iba pang naging mga tuta ngayon ni GMA ay dapat ilubog sa kumukulong tubig.

    I also remember Tony mentioned there were more journalists killed during the time of Cory Aquino. Of course her beloved son Sen. Nonoy Aquino immediately protested Tony’s statement. Smart as he was, Tony explained that he was not saying Cory killed those jourmalists; but during her administration. Tutoo naman…I even remember that Mendiola massacre when a number of farmers were shot and killed. And not long ago, many militants were killed at Hacienda Luisita owned by Cory’s family. Hindi ba number one suspect si Nonoy na nagpadala daw ng mga armed goons doon? What happened to the case and investigation? Hindi puwedeng magmalinis sina Cory.

  49. I think Tony was a bit rattled. You know how intimidating JPE can be. But he recovered right away.

    There were many things Tony Lopez said that I didn’t agree. But I think in that part, he was right.
