Opportunity for Heroism

No arraignment took place yesterday in the court martial hearing of the 28 officers accused of withdrawing support from Gloria Arroyo two years ago.

The court, though, denied the motion of Atty. Homobono Adaza for a suspension of the hearings for 45 days as a cooling off period. He said there’s no point “for both parties to be shouting at each other now,” when considering the current political situation, the case might be “moot and academic” in a few weeks time.

The court also didn’t agree with the defense that they have to wait for five days after service of the corrected amended charge sheet which was yesterday before they can go to arraignment. The five- day wait, the court said, applies only to the original charge sheet.

The court agreed only to adjourn at 7 p.m. after Atty. Alex Lacson, counsel for Lt. Col. Custodio Parcon, appealed to the sense of justice of the president of the panel, Maj. Gen. Jogy Fojas, for a “proper conduct of the proceedings.”

Lacson, Adaza and Atty Vic Verdadero, counsel for Brig. Gen. Danilo Lim, moved for an adjournment because it was already way past end of office hours, everybody was tired, and they have to be with their families.

Motion granted. No schedule has been set for hearing next week.

Statement of the officers:

Continuously evolving as an institution that is a source of national security and pride, the Armed Forces of the Philippines is borne out of the life, blood, sweat and tears shed by our forebears. Our Military History is replete with heroism of combatant and non combatant valiant and noble members of the armed forces.

Apparently, a combatant has a lot of opportunity to show heroism by risking his life in the “field”. But for the non combatant who is equally endowed with nobility and courage, the opportunity is simply scarce. Such opportunity may not necessarily be in an armed confrontation in the “field”. For today in this chamber is one such opportunity. And the non combatants among us here specifically refer to the members of the prosecution and the law member of the panel.

Lawyers in uniform are primarily called upon into the service for the sake of upholding the law. And before the brave and proud men and women in uniform, these lawyers are the experts of the law. They are the primary vanguards of the law before the nozzle of a gun, the voice of a commander, the force of an order and even the expediency of a given situation. The uniform is not to deny the rule of law, but only to further it.

These lawyers are no less than the common soldier. A soldier is trained to fight in order to accomplish a mission in any adversarial situation. He should maneuver and counter maneuver every move of the perceived enemy. But not until he becomes the enemy himself.

Today in this chamber, 28 officers are accused of violating military laws and are projected as having acted beyond the constitutional mandate of the AFP, the organization in which they belong. But everyone is aware how the accuser has been trying to impose his will with total disregard to the rule of law-Laws which are embodied no less than in the court martial manual or the Constitution.

The tolerance to the whims and caprices of one man playing god has just stolen two precious years of the lives of these accused and their families. For two years, these officers have been incarcerated, far from the meaning of standardized “military confinement” given to an accused that is presumed innocent until proven guilty.

But foremost, this tolerance as may have been foreseen by Col Parreras, has perpetuated the lost of nobility among those who wittingly or unwittingly become cohorts in the tailoring of reports, fabrication of information and even planting of evidences just to strengthen speculations and lies. This does not only hurt the accused or the organization, but the nation as a whole. This does not augur well with that AFP as a pride of every Filipino.

Acting bigger than the institution and above the law, the accuser now continues as he has been even intending this court martial to be his instrument. This court, with the prosecution and the law member of the panel has to rise above this decadence. At the least, let legal remedies be accorded the accused for the sake of the rule of law. Let not legal remedies for the accused be understood as mere wit of the defense. Nor beating the deadline of prescription for the arraignment of the accused is the victory. For the fight we are in is not just between the accuser and the accused or the prosecution and the defense. More than anything, the fight is upholding the law. This in itself is the victory for us all, including the whole AFP and the Filipino nation.

As an appeal to the prosecution and the law member of the panel, let this opportunity for heroism be yours. Allow this military court to be a court of law amid the pressures of the powers that be.

This heroism is needed today, at a time when there is a growing national uproar against dysfunctional system of corruption in almost all government institutions, including the AFP. As well said in the paraphrase of a notable legal quotation, “when a soldier is on trial, the whole AFP is on trial.”

Hang in there, brave soldiers of the Republic.

  2. Ellen, if I understand, this whole circus will have to close down now! Deadline not met so those circus players will have to go back to their animal pens and train for other tricks, right?

As usual and as expected, FG Mike Arroyo is leaving for Hongkong allegedly to get acupuncture treatment. Why is he able to travel again this time? If Ombudsman is fair and serious, it should demand that Mike Arroyo produces a certificate from the acupuncturist in Hongkong. He has been consistently leaving the country whenever there’s a serious charge against him. People must not allow him to do this again. Recently, didn’t Malacanang explain that the reason why there were PSG men in the airport was for Mike Arroyo’s arrival. That was the reason why these PSG men were seen at the airport when Jun Lozada arrived. Enough is enough. This number one Mob Boss must be persecuted to the fullest!

  4. Ellen, is Atty. Alex Lacson, the Alexander Lacson who wrote 12 little things every Filipino can do to help the country?

  5. Yes, the same Alex Lacson. He is so good. He speaks clearly, divinely.

Like you, Jug, he was at the PMA. A classmate of Col. Parcon. He didn’t finish at the PMA. He went on to UP and Harvard.

  6. In arguing for a “proper conduct of proceedings”, Lacson related a lesson learned from his law professor, the late Haydee Yorac:”Let justice be done though heavens fall.”

  7. Ellen, I met him last night at the World Vision Dinner, unfortunately we could only talk briefly. I have an autographed copy of his book. It would be nice to have a chat with him one of these days…

  8. It feels a bit strange though talking to an obviously very intelligent person who is not hesitant to share his faith. I understand his book made a lot of money but he used the proceeds to build a chapel in a remote area somewhere.

  9. Sayang, you should have been at the hearing yesterday.

It is not often that he attends hearings though.

    *****************************

Survivor din pala ni Yorac ito.

She always said that on the first day, in the context of stating that “Your fathers’ wealth or fame does not impress me. You will get the grade that you deserve.”

That is because there were many students who were sons and daughters of this and that bigwig.

She was a reputed terror, and struck the fear of God in every freshman. She seemed to relish this, so she would usually come into the classroom on the first day and say:

“Everything you heard about me is true.”

But taken as a challenge, you learn a lot from these types.

  14. While these officers are toughing it out, one piglet is on the run:

Mike Arroyo trip to HK stirs talk of flight

MANILA, Philippines — As the scandal in the National Broadband Network project continued to rock the administration of President Gloria Macapagal-Arroyo, her husband quietly left Manila Friday morning for Hong Kong.

But Ruy Rondain, legal counsel of Jose Miguel Arroyo, said his client flew to Hong Kong for acupuncture treatment and would return in a few days.

I don’t believe he went simply for acupuncture treatment — I bet the so called treatment coincides with a trip to a HK bank so he can fondle his stolen funds!

Thank God Ellen, these men survived another day! What is next? Isn’t their prescription period ending on the 26th? God id good and He saw to it that this sham court wont prevail, at least. But I heard that the mutiny charges will prevail. Hindi ba pwedeng pauwiin na yang mga yan to breath some fresh air, at least?

The piece is well-written. Isa lang ang problema ko.

Heroes are not called upon, nor appealed to. They are called by their consciences, and rise to the occasion. If you have to appeal, then there is no hero within the person.

Nobody appealed to Lozada, except that inner voice from within. The Gold Cross did not call Querubin while under fire; it was that voice from within which called forth the soldier and gentleman in him.

Batukan niyo na lang ang mga gago – not because baka matauhan, but because they deserve it. While you’re at it, give the dirty finger salute to Esperon.

Matagal ko nang gustong maki-blog dito sa site mo Ellen, but that time I forgot my password and I became busy so hangang sa pagbasa na lamang ako ng inyong mga blog.Alam mo I admire these brave men who are fighting for truth and justice against the FAKE President and her cohorts,at nawa with GOD blessing ay matapos na ang reign of terror and corruption diyan sa Pilipinas, at maparusahan ang mga mandarambong.

  19. parasabayan parasabayan

Atty, hopefully, the voice from within will be more audible to our contrymen. There are still those who can not hear any voices even if the sounds (inside and outside) are almost deafening sa lakas ng decibel! Mas marami pa ring nagtutulog tulogan!

  20. parasabayan parasabayan

More than anything, if indeed the prescription period of this case ends on the 26th of February, it is the family of these incarcerated men who should get the kudos because they stood by their men through thick and thin! Kudos too to the media! When all the other outfits stopped covering the plight of these incarcerated men, Ellen has kept on going and has continued to stand by them till tha last minute! Ellen….thanks for all your efforts!

I bet you baka nag-mature na naman yung isang bank certificate niyan o kaya eh mayroon ilalagay sa “higher yielding” stocks some place.

  22. parasabayan parasabayan

Atty, WE ARE CALLING ON ALL THE “HEROES” of the land.

  23. parasabayan,
I don’t understand why he has to go to HK for accupuncture, we have competent practitioners here? Maybe he’s afraid that someone will use a hypodermic needle instead with the syringe filled with formalin?

  24. parasabayan parasabayan

  26. Diego K. Guerrero Diego K. Guerrero

Bulok ang style ni Jose Pidal. Kapag may hearing sa Senado may sakit kuno pero kapag good time tour sa Europa at HK siya ay masikasig. Gina-gago niya ang Senado at taumbayan.

  27. PSB, I expect the prescription to be another contentious issue.

In some of the Scout Rangers’ case the charge of Conduct Unbecoming Officer and a Gentleman cites a Feb. 23. 2006 meeting in Bulacan. So that’s supposed to prescribe today.

In cases connected to the February 24 alleged withdrawal of support, that should be considered prescribed on Monday, a non-working holiday.

In cases connected to the Fort Bonifacio standoff, it’s supposed to expire on Tuesday, Feb. 26. But then, the panel may hold the next hearing on Tuesday and impose an arraignment.

Given how the panel deprived seven officers to exercise their right to peremptory challenge including Lt. Homer Estolas, I expect them to say the cases have not prescribed “and if you have any problem with our decision, you go to the Supreme Court.”

    But then, miracles can happen.

  28. parasabayan parasabayan

Thanks Ellen, we do need a BIG MIRACLE! GOD IS GOOD. He will not let us down!

  29. parasabayan parasabayan

Sana matapos na ang paghihirap ng mga 28 opisyales and their families. Mahirap talaga ang pinagdaraanan nila.

  30. That the trial has reached this far without being unjustly arraigned is already a miracle.

That’s no mean feat under Esperon who is determined to put away anybody who is in the way in their desire to hold on to the stolen power of his patron, Gloria Arroyo.

  31. parasabayan parasabayan

Ellen, with the people’s wrath now, I do not know if asspweron will be able to do anything!

I never saw students passionately involving themselves in rallies. It reminds me of how we were in the Marcos regime. When the youth starts to get involved, the dynamics change. Sana naman they do not lose the momentum to fight this EVIL regime!

  32. And nowhere can you get ALL the blow-by-blow details of this trial but here in ellentordesillas.com.

Ellen may not get a Medal of Valor for what she’s doing but she definitely deserves a token equally rewarding.

    Mabuhay ka, Ms. Ellen Tordesillas.

  33. As they say, “God moves in a mysterious way.”

I thought I’d share this poem to all those brave ones joining the Monday protest not just in the Philippines but around the world. People in far provinces in fact, need not go to Manila, They can protest in their own towns and cities so it will be nationwide to be more dramatic and full of impact!

God Moves In A Mysterious Way

God moves in a mysterious way
    His wonders to perform;
He plants His footsteps in the sea,
    And rides upon the storm.

    Deep in unfathomable mines
    Of never-failing skill
He treasures up His bright designs,
    And works His sovereign will.

Ye fearful saints, fresh courage take,
The clouds ye so much dread
Are big with mercy, and shall break
    In blessings on your head.

Judge not the Lord by feeble sense,
    But trust Him for His grace;
    Behind a frowning providence
    He hides a smiling face.

    His purposes will ripen fast,
    Unfolding every hour;
The bud may have a bitter taste,
But sweet will be the flower.

Blind unbelief is sure to err,
    And scan his work in vain;
    God is His own interpreter,
And He will make it plain.
    —William Cowper

  34. Does the Philippines have extradition treaty with the HK? Kung wala iyon ang dahilan kung bakit siya sa HK magtatago in anticipation of what will happen one of these days.

I recommend fasting to be done for the success of this feat to remove the creeps!

  35. parasabayan parasabayan

Yuko, the EVIL family is probably banking on China to bail them out of the mess they are in now. Thus the Fatso is the advance party.

  36. grizzy,

That was a beautiful poem; “God Moves In A Mysterious Way”…

    Sounds like Him alright 🙂

  37. If the Chinese can have the Philippines back through the creeps, why not? Except that I am told that the Chinese would see first if the US still has the strength to fight China with the US now owing Cnina big money. Japan has been wary on the other hand of the Bobobitch’s loan contracts with China even as early as her first visit there when she made collateral of some Philippine territories—hindi lang Spratly’s according to my husband and news reports here. Truth is Japan was the first to get worried about it because the idiot had I guess made agreement to lenders from other countries remitted to Chinese banks para hindi raw marami ang babayaran, or that all loans should be coursed through Chinese banks, which was the reason, I guess, why Japan has opted to do all biddings for public works checked first by Japan, and loans be in kinds not in cash after the idiot made that first agreement with China.

Akala ng idiot makakalamang siya to make it look that the Philippines does not have that much debts by making it look that the Philippines owes only the Chinese, and that the IMF for instance will not notice the remittances in loans from Japan, etc., and the Chinese getting benefits in terms of charges for bank services that would in fact be extra costs to the lenders. It is in fact more like iyong inutang sa China, pinababayaran sa pamamagitan ng utang sa iba. Na-worry talaga ang mga hapon sa gusto ng boba, and there was a loud protest against it in Japan according to my husband, who says that what this idiot does has repercussions in the economies of the Philippines’ neighbors in Asia.

Wise? Nyet!

  38. Kabayan:

Thanks. May music pa nga iyan sa totoo lang.

Meron pang isang magandang kanta that the rallyists on Monday can sing. Ang title “Who’s On the Lord Side Who?” or the more popular, “Onward Christian Soldiers.”

    Onward Christian soldiers!
    Marching as to war,
    With the Cross of Jesus
    Going on before!

  39. balweg balweg

Continue our prayers at yong God’s soldiers ang ipapadala niya to save our country sa kuko ng halimaw.

Believe God is alive and always in our side!

  40. Ellen,

Is that Mrs. Querubin? What a lovely couple they make indeed! Subok na pagmamahalan, truly made in heaven!

In contrast, iyong mga Pidals–Gloria the Si-Evil, and Mike the Fugitive–a love made in hell!!! 😛

  41. Anyone in this blog who can give me the email of Alfredo Cayton. I just want to get in touch with him. Kung puede pakibigay kay Jug or Ellen.

  42. rose rose

grizzy: Thanks for sharing the poem..Ang ganda..
..ang cute yong anak ni Maj. Aquino..

  43. Sinabi mo pa, Rose. In essense, it says, trust only in the Lord. Filipinos should not trust these crooks now pretending to squeeze out the truth but won’t, but God i His infinite wisdom has moved a probinsyanong intsik to take courage to defy the convention of evil and immoraltiy under the rule and leadership of a criminal. Surely, and no doubt about that, truth and justice will prevail, and the Will of God at last will be revealed at last.

  44. Funny how these movements to remove the creeps are now headed by the youths of the land. “Out of the mouth of babes and sucklings hast thou ordained strength because of thine enemies, that thou mightest still the enemy and the avenger.” (Ps. 8:2; Matt. 21:16)

  49. Thanks, Chi. Still, we all know what the Mrs. has risked herself doing so the husband can be free. Ngayon pati siya kinulong na yata. Hayup talaga, di ba?

Over in Japan with the simple harmless protest she did, a grieving wife like Mrs. Querubin would just be cautioned and asked to go home as authorities here can understand such feelings by grieving wives, daughters or sisters. Culture-wise, they expect spouses to feel vindictive as a matter of fact. In ancient times, they even have what they called a “kataki”!

  51. Zardux Zardux

Here are some overt signs that mister esperon has lost control over his soldiers:

    1. During a presscon last week, he was so confident and declared that the 28 Tanay boys would be arraigned by his own kangaroo court.
Walang arraignment na nangyari. His orders were defied by his own GCM?
    2. He toured all major camps. The soldiers welcomed him with cold shoulders.
    3. He called in troop reinforcements from nearby provinces. Purpose: anti-coup???
    4. Together with his 3 commanders, he led a ”walang iwanan” pledge. Lumabas ang tunay nilang kulay: mga gangsters! Daig pa an Oxo at sige-sige gang!

  52. Now is the time, the opportunity for heroism indeed! Good luck to every one. May the force be with you. I’d say, may the Lord be with us all always till the criminal has been brought to trial and punished for her crimes together with her partners in crime, including the wannabe fugitive now in Hong Kong! 😛

  53. Don’t Quit

When things go wrong as they sometimes will.
When the road you’re trudging seems all up hill.
When funds are low and the debts are high.
And you want to smile, but you have to sigh.
When care is pressing you down a bit.
Rest, if you must, but don’t you quit.
Life is queer with its twists and turns.
As everyone of us sometimes learns.
And many a failure turns about.
When he might have won had he stuck it out:
Don’t give up though the pace seems slow –
You may succeed with another blow.
Success is failure turned inside out –
The silver tint of the clouds of doubt
And you never can tell how close you are.
It may be near when it seems so far:
So stick to the fight when you’re hardest hit –
It’s when things seem worst that you must not quit.
