What could spark military outrage

Immediately after last Friday’s 8-hour court martial hearing of the mutiny case against Maj. Gen. Renato Miranda and 27 other officers allegedly involved in the plan to withdraw support from Gloria Arroyo in February 2006, the members of the panel met with AFP Chief of Staff Hermogenes Esperon.

Esperon, the source said, was upset that no arraignment of the 28 officers took place. A member of the panel, the source said, told the AFP chief that much as they want to follow his timetable, it’s difficult for them to railroad the process. That would open them later to charges of violations of the law. They risk being subjected to court martial themselves for rendering unlawful judgment.

There were two issues that the panel had difficulty resolving and even necessitated a backroom conference with five defense lawyers. One was the motion of Atty. Homobono Adaza, counsel of Col. Ariel Querubin, to suspend trial for 45 days as a “cooling off” period considering the current volatile political situation.

“For all you know,” Adaza said, “the next 45 days, this case will be moot and academic.”

In the end, the court denied Adaza’s motion. Trying to be inscrutable, Maj. Gen. Jogy Fojas, president of the court panel, ruled that”the present political situation has no relevance to the arraignment.”

The other issue was more problematic because the Articles of War No. 71 provides that “In time of peace, no person shall against his objection, be brought to trial before a general court martial within a period of five days subsequent to the service of charges upon him.”

Some of the accused were served the corrected amended charge sheet Thursday, the day before the hearing, while other were served their copy on the day of the hearing itself. That means, no arraignment could be done until March 3, if “five days” means working days.

Esperon wanted badly for the officers to be arraigned last Friday, Feb. 22, because the charge of “Conduct Unbecoming of an Officer and a Gentleman” has a two-year prescription period.

The charge sheet of the 19 accused Scout Rangers led by Brig. Gen. Danilo Lim cites a Feb. 23, 2006 meeting as the basis of the charge. There were also charges that cited a Feb. 24 incident. Since no arraignment happened, that particular charge is now considered dropped.

The charge sheets of most of the nine Marine Officers cites the Feb. 26 Fort Bonifacio standoff as basis for their cases of “Conduct Unbecoming of an Officer and Gentleman” and “Conduct Prejudicial to Good Order and Military Discipline.” If the five-day rule were observed, those charges would also be dismissed.

Only the charge of “Attempting to Create or Begin, Excite, Cause or Join Mutiny” which has no prescription period remains. The Pre-trial Investigation Investigation Report which is one of the basis for the convening of the court martial recommended the dismissal of the mutiny charge “for lack of factual and legal bases.”

Although a pre-trial advice by Col. Pedro Davila overturned the recommendations in the PTIR, it was not signed by Esperon to signify his official approval and it was not attached to the charge sheets.

A source said during the backroom conference, it was obvious that some members of the panel were torn between Esperon’s order and the reasonableness of the defense lawyers’ arguments.

Many times, the members of the panel mentioned about the prescription period. Adaza told them, “What are you worried about? Even if the minor charges prescribe, the same alleged incidents are included in the mutiny charge.”

One defense lawyer also said that Esperon has been quoted to have a different interpretation of the two-year prescription saying that the court will have to consider the interruptions caused by the defense.

The source said while other members seemed open to the arguments of the defense lawyers and not completely impervious to the current political situation, it was Brig. Gen. Rolando Capacia who took the hardline stand.

When the court resumed at 7 p.m., Fojas announced their decision to deny Adaza’s motion for a 45-day moratorium.

On the five-day notice, the court said that applies only to the service of the original charge sheet. That is something that the defense will contest in the next hearing.

But the court granted the motion of the defense to adjourn without an arraignment, which upset Esperon.

Esperon’s interference in the court martial proceedings is illegal because his job is only to convene the panel for the court martial. The law states that any proceeding where the “ accuser, prosecutor,judge and executioner” are one and the same is a gross violation of due process which is guaranteed to all citizens under the Constitution.

In his statement saying that the military won’t intervene in the current political unrest precipitated by the NBN/ZTE corruption scandal, Esperon said, “Let’s allow the democratic process to go on unhampered. It is the job of the military to see to it that this process goes on. It is a way of strengthening our democratic institutions. Let’s let the institutions function, otherwise, we will not be strengthening our democratic institutions, we will be weakening it.”

Esperon better practice what he preaches. The soldiers are closely watching. They may tolerate dysfunction in civilian government but it’s a different thing with military injustice. As a Supreme Court ruling states, “It would indeed be paradoxical if military men who are called upon in times of the grave national crises to lay down their lives in defense of peace and freedom would be the very people to be singled out for denial of the fundamental rights for which they risk their lives.”

    It is a high time now to reform yourself and hear the voices of all loving Filipinos and your fellow soldiers who wanted a free and peaceful transistion of our leadership.

    We OFWs and Migrant Filipinos already withdrawing our cooperation sa Pidalismo regime. Nawa Gen. Esperon feel the spirit of love, ito po ang aming pagsusumamo sa inyong hanay para naman sa kinabukasan ng mga kabataan.

    We are doing our best to help our country kahit na sobra ang hirap at sakit na malayo sa pamilya. Kaya please help the Filipino people once and for all!

    The PNP and AFP are unfortunately under well-controlled by these evil Generals led by Esperon. Gloria Arroyo knew and realized this from day one in office. Iyan mga Generals ang mga isa sa binusog niya hanggang ngayon. After retiring, they are being appointed to juicy civilian positions. Ramos could be a key to spark military outrage since he has many men in high positions. If we base it on his recent speech, he seemed to be sending some signals to the military to withdraw their support from this evil woman. Of course we also hate Ramos. But at this time, his help and influence is very much needed just like what people needed in the last two Edsas. Finally, the military just needs a signal from Uncle Sam. Huwag lang makialam ang mga Kano kahit na hindi tumulong, maraming babaligtad na sundalo para mapatalsik si Gloria. The problem is the US still supports her. If some of you don’t buy this US factor, I don’t care.
    Pero iyan ang isang tunay na dahilan kaya hindi makakilos ng husto ang ating Militar. Halimbawa nga kumilos sila…what if the US jets fly all over Metro Manila and US Marines are sent to help the government?

Trillanes, et al… But the problem is pag nalagyan na ng estrella sa balikat, pag naging heneral na, kadalasan iniisip na ang sariling future, at nalilimutan na ang pagmamahal sa bayan!

    Sa ngayon mahirap mangyari ang malawakang pag-alsa ng military laban sa mapang-abusong gobiernong ito. Certainly marami na sa pulis at militar ang galit at nangigigil. Nagmamatyag lang ang mga iba at naghihintay ng pagkakataon upang umaksion. Kaya kampanti lang ang administrasyon na walang mangyayarin kudeta. We cannot discount however the possibility that a group of young and idealist officers may just provide the necessary spark which may draw a huge mass of people on the streets. Even those military contingents called on by the administration to protect GMA may not be that 100% loyal to her. Anong malay nating kapag nagkagipitan na, baka bumaliktad din ang mga iyan at kumampi sa mga tao na nagnanais ng pagbabago. Marami pa ang maaring mangyari. Nasa mamayan na iyan.

    As I write, the pro-Arroyo groups have taken the Edsa Shrine that was previously off limit to rallyists. Sabi ni Bayani Fernando bawal sa lahat ang Edsa Shrine pero bakit nandoon ang celebration ng gobyerno? Sabi naman nina Gen. Razon hindi magdadala ng baril ang mga Pulis pero kitang-kita sa TV na nakasukbit sa kanilang baywang ang mga baril. Si Gloria Arroyo naman bumisita sa Camp Crame at Camp Aguinaldo one day before Edsa celebration para pakiusapan ang mga sundalo na huwag makialam. Bilang sagot, may “unity walk” daw sina Esperon at Razon. Banta din ni Esperon sa mga sundalo na aarestuhin sila kung sasama sa rally. If they keep doing this; that is, preventing people from expressing their rights against the government by matching it with paid pro-government groups, baka magka civil war. Ang mga civilians ang magpapatayan. Whether they are from the government or the opposition, all are Filipinos. Parang ganyan ang gustong mangyari ng Malacanang so that they could resort to some emergency action to remain in power.

    Whichever side wins they are on the same status, hand to mouth existence. So why join anything at all this time. All that we need now are the top people to change side, not the rank and file.     Actually the sparks had been there before and it is still now. They spark plugs for a revolution are the Pidals and Assperon. Just looking at the faces of these people is enough to make you puke and spark an outrage. Add to this their acts from rigging the election, their insatiable greed and to unabated corruption and scandals could have been enough to spark an outrage among the soldiery, unfortunately, only a handful, a small group led by former Capt. Trillanes, and followed by the group of Gen Lim, Miranda and company have been “sparked”. Entering into the picture is the ongoing trial of the jailed officers which is being marked by short-circuiting the process upon the orders of Assperon who wants to be the judge and executioner. An injustice and unfair application of the law might lead to some grumblings among the soldiery but it is not a sure fire way to spark an outrage that will translate into some movements. We can not blame the soldiers. They have their own family and just want their job and will not move unless sure of victory.

    Well, as PSB said, “the real spark would be the number of people in the streets” and I fully agree with it. Fill the streets with people and that will be the time and opportunity for the soldiers to move on for the kill. As things stand and knowing how the people hate the Pidals and Assperon they will not even allow them to say their last goodbye.

The growing trend to fire CEOs quickly raises the question of when they should be let go. Should a chief executive be removed at the first hint of a difficulty, or should boards stand behind him or her, even if the CEO is responsible for a bad decision or an egregious error in judgment?

    If we were the Board of Directors of Philippines Inc., is it right for us to ask for the head of Gloria Arroyo, the CEO of the Company?

    Let’s review her performance:

    A)One of the key responsibilities of a CEO is to drive growth, increase operational efficiency, and enhance profitability of the Company.

    The Malacanang Argument: “2007 was the best year for the Philippine economy in over 30 years. Economic growth was 7.3 percent, as we have seen and you all know; a million new jobs were created; unemployment is down, poverty is down; the stock market is up; the peso is at its highest level in many, many years.”

    B) CEO is responsible for maintaining relations with employees, major customers, shareholders, stock analysts, congressmen, heads of governments, regulators, union officials, and, not the least, the media.

    The “standard answer” of Malacanang during a Scandal: President Gloria Arroyo remains focused on the job of improving the economy and won’t be sidetracked by current political challenges. Ignacio R. Bunye said “The President’s schedule is consistently driven by her economic plan.”

    In the same interview, Bunye reiterated his call on the Filipino people to unite and work together in improving the country’s economy.

    “Disunity and political instability in the country would only send negative signals to potential investors…it is important that investors have confidence in our economy and we can only achieve that confidence if we unite,” he said. (July2005,at the height of the Hello Garci Scandal).

    C)But the MOST IMPORTANT JOB of a CEO is to build the moral and ethical tone of a company and cultivate a culture of transparency. The CEO must be the role model .He or she must ensure that the Company will NOT tolerate an employee who will cut corners and jeopardize the company’s reputation or create enormous losses such as the rogue trader at Société Générale .

    There is a difference between good CEOs who make mistakes and CEOs who commit REPEATED BLUNDERS particularly on the ETHICAL side.

    If were the Board of Directors of Philippines Inc., we should initiate the ouster of Gloria Arroyo for a long litany of “Conjugal Greed” SCANDALS in 7 years as CEO of Philippines Inc.
