Can Arroyo reign beyond 2010?

Read this article by former Chief Justice Artemio Panganiban in the Inquirer and be afraid:

President Macapagal-Arroyo’s present term expires on June 30, 2010. Can she legally extend her reign beyond that date? My answer: Yes, if our Congress, Supreme Court, Commission on Elections and people will agree to a revision of our Constitution.

Failed Cha-cha bid. Let me begin my thesis by recalling the most recent bid for Charter change (Cha-cha). In 2006, during my term as chief justice, the allies of the President, led by then Speaker Jose de Venecia Jr., launched a “people’s initiative” to alter our form of government from presidential to parliamentary.

Armed with the alleged signatures of 6.3 million voters, the initiative’s visible proponents—the “Sigaw ng Bayan” and the Union of Local Authorities in the Philippines (Ulap)—asked the Supreme Court to compel the Comelec to authenticate the signatures and to schedule a plebiscite to ratify their proposal.

However, the Court—by a close 8-7 vote—refused. It described the Sigaw-Ulap initiative as “a deception” and “a gigantic fraud” because the signatures were gathered “without first showing to the people the full texts of the proposed amendments.” Equally important, a change from the presidential to the parliamentary system is a “revision, not a mere amendment” that cannot be authorized by an initiative.

The decision was penned by Justice Antonio T. Carpio, concurred in by Justices Consuelo Ynares-Santiago, Angelina Sandoval-Gutierrez, Ma. Alicia Austria-Martinez, Conchita Carpio Morales, Romeo J. Callejo Sr., Adolfo S. Azcuna, and yours truly. Since then, three (Gutierrez, Callejo and I) of the eight have retired.

On the other hand, the dissenting opinion was written by Justice (now Chief Justice) Reynato S. Puno, joined by Justices Leonardo A. Quisumbing, Renato C. Corona, Dante C. Tinga, Minita V. Chico-Nazario, Cancio C. Garcia and Presbitero J. Velasco Jr.

Initiative—as a means of overhauling the Charter—is indeed problematic. Hence, I believe the Palace allies will not repeat the mistake of launching a new one. Neither will they avail of the more tedious constitutional convention (Con-Con). Furthermore, the Cha-cha proponents may not be able to elect enough partisans into the Con-con, due to the low popularity rating of GMA.

Weapon of choice. I think their new weapon of choice will be the constituent assembly (Con-ass). Under this method, the shift to a parliamentary system shall be proposed by “Congress, upon a vote of three-fourths of all its Members.” Per Article XVII of the Constitution, the proposal “shall be valid when ratified by a majority of the votes cast in a plebiscite which shall be held not earlier than 60 days nor later than 90 days after the approval of such revision.”

The big question is whether the two houses of Congress shall vote jointly or separately. Voting separately, the Senate will—I believe—turn down the parliamentary shift. However, if the voting is done jointly—meaning that the votes of the senators and the representatives would be added and thereafter the three-fourths count obtained from the total—then the shift may get the needed majority.

How? GMA’s ruling coalition lists more than 200 of the 240 House members. Hence, in a joint vote, even if all the 24 senators would align with the House’s puny minority, the required “three-fourths vote of all Members” could still be obtained. Will the Senate agree to convene a Con-ass? It seems so. Sen. Aquilino Pimentel has already proposed to the Senate to tackle his plan for a federal system. Once convened, nothing prevents the Con-ass from dancing the parliamentary Cha-cha.

The Supreme Court will ultimately decide the validity of a joint vote. Considering that the eight justices who rejected the “Sigaw” initiative have been decimated by three retirements (four by Feb. 6, 2009 when Justice Azcuna turns 70) and considering further that GMA has lately been winning controversial cases, the high court may affirm a “joint” vote. It may wash its hands and say: Let a plebiscite be held to determine whether the people want the parliamentary system.

Ideally, a plebiscite determines the peoples’ choice. However, the voting process here will be easy to manipulate. Voters will simply choose between “Yes” and “No.” In fact, the Marcos Constitution was approved by a mere raising of hands during “citizens’ assemblies,” a scandalous voting process validated by a compliant Supreme Court.

Expect the GMA administration to use its full resources to secure a resounding “Yes” from the Court and from the people. Hence, the Comelec’s role in counting the ballots (and those of Namfrel and PPCRV in guarding them) will be critical.

Sufficient time for change. Will there be enough time to approve the parliamentary shift? Yes, under this timeline: congressional approval by Dec. 31, 2008, Supreme Court decision by June 30, 2009, and plebiscite in September 2009.

The elections scheduled on the second Monday of May 2010 will then be held for members of the new Parliament, not for president, vice president, or senators. GMA will secure a parliamentary seat in Pampanga and then become prime minister in a Lakas-Kampi-dominated Parliament after her term as president expires on June 30, 2010.

Theoretically, it is possible to revise the Constitution and enable GMA to continue her reign after June 30, 2010. But will our Congress, Supreme Court, Comelec and people allow her? Realistically, can GMA—unlike Ferdinand Marcos—extend her reign without martial law?

  5. Nothing new really. The bruha has been sounding it as often as she is allowed to. I bet you she will be speaking again of the progress of the Philippines in the next 20 years or until she dies, and the only growing thing Filipinos will see are the how -illions and illions of debts the creep has incurred and will still incur like what her father did before her.

    I say -ilions because we do not know how much more in -illions she will borrow. Right now, Philippine debts are in the trillion. If she stays beyond 2010, it will surely be more.

    Tama na, please. Maawa kayo sa Pilipinas!

    Can Arroyo reign beyond 2010? Of course she can and she will. There is nothing in the Philippines that can stop her. Everything is in place. Think Pakistan. Its going to be like that. I can just smell it from where I am. No need to proclaim Martial Law. Dissent has been neutralized. The S. Court and Congress is with her and so are the church and military. The only chance – the youth. So what happened to the LFS rally?

  22. Legally, Arroyo may not reign beyond 2010. But this woman is above the law and the Constitution. And there is a Supreme Court that will sustain her exalted position above the Constitution. (Just consider its recent decisions on the issue of executive privilege. While the Filipino nation can trust Chief Justice Puno, this is not translated into trust for the entire institution.)

    It is not far-fetched that she will reign beyond 2010, even without a Charter Change. To her the Constitution is nothing!

    My response: God never forget HIS people. If you ever think that God forget us the Filipino people, it only means that we are not HIS PEOPLE. If you think otherwise, then do not say that. The LORD is, always and has been keeping His covenant to His people. The problem lies on us, the Filipno people. We have that wrong humility, we do not know how to fight straight and fairly, we always think of ourselves first..not of others, we are afraid to stand up and fight. If we will not change our attitude, then who we are to blame those who transgress our right (like the midget and her cronies)?

  24. To Chi, Chief Justice Panganiban was not the one who officiated the swearing in of that b***h. That was his predecessor Hilario Davide under whose tenure litigation became expensive thus making justice difficult to access.

    In his book Reforming the Judiciary, Panganiban takes the reader back to those days of political turmoil. Estrada’s impeachment trial had collapsed when the prosecution walked out in frustration; the military had publicly withdrawn its support from Estrada, the duly elected commander-in-chief; hundreds of thousands of anti-Estrada partisans had gathered at the shrine. Panganiban says it was at that time that the justices acted to save “the constitutional system from collapse”. He actually states that he and the chief justice decided to swear in Arroyo even though they knew Estrada had not resigned.

    “Let me articulate my faith that Edsa II [the name of the event that led to Estrada’s ouster] was indeed a confluence of events planned in heaven,” he writes. “I am still wondering up to now how I had summoned the courage to propose the oath-taking of Mrs Arroyo even when President Estrada was still in Malacanang; and why Chief Justice Davide immediately agreed to it, even prior to consultation with other justices.”

    Perhaps the most amazing passage out of the book comes when Panganiban talks about “restoring Zion”. He writes that both he and the chief justice have a daily habit of consulting the Bible. Panganiban has a certain passage that he reads on particular days. Davide, though, prefers to cut the Bible at random, taking inspiration from whatever passage happens to appear.

    Before dawn on the morning of January 20, 2001, Panganiban tells how he called up Davide, who related that he chanced upon a passage in Isaiah, Chapter 62, about “restoring Zion”. It was then, Panganiban states, that Davide had his higher calling. Yes, that was the answer to the turmoil that was currently besetting the Philippines. The chief justice would have to “restore Zion”.

It’s the only way for her and her family to escape charges, prosecution and conviction of all the crimes she committed. The moment she leaves office, she will suffer worse than the fate of Marcos and Erap.

  43. Gloria is not actually stepping down after 2010. That was the plan when she grabbed power. I noticed that in fact when they started propagandizing that she was a descendant of Lakan Dula that was something new, for not even the father, who was president of the Philippines in 1962-66, did that although like the daughter now, he did a lot of travelling overseas that the presidents before him did not do, despite the pinch that prompted President Garcia before him to adopt the policy of austerity even with all those reparations money coming in from the USA and Japan.

    Recently, there was even a news item about some relative of the Fatso in Mindanao claiming that they own the Philippines since the Americans did not pay them the money their family allegedly lent the US to pay the Spaniards when the former conquistadores gave up the Philippines and some other islands they owned in the Pacific.

    Then there were the frequent visits to countries with royalties like Japan, and recently to Spain and UK in what I thought was a vain attempt of the sick in the head to project an image of royalty, something reminiscent of Imelda’s hallucination likewise that she was royalty.

    Notice the use of the Pidals of those ribbons that presidents and the spouses never did when visiting overseas and in the companies of royalties like the Emperor and Empress of Japan or the King and Queen of Spain. Kulang na lang maglagay ng korona ang mga hibang sa totoo lang. And I bet you, these creeps must be sleeping now in that bedroom renovated by Imelda for the royalties of Spain during their visit there complete with those regal insignias.

    In short, hindi bababa iyan even after 2010. Kaya nga taeng-tae doon sa Cha-Cha. I have no objection to the revision of the Philippine Constitution to change the flaws there that Panganiban, et al were able to help grabbed power from Erap and placed the dorobo in his stead, but not until the dorobo is removed by force as it is the only way to remove her since there is no chance the Philippines is going to have a fair election with her appointees dominating the COMELEC and placed there exactly for the purpose of insuring that she is not removed even at least for the next 20 years that she brags about that she can make the Philippines a G9 country! Akala mo naman talagang kaya niya.

    Magaling lang namang mangabisote ang ungas. Empty coconut naman ang ulo! Kawawang Pilipinas!

Lalo na ngayon siguro dahil di lang iyong mga kamag-anak ni Macapagal, pati kamag-anak ni Arroyo nakapuwesto, plus iyong mga kamag-anak for instance ni Ermita, et al. nakapuwesto din where they can really nakaw.

    Iyong mga patrimonies nga dito sa Japan kinukurakot na. Pasalamat nga lang ang mga pilipino at may clause ang reparations treaty na puedeng idemanda ang mga maglulustay ng mga bayad ng Japan sa Pilipinas. Kung di tanggapin sa korte ng Pilipinas dahil sa mga political appointees doon, puede dito sa Japan. Litigations dito kahit mahirap puedeng magsampa. May legal help and assistance from the government.

    I advise ALL Filipinos in Japan and the Philippines to take advantage of this provision of the Japan-Philippine reparations treaty in protecting Philippine patrimonies and interests in Japan. At least, para makaganti.

Dahil sa mga kurakot sa Pilipinas, mas malakas ang laban kapag isinampa ang kaso sa Japanese court, especially when the objects of dispute are in Japan. Madali namang makakuha ng mga papeles gawa nang kailangang ipaalam din sa Ministry of Foreign Affairs namin dito ang ginagawa sa mga patrimonies ng Pilipinas sa Japan na sa totoo lang ay hindi puedeng ibenta sa ibang lahi maliban sa hapones at pilipino lamang.

    Pagtulungan nating lahat na huwag makinabang si Gloria Dorobo sa mga patrimonies na iyan.

    Please do not use the acronym CON-ASS for Constituent Assembly. It does not sound right and it’s as if we despise the Constitution the Filipinos voted for.

    CON normally refers to fraud and con artists while ASS is “the behind”. When a fraudster CONS you, you are sc$#%&d from behind.

    Is that the purpose really of the Constituent Assembly? I don’t think so especially if Congress will amend the Constitution to prohibit political dynasty-ism i.e., no citizen may be elected or appointed to public office if he/she has a relative within 3rd degree of consanguinity or affinity already elected or appointed to a public office. Short of this is un-civilized.

    BTW, I am also Don Quixote de la Mancha.
