The Value of Legacy – Why the President Should Support a Credible Impeachment Proceeding

by Atty. Adel A. Tamano

(The author is partner in Kapunan Tamano Villadolid & Associates law office and assistant lecturer at the Institute of Law, Far Eastern University in Manila)

Essentially, the political opposition has branded the President, in their words, as a “cheater”, “thief”, and “liar” on the basis of allegations of unlawful use of public money for the 2004 elections, vote-rigging, and the subsequent cover-up by the executive. Moreover, critics argue that the killing of the members of the political left, the silencing of dissent, and the rush to amend the Fundamental Law are merely the logical consequences of the failure to obtain a genuine mandate. These are the bases for the filing of the impeachment complaint against the President on June 26, 2006, a year after the filing of the first impeachment complaint.

From the actions of the President’s counsel, by raising the pendency of a petition with the Supreme Court related to last year’s impeachment, as well as statements by the President’s official family prophesying an imminent defeat of the second impeachment proceeding, it appears that the Executive is, once again, bent on “killing” the current impeachment. However, it may not be in the President’s best interests, in the long-run, to oppose the impeachment. On the contrary, there are reasons, which are sound, valid, and serve not only the President’s interests but those of the country as well, that demand her support for having a credible impeachment proceeding, namely:

1. It gives her an opportunity to clear her name;
2. It will allow her to objectively assess her mandate;
3. It strengthens legal institutions and respect for the rule of law; and
4. It will enable her to focus on nation-building.

Opportunity to clear her name: Impeachment proceedings are not one-sided affairs and afford the President a valuable opportunity to refute persisting allegations of misconduct. The proceedings specifically allow the President to present evidence of her innocence: in fact, historically, the odds are stacked in her favor. In the United States, in two centuries of constitutional history, there have only been seven (7) convictions of impeachable officers, all from the judiciary. In the Philippines, no public officer has ever been convicted and removed from office by impeachment.

Assessment of Mandate: The French label impeachment as “political justice” and, thus, impeachment proceedings are a practicable means for assessing political mandate. Simply, if the President has a genuine mandate to govern, then this will be expressed by public pressure on representatives in Congress to find her innocent.

Strengthening of Legal Institutions: Impeachment is a constitutionally mandated mechanism for enforcing accountability of highly powerful government officials. It is the very fact that impeachable officers possess such immense authority and political influence that a countervailing measure, their impeachability, was built into the constitutional framework as an assurance of their accountability to the people. The President, by allowing herself to be subjected to the process of impeachment, strengthens not only this constitutional mechanism but also enhances the people’s faith in the workability of our legal system and, in the long run, strengthens the rule of law.

Focusing on Nation-Building: Hearings at the Committee on Justice, or even at full hearings during the Senate Trial, will not require the President’s full time and attention. There is no obligation under the Constitution for her to be present at the impeachment proceedings. Moreover, if she is in fact innocent of the charges, then it will be a simple matter for her lawyers to present evidence to refute the allegations of the impeachment complaint. By voluntarily participating in the process, which lessens her need to use both her time and political capital to stop the impeachment, she can turn to more pressing matters of governance and nation-building.

These reasons, predicated on higher notions of institution building and good governance, would appear counter-intuitive to political operatives who value short-term political survival over longer-term considerations of the general welfare of the country. Certainly, based on past behavior, the advisors of the President will suggest a vigorous opposition to the impeachment proceedings seeking a quick – or even quicker than last year’s – ending of the proceedings, probably on the basis of a self-created technical defect of the complaint. Unfortunately, for the President, such counsel is not only unwise but incredibly myopic and fails to acknowledge the deeper self-interest of those who achieve the heights of political power, which is the need for an enduring legacy.

As a find point, in the field of Economics, on the temporal effects of policy, the morbid witticism is that in the long-run, we are all dead. This is where the value of having a legacy comes in. Will the President leave a legacy of strengthened legal institutions and improved governance or will she allow democratic institutions to be undermined for short-term political gain? Ultimately, this is the question that stands before the President: how does she want to be remembered? Certainly, she would not want history, cruel and unforgiving as it is, to remember her by the terms that the opposition have predicated the current impeachment complaint.

…SAID the Spider to the Fly!

No way. If I’m GMA. Impeach me huh? Just you try.

There is no appealing to suicidal stateswomanship in members of the species Drosophila melanogaster! That’s why they have compound eyes.

An impeachment in the House would mean almost certain conviction in the Senate. Erap WAS willing to face impeachment because he was confident in the numbers he controlled. He didn’t count on envelopes, cell phones, and Davide’s obsessive need to recover control of the greatest trial in history (of which he lost control!).

The Senate today would be the guillotine for GMA.

  2. Kaya nga gusto ni Pandak na mawala ang Senate at gawin unicameral daw dominated by her paid palakpak tongressmen.

Now, the question is, why should Filipinos allow this to happen?!

Arroyo’s guilt is obvious in her refusal to face the impeachment trial squarely. She would rather destroy institutions that be ousted. All that she is doing now is to save herself at the expense of democracy in this country.

I feel sad with what happpened to the Magdalo soldiers.

yes dominique, I agree very much with you. If mike “the defender” and bunyeta, GUNGonzaleses, and their band of brother”HOODS” will just let the impeachement proccedings to get on, all of will know what really happened, the problem is they are trying to cover up the leprechauns wrong doings.

I SAY WE PRESS FOR A SNAP ELECTION, NOW NA!!!!

OR shoud I say “NOTA” (NONE OF THE ABOVE) for all who are running for elective office/s in next year’s election.

It will GMA political hara-kiri if her congressional allies allow a senate trial. The present composition of senator-judge will be a hung jury. The four impeachment complaints have strong evidence/s to pin her ASS down. Why Executive Order 464 was issued? The main purpose is to cover-up and suppresses GMA crimes against the Filipino people. EO 464 prevents government officials from attending congressional hearings. Gloria and Jose Pidal mafia family will use political power and money to junk any impeachment complaint. I think extra constitutional means is the last alternative in case all legal means are exhausted. Where’s Joc-joc Bolante?

  6. Even without impeachment, GMA has long shown to be unfit to continue serving the Presidency which she did not have in the first place. She will go down in history as the most unloved, disrespected and hated “President” this country ever had!

  9. lakay lakay

Simple lang naman, eh. Impeachment process should be allowed to run its course. If GMA is innocent(I hope and I pray hard that she is)then ALL Filipinos, ALL-including the present anti-GMA people, and I dare speak for the rebels, including the communist rebels, the Muslim rebels and the military rebels will rally behind her to once and for all push a real Philippines, Inc. for the long-dreamt of prosperity of our nation.

Enough of the cover-up! This is an appeal to Congressman Nograles and comrades in the House to let the impeachment proceedings take its own course.

  14. vic vic

Ms Arroyo has only a few options here. Let the impeachment proceeding takes its course, unpleasant it maybe, if she thinks the evidence too much for her to handle, resign or face the never ending coup attemps that could turn different from all the previous attempts, failed or successful.

  15. My brother who’s a consultant for several businesses confirmed to me the perception of the business community regarding the latest SWS survey on the credibility of the different agencies in government. If business has lost trust in the current dispensation, where else will this country go? To lose faith in who runs the country means that GMA has lost her presidency. Expect GMA to be holding an empty bag at the end of the day.

  16. jorgie jorgie

Unknown to many and the media didn’t play it for obvious reason, one reason why last year’s impeachment against GMA failed was INC’s behind the scene maneuver. I have kept this news clip from the PDI published last year. If it’s true, will INC repeat it this year? INC continues to support GMA and unless INC takes her hands off this time, impeachment complaint might not prosper again. Please read:

INC tipped balance for GMA, says solon

By Philip C. Tubeza, Gil C. Cabacungan Jr.
    Inquirer News Service

PRESIDENT GLORIA MACAPAGAL-ARROYO might have implored divine intervention in the most serious political crisis of her four-year administration but it was the hand of the influential Iglesia ni Cristo (INC) that ensured that the impeachment process would be decided in her favor, administration officials said yesterday.

Albay Representative Joey Salceda said the INC tipped the balance in favor of the President when the religious sect decided to flex its muscles and called on members of the House of Representatives whom its flock helped get elected in 2004.
“The Iglesia came in at a crucial moment last week by putting the brakes on the signature campaign (by the pro-impeachment camp) just when it was starting to snowball,” Salceda said.

The President’s economic adviser noted that the common denominator among those who were absent or those who abstained from the voting was their debt of gratitude to the INC.

“The (INC) helped her (President Arroyo) not once, but twice,” said Salceda in reference to the crucial role played by the sect in Ms Arroyo’s victory over the king of Philippine movies, Fernando Poe Jr., in the 2004 elections.

    Tears of joy

A Malacañang source confirmed the INC’s role in holding the fort for the President, who was grateful for the religious sect’s support.

“The President was brought close to joyous tears when she learned that it was Ka Erdie Manalo (INC’s spiritual leader) who was calling the lawmakers one by one,” the source said.

Salceda said that the INC was a prime believer in the status quo and that this was not an opportune time to be rocking the boat in the face of the crises facing the country.
But while the INC proved to be the President’s trump card, Salceda said the opposition should not look beyond itself for losing the impeachment battle because of their “big-ticket blunders.”

  17. Dominique Dominique

INC’s track record shows that they support whoever is in power that will serve their interest. It’s a religion of vested interest. Manalo supported Marcos, Estrada, and now Arroyo.

Ka Erdie manalo is no different from Eduardo Cojuangco, to name just a few.Actually the elites are like that. They will side with whoever they think will protect their interest.

  18. I doubt if it is just the INC, because the bigger motivation is MONEY especially because the majority of the tongressmen are not members of the INC.

Why should a non-INC tongressman for example listen to Manalo? I would not if I were a Congresswoman over there because I am not an INC and I would consider the meddling of this religious leader as impertinence.

It was actually the money being distributed by the Bansot even perhaps through Manalo that made these Congressmen not to join the Opposition last year. It is still the big consideration in fact. That is why Joe de Venecia came to Japan and insisted that the grant promised previous administrations to be given now thinking that the Japanese would be too easy to be convinced that now is the time to release those grants; that even when Japan decides to give goods instead of cash, they will be able to turn those police cars for example into cash—turn them perhaps into taxis that they can distribute to the tongressmen to do the selling of them on their own without being conspicuous as when the Bansot says they are going to be distributed to regions to fight communist insurgencies there.

I join this kind of egroups, but when I go to church and am within the walls of our church building, I forget the world outside. We don’t talk politics there; only things that pertain to our relationship with Our Heavenly Father and His Only Begotten Son, Jesus Christ. One thing good about our church is we abide by the rule about the separation of church and state although we are encouraged to do our duties and responsibilities even to the society to which we belong and move each day of the week, but we surely know how to separate our religious and secular activities indeed!

Filipinos, in fact, need some chastising. As long as they allow these evils to prevail even by their indifference and love for material things, they suffer the consequence of their follies. Otherwise, they would not be easy preys and easy to be convinced to ignore the law by supporting a lawbreaker to lead them.

OK, so Bansot thinks God blesses her, but she definitely is wrong, because what she gets are not hers to own as a matter of fact. What she has now are not blessings from Up Above but ill-gotten with the help of her fellow crooks in the government, and even by the ordinary citizens of the Philippines who are gullible enough to be convinced and persuaded to believe such spin as this role of Manalo in helping Bansot win over FPJ, or that this religious leader has been using his magic wan in convincing the tongressmen to continue to support the lawbreaker because he believes that this is “not an opportune time to be rocking the boat in the face of the crises facing the country.” Nice try!

We know now in fact the truth of what she did with the help of her appointees in the COMELEC, that she stole 1M or more votes from her opponents, for even in Tokyo we discovered that votes supposedly for FPJ and Roco were added to hers to make her look as the winner! I even got the hint that there were votes sent from the COMELEC with the added spin that they were supposed to be votes from voters here allegedly sent by mistake by the Japanese Post to the COMELEC.

Nice try, because that was unlikely to happen because there were return envelopes provided with the address of the Philippine Embassy or Consulate on them, and the efficient and conscientious Japanese postmen are not likely to send them to the COMELEC for that would mean additional postage!

The crooks are having their heyday now, but like the other men of their kind, they will have their due reckoning someday, if not soon. Perhaps, God wants Filipinos to learn from their present experiences to make them a better people.

Frankly, I don’t support Joma Sison’s armed revolution, but I cannot help agreeing with him in a way, for let’s face it. This struggle for what is right for the Filipinos, it seems, now requires the shedding of much blood, especially when we see a bunch of unscrupulous jerks like the Bansot and her minions branding their own kind of banality.

It’s tragic, but the last world war for example did a lot many people good. People of Japan, for example, learned a lot from that experience to try to achieve and preserve the kind of prosperity, peace and harmony that they enjoy.

Going to war is definitely not in their vocabulary, and reason why majority of us are literally fighting tooth and nail to preserve our present pacifist Constitution.

At least, they were not killing their own people then, but fighting a war with some foreign enemy that actually tried to subdue them even by some oil embargo unlike in the Philippines that is likely to become a killing field of Filipinos versus Filipinos. Heaven forbid! For me, that sucks indeed!

  19. GoogleMogul:

The Bansot and her minions are saying that there would not be any election in 2007 for Senators! Lagot! Hindi dapat iyan na mangyari!

I am for the amendment of the Philippine Constitution that was apparently done haphazardly and this government especially not having any intention to abide by it. There is no need for a charter change especially one done with the dictate of a lawbreaker who wants to stay in position permanently even as a queen, and definitely not one that will discriminate on the Filipinos this government does not even have the intention to provide with even a simple education!

Hindi nga iyan nakapasok sa UP in the 60’s kaya nagpunta sa Georgetown U na ipinagmamalaki niyang nagtapos siya doon when her actual record says she finished her undergraduate studies and got a diploma from Assumption College.

O baka naman magpagawa siya ng diploma doon sa Claro M. Recto to prove that she really graduated from Georgetown U, which was virtually unknown among Filipinos in fact at that time. Mas kilala pa nga ang Darthmouth College, which is now a university, as one of the Ivy League.

I understand that Clinton denied such relationship nor did he know a daughter of a Philippine president was studying there then!!!

Sorry, Ellen, may konting green as a friend described Bansot and Bill’s relationship to me!

  20. jorgie jorgie

INC claims they’re consistent in their choice and policy. They supported the midget as a senator, vice-president, then president. So, we can partly blame Manalo’s INC for the current sufferings of the people under this corrupt government. My source told me that INC was actually ready to endorse Ping Lacson but held on to this decision when FPJ suddenly declared his candidacy. INC was with the opposition ever since. Manalo was very upset with the death of at least two or three INC members during Edsa Tres’ May 1st riots. Manalo’s anger was even more when Gloria didn’t keep her promise to place Erap on house arrest. Also, INC’s doctrine doesn’t support a woman to be the leader. But, why the sudden turn around switching to this midget at the last minute. The one million INC votes certainly spelled the difference. The truth is and even this is acknowledged by many in the opposition…the midget won the election but by only about two to three hundred thousands votes. But the greed in her and in order to convince the people of her legitimacy, she wanted more so she targeted one million votes. Had INC supported either FPJ or Lacson, the midget could not win no matter how she tried to cheat. Remember Erap won by a wide margin despite attempts to cheat him and the attacks from Cardinal Sin and Erap’s foes. So, INC is the culprit including its influence in last year’s impeachment. This year, INC must stay neutral. More and more members are leaving and thinking of leaving because of Manalo’s politicking. No wonder ADD’s Bro. Eli Soriano is smiling these days.

  21. Ronnie Mabini Ronnie Mabini

    jorgie;

Ipagdarasal ko kayo GABI-GABI for your peace of mind!

  22. jorgie jorgie

The church, I mean the Catholic Church, has never been so involved in politics until this Sin came to being, though the church has been meddling even during the time of the Spaniards.

Of course ordinary Catholics and those who respected Sin are offended by my opinion. Pero iyan ang tutoo eh. Noon, kabarkada iyan ni Imelda. There was a video showing him laughing and clapping his hands in a lavish party with Imelda dancing. That was when they were still the best of friends. Knowing how generous Imelda was to her friends, we wonder how much gifts Sin received from her. As early as during the election campaign, Sin was already attacking Erap…attacking his character keso babaero daw, lasenggo at kung ano pa. Nanalo din siya bilang senador, vice president and then president.

In fact, Gloria gifted him with a diamond ring during his last birthday. At si elepanteng Mike Arroyo naman, in one media report as published in a paper with a photo taken, he gave Sin a check in the amount of one million pesos as a contribution to we don’t know what.

Isn’t that hypocrisy? But in fairness to the Catholic Church, ang ibang religious groups ay ganoon din. Mike Velarde at El Shaddai niya. Mike?

3 bishops slam attempts to buy off Church leaders

    By Christian V. Esguerra
    Inquirer
Last updated 01:44am (Mla time) 07/10/2006

PRESIDENT Gloria Macapagal-Arroyo has come under fire for allegedly trying to buy off bishops as they discussed a Church stand on a renewed opposition attempt to unseat her over unresolved charges she stole the 2004 election, a participant told the Inquirer yesterday.

The two-day annual plenary of the 124-member Catholic Bishops Conference of the Philippines (CBCP) closed yesterday. A statement on its decisions was expected today.

As the prelates sat down, Pope Benedict XVI sent a message of “spiritual closeness” that was regarded as sympathetic to the bishops who in recent weeks had come under criticism from Malacañang for allegedly violating the principle of separation of Church and state.

  24. goldenlion goldenlion

Adel Tamano that an impeachment process will clean gloria’s name in the 2004 election cheating scandal. IT WILL NOT!!.

I was shocked when I learned that the INC hierarchy endorsed the bansot for president. But to all Filipinos, don’t worry, Ka Erdie was not able to convinced his flock. The INC members did not vote for bansot. and I guess, Ka Erdie learned his lesson.

  25. Goldenlion:

I have it in good authority that INC members in Japan did not receive any instruction to register for the election in 2004. Kaya I doubt kung may bumoto sa kanila dito.

In other words, pinayagan naman yata ni Manalo na bumoto ang mga INC according to the dictate of their conscience; or, dahil nga sa walang endorsement para magparehistro sila ay hindi na lang sila bumoto!

Tricky pa rin ang dating! Masama iyan dahil parang pangloloko na, and no human leader of any sect or religion is immuned as a matter of fact to the enticing of the devil lalo na’t wala ang pag-iisip nila sa Panginoon, whose way is actually not our way, and will not in any way meddle or enter into dirty politics.

BTW, I found these quotes from the Bible and want to share them with those who oppose the filths in the present Philippine government that may serve to inspire them:

“Beloved, believe not every spirit, but try the spirits whether they are of God: because many false prophets are gone out into the world. Hereby know ye the Spirit of God: Every spirit that confesseth that Jesus Christ is come in the flesh is of God: And every spirit that confesseth not that Jesus Christ is come in the flesh is not of God: and this is that spirit of antichrist, whereof ye have heard that it should come; and even now already is it in the world. • • • We are of God: he that knoweth God heareth us; he that is not of God heareth not us. Hereby know we the spirit of truth, and the spirit of error. (Jn. 4: 1-3, 6)

iyong salitang pagmamaniobra ng eleksyon noong 2004 wala ba nakakapansin?pandaraya?pagmamanipula?rigged philippine 2004 election by congress?

    >Of course ordinary Catholics and those who respected Sin
    >are offended by my opinion.

“we thought it would end with the fleeing of the ousted dictator, Ali Baba, yet there are still 40 thieves around.” –masarap pakinggan diba?

Madalas siguro mag-poker sina Bro. Mike at Ka Erdy.

    jorgie:

Of course she would claim she was there in those places for prayer and spiritual advice.

Parang may connection di ba?

  31. Gloria Arroyo was asked today about the second impeachment complaint. her reply:”Only God can judge whether I am good or bad.”

That means, tayong mamamayang Pilipino ay walang karapatan. She thinks she is God’s favored creature.
