Update: Rep. Roilo Golez raises questions on “independent” panel investigating Alabang Boys bribery case.

I got a letter from a province mate, Restituto Tapacal, about the gang-rape and murder of a high school student which he said, “sent chills and shock to the peace loving people of Antique.”

Tapacal said the victim, a daughter of a prominent family in Antique was riding on a motorcycle with her boyfriend along the road in barangay Dalila early evening when a group of men hit them with a wooden club. “The boyfriend lost consciousness and the men grabbed the girl and brought her to ‘kampo”, an area adjacent to the police headquarters. The men took turns in raping her.”

While they were doing their evil acts, the girl’s cellphone rang. It was the girl’s mother asking where she was. One of the rapists even mocked the mother, telling her of what they were doing to her daughter, Tapacal related.

“The following day the girl was found dead in the said area, her head bearing the marks of having been hit with clubs, her face unrecognizable due to lacerated wounds on her cheeks inflicted by a sharp weapon, her body bearing all the signs of a violent beating, her organ slashed and stuffed with sand, plastics and pieces of wood.

“The father, upon learning what had happened to her daughter, suffered a stroke and died also.

“ Fortunately, the girl’s boyfriend recovered and made his way home to tell what happened to them in Bgy. Dalipe but didn’t know where they took the girl and what had happened to her afterwards. As of this writing, one of the suspects has surrendered, an 18-year old. The initial report stated that nine (9) men participated in the crime, now there are reports that as many as fifteen (15) men could have been involved. “

Antique is one of four provinces in Panay. Not as economically progressive as its neighbors Iloilo, Capiz and Aklan, the people are peace-loving and hard working. Tapacal said, “In my 39 years I have never known a crime more brutal that had ever happened in Antique since the murder of Governor Evelio Javier in 1986. Only people with sick and unstable minds or drug-crazed persons could have perpetrated such a horrendous crime.”

I talked with some friends in Antique and they said the reports said the perpetrators of the heinous crime were high on drugs.

Horrible acts like this by people under the influence of drugs should jolt those who feel indifferent to the issue of bribery in the justice department in the case of Richard Brodett, Joseph Tecson, and Jorge Joseph known as the “Alabang Boys”.

The three were arrested in a buy-bust operation by the Philippine Drug Enforcement Agency in September 2008 peddling Ecstasy and in possession of cocaine and marijuana.

The decision of State Prosecutor John Resado dated Dec, 2, 2008 (Information reaching the NBI P1.6 million was deposited in his bank account that same day) would have freed the three had it not for the insistence of PDEA that it should be subjected for review by the justice secretary.

A three-man panel headed by former Supreme Court Associate Justice Carol Griño-Aquino has started investigating into the “Alabang Boys” issue. The two other members are former Court of Appeals Justice Raoul Victorino and Fr. Ranhilio Aquino, who is identified in his placecrd as “PhilJa”.

PhilJa is Philippine Judicial Academy where Aquino once served as its chair, Jurisprudence and Legal Philosophy Department. PhilJa is a training school for justices, judges, court personnel, lawyers and aspirants to judicial posts.

A friend in the judiciary said Aquino’s stint in Philja didn’t sit well with many members of the judiciary because he is not a lawyer. “I understand he earned a degree in jurisprudence through a correspondence school,” a source said.

Aquino is dean of the San Beda Graduate School of Law. In one of the articles I found on line, his biodata says he is member of the International Criminal Bar.

I googled the International Criminal Court and he is not listed among those accredited in ICC. There’s only one from the Philippines: Harry Roque of the Center for International Law, University of the Philippines.

Among the articles I read about Fr. Aquino is his statements against the Catholic Bishops Conference of the Philippines for criticizing Arroyo. He had written an open letter criticizing the Senate for investigating the NBN-ZTE, where Gloria and Mike Arroyo were exposed to be cutting huge under-the-table commissions. He said the issue should just be left to the Ombudsman and the DOJ, known to be protective of people close to Malacañang.

Griño-Aquino and Victorino are respected in the judiciary community. The appointment of Fr. Aquino, however, in a panel that investigates a very delicate issue casts doubt on the sincerity of the government to fight illegal drugs..

    Sorry for the above error. The above incident has happened and is happening everywhere in the Philippines. Drug addicts have no mercy. They rape and kill. They are worse than drunkards. That’s why I won’t be surprised if the three Alabang Boys have committed similar crimes in the past but were able to get away with those.

    I was shocked to read this happened in San Jose. Had it not been written by you, I would not believe it..I could not identify where Bgy. Dalipe is so I called two friends and they too have heard the news..Now I know where it is..and I understand there are beer houses around there..and they also told me that some people got rich because of the business..but where was Inday Sally and what is she doing about the problem? Malungkot!

    Damn this Drug Crazed People! This is one reason why the Death Penalty should be reinstated, even only for the Drug Traffickers and Manufacturers. The Philippines has become a haven for drug manufacturing from the world over, because, they are aware that the Justice System can be bought, at worse, they would spend a short time in prison, and voila! They escape and have taken a flight out of the country. Especially the Chinese Drug Manufacturers, they come to the Philippines to manufacture “Meths”, simply because, if they are caught in China, they would be sentenced to death, via firing squad.
    Lim Seng, the notorious Heroin manufacture suffered this fate under the Marcos regime. This somewhat became a deterrent and sent a strong and chilling message to other
    would be drug manufacturers to stay away from the Philippines.
    Damn this Drug Crazy people! sorry have to open and close with similar statement.

    This is the most horrifying story I’ve read so far. It is so brutal. Its worst than animal.

    Our government is to be blamed for drug related crimes such as this.

    In Marcos’ time, drugs disappeared in the streets not only because FM had a drug manufacturer Lim Seng be shot by a firing squad in Intramuros. Drug pushers knew they will be punished by law if caught.

    “What if a drug pusher operates along our street ?” said GMA on the Alabang boys controversy.

    Death penalty won’t work because the corrupt judicial system will not allow the suspect to be convicted. Only the poor who cannot afford a lawyer and therefore poorly represented will be the ones to face the death row upon conviction. What about the rich pushers and manufacturers?

    After Lim Seng’s execution, drug cases declined dramatically under Marcos regime. At that time, the most commonly used was marijuana or Mary Jane that’s legal in some countries. Today, we can see all kinds of dangerous drugs. Do you know that a current cabinet member is a drug user?

    The body formed to investigate the Alabang Boys bribery case is composed of some questionable members. And why not? It was DOJ Raul Goonzalez who formed the body. As of this writing, it was learned that a Judge and three CA justices issued TRO in the Legacy bank scam despite knowing that such issuance was against a Supreme Court ruling. The House hearing is ongoing.

    I still think religion is remiss on the spiritual upbringing of the youth. I have been always drumming up on the door to door evangelists to meet more the kids who are the future dregs of the community raher than polarizing to us elders who may have already gone past the point of no reform anymore. Our government is inadequate with everything, even on law enforcement so anyone can just fool around in wild abandon.

    Usually a Judicial Inquiry, Coroner Inquiry, for Aid, Fact Findings or for any other purpose is headed and conducted by a singular head and that person alone assume all responsibility, the direction and conduct of his Inquiry according to his mandate and resources provided. That after wrapping up the Inquiry will submit reports and recommendations to the intended authorities.

    Drug menace is everywhere..just the other night, a woman was sexually assaulted inside the Bar when her drink was spiked with “date drug” but luckily the cops was able to published the image of the rapist retrieved from the security cameras and the rapist was charged immediately upon him surrendering. and usually the drug is just but another contributing factor to symptoms to the already worsening illnesses of the society…

    This headlines was about Bid-Rigging and the Government Pursuit of Justice for the last 8 years, but in some way failed to bring criminal charges to the perpetrators, but instead, successfully obtained civil judgment for damages, and even it is only the fraction of the cost of outside lawyers hired to (which was considered a big blunder, as the case was eventually taken by the government lawyers themselves)prosecute the case in civil courts, the government spokesman stated it is worth preserving the good Name of the Province and it can not be measured by the amount of Lawyers pay..yes, fight corruption and all misdeeds to the end, win or loss and let everyone know that noone will be spared…here is the story…it was an inside job, very hard to prove, but to give up is to accept Weakness and that is not acceptable.

  24. Once I read a counsel of a prophet of our church who stated emphatically that female members of our church should try to defend their honor even if they are killed or die in the process. I thought that was too much an advice, but when I started interpreting for rape victims in the police, I understood why.

    Over here, one thing investigators make sure to emphasize when in their reports to make a sure case is never allow the victim to admit that she has enjoyed it especially when the rape is repeatedly done for a certain period of time. Katwiran kasi, and the defense lawyers here in fact make a big issue and point of it during trial is whether or not the victim enjoyed it, too—something like what FVR and Manglapus had in mind, “relax and enjoy it.”

    That’s why I supported Nicole in her fight for her honor versus the horny US serviceman. Rape in fact is something not forgiven in heaven, for there is no retribution for lost virginity!!! Lalo na sa kasong ito na rape with murder. Over here, the penalty for sure will be death.

    I join Chi in her cry for death for the 15 rapists!!! There should be no excuse for them drug addicts!

    Is there any shred of doubt how insincere this “government” is to “fight” any illegal activities? It has an illegal president at its helm, surrounded by officers from the AFP and PNP, but definitely not gentlemen by any measure. This is country has too many sacred fattening cows; the media have their own untouchables, di ba?

    For as long as people have selective sense of who to condemn publicly, the public will always get what it deserves – leadership that reflects the core of its values.

    Over here, the police make sure in their reports to add that the victim has never enjoyed the act, for otherwise, if the rape is not established, there can be no indictment and the perpetrator cannot be tried criminally although the victim may try to sue him in a civil court.

    Problema sa Pilipinas, pag may pera naaareglo. Pati hustisya binaboy!

    Matagal nang maraming drug addict sa Pilipinas. 98% nga ng mga Japayuki na ipinapadala sa Japan, drogista—mostly shabu at marijuana, the shabu is for dieting and to stay awake. Iyong marijuana para daw bumalik ang gana. Both however are good for sex, sabi ng mga puta kaya sila gumagamit. Kahit pangit at mabahong hininga natitiis daw nila!

    Ang masagwa iyong mga gumagawa ng shabu sa Pilipinas, majority may political at police connection. Isang documentary na ako ang nag-translate ng interview sa Japanese, ang patron, mayor ng isang bayan sa Metro Manila kaya iyong mga TV crew na hapon nakaka-interview ng mga pusher, etc. sa Pilipinas. Ang laking padulas daw ang kapalit, kahati pa siguro iyong politiko.

    Kaya huwag na silang magmaang-maangan na wala silang alam!

    I forwarded the letter sent to me to other news editors. I don’t know why they didn’t follow it up.

    1.Secretary Raul Gonzalez should already decide on Alabang Boys case. He should not be influenced by the proceedings in the Independent Fact Finding body. Secretary Gonzalez should assume full responsibility for the review of teh resolution to dismiss case against the Alabang Boys and not wait the findings of the fact finding body.

    2. The fact-finding should not delve into the merits of te “Alabang boys” case because that is the exclusive domain of the DOJ secretary.

    The fact-finding should limit themselves, per AO 252 to “look into the conduct of the prosecutors in the handling and resolution of the “Alabang Boys” and to validate the findings of the NBI on the allegations of bribery…”

    3. Undersecretary Ric Blancaflor has not yet decided on our request for a waiver. He promised to decide ASAP.

    4.The DOJ has not yet exlained how a dimissed Philippine Tourim Authority attorney ended up being assigned with the prosecution task force.

    5. The fact-finding body has failed to explain why the double standard in treating PDEA officials (sent subpoena) and DOJ officials (only given mere notice.)

    Richard Brodett took the witness stand before Malacanang’s independent fact-finding panel and testified how “armed goons” beat up Jorge Joseph near his house in Ayala Alabang.

    He then told the committee how armed men in a white Isuzu Crosswind SUV chased him “recklessly” inside the village before catching up with him as he neared a village gate.

    Brodett said that after the Crosswind blocked his car, there was a hail of gunfire (“there were too many”) that led him to shout, “I’ll do anything you want.”

    He said he was dragged out of the car, hit with the butt of a rifle on his mouth that caused lacerations on both his upper and lower lips, slammed on his vehicle and was hit on his chest also with a rifle.

    ….Now, the drug addicts are turning the table on PDEA. The above version was obviously prepared by their lawyers. What’s next?

    Yung drugs, nine hours daw bago na-inventory. Baka na-contaminate daw, according to Felixberto Verano. Nice try. A la OJ ang depensa. Reasonable doubt, nga naman? Fine. But that is for the judge to decide (jury sa Tate). The case, however, must still be filed.

    Baka na-contaminate? Tanga. Hindi naman dugo, how can it be contaminated. What further inventory do you need, e nabilang na, 60 tabs, etc. etc.

    Presumption of regularity daw, sabi ni Resado, sa pag-dismiss. Gago. Wala bang presumption of regularity ang pagtago ng nahuling droga?

    Note, they never denied that drugs were in their possession. The alleged beating up is of no consequence, because there was no confession extracted. They were caught in flagrante.

    May kilala akong fiction writer. Anytime he wants, Felisberto Verano can hire him as a consultant. You never know; baka madaig nila si John Grisham. At 50 million pesos (1 Million US$) daig pa nila ang downpayment sa libro ni Bill Clinton.
