  2. Balik tayo doon sa order ko May 4, ito lang yata in Philippine history na pinost sa Internet. Yung mga bloggers medyo pilyo ito, sina Manuel Quezon III, si Ellen Tordesillas ng Malaya. Meron silang theory na kaya ko raw inisyu yan para ako mag-inhibit. Well, I would like to correct, although binasa ko ang blog ni Ellen Tordesillas, naiyak ako e. Kasi marami palang nagdadasal sa akin na pagpatuloy ko raw to. Kaya lang ang misis ko tinutukso ako kasi meron din doon ano ba yun, kaklase ko yata yung judge na nakikipagusap sa dewende.     does that mean that if Gonzalez launches (or continues with) into intemperate criticisms(never mind unfair because unfair may be seen as subjective) of Lorredo, i.e., abuse and slander of courts and the judge, the latter can cite Gonzalez for contempt?

    In such an event, will Lorredo have to file charges against Gonzalez or could he simply, from his bench, bang his gavel and cite the DoJ chief, for contempt?

    There is direct and indirect contempt. Direct contempt is in facie curiae; in your face, as the Americans say. That occurs when one is arguing before the Court. The citation here is immediate; pay a fine or go to jail. This is not appealable.

    What Raul Gon may be cited for is indirect contempt; for he is not before the Court. He will be asked to explain, why he should not be cited in contempt. That is what happened when he was cited in contempt by the Supreme Court, making statements in print media. He was made to explain, but, as the Supreme Court stated, he was unrepentant.

    Ignorance of the law? Yes, that is contumacious. Even if a judge were, in fact, a dumbkopf (like Miriam while in the RTC QC), you do not say that in public, because it undermines the confidence in the Courts. Besides, the Judge may be dead wrong on only that point, but correct in all the other decisions. The “quip” would undermine confidence, even on those other decisions.

    Consider, for instance, our loss of confidence in the Supreme Court, because of the Neri case. Now, all other decisions, even if correct, inspire diminished confidence. That was the pain that Justice Souter felt when the Supreme Court broke precedent and overruled a State Supreme Court’s (Florida) interpretation of its (Florida) own laws.

    Notice that it took years of the Cory Supreme Court to reinspire confidence after Macoy.

    This talk of “proper judicial demeanor” and fitness for the robe reminds me of an old Al Pacino film – And Justice For All.

    There are two judges, one eccentric one, who packs a pistol in his courtroom, and shoots blanks in the air when the gavel does not work. He eats his sandwich by the ledge, sitting precariously, watching the traffic below.

    The other judge is a stuffed shirt, exuding the air of all that is honorable and proper. Pacino is a public defender (PAO in the Philippines), who later is forced to defend the stuffed shirt he hates. The stuffed shirt is accused of rape.

    You know the ending, Pacino says “the prosecutor will not get this man, neither the jury. I will. My client raped and beat up this girl. You should stand for something you sonofabitch.”

    So who is the magistrate deserving respect? Teresita De Castro? Renato Corona? Miriam when she was at the RTC?

    Pacino was being forced to defend the stuffed shirt judge, although it was common knowledge that he hated the judge, to lend credibility to the defense. Parang asking Harry Roque to defend Pidal. High powered people were said to be exerting pressure. So he defends the judge. But one of the former clients of Pacino gives him evidence that the judge did it.

    So in the final scene, where lawyers are given the opportunity for an opening statement, Pacino gives that statement saying “ladies and gentlemen of the jury, people want to nail somebody here… the proscutor wants to nail a judge, the media wants the judge nailed…. But no, nobody will nail the judge. Why? Because I will….

    Bitin ang ending. Pacino is declared out of order and thrown out of the case. Apparently, he wanted to be thrown out, because in principle, he did not want to defend the judge. The ending scene shows his lawyer girlfriend leading the audience in a standing ovation. He rushes out to the steps of the courthouse, sits down, and stares out the streets, media cameras panning him. Fadeout.

    80s pa yon. So I’m sure there would be some old video available.

    And justice for all?

    Tapos the movie is about lawyers gaming the system. A public defender who does corporate work on the side, so has no time for his public clients. One client (a transvestite prostitute) who was deathly scared of a day in prison, commits suicide, because the public defender was late in court, to move for bail. A judge in the pockets of corporate money, etc. Pacino, a principled public defender, as well as his friend. His friend suffers an emotional breakdown because the client the friend defended, who was of murder, after he was released, did it again.

    There is that scene where the friend, obviously drunk, asks Pacino. I did a good job right? Brilliant defense right? I’m a goddam good lawyer right? Pacino says yes, yes. Friend breaks down and says, the guy did it again. This time, a six year old kid.

    This, and the 70s classic “Paper Chase” are what inspired me to take up law. Before that, I thought, What? Another four years?
