Ombudsman clears Comelec.So, what’s new?

(Following is the story of Peter Tabingco of Malaya on the Ombudsman’s clearing of the Commission on Election on the P1.3 billion computer scam. Last July 4,(click here) Malaya came out with are report that there was a June 28, 2005 report recommending indictment of all the Comelec officials involved inthe anomaly including Chairman Benjamin Abalos.The Ombudsman later came out with a decision to put all the blame on Commissioner Borra, an incredulous decision. Now, they reversed themselves and cleared all.

(We are not surprised that Ombudsman had to clear Abalos. He has to be rewarded for his role in making Gloria Arroyo the winner of the 2004 elections even if she was not elected by the people. Payback continues….)

THE Office of the Ombudsman yesterday dismissed all criminal and administrative charges against officials of the Commission on Elections, executives of the Mega Pacific eSolutions Inc. (MPeI) and technical experts from the Department of Science and Technology in connection with the P1.3 billion poll automation deal nullified by the Supreme Court in 2004.

In a 52-page resolution, the anti-graft body reversed its ruling dated June 28, 2006 that recommended the indictment of five Comelec officials and eight MPeI executives for graft and the filing of impeachment charges against Comelec Commissioner Resurreccion Borra.

The panel of investigators headed by Overall Deputy Ombudsman Orlando Casimiro said it “cannot find an iota of evidence to show that the acts of BAC (bids and awards committee) in allowing MPC (Mega Pacific Consortium) to bid and its subsequent recommendation to award Phase II Contract to MPC constitute manifest of (sic) partiality, evident bad faith or gross inexcusable negligence.”

“The finding of probable cause must …be supported by a clear and convincing evidence of malice, bad faith, bribery, manifest impartiality, unwarranted benefit and undue advantage. In this case none has been presented,” it added.

The latest ruling is also in sharp contrast to the June 23, 2005 resolution by a panel of Ombudsman graft investigators that recommended the filing of impeachment complaints against Chairman Benjamin Abalos and Commissioners Borra, Mehol Sadain and Florentino Tuazon on the grounds of graft and corruption and betrayal of public trust and held retired Commissioners Luzviminda Tancangco and Pablo Ralph Lantion liable for two counts of graft each.

An investigation has been ordered regarding the identity of persons responsible for releasing the 2005 resolution which the Ombudsman said was unauthorized by the Office of the Deputy Ombudsman for Luzon to which it was submitted.

“This incident must not be left ignored as it served no other purpose but to undermine the processes undertaken by this Office. In view whereof, this Office hereby refers this matter to the Internal Affairs Bureau for investigation and imposition of appropriate sanction on the persons responsible,” the Ombudsman said in the resolution.

The reversal was recommended by a special panel created by Ombudsman Ma. Merceditas Gutierrez and chaired by Casimiro.

Casimiro’s panel held 12 public hearings from July 13 to August 23, 2006, and invited resource persons and experts to testify on the ‘legal, financial and technical aspects of the MPeI contract.

Among its findings were that “the bid offer submitted by the Mega Pacific Consortium was the lowest and most responsive”; that it “provided for a nationwide coverage”; that the automated counting machines (ACMs) “passed mandatory key requirements when tested by the DOST with a 100 percent accuracy rating”; and that “there was no overpricing” since MPC’s bid is less than the agency cost estimate.”

The June 28 findings recommended that graft charges to be filed against Borra, Eduardo Mejos and Jose P. Balbuena Jr., Lamberto Llamas, Bartolome J. Sinocruz and Gideon de Guzman, members of the bids and awards committee.

It also recommended the further investigation of Abalos and the rest of the election commissioners and the filing of criminal charges against MPC officials Willy U. Yu, Bonnie Yu, Enrique Tansipek, Rosita Y. Tansipek, Pedro O. Tan, Johnson W. Fong, Bernard L. Fong, and Lauriano Barrios.

The Casimiro panel declared that “(n)either was it established that an unwarranted benefit, advantage or preference was extended to MPC or MPeI by BAC in the exercise of its administrative function in the determination MPC’s eligibility and subsequent recommendation made to Comelec.”

The resolution was submitted in compliance with the high court’s September 30 deadline for the Office of the Ombudsman to complete its investigation to determine the liability of Comelec officials and other individuals involved in the voided contract.

Comelec spokesman James Jimenez said the poll agency was vindicated with the Ombudsman report.

“This is what we have been saying all along, that there is no irregularity (in the acquisition) of the ACMs,” Jimenez said.

He also expressed hope that people will take time to read the decision to fully understand the findings of the investigation because it is “important for them to know the truth.”

Asked what will happen to the ACMs, he said they still do not know because it is already too late to use them for the 2007 elections.

He added they will wait for the Supreme Court’s decision before planning their next move.

“We’re tempering our enthusiasm as we will wait on what SC will say,” he said.

The case started on Oct. 29, 2002, when the Comelec adopted Resolution No. 02-0170 for the modernization of the 2004 elections. In January 2003, President Arroyo authorized the release of P3 billion for the modernization program for the elections in 2004.

On April 15, 2003, the Comelec, in an en banc resolution signed by Abalos, Javier, Tancangco, Lantion, Sadain, Borra and Tuazon, awarded the contract to Mega Pacific Consortium to supply the automated counting machines for purposes of the modernization program.

On Jan. 13, 2004, the Supreme Court invalidated the contract due to the failure of the Comelec to observe the bidding procedures provided by law. – With Gerard Anthony Naval

    On the failure to “find an iota of evidence” – the investigators suddenly looked for proof of reasonable doubt, whereas what they should be looking for is mere probable cause. Proof beyond reasonable doubt is for the courts to decide.

    On overpricing – Mega Pacific had the lowest bid! And its “overpricing” of PCs is no different from the “overpricing” done by contractors on supplies in constructions. In other words, putting a premium on supplies is hardly surprising, and should be expected.

    On Mega Pacific being a new company undercapitalized – Mega Pacific is a consortium. Mega Pacific the corporate entity may be young, but its members are respected key IT suppliers and service providers. The members had to form a consortium because no single supplier/service provider can put forth a quality bid; an aggregation of different vendors is needed to come up with a unique solution.

    Why am not surprised at all! This is another exercise in futility, of course in the regime of illegitimate Gloria. And lets us leave it at that, to make us feel good -Gloria is illegitimate occupying our house. We lost again and nothing can be done about it, but we all know the choices. Commission on Elections, Mega Pacific and automation of voting machines was with good intention at the very beginning. Yet, when it was very clear the popularity of FPJ among the populace will take him to Malacanang, the automation of voting of all a sudden got stopped in its track. It was deliberate and conspiracy written all over it. Hence, Hello Garci were put into place instead of the state-of-the art modern technology, automatic voting machines. We heard so many times – hello Garci! Now we know the rest of the story.

    Once again, Gloria’s laws has prevailed, and Philippines justice has to step back. Automation of voting machines was an indication of moving forward and progress, but we know illegitimate Gloria better than she knows herself. Fake Gloria would rather remain in reality a third world country and 2nd world on paper put out by Malacanang.

    P1.3 billion is lot of money just to find no one guilty of impropriety. We, the people are not that gullible and we know the real story of the voting machines and what happen to the money. We don’t need to hear it from Merceditas Gutierez, since she’s just fooling ownself. The joke is on you Aling Mercy, It doesn’t need to be said, but your conscience will, one day soon.

    According to The Daily Tribune, with regard to the announcement of “Ombudsman Merceditas Gutierrez…to determine if there is probable cause and said it finds no basis to indict Comelec officials on the contract originally turned down by former Comelec Chairman Alfredo Benipayo, citing overpricing.” However, “a Supreme Court official yesterday said, in explaining that the tribunal’s earlier ruling nullifying the multibillion-peso computerization contract stands despite the latest development on the issue.”

    What’s wrong with the picture? It seems to me like a classic case of a country whose institutions are falling apart! Worse than the aftermath of Typhoon “Milenyo”, this TYPHOON GLORIA HAS WREAK HAVOC ON THE COUNTRY’S INSTITUTIONS. It just doesn’t get any worse than this!

    THE noted French political historian, Baron de Montesquieu, once went to England where he paid tribute to its parliamentary form of government. But he declared that kind of system seemed fitting for the English, not necessarily for others because a nation’s government should reflect the peoples’ traditions, their land, their hopes and their aspirations. For France, the peoples’ desires rested on basic freedoms that should not be unduly curtailed by a dominant authoritarian ruler. He therefore advocated a form of government in France that would protect the diverse interests of the people and make tyranny impossible by dividing all the power of governance into the executive, legislative and judicial branches.
     

    This system is what we in the Philippines adopted. This presidential form of government has flaws, but the deficiencies are mainly in the implementation by men, not in the system itself.
     

    The Filipino desires to vote directly for the nation’s leader. It is his meaningful participation in government, and its exercise during elections gives life to the declaration that sovereignty resides in the people.
     

    He also wants freedom not just from a colonial master but from abuse and undue domination by our own government. That is why the Constitution has enshrined a system of checks and balances. This is because we are like the passengers in one big bus who rely on brakes being applied to make the journey safe. The legislature, composed of the Senate and the House of Representatives, enacts the laws, the executive enforces them. One has the power to investigate in aid of legislation; the other has the capacity to veto unwise legislation or specific items in the budget. As an additional safeguard, the judiciary possesses the power to review and declare an act unconstitutional or illegal for lack of or being in excess of jurisdiction.
     

    The challenge of Charter change (“Cha-cha”), if it is successful, may reverse this process. Instead of a rational division of powers, there will be a fusion of prerogatives in one body — the parliament. Its members enact, and they implement. No breaks, no safeguards. They enter into illegal contracts or borrow for questionable transactions, no deterrents. They change the economy or alter the rules, no impediments. They do something like the Venable contract that harnesses foreign funds to the prejudice of national interest, no obstacle — not even the Supreme Court’s power to review, because by then they will have defanged the Court of such power or relegated the same to a subordinate level as done in many parliaments. The Supreme Court will become less supreme, answerable to parliament. And if there is no impeachment now, there will likely be no impeachment for the interim assembly because they have already increased in their proposal the required number to impeach from one-third to a majority of members of parliament.
     

    When the prime minister commits a grievous wrong under a regular parliamentary system, an aggrieved member may file a motion for a vote of no confidence, and if the motion is granted and a majority vote that they no longer have confidence, then that prime minister has to step down and fresh elections are scheduled to determine who will lead the next government.
     

    But this is good in theory, not in practice. Because when a no-confidence motion is made, there usually follows a cooling off period of several days. Then political ploys come in. The grievous wrong is reassessed, hurt feelings are assuaged, new promises made and most likely the movant himself withdraws his motion. A sitting prime minister who knows his craft can hardly be booted out. He is the head of the executive and legislative. Under him, the body legislates and implements the laws, and dominates the judiciary. He approves disbursements of funds, makes appointments, exercises tremendous influence over members of parliament itself.
     

    The example of Thailand comes to mind. In spite of much unrest during his tenure, there did not arise a vote of no confidence against Thaksin Shinawatra — and the military had to oust him. Good for Thailand, they have a king and dedicated generals there. In the Philippines we may also have some dedicated generals but we have no king — which is a characteristic requirement of a parliamentary form of government: a monarch as in England, an emperor as in Japan, or a respected head of state as in India, to act as a responsible stabilizer in the wake of sweeping unrest.
     

    Changing the Constitution is more vital than just changing an important law. Because it will shape the future course of events, we should ensure that we meet the other requirements of a parliamentary form of government such as disciplined parties. We should not try to cure them after we shall have rushed to a parliamentary form, like prohibiting the transfer of a member from one party to another, because this remedy may clash with the basic freedom of an individual to choose his party.
     

    The other requirement for a successful parliamentary is a strong civil service because it is the civil servants who will carry on the business of government while changes in the prime minister and his Cabinet are being made. Do we now have a strong civil service?
     

    Finally, a healthy change needs deliberation. Our present Constitution requires the correct legal processes be observed and that a plebiscite be conducted before it is changed. If we change to a parliamentary system, parliament can change the Constitution again and again. It can change or remove the economic provisions, restrict or stifle accountability. It can even remove the plebiscite—because the essence of merging the three branches of government into one parliament will make that government a virtual dictatorship of a selected few.

    The Ombudsman’s decision absolving Commission on Elections (COMELEC) officials from liability for the voided P1.3-billion poll automation contract with Mega Pacific Consortium is a grand conspiracy to cover-up massive cheating in the 2004 presidential election. COMELEC Chairman Benjamin Abalos and Commissionaire Ressurection Borra may spill the beans if they are not fully protected by Gloria Arroyo and Jose Pidal crime family. The Ombudsman has recommended the impeachment against Commissioner Ressurection Borra. WHY the unexpected 180 degrees turn? The Senate Blue Ribbon Committee and the Supreme Court had established an anomalous transaction between COMELEC and Mega Pacific. It’s impossible that the findings of the Senate and the Supreme Court are both wrong and lack proof of guilt. She is the first woman Ombudsman and the first to reverse Senate and the Supreme Court findings and ruling. Lutong Malacanang-Macao!

    The appointment of Merceditas Gutierrez to the Office of the Ombudsman is purposely to protect Gloria Arroyo and her cohorts from crime against the Filipino people and the State. The Ombudsman can no longer be trusted under the corrupt and illegitimate Arroyo regime. What transparency and accountability? GO TO HELL Merceditas Gutierrez! EAT YOUR OWN WORDS!

    Natawa ako sa sinabi ni Cong. Joel Villanueva na para raw lumalabas na merong krimen pero walang kriminal! E di nga ba sabi ng Supreme Court sa Ombudsman “to determine the criminal liability, if any, of the public officials (and conspiring private individuals…” dahil malinaw na pinalitan ng Comelec ang bidding rules in the middle of the bidding process.

    According to Casimiro:

    Let’s revisit the Supreme Court decision:

    PANGANIBAN, J.:
    There is grave abuse of discretion (1) when an act is done contrary to the Constitution, the law or jurisprudence; or (2) when it is executed whimsically, capriciously or arbitrarily out of malice, ill will or personal bias. In the present case, the Commission on Elections approved the assailed Resolution and awarded the subject Contract not only in clear violation of law and jurisprudence, but also in reckless disregard of its own bidding rules and procedure. For the automation of the counting and canvassing of the ballots in the 2004 elections, Comelec awarded the Contract to “Mega Pacific Consortium” an entity that had not participated in the bidding. Despite this grant, the poll body signed the actual automation Contract with “Mega Pacific eSolutions, Inc.,” a company that joined the bidding but had not met the eligibility requirements.
    Comelec awarded this billion-peso undertaking with inexplicable haste, without adequately checking and observing mandatory financial, technical and legal requirements. It also accepted the proffered computer hardware and software even if, at the time of the award, they had undeniably failed to pass eight critical requirements designed to safeguard the integrity of elections, especially the following three items:
    They failed to achieve the accuracy rating criteria of 99.9995 percent set-up by the Comelec itself
    They were not able to detect previously downloaded results at various canvassing or consolidation levels and to prevent these from being inputted again
    They were unable to print the statutorily required audit trails of the count/canvass at different levels without any loss of dataBecause of the foregoing violations of law and the glaring grave abuse of discretion committed by Comelec, the Court has no choice but to exercise its solemn “constitutional duty” to void the assailed Resolution and the subject Contract. The illegal, imprudent and hasty actions of the Commission have not only desecrated legal and jurisprudential norms, but have also cast serious doubts upon the poll body’s ability and capacity to conduct automated elections. Truly, the pith and soul of democracy — credible, orderly, and peaceful elections — has been put in jeopardy by the illegal and gravely abusive acts of Comelec.

    Panganiban also discussed in detail how Borra and Abalos admitted in open court that the software that was tested was a mere “demo” version and that the final error-free code would still have to be written, if they will be able to, that is, in clear violation of its own rules.

    Pero Ellen, lahat na lang ginagawang inutil ng gobyernong ito. Pati ba naman Supreme Court malinaw na na-rebuke sa kasong ito. Kulang na lang murahin ni Panganiban ang Comelec sa pinag-gagawa nila, kaso nga lang, nagbigay respeto pa sa Ombudsman na naatasang alamin kung merong criminal liability, ayun, ginamit ang desisyon nila mismo para sabihing nagkamali sila. Kung alam lang ni Panganiban at Hilarious Davide na magkakaganito lang, siguro sila na mismong dalawa nagfile ng kaso sa Comelec. Hmmph! Pag hindi ka marunong sumunod sa Malakanyang, siguradong hihiyain ng mga uod na sumususo sa mga dipungal na mag-asawang Baboy.

    At hindi basta-bastang pang-gagago, pambababoy, o panlilinlang lang itong ginawa ng Ombudsman, pagkatapos pinaghintay ang SC ng matagal bago naglabas ng “partial recommendation” tungkol sa pagpapa-impeach kuno kay Borra, at pag-file ng kaso sa 5 pang iba sa Comelec, pati na yung mga may-ari ng Mega Pacific, eto’t pinawalang-saysay pa at inabsuwelto lahat ng dapat sanang sumabit.

    Hindi lang pala mapurol na ABOGAGA itong si Mercenary Gutierrez, reyna pa rin pala ito ng mga SIRKERA. Lintik kung tumambling! Klasmeyt yata ‘yan ng ABOGAGONG si Baboy.

    i’m seething with anger hearing the news of the ombudsman decision to reverse the june 28 report of field investigator, atty. roxas finding probable cause for criminal liability for graft against the comelec commissioners and officers of mega-pacific on the botched deal. i could not secure a copy of the decision and i will make further comments later after i have read the entire decision of reversal.

    since the SC invalidated the poll automation contract, the ombudsman took their own sweet time in complying with the court’s order for them to determine the criminal liability of those involved in the transaction “if any”. that june 28 report was only to appease the SC and the beat the june 30 deadline set against them.

    that it took the ombudsman that long to complete their investigation only reinforce the suspicion that they are indeed cooking something to exonerate all those involved in the contract deal denominated by no less that the SC as “illegal”.

A wise leader will not impose a system on his people that he/she does not even have the brain to know whether it will work or not as in the case of this Bansot whose aim in imposing this ChaCha is for her to have full control to declare the Philippines as her own personal property that she can head as a queen with her Fatso husband as her Rasputin.

    It is actually not a solo-flight decision that the Bansot for instance can impose on the Filipinos with the help of some asslickers who hope to profit personally from it like this crook of a politician whom a lot many Filipinos must be fed up by now if not for the money that he rolls around.

    Yup, I mean Joe de Venecia, whom I am told made a fortune during the Marcos administration with his operation of the recruitment of Filipino workers to KSA, and reason for why this guy leads the wannabe recruiters in the Philippine Tongress in pushing for institutionalizing the exportation of Filipino workers overseas as Super Atsoys/Atsays and Super Tapu/Topu. Otherwise, Filipinos who cannot get out of the poverty in the Philippines just resort to selling their organs as in the case of slum dwellers who now make it their means of livelihood the selling of organs even of their young children being allegedly recruited to come to Japan, etc. as donors for kidney transplants.

    Tangna wala na bang katapusan ang mga kahayupang ito?

    On the other hand, I find it amazing that God would preserve the organs of the least privileged who have healthier organs it seems but not to sell for sure, for there must be an infinite valid reason why we have organs the way they have been placed there in our bodies not to be tampered with by silly and selfish men.

    Nurses, Erap kay GMA: Re-take din sa eleksyon

    Iginiit kahapon ng mga nakapasang nurse sa pinakahuling licensure examination na yamang nagmamatigas si Pangulong Gloria Macapagal-Arroyo sa desisyong ipa-re-take ang naturang pagsusulit, dapat din umanong mag-re-take sa eleksyon ang Pangulo dahil tulad ng kanilang pagsusulit ay pinagdududahang may naganap na dayaan noong May 2004 elections.
     

    Ayon kay Sen. Panfilo Lacson, nakausap niya ang mga pumasang nurse at ilang grupo ng mga kabataan sa Bohol noong nakaraang linggo at galit umanong sinabi ng mga ito na hindi katanggap-tanggap sa kanila ang nasabing desisyon.
     

    Bukod sa dagdag gastos ito dahil kailangan pa nilang lumuwas ng Maynila o magtungo sa Cebu para kumuha ng ganitong pagsusulit, hindi umano maganda ang impresyong ibinibigay ng re-take dahil pinalalabas dito na ‘guilty’ silang lahat sa paratang ng pandaraya.

    Kahapon ay kinumpirma ni Executive Sec. Eduardo Ermita na ibababa ng palasyo ang isang executive order (EO) na magsasapapel sa tunay na posisyon ng palasyo sa isyu ng re-take at kung sino ang dapat na kumuha nito kung sakali.
     

    Aminado si Ermita na maaaring mapangunahan ng naturang EO na ilalabas kundi ngayon ay bukas ang desisyon ng CA.
    “The spirit is whether what are the rationale for the decision to have the re-take or not to have the re-take. Kaya makikita n’yo kung ano ba ang pagbabasehan ng desisyon ng Presidente. Titingnan natin kung re-take or no re-take,” anang kalihim.
     

    Para naman kay dating Pangulong Joseph Estrada, hindi katanggap-tanggap ang re-take sa nursing licensure examination at nahiling nito na sana ay pinag-isipan muna nang husto ang desisyon bago ibinaba.
     

    Sa isang text message na ipinadala ng abogado ni Estrada, si Atty. Rufus Rodriguez, sa media ay sinabi nitong kung isinusulong ang re-take sa board exam alang-alang sa katotohanan, dapat ding ikonsidera ng Pangulo ang pag-re-take sa eleksyon.
     

    Kung ihahambing umano ang sinasabing leakage o dayaan sa naturang pagsusulit ay napakaliit na kasalanan nito kumpara sa pandaraya sa eleksyon para lamang kumapit sa kapangyarihan at ang biktima pa umano ay ang kanyang kaibigang si yumaong Fernando Poe Jr., anang text message.

    Mistulang tuluyan nang sumabog sa mukha ni Pangulong Gloria Macapagal-Arroyo ang isyu sa retake ng nursing board examination makaraang kuyugin ito ng reklamo hindi lamang ng mga apektadong examinees kundi maging ng oposisyon.
     

    Kahapon, pinagre-retake ni Sen. Panfilo “Ping” Lacson si Mrs. Arroyo para matuldukan ang ginawang pandaraya noong 2004 national election, katulad ng rekomendasyon nito sa nursing board exam.
     

    Ayon kay Lacson, founder ng Unlad Pilipino, walang ibang guilty at may hawak ng rekord sa pinamalaking pandarayang naganap sa kasaysayan ng Pilipinas kundi si Mrs. Arroyo, partikular ang pagnanakaw sa kapangyarihan noong 2004 national election.
     

    Sa Youth Convention na ginaganap sa Bohol, dinagsa ng reklamo si Lacson tungkol sa retake policy ni Mrs. Arroyo, kaakibat ang alegasyong umaastang hudikatura ang Presidente at pinangungunahan ang desisyon ng korte.
     

    Kung pinagre-retake ni Mrs. Arroyo ang mga nursing student bilang solusyon sa nangyaring leakage o dayaan sa pagsusulit, higit aniyang may karapatan ang mga kabataang humingi ng Special Election upang magkaalaman kung sino ang nandaya noong 2004 national election.
     

    “There should be a presumption of innocence. Yet, those who passed the examinations feel they are being treated as if they were guilty. Many of them were even saying, what about Mrs. Arroyo? Should there not be a ‘retake’ of the 2004 elections?” ani Lacson.
     

    Tanging Court of Appeals (CA) lamang ang may kapangyarihang maglabas ng desisyon tungkol sa retake policy ng gobyerno, ayon kay Lacson, kaya’t sablay ang muling pakikialam ni Mrs. Arroyo sa kapangyarihan ng hudikatura.
     

    “The Court of Appeals has not issued any decision on the matter, yet Malacañang already made a decision. Why is it preempting the judiciary? Does it feel it is above a co-equal branch of government?” ani Lacson.
     

    Dobleng pasanin sa balikat ng mga estudyante at magulang ang retake na itinutulak ni Mrs. Arroyo, ayon kay Lacson, dahil malaking gastos ang inisip ng palasyo at lumalabas pang pinapaamin sa pandaraya ang ibang estudyante gayong hindi naman lahat nakinabang sa leakage ang mga ito.
     

    “They are crying foul because even if they did not cheat, they will be made to spend anew for the ship fare to Manila, the review, and board and lodging and other expenses,” ani Lacson.
     

    Kaugnay nito, mahigit dalawang daang nursing graduates ang nag-rally kahapon sa harap ng tanggapan ng Professional Regulation Commission (PRC) upang iprotesta ang retake policy ni Pangulong Arroyo.
     

    Hindi matanggap ng examinees ang biglang pagbabago ng desisyon ni Pangulong Arroyo at kinukuwestyon ng mga ito kung sino ang nagsulsol dito para baguhin ang naunang posisyon na hindi magkakaroon ng retake.
     

    Anila, nais nilang maparusahan kung sinuman ang promotor ng leakage subalit hindi makatarungang idamay silang mga nakapasa na hindi naman nandaya.
     

    Kinuwestyon din ng grupo ang desisyon ng Malacañang na anila’y pinangunahan pa ang paglalabas ng desisyon ng CA.

    Another terrible blow was dealt to justice today, this time courtesy of the Ombudsman. Like a bat-wielding banshee, the office of the Ombudsman declared that there was no one to blame for the Mega Pacific scam, absolving the COMELEC and the rumored to have filed for dissolution, eleven day old (at the time of bidding) company of any wrongdoing.

    “This is a travesty of justice! This is like saying a rape was indeed perpetrated, but there was no rapist”, declared Enteng Romano, lead convenor of the Black & White Movement. “The Ombudsman has committed grave abuse of discretion, not even bothering to point us in the right direction. Who shall we hold accountable?”

    “This sad act has made the Ombudsman seem to be as dirty as the COMELEC is perceived. If the COMELEC believes it has been vindicated, it is sadly mistaken. First, Cha-Cha, now this. We hope our people see just how much injustice is being done to us”, said Leah Navarro, Black & White spokesperson.

    The Supreme Court was clear, and we quote – “Truly, the pith and soul of democracy – credible, orderly, and peaceful elections – have been put in jeopardy by the illegal and abusive acts of the COMELEC.” And what shall become of these “illegal and abusive acts”? Will these abuses be relegated to our nation’s dimming memory? We pray our nation will not stand idly by.

    The Black & White Movement condemns in no uncertain terms this obvious whitewash. In making this decision, the Ombudsman has proven that the people no longer have any where to turn for succor or assistance. Along with a few others, this institution has gone from the heights of probity to the bowels of infamy.
