    In an interview with radio dzBB, Fr. Joaquin Bernas, who was a member of the 1986 Constitutional Commission, blasted House legislators allied with President Gloria Macapagal Arroyo who insisted on passing the measure allowing for a Senate-less constitutional assembly.

    “Kasi pinaglalaruan nila ang Saligang Batas at pinaglalaruan nila ang tao [They are toying with the Constitution. They have been fooling the people],” said Bernas, who is dean emeritus of the Ateneo de Manila Law School.

    Bernas also echoed Nueva Ecija Rep. Eduardo Nonato Joson’s opinion that the approval of the measure was like “gang raping” the Constitution.

    Asked how the public should react, Bernas’ reply in Filipino was, “Magalit (Be outraged).”

    I don’t remember the imposition of martial law per se. I was not in Grade 3 pero not far. first year high school yata ako noon.

    All I could remember overall was that Manila was clean! Haha! And of course that two of our closest family friends were nadampot — Max Soliven and Louis Beltran; the Dad of Tommy and Boyet Joson had to pledge allegiance to Marcos. And then later on, one of Dad’s closest friends from the Tanada family was missing and a few other things.

    Also remember the Delgado brothers (who owned Hilton then) were very happy with the way the things were going. I also remember seeing Pilar Pilapil drunk and was making a scene (didn’t know she was a famous actress until then) at a party that Dad and Mom were attending, with me in tow, because Doy Laurel was with another girl.

    My best souvenir was meeting Dame Margot Fonteyn in a Malacanang party during Martial law.

    These are some of the events that marked me during Martial Law.

    The development is clearly alarming following unveiled plans that GMA plans to run for Congress in Pampanga by 2010 paving the way for her to hold real power come 2010 as prime minister.

    “We woke up to a nightmare made by Gloria and her paid cronies in Congress (Kaya paggising natin bangungot pa rin ang kinamulatan natin na gawa ni Gng. Gloria at ng kanyang mga kawatan),” Ejercito said.

    Charter change resolution questioned at SC

    Two lawyers asked the Supreme Court on Wednesday to nullify House Resolution 1109, which seeks to convene lawmakers into a Constituent assembly, even without the approval of the Senate.

    In their four-page taxpayer suit, lawyer Oliver Lozano and his daughter, lawyer Evangeline Lozano, said HR 1109 was railroaded by the House of Representatives to extend the term of President Gloria Macapagal-Arroyo beyond 2010.

    “The railroaded HR 1109 is unconstitutional or bogus for deviation from the prescribed procedures to amend the Constitution by excluding the Senate of the Philippines from the complete process of proposing amendments to the Constitution and for lack of thorough debates and consultations,” the Lozanos said.

    “The nullification of HR 1109 will refocus the nation’s attention to find alternative solutions to the economic crisis, poverty, hunger and rebellion… Wherefore, it is respectfully prayed that HR 1109 be nullified in the interest of public welfare,” they said.

    Speaker Prospero Nograles is the lone respondent in the petition.

    Arroyo’s allies in the House of Representatives passed HR 1109 in a marathon session on Tuesday night.

    They want to bait the opposition in filing a petition to decide the voting. Okay lang, papatulan ko yan. Puwede silang paunlakang. The issue, however, will be limited – whether or not business can be conducted while the Congress is adjourned sine die. The petition will not even touch on the issue of voting, because that is not in controversy.

    Puwedeng i-cite diyan ang Guevarra v. Inocentes, where the Supreme Court cited the following statement:

    Mr. MACAPAGAL . . . Since the Senate has, by its own responsibility, adjourned one and a half hours ago, therefore, under the present facts, in our Constitution this House is automatically adjourned, and therefore it is improper and illegal for us to continue the proceedings farther.

    Mayroon pa yatang hindi napasama sa listahan ng signatories dyan sa alphabetical order. Hindi nabasa ang pangalan nina Roque Ablan, Mark Cojuangco, Leandro Mendoza, among others while their names appeared in the HR 1109.

    Sa mga nasa probinsiya at distrito, dapat tandaan ang inyong “magigiting” na kinatawan who signed the resolution sa kanilang katakawan. Ikalat, itawag, i-email, i-text ang kanilang pangalan. Manghingi ng balato sa kanilang P20M at mga darating pang pabuya mula kay glorya. Glad to say, our congressman, Rep. Erin Tanada of Quezon 4th district is not among them.

    Puwede ring pabayaan na lang. Let the House discuss themselves hoarse, and come up with proposed amendments. There will be no controversy until they vote.

    In fact, even before the vote, there will be no justiciable controversy, because no rights will be in danger of violation. The justiciable controversy only occurs when there is implementation, or pending action on the amendments. That comes when the amendments are presented to the people for a vote.

    But, to put it to a vote, there is a need for ordinary legislation. That is where the Senate comes in; and there is no way to bring a justiciable controversy here; because it is the absolute prerogative of the Senate to determine its business. So they can sit on the legislation to put the amendments to a vote.

    Too bad. The twenty million becomes an accounts receivable, not cash on hand.

    Throwing a party for no reason and inviting only the host

    by Makati Rep. Teodoro L. Locsin Jr.

    BECAUSE this is just a resolution, the House will vote by mere yells of yeas and nays. In the tumult, the public and the press may mistake who voted for and against it. Make no mistake RONNIE ZAMORA AND I are voting NO because we have kept our wits about us unlike the others who have lost all of theirs. For this resolution convenes only the Lower House of Congress as a constituent assembly to “consider,” as the Constitution puts it, constitutional amendments that no one has proposed, do not exist, and therefore cannot be considered.

    This strictly House only resolution is like sending out an invitation to a party to which the host has invited only himself.

    This is also like sending out an invitation to a party on no definite date for no stated occasion other than the host throwing a party for himself by himself. On top of which, the host—Rep. Luis Villafuerte—has cancelled the party and withdrawn the invitation though some—how shall we call them?—housebreakers, I suppose—have decided to go on with the party.

    This is a resolution calling for the convening of the Lower House of Congress as a constituent assembly the day before it adjourns. This is like sending out an invitation to a party on no date, for no stated occasion, while announcing that the host is leaving for a long vacation abroad.

    It is said that this invitation to a party inviting only the host is intended to provoke a reaction from those not invited.

    Whoever came up with this idea of a party has no idea about throwing a party except what he might have learned from the videos of the parties that Hayden Koh threw where he was both host and sole party animal except for his unwitting partner. But Hayden Kho had an excuse. He was drugged. The question is under what kind of influence is this kind of party being thrown? In other words, nag-e-Ecstacy ba ang mga proponents of this House resolution and why are not they not sharing the joy?

    It is said that we must do this because, unless we throw a party for no reason inviting only ourselves, we will never know for sure if such a party can be thrown?

    But how will we know? We are sure to be ignored by those we did not invite even as we will be ignored by the social arbiter to which we are appealing on this score.

    I submit that the Supreme Court and the country as a whole will ignore us—and then laugh at us all the way to the ignominious end of the 14th Congress. We shall be ignored as surely as we shall be laughed at.

    For this is a resolution calling upon the members of Congress but naming only the members of the House to convene constituently for no stated purpose. And yet the Constitution specifies that Congress may convene as a constituent assembly only for the purpose of considering—considering—not introducing let alone just awaiting—proposals to amend or revise the Constitution upon a vote of 3/4th of all the members of Congress. This resolution puts the cart before the horse because, there being no amendments to consider, there is no purpose to convene Congress as a constituent assembly.

    It is a blatant lie that this resolution reflected upon its introduction to the floor of the House a consensus of the House of a need to amend the Constitution because, aside from the Speaker of the House who filed his amendment to the economic provisions as a regular bill, no one has expressed any desire to change the Constitution or expressly specified in what particular respect.

    As for the lawyers among us who say they want to litigate this question, they will be provoking the Supreme Court to render what it cannot and will not—to wit, an opinion in no concrete case and controversy. These lawyer-legislator should tread carefully for the Court is liable to strip them of their license for trifling with the Court and the processes of justice.

    This resolution mocks the House and holds it up to ridicule. If anything, it is a fit subject not of a vote but an ethics investigation of the proponents of this measure for inviting the contempt of the nation upon our House.

    This is a venture which can be described by only one word that politeness forbids me to say.

    Bakit nagmamadali, kahit adjourned na? Because if they have amendments before the SONA, then they can attempt to force a vote on it by that date, because the Senate and House will be in joint session that day.

    Yan talaga ang plano. Kaya lang, dahil hindi pumayag ang Senate, that joint session convened is a regular session, not a session of the constituent ass-embly. An act of the Senate is required, to concur in the resolution to convene as a constituent assembly. Too bad, that can no longer be done, because they have adjourned.

    Also, they will be voting on proposals made while the Congress was adjourned, so the proposals legally, do not emanate from either the House or Congress as a whole, since, in legal contemplation, no business was had during the days of adjournment.

    Narrow pa rin ang magiging issue, Can the Congress vote on a legal nullity? Hindi pa rin magiging issue ang manner of voting, whether joint or separate.

    Gusto niyo ng mass action, fine.

    Since the politician’s have already started to do their rounds, why not initiate a people’s initiative, which will propose the following:

    1. No term extension may be proposed by a Constituent assembly. Term extensions may only be proposed through a people’s initiative.

    2. Any amendment to the Constitution by a con-ass will be made by a separate vote convening the con-ass, and a separate vote to adopt any proposal.

    That way, if the con-ass finishes its proposals, and the people’s initiative is also put on the table, there can be a petition before the Supreme Court to put the people’s initiative to the vote before the con-ass proposal, since it is a direct proposal of the people, and should take precedence over proposals of mere representatives.

    We keep talking of mass movements, etc. Let the so-called leaders, Erap, civil society, et al put their money where their mouths are, and move the people.

    It helps the Lozano petition, because there is an actual controversy. Lozano will pray that the convening be stopped, because it is a waste of money, it being invalid.

    The issue, however, also helps us antis, because the issue is narrowed down to whether or not to conduct business while Congress is adjourned.

    Nograles will try to worm in the issue of whether or not the vote to authorize is valid, there being no Senate participation, in a vain attempt to insert the issue of manner of voting. But the Supreme Court always decides on narrow grounds. If the issue of validity of business can be disposed of on the question of whether or not business can be conducted while in adjournment, there will be no need to decide the issue of whether the authorization is valid.

    Again, the issue, is, is the conduct of business allowed, regardless of whether or not the resolution authorizing it is valid. In fact, the validity of the resolution will be presumed, in gratia argumentis (fancy Latin term for “granting for the sake of argument”.

    It’s not the Fundamental Law that needs revising, it’s Congress itself.

From 2001-2007, it’s been long years my fellow pinoy never learned the lesson of electing their representativws of thier district,how many times impeachment been lodge from the time “FAKE”leader of the country took charge,they still insisting electing an official of capable of robbing,raping and make our country look the worst place to live in this planet.Probably the weakness of most our kababayan,are easy to corrupt,just because for a few pieces of paper w/ Ninoy faces they sold already their honor being a PINOY,or just for cans of sardines & a bag of rice just quenched thier hunger for a day or two,the cried of the whole country has been defied by these UNGAS and HUDAS voters,created more problems for the entire population.It look like a stupid guy pick up a piece of rock to hit his and cried it hurts. when our fellow countrymen will learned to elect thier rightful leader.

  73. Hindi pa rin sumasablay ang crystal ball ko. Alam kong designated hitman si Oliver Lozano kasi wala na naman siyang reputatsyong dapat alagaan pa. Note that he can only convince his daughter to join him.

    I’ve written on many walls in Facebook that the antidote is to make it appear that the Senate is “studying” the invitation but at the same time dragging their feet while doing so. In other words, IGNORE. I guess that message has reached many people and are concurring further that the Senate does not need to formally reply to the “invitation”, hence Lozano’s predictable response.

    The Senate must deliberate and think wisely. We should not push them to act or respond in a manner which we may regret later. Remember, the forces of evil have been planning this for years so let’s not be impatient if the Senate is not acting quick enough. Some foolish presidentiable, the likes of Villar or Noli, may start “playing to the audience” and though it may not be the best solution, they may be pushed into filing a TRO with the SC, which we need to avoid at the moment. Saxnviolins had explained it well enough.

    What we can do is organize our local groups and demand action against our congressmen who voted in favor of the resolution. We can also join the mass actions and hope there is enough logistics (and headcount) to counter-attack, as one proposed by SnV, to make a people’s initiative signature campaign which is an act of the sovereign and takes precedence over a mere resolution of one of the houses.

    That is our role at the moment.

    people of the Phils, wake up! All these years of GMA’s term was a complete nightmare for the people. And now, these filthy animals in the congress have pushed the conass without consenting their constituents. This is a complete deceit to the people, as we all know, majority of the Filipino people would not want the constitution to be revised. Letting this to happen would mean Arroyo’s term will be extended in some other ways. It’s about time to wake up fellow countrymen, we know times are hard right now but if we all come out to the streets and strongly condemn this conass, we and our children would benefit from it..
