Abalos: ‘Garci’ a thing of the past with reduced poll role of military

According to Benjamin Abalos, the next election will be clean with him and Esperon overseeing it.Ha!Ha!Ha!

COMELEC Chairman Benjamin Abalos yesterday said there would be no-repeat of the “Hello Garci” scandal in 2004 with the signing of a memorandum of agreement that would limit the role of the military in during elections.

“With the role of the military now well-defined…there’s going to be no Garci (controversy),” he said.

“May you (media) know that Garci is no longer with us so definitely there will be no more Garci. I don’t know if there is going to be ‘Hello Brownie’,” he said in jest, referring to Comelec Commissioner Romeo Brawner who was at the signing.

In the alleged conversations between former Commissioner Virgilio Garcillano and President Arroyo, current AFP chief Gen. Her-mogenes Esperon and now retired generals Gabriel Habacon and Francisco Gudani and Roy Kyamko were mentioned as having helped rig the elections in Mindanao to ensure Arroyo’s victory.

Gudani was mentioned as having helped the “other side.”

Abalos said it was time to end “this shabby and dishonorable action since the military has been dragged into this mess for a long time”.

“Kawawa naman sila (military),” he said.

The other signatories to the memorandum were Defense Secretary Avelino Cruz, National Movement for Free Elections chairman Jose Concepcion and Parish Pastoral Council for Responsible Voting chairman Henrietta de Villa.

Also present were other Comelec commissioners and AFP top officials led by Esperon.
The signing was held at the Wack-Wack golf club in Mandaluyong.

“This agreement is a big step toward insulating the military from politics,” said Cruz.

The four-page agreement says that the Comelec shall only deputize the military “in areas affected by serious armed threats to the electoral process.”

The armed threats would be identified jointly by the Comelec, DND and AFP.
The agreement defined “serious armed threats” as paramilitary forces, private armies or identifiable armed bands “widely perceived to have committed or is committing terrorism, fraud or other election irregularities and threaten or tend to disrupt the holding of free, honest and orderly elections in any political subdivision or unit or any part thereof.”

In areas where there are serious armed threats, the agreement said only the commanders, officers and enlisted personnel actually assigned in the area would be deputized.

“The Comelec shall designate the particular Comelec official responsible for said area covered by the serious armed threat from whom the deputized AFP commander and units shall get their instructions and assigned tasks exclusively during the period of deputation,” it said.

The agreement said the functions of the military personnel who may be deputized by the Comelec shall be limited to provision of security to the area covered by the serious armed threat through deployment of personnel to man, patrol and provide AFP visibility.

The agreement specifically cited the counting of ballots or canvassing of ballots and clustering of precincts as among the responsibilities that should not be performed by deputized military personnel.

It also said soldiers should not be transporting ballots, other election paraphernalia, and election results. It said soldiers may escort such transportation if security provided by the PNP cannot address the threat.

The agreement also prohibits soldiers from acting as security escorts to candidates and providing security to polling places and to members of the Board of Election Inspectors, Comelec personnel and other government personnel performing election duties, including the accredited citizens’ arm.

“In no case shall any counting and canvassing be conducted inside military camps, installations and facilities,” said the agreement.

Cruz vowed that soldiers who violate the agreement would be punished under the military justice system.
“Now, if there are critical areas where we (military) are needed, we are going to help but we are going to be far from the polling booths. We are not supposed to handle election paraphernalia,” said Cruz.

Cruz said the Comelec should be contracting vessels to be used in the transportation of election paraphernalia to far-flung areas like Sulu, Basilan and Tawi-tawi. “If there is a need to escort the vessel, we will provide patrol boats,” he said.

On his alleged involvement in the scandal, Esperon said: “Those are aberrations which remain to be charges and we will allow the investigating bodies to continue with that. I believe the appropriate agencies have taken cognizance of that. In fact, as far as I know, the House of Representatives has terminated its investigation on this.” – Gerard Naval and Victor Reyes

The crocks at the provincial and local levels are still manning their outposts. What revamp? Most of the rank and file Comelec employees are political appointees or recommended by politicos, big landlords and political dynasties. What do we expect? They can manipulate election results when the price is right and pressures from the ruling clans. Election watchdogs, monitors and observers must focus their attention on city and municipal registrars. Election results for every congressional district are decided at local levels. They are election magicians or manipulators. Dahil hirap sa buhay kahit kaluluwa ay puedeng ibenta kay Satanas at kanyang ganid na alipores katulad ni Gloria Pandaka.

    Like they said it’s not worth the paper it’s written in. What a waste of valuable papers. In the end they have to demonstrate to the public that they are capable of conducting a clean and honest election, and not themselves that muddle and turn it into on exercise of comical proportion.

    Let’s forget this Opposition propaganda Garci case. It was unmasked by Enrile that it was actually the oppositions who called Garci and cheated last elections. The tapes allegedly possessed by this group are tainted with lies. Oppositions admit that they called Garci during those times. But why not even a single opposition candidates heard conversing to Garci? Why? Because they already manufactured the tapes. Dinoktor doctor, pinagputol putol para yung kay Gloria lang ang marinig ang galing galing talaga ng mga dimonyo. Tapos dinagdagan na ng kung ano-ano para tuluyang sirain si Gloria. Sira ulo na lang ang maniniwala sa tapes na hawak ng mga oposisyon na to. I believe Gloria called but not to cheat. I repeat naging intrimitida sya which is natural among people who are excited to know the results before hand. This is not actually grounds to ask for any apology kaya lang sinulsulan sya ng Hudas na 10 na humingi ng apology, kaya pala para magmukha syang guilty then sinabayan ng resigns ng mga walanghiya. Mga ugaling satanas. They even convinced Gloria to send Mike to exile para wala nga naman walang katuwang yung tao in times of crisis. Napakawalanghiya talaga nitong sampung ito. History will tell. Sinasakyan na lang ang kasong ito ng mga taong swapang sa pwesto. Kita mo sila-sila nga di magkasundo dahil pare-parehong mga buwaya. God will never allow this people to reign in this country. Thank God!

    I just wonder if Filipinos realize that Abalos, consciously or unconsciously, is admitting that there indeed was cheating perpertrated by Bansot’s political appointee, Garcillano, when he says that there will be no more Garci!

    Unbelievably fantastic! Actually, in more progressive societies this will mean a lot of sacking and criminal procedures that can lead to a lot of self-destruction. Abalos in fact should have been made legally responsible for all these cheatings, but lo and behold! He is one untouchable because he is under the protection of another political appointee, the maldita pal of the Fatso and the Bansot! Yup, he should have been sent to jail instead of being promoted and/or paid big with public funds sucked from even the basura pickers living on top of garbage bins. Really pathetic, I dare say. Question is “wala na bang katapusan?”

    So, in forging this memorandum of agreement, these people finally admitted and accepted that there was indeed massive cheating during the last elections done by Garci. And they want the people to just forget it?

    i agree with the previous comment … para bang inamin na ni Abalos na nagkadayaan nga noon with Garci and the military … kaya after this agreement hindi na ma-uulit yun. perhaps they have thought of another way to steal votes.

Kayo lang naman ang pumapatol at nauuto ng mga oppositions tungkol dyan. Puro pagdududa walang ebidensya. Di tinatanggap sa husgado ang tsismis at ang mga fabricated na ebidensya.

    Kaya nga di na pinaabot sa husgado dahil walang patutunguhan sayang lang ang panahon napakaraming dapat pagka-abalahan ng mga mababatas na dapat unahin kaysa dyan sa kasong wala namang ebidensya pansarili lang. Natural, kunwari aalisan nila ng papel ang militar sa 2007 para pakonswelo sa mga Filipino. Paano nga naman ay nakapwesto na si bansot. As if naman, ay kaya ni Abalos gawing maging malinis ang halalan!!! Kapal ng mga mukha nila, pinakapal ng mga perang kanilang nakurakot at mga pandaraya. Tamaan sana siya ng kidlat, kasama ang mga mahal niya sa buhay.!!

    Talagang nanghihingi pa ng isang karma itong si Abalos. Susunod na makakarma ay si Merciless ng Ombudsman. Tingnan natin kung hindi sila bumigay kapag nakita nilang ang kanilang mga anak at apo ay sunod-sunod magkasakit hanggang pu….w!! Ano pa ba ang hinihintay natin, sukdulan na ang kanilang mga pambabastos sa bayan at tao. Hanggang Kailan pa? Huwag ng hintaying lubugan tayo ng araw. May darating na naman bagong disaster…..mas matindi kay “milenyo” dahil sa kababuyan ni bansot at mga alipores niya.

Kung hindi lang siguro takot ang mga TV writers na ma-salvage sila, matagal ng ginawang thema ang mga pinaggagawa ng mga govt agencies na ito. Kung sa US lang ito, everyday siguro may “humour” na lalabas sa bunganga ni Jay Lino! Pero palagay ko, kaya haghi-hit ang mga local Pinoy movies lately kahit “korni” raw ang mga movie themes kasi ginagawang outlet na lang ito ng mga tao to escape from reality!

    O naalala mo na? Ano ba yung sinasabi ninyo na kailangan paabutin sa husgado kung talagang di nandaya. Kundi ba naman kayo engot ang sinasabi ninyong husgado ay yung Senado. Itong si benjamin abalos, kapag nakikita ko sa TV, mahahalata mo na “kinakapalan” na lang talaga ang kaniyang mukha, to the extent na “magmukha” siyang “nakakatawa o nagpapatawa”. And if you want to pursue further your education in the University of your choosing evaluate all the pre-requisite courses needed to get to where you want to be. If I where in your shoes I would take the courses needed to continue your goal. I have quite similar experience when I want to continue my formal education. Philippines school are lacking needed courses to be admitted to higher level of education in some university abroad. I suppose Japan is one of them. Each have their own rules and policies. It’s almost to the impossibility for a new comer to change thing in the university to fit one need. Moreover. if you young, time is on your side.     Your problem is not unique to you. Each country has its own policy when it comes to foreign graduates and universities won’t just accept foreign graduates unless, after her qualifications is evaluated by the country or the States ministry of Education, and most states or country has already an established recognition guidelines for foreign graduates, according to their countries and the institution where they acquired their education..

    I would further suggest that if in Japan, Professionals are regulated by the Profession itself, you can submit your qualifications to the said body for evaluation. Like if you are engineer, you may submit your qualifications to the “Society of Engineers” or college or engineers or whatever it calls itself and they can evaluate your qualifications and tell you how much you need in upgrading to match up to their standard and also to qualify for licensure acceptance. You may have to take this upgrading in the university or in the courses offered by the profession itself.

    Just like here in most provinces in Canada, our post college level of Ten years is also given a grade ten equivalent, while theirs used to be l3 for university and l2 for college. Now it’s a Twelve years Uniform pre college and university requirements and highs school graduates must still take a qualifying exams for entering either. For Professional and skilled Pilipino graduates, they can go to their respective Professions Regulating Body for Evaluation and every profession differs as to its standard of requirements and upgrading.

    As to your idea of filing discrimination case against the university or the education ministry only a lawyer, specializing in such case could give you a sound and valid advise. So if you still think that your individual right had been violated please see a good lawyer, or any legal adviser dealing with this case and wish you and your child the best..

    It is not discrimination. It is a matter of following the standard. Japanese education requires 9 years of compulsory and another 3 years of preparatory college education called “Sr. High School.” One has to pass the rigid college entrance test to be able to enter a Japanese university. You must be exceptionally talented to merit admission into a Japanese university without going through this process, however, as in the case of some people who have had home schooling and are able to pass their high school education as those US students being accepted into the International Christian University or the Sophia (Jochi) University.

    With the nursing exam scam, why should the Japanese Education Board now give exception to Filipino students, who have not met Japanese standard at that? Please, do not say discrimination, for there is no such thing. As I have stated, it is a matter of following the rules and standard.

    Two years of college education in the Philippines will qualify anybody to enter a Japanese university. Problem is language. Most Japanese universities do not have English as a medium of instruction. That is why even scholars of the Mombusho (Ministry of Education) are required to take up two years of Japanese language training at the least.

    As the old adage says, “When in Rome, do as the Romans do.”

    I recall a discussion elsewhere in this blog (can’t find it now) about U.S. permanent residents/citizens rendering jury duties. Allow me to use a personal example. I also received a summon to do so, but I didn’t oblige, or couldn’t. As a greencard holder, I realized that I was not eligible because the law says (am not sure if it’s federal or state) that only U.S. citizens can be jurors. Hawaii, South Carolina, Connecticut and other states (don’t remember the others) are among those that follow this.

    There are a lot of lawyers in Japan who specialize in cases of discrimination, but Mimi will definitely be just wasting her time, because hers is a matter of meeting standards. There are requirements that she has to meet definitely like having authentic credentials like a transcript of record from the university she claims she has gone to, language proficiency, etc.

    I have helped a lot many people enter school in Japan from elementary to college, mostly children of Filipino women adopted by their Japanese husbands, and have helped teach them Japanese because it is the medium of instruction in Japan. Otherwise, they enter schools for Japanese returnees from overseas and foreign children.

    There are very few universities that teach in English as a matter of fact. Thus, the required language training and language proficiency test.

    I should add. It is not discrimination. It is trying to keep the high standard of education. Japan cannot afford to provide mediocre education and turn the educational system upside down by granting some exception/exemption to the rule Philippine style resulting in some despicable diploma mill, and cheating scam.

    I was the one who mentioned it in some other threads. I was actually surprised to receive several summons that were redirected to my Japan address by my mother. I don’t even have a green card as a matter of fact because I gave it up long time ago although I have retained my SS No. I thought it was more based on my paying taxes on my business and other holdings in the US, and wondered if that was in fact the standard in California to invite even non-US citizen for they could easily check on my credential with my SS No. I just assumed that perhaps they thought that just because my parents were US citizens, I was one, too.

    I never bothered to check the rules, however, because I had no intention to fly to the US using my own resources for such. I could not afford to waste time on such thing, too, especially when I was busy doing side jobs in Japanese courts and police, too as an interpreter, and recently as paralegal.

    BTW, for keepsake, I have kept copies of the summon in my Book of Remembrance. My other siblings in the US never had received such summons as a matter of fact.

    This is the beauty of a forum like this – sharing.

    Re- that jury thing. It’s a federal law affecting U.S. citizens. Like the draft or enlistment to the army, one cannot escape it without a reason (unless one does not meet the qualifications). It got me scared somewhat when I got the summons myself. You know, one can be penalized (by fine or whatever) for not complying. The state laws differ somewhat only in terms of how jurors are released for duty by employers (paid leave or whatever), and other minor particulars.

    Jury is part of the check and balance in the US that citizens can exercise as a matter of constitutional obligation. In some ways, it is more powerful than Congress or the Executive Branch, esp. if one is nominated to the Grand Jury (there is also Petit Jury).

    I just found these for Hawaii and California, so you need not bother coming yourself –

    California law says you are qualified to be a juror if you:
    •Are a U.S. citizen
    •Are at least 18 years old
    •Can understand English enough to understand and discuss the case
    •Are a resident of the county that sent you the jury summons
    •Have not served on a jury in the last 12 months
    •Are not currently on a grand jury or on another trial jury
    •Are not under a conservatorship
    •Have had your civil rights restored if you were convicted of a felony or malfeasance while holding public office

    No one is exempt because of his or her job, race, color, religion, sex, national origin, sexual orientation, or economic status.

    Hawaii
    By law, jurors must meet certain requirements (Hawai’i Revised Statutes, Section 612-4). You must be:
    1.A United States citizen (a person born or naturalized in the U.S.)
    2.A resident of the State (a U.S. citizen who resides in Hawai’i)

    It is the policy of the United States that all litigants in Federal courts entitled to trial by jury shall have the right to grand and petit juries selected at random from a fair cross section of the community in the district or division wherein the court convenes. It is further the policy of the United States that all citizens shall have the opportunity to be considered for service on grand and petit juries in the district courts of the United States, and shall have an obligation to serve as jurors when summoned for that purpose.

    I actually replied to the Court in CA that I was a Japan-based and a non-US citizen to be doing such jury duty that they should better give to US citizens although with my experience in Japanese courts, I was more than qualified. After two or three more summons, they finally gave up.

    Yes, you bet, I got worried about the penalty for not serving as jury especially when you think of the seeming injustice being forced to do something that you are not interested much less qualified to do. I thought it was unfair if one would be penalized for something he is not even interested to do, and more often than not, even prove risky.

    We do not have yet a jury system here although there is a plan to introduce it in Japan in the near future. It will not prosper though I believe because not many people can have the time to spare to be a juror.

    Yuko, Jury duty is not forced on citizenry, but it is not an excuse to refuse one, if you are qualified and able to serve one. Living in democratic society, everyone has a duty an obligation to serve it is functions, and being selected to serve in a Jury is highlight in most people participation in that process parralel to that or even for some, more significant than in voting. If you believe, you can not render an unbiased or fair judgement on the case you are called to hear, you may state your case to the presiding judge to determine your fitness to sit among the ladies and gentlemen of the Jury. My sister had sat in one, and I have not received any summon myself, but if I do, I’d love to experience being the judge of my own peer.

    In our case, we are selected randomly from among the list of property owners or voters list. You maybe excused by the presiding judge if it will cause “undue hardship” on you or your family. You may be called for selection every year and can actually serve every three years. If deemed qualified, any other reason is not acceptable under the penalty of the Jury Duty Act, under summary trial and conviction. It a very fair process and I always believe it’s better than a judge alone trial, which in our court, in some cases, the accused has a choice, between a trial of ‘Judge and a Jury’ or by the ‘Trial Judge Alone’. thanks..

That should give some a lesson to check first before providing inaccurate or false information. The way some people share information are behaving as if they are always right. No apology. No acknowlegement of correction…until this time when you clarified this once and for all. Thanks Hawaiianguy. Why do peope receive notices even if they are only green card holders. Because the names come from Department of Vehicle database such as the DMV of California. Those with driving licenses are on the data system. Names are picked up by random. They don’t know your status. The notice has instruction for you to submit proof of not being a citizen because it’s against the law to refuse to act as jurors if you are a US citizen. That should now rest this issue. Again, a lesson for those who act as if they know it all. Sometimes, it helps to be a little humble.

    I was chosen because probably because I owned an apartment in SFO, and a house in Hayward, but my siblings and cousins likewise own properties, too, but they have not received any summon to be juries.

    Over here, simple criminal cases are judged only by one judge. It is when the crime is grave as when a criminal has committed murder, attempted murder or double crimes that they are presided by three judges. But then, Japan has a different justice system.

    The court is presumed to be a court of appeal since no one is supposed to be presented there guiltless. Any person indicted in a Japanese court is supposed to be guilty based on investigations done by the police, who have to be careful in their investigations, for a simple misdemeanor, etc. can lose a case as for example in the case of a Pakistani accused of murdering a fellow Pakistani. He was given a Urdu-speaking Pakistani instead of an interpreter who spoke Punjabi, his native tongue that the police were not aware were different and lawyers, who defended the accused, used as reason to argue his case in court. The case was immediately dismissed, and the Pakistani, who was overstaying in fact was immediately turned over to the Immigration for deportation.

    Imagine the feelings of the family of the victim. We have never heard of him again but maybe the victim was avenged by his family considering the nature of the people there!

    The court’s function here is actually to determine the corrigibility of an accused and base their judgement on it. Otherwise, he/she is sentenced to death. A life sentence can mean a release after 15 years in incarceration when their cases are reviewed. If they are good, then they can expect to have consideration to be released especially if they are foreigners. In most cases, they appeal, but real repentant Japanese don’t appeal, and accept the sentence of the court. Execution here is done by hanging.

    I have handled murder cases here of Filipinos in Japanese courts. The longest penalty that one I handled got was a life sentence. He thanked me for it. He was supposed to get a death sentence for killing and robbing a Japanese woman living alone in a house he trespassed. His sentence is for review in two years’ time as a matter of fact. Others got from 7 to 20 years with possible parole except for one guy who was a member of a Yakuza organization in Japan.

    One thing the Japanese prison officials are learning and cannot help admire in the Filipino prisoners though is their filial piety to their families. On the other hand, they cannot understand how their families would even rely on them for financial support while serving their sentences in prisons in Japan.

    Just imagine the Bugaw clinging by the pillars in the palace by the murky river bragging about the remittances of these PFWs in Japanese prisons. Last year, in fact, the Philippine Embassy asked the Japanese Prison to provide a list of Filipinos serving their sentences in Japanese prison.

    I am told that a list was prepared sans the names of those who did not want to be included in the list. Perhaps, it was to make sure that their remittances are controlled by telling them to open accounts in PNB, Metrobank and the Landbank, which reportedly operate in Japan sans any legal permit to operate as an ordinary bank and/or foreign exchange dealer.

    I never heard of such thing being done during the Marcos regime. Marcos, at least, did not tolerate the Japayuki and was not party to the deployment of wannabe prostitutes to Japan. Ironically, the problem of the Japayuki was used by his critics in Japan in pulling him down. This time, on the other hand, the Japayuki is being promoted by the Bansot sans any cry from yen-craving Filipinos. Fortunately, the Japanese government has seen it as human trafficking and closed the door of Japan to these Japayukis, actually teen-agers, male and female!

    In short, utak kriminal! 😡

  101. I should add that indictment of cases here depends on the prosecutor or a fiscal, who is in fact different from a judge of the court although both are agents of the Ministry of Justice.

    The police is a different entity likewise. It is not under the Ministry of Justice although in principle, it is supposed to work with the Ministry of Justice so that justice can work and prevail. Neither is it under the Self-Defense Force Ministry.

    Our National Police Agency is a separate entity and not even under the control of the Prime Minister of Japan or any ministry. This is definitely the reason why police here can effectively corner an erring elected official or a bureaucrat. They should have something like that in the Philippines if they want the Bansot, et al sent to jail for crimes committed against the people of the Republic of the Philippines even for treason for allowing for example foreign militaries to operate in the Philippines like the permit that it is said to be granting to the Australians to build a military base in the Philippines to contain neighboring countries in S.E.A.

    The Tokyo Metropolitan Police Department BTW is patterned after the Scotland Yard of Great Britain.

    The truth is I fight against discrimination of any kind having experienced it myself in the Philippines and the US. I fought hard in fact together with members of my group against the lumping up and labelling of Filipino women as “Japayuki,” a word that most Japanese now avoid using in reference to Filipino women because it connotes “prostitution.”

    On the other hand, I find it unfair for Filipinos to accuse the Japanese of being racists, etc. especially when they do not abide by the rules of this country where they forget they are nothing but visitors expected to behave as in the case of Filipinos who are often reported to the police for making loud noises in predominantly quiet neighborhood.

    You bet, why insist on entering a university in Japan that will not accept you most likely because they would not want to get extra teaching staff to teach in the language of the foreign student? Gastos pa nga naman iyan.

    The truth is there are in fact some community colleges in Japan that offer instructions in English like Sophia University and ICU. Problem is will the student qualify and pass through the rigid college entrance examination?

In fact, I thought the court in CA was crazy to be sending me such summon knowing that I was not a US citizen, for I never had applied to being one under my Japanese name.

    COMELEC Chairman Benjamin Abalos yesterday said there would be no-repeat of the “Hello Garci” scandal in 2004 with the signing of a memorandum of agreement that would limit the role of the military in during elections.

    John Does as defendants/accused

    In the US, it is common to have defendants/accused who are named “John Does.” Here in the Philippines, that is also allowed. As long as the “John Doe” has other descriptions and the correct name is later supplied. But “John Doe” is enough to initiate a court case.

    If I’m not mistaken, in Japan the same procedure is allowed.
