Miriam as SC chief?

Sen. Miriam Santiago is among those being considered for the position of Supreme Court chief justive which will be vacated when Chief Justice Artemio Panganiban retires on Dec. 7, 2006.

Senate Majority Floorleader Francis Pangilinan, ex-oficio member of the Judicial Bar Council (JBC) confirmed the inclusion of the name of Santiago, known as an ally of Gloria Arroyo. She was nominated by the Young Lawyers Association of the Philippines. Others in the list are Supreme Court justices Reynato Puno, Leonardo Quisumbing, Consuelo Ynares-Santiago, Angelina Sandoval-Gutierrez, and Antonio Carpio.

Santiago has not been shy about her interest for the position of Supreme Court justice. Last year, she threatened to cut the budget of the JBC, which screens nominees for the Supreme Court, when the body refused to extend its deadline to accommodate her late nomination.

There have been talks that the position of chief justice has been promised to Puno, who voted against the majority decision dismissing the petition of Singaw ng Bayad and ULAP (Union of Local Authorities of the Philippines) to change the Constitution through a fraudulent People’s Initiative. The score was a close 8-7.

But there are also talks that Quisumbing, who was among the seven, was also promised the top SC post.

Carpio penned the majority decision that called the Malacañang -supported petition of Singaw and Ulap a fraud. Santiago and Gutierrez were among the eight that stopped Malacañang’s bid to change the Charter through a dubious People’s Initiative.

CODAL ( Counsel for the Defense of Liberties), meanwhile, demands that the new justice to be appointed by Arroyo inhibit from voting on the Sigaw petition and other issues related to charter change to ensure credibility of the decision and avoid a constitutional crisis that will ensue should the Court’s decision be tainted with partiality. In fact, it is imperative on the new justice to recuse himself from deciding the Sigaw petition under Article VIII, Section 4 (2) which states that :

Sec. 4(2) All cases involving the constitutionality of a x x x law x x x and all other cases which under the Rules of Court are required to be heard en banc, including those involving the constitutionality, application, or operation of presidential decrees, orders x x x and other regulations shall be decided with the concurrence of a majority of the Members who ACTUALLY TOOK PART IN THE DELIBERATIONS ON THE ISSUES IN THE CASE AND VOTED THEREON. “

“Since the new justice did not participate in the deliberation of the Sigaw petition, said justice cannot vote on that issue, as this is prohibited not only by the principles of delicadeza but also by an express provision of the Constitution. It is foolhardy therefore for charter change supporters to pin their hopes on the new appointee,” CODAL said..

    The nomination of Miriam “Brenda” Santiago is a twist in the Cha-Cha bid. I believe that she will be used by the administration in circumventing the Constitution.

    With the swift demise of the PI, the Con-Ass is the emerging battleground. If Brenda is named new CJ, we can kiss our asses goodbye. With her position secured, Brenda will not bat an eyelash to go along with the Con-Ass. Being the political traitor that she is, I am sure she will side with the moral pygmy. I can still see the NO-EL scenario rearing its ugly head. I hope the opposition has an answer to this.

    Miriam as SC Chief Justice? Considering in the past GMA has a propensity to break the screening process of the Judicial and Bar Council – making appointments even before the JBC has screened the appointee – Chief Justice Defensor-Santiago may not be impossible. GMA might be looking for a swing vote.

    In the US, George Bush appointed an outsider as Chief Justice, John Roberts. I don’t know how the US bar reacted to this. Could it be that Bush thought that since a seat was vacated by the then Chief Justice, the replacement should be appointed Chief Justice as well? It seems it didnt occur to Bush that he can name a replacement, then select from the existing 8 justices the next Cheif Justice. So now, the most junior member of the US Supreme Court is the Chief Justice!

  3. And they say that the Philippines is a democratic country! And yet, look at how the fate of the nation is left in the hands of a handful of crooks and hypocrites.

    Over here, our Supreme Court judges come from the rank of judges, and approved by the people by election. Their names are presented during elections, and any mark on any of the names presented for approval will be considered disqualified on the premise that the judge should have complete and 100 percent trust of the voting public for the sake of ALL concerned citizens of Japan. Why can they not do the same thing in the Philippines, and not appoint any one, especially one who is believed to have a damaged brain!!!

    Over here, too, a judge is expected to be morally upright. Any skeleton in the closet as in the case of Art Panganiban, who defied the rule of law when they connived to remove a duly elected president,etc., will be enough basis for disqualification.

    You can’t be serious? I thought Brenda herself said that she had a recurring (left or right?) frontal lobe problem, reason why she went to the US for treatment or something to that effect.

    If my hunch is right, she is being afflicted with a form of either Parkinson’s disease or Altzheimers.

    Surely even Gloria (what with her ambitions to cling to power at all cost) could see that appointing Brenda to SC might cut both ways and could prove detrimental to her (Gloria). Now, if that happened that would be the height of stupidity!

    Oh boy! Miriam, as Chief Justice (CJ) of the Supreme Court (SC)!? The MIDGET and The PIG Mike MUST BE DESPERATE to even consider a cuckoo as CJ! They must be scraping bottom! After the SC’s recent decision on the PI, they were able to redeem themselves as a bastion of Hope for the Filipinos (maybe next to the Senate), if this “Brenda” is appointed CJ, the credibility and integrity of the SC will have a -100 trust rating!!! And isn’t Miriam’s husband also a PIG?

    In France, there is an Ecole Nationale de la Magistrature – a university of sorts but reserved solely for those who wish to make a career in the state’s judicial system.

    It is not enough for a person to be a lawyer or possessing a degree in law to be qualified to become a judge, district or state prosecutor – he/she needs to be accepted first to the magistrates’ university and to study AGAIN.

    The Ecole de la Magistrature is one of the toughest schools in France. Not only does it have a very difficult entrance exam, i.e., it does not base a candidate’s acceptance solely on his “passing the grade” but should be among the first, say 50 top examinees, but all along the school life of the successful “entrant” to the Ecole, the candidate must pass a rigorous series of interships. Out of say 30 graduates, half would be “forced” to quit if the judicial system finds them unsuitable for the job.

    If the “student” finally manages to pass the State bar exams and qualifies to become part of the judiciary career service, like any civil service careerrist, he/she is subject to the rigours of promotion. The state jurist (judge, district or state prosecutor) must go through the promotion channels like all state public/civil servants.

    The appointing authority to the Supreme Court or arbiter is the State but members of the Supreme Court must have proven first and foremost that they are qualified to sit as SC justices by having gone through the State judicial system mill FORMALLY!

    Its the CA (bicam) which confirms but Glueria appoints. But Miriam comes from their ranks and that’s a plus for her. Miriam’s political life is dead and she knows it. Her only recourse is the SC to stay in the limelight. This will be used Glueria to her advantage. The swing vote the administration is seeking is Miriam. The previous 8-7 will now be 7-8 in favor of the administration.

    Not only is she freelancing, she had sold herself to the highest bidder. The senate cannot offer her anything but the bansot can. Security of tenure is what she is after and the SC will give her that.

    It’s the same thing in Japan, Anna. When one finishes studying law over here, he/she has to decide whether he would like to practice as a lawyer, prosecutor or a judge. That is why it is not uncommon here to see new graduates sitting there together with a senior judge especially in serious cases that require 3 sitting judges.

    Budding lawyers more often than not also volunteer to sit with a senior lawyer to learn the tricks although in Japan, lawyers tend to be argumentative except perhaps in civil cases because the would have to present a lot of proofs and evidences to support their arguments unlike in criminal cases where the courts already have the evidences, etc. such as statements made by the accused during police investigations.

    This is the reason why there cannot be any conflict of interests unlike in the Philippines where as in the case of the rape of Nicole, the prosecutors would even side with the accused instead of protecting the interests of the victims. If that is not being stupid, what is?

    When they retire, judges of the court and prosecutors may try their abilities in being on the side of the accused as their lawyers.

    Judges of the higher and supreme courts rise from the ranks. There is no short cuts. Not everyone wants to be a judge of the Supreme Court because of the heavy responsibility that goes with that job.

    At election time, we are asked to mark the names of those we do not want to serve as Supreme Court judge. The ordinary people would not know them in fact because they do not even get published often except when their names come out in connection with the final decision on a sensational case. So, the most likely person to scratch their names out are those who have experienced being judged by them, and over here, just one scratch of the name would be enough to disqualify or terminate a judge of the Supreme Court.

    The procedure is simple, and over here, the simpler, the better. Beat me why Filipinos have this penchant for complicated things, or why they would prefer to make things more complicated.

  17. Yeah, same in France – court hearings in “cassation” or in cours d’appel are usually held by having 3 magistrates sitting en banc. Same in hearings of criminal cases. In divorce or family courts, usually, there’s only 1 judge sitting.

I should add, Anna, that when a law graduate here decides to become a lawyer or a prosecutor or a judge, he/she will have to go into some internship like a doctor and then take a board exam to get a license or accreditation. It’s more or less similar to the procedure in Europe where Japan has copied a lot of its court and police systems.

  19. The Philippine system is quite similar to the US system except that they don’t have the jury system which Europe, the US and Japan practice.

    I understand that in many counties in the US, they also elect their prosecutors and judges, i.e., NYC.

    Not the case in France though nor in the UK.

    I really, really hope Gloria isn’t forced to appoint Brenda as SC justice then SC mischief, er chief justice for the sake of political expediency. Appointing Brenda could be a good tactical move, a short term tactical move but in the long term, she would find it could be a monumental strategical error, not only for herself but for the nation as well.

This appointment of judges of the Supreme Court is patterned after that of the US, but over there at least, without the US lawmakers’ nod, it will be difficult to get an appointed judge to confirmed. Likewise, the candidate for such exalted position needs to prove a clean slate, no record of philandering for example.

    Bawal dito iyan, Anna. The judge of the Supreme Court has to be exceptionally and immaculately clean as far as moral standards are concerned.

    It’s simple logic. An immoral man will never be able to make good and sound judgement.

    I think the selection of the Chief Justice should be one of the things that needs to change in our constitution. I believe it is better that the Chief Justice should be selected from among the justices themselves to avoid being politicized. No influence or intimidation/control of the one who appointed him/her. The preservation of integrity and credibility would be upon them… Also, the same thing should be done also with our Military Organization. Free them from ‘Utang-na-Loob’ syndrome. There will be less politics in these sensitive institutions.

  25. Its been the practice of choosing the CJ from the ranks of the judiciary but there are no written guidelines on this. Any lawyer then can be named CJ. This is how it is done here. The appointing power of the president should be amended as partisan politics can be abused. Such is the case with Glueria who has appointed officials to the detriment of the country. This is why I hate lobbying as it has been overtaen by corruption. Fine if lobbyists are all advocates, the problem is most end up as businessmen. Even teh NGOs here have been tainted as they are used by politicians to hold hostage sectors of society.

And so far they made only decisions that are not resolved in the lower courts, very seldom. And now Gloria is appointing a politician known to be a political turncoat, and will make decision to whoever the highest bidder, let see, an ambassadorial placement for a cousin, or cabinet position for “kasimanwa” (maybe me) hehehe. Well, I hope the senate committee on appointment will come to their senses and block her appointment at First Base..

    You bet! The Philippines and Japan, in fact, with the US as their tutors or providing them with Constitutions to start with should have developed similarly but for some reason, the Japanese have been able to evolve better laws to fit their mentality, their needs and requirements.

    The Filipinos, on the other hand, in wanting to show off, have seemed to have opted for the more complicated things that they have misunderstood and/or misinterpreted especially when they have laws written in some foreign tongue regardless having boasted once that they are the second largest English-speaking people in the world.

    I think it is also the same in the US until the Bushes inserted politics in their appointments that the solons there approve and confirm!!!

    It’s common sense. An appointee naturally cannot be non-partisan!!! And when there is that “utang na loob” that is far from the concept of true gratitude, you cannot expect an appointee to be non-partisan. It should be stopped, especially when the person appointing the judge is as warped and corrupt as the Bansot!!! 😡

    US turns down Arroyo’s EAS invite

    The United States is not attending the second East Asia Summit (EAS) of 16 countries that will be hosted by the Philippines in Cebu in December.

    Matthew Lussenhop, US Embassy spokesman, yesterday confirmed that the US government was invited by the Philippines to attend the EAS but said it will not send a high-level delegation to the meeting.

    “Nobody is coming to the meeting because we are not a member of the EAS,” Lussenhop said.

    He did not say if it was US President Bush who was invited by Manila or US Secretary of State Condoleezza Rice.

    The Department of Foreign Affairs said the US was invited by President Arroyo as guest of the host. Russia, which

    has applied for membership during the inaugural meeting in Kuala Lumpur last year, is also not attending the meeting.

    “I think we will just send some observers from the US Embassy in Manila to attend the meeting,” Lussenhop said.

    The EAS brings together leaders of the Association of South East Asian Nations—Philippines, Malaysia, Indonesia, Thailand, Singapore, Brunei, Cambodia, Laos, Vietnam and Myanmar—plus dialogue partners China, South Korea, Japan, Australia, New Zealand and India.

    Trade and security issues are high on the EAS’ agenda in this year’s meeting. The European Union, France and Timor Leste are also expected to accede to the Treaty of Amity and Cooperation (TAC) during the summit.

    All dialogue partners are signatories to the TAC, one of the requirements before any country could join the EAS.

    The US has not acceded to the TAC.

    According to Lussenhop, Washington has no immediate plan to join the new regional group but will continue to monitor developments in the EAS.

    “We have stated in the past that the US has no objection to it (EAS) and there is no problem with it. However, we will see what kind of forum it will develop and evolve,” he said.

    The EAS is seen as a precursor of a pan-Asia summit which promises to be “open, inclusive, transparent, and forward-looking.”

Someone who openly admitted to be suffering from severe depression and on medication should not occupy the highest position in the Highest Court. Of course she would also be there to protect and defend Malacanang. If She indeed is appointed, what would be her position regarding the Conass and other attempts by the Palace to amend the constitution. Miriam has publicly and consistently voiced her disagreement on such amendment. Let’s see how this thing goes…

    Chi, that wasn’t at all “off topic,” that was a GREAT topic! You know what, Chi, your topic just verified this gut feel I had that the U.S. will NOT attend the EAS! Come to think of it, it really would not be a wise move for the U.S. to send a “high-level delegation to the meeting” in the Philippines, especially when the U.S. leader is an advocate of Kleptocracy. They cannot be seen supporting the midget, who is suspect of this advocacy. Furthermore, the Midget’s trip to China did not please the U.S., especially when she spoke and said that Asean should rely less on the U.S. and the EU. The U.S. also is aware that sending a “high-level delgation” may be used by Gloria for political mileage, especially now that the elections SEEM to be pushing through in ’07. We can’t forget that before recanting her words that she would not run in the 2004 elections, President Bush visited the Philippines and she used that to her political advantage, and then announced that she would run instead in the 2004 presidential race!

    The Midget’s support base is dwindling, dwindling, dwindling,… Her end is not a matter of IF anymore. It’s a matter of WHEN.

    Je ne sais pas, Chabeli. What I know is that she’s on medication and has regular mood swing. How can she properly run the SC and give fair decision with that state of mind? Miriam put the blame on the UP administration for failing her son. His death shall remain a mystery until someone reveals. It’similar to that murder of one popular actor in the 70s.And of course Ninoy’s assassination…mastermind is still alive and active today.

  37. My fears have been confirmed, the palace and its minions are all supporting Santiago. They also said that there is nothing wrong if she should be appointed. How immoral this bozos really are. They should have instead nominated some one who was never involved in politics.

    Now this really changes the entire political/constitutional landscape. With her at the SC’s helm, consider Cha-Cha in all forms alive and kicking.

This midget thinks that she’s a significant world leader, and could make Bush jealous and would beg her to visit the US. No way! It’s a ridiculous and bizarre proposal. She cannot be trusted due to her close Malacanang Palace connection. Besides, a 78 % average bar exam is not an impressive record to become the first woman chief justice of the Philippines. The Filipino people deserve a better chief magistrate. Brenda is always a brenda (brain damage). Baka chief administrator ng National Mental Hospital puede pa. Sa korte suprema? No way Jose’!

    Just got back from the Philippine Embassy reception for former President FVR who’s arrived in the EU capital for a 2 day meeting of the board of trustees, ICG, International Crisis Group.

    A handful of Fil community leaders led by Ambassador Cristina Ortega received the former Philippine executive (btw, Ambassador Ortega says “hello” to you.

    He addressed a round table meeting at lunch today hosted by an EU business group. On Sunday, he will proceed to Berlin.

    Hê played the role of an elderly statesman quite well by speaking about the cha-cha and why he thought it would have been good for the country, as well as the OFW group concern of being represented in the nation’s legislature outside of the current party list system.

    He sort of criticized the non-unity of Filipinos in general which he believes is a defect in the nation’s inability to do team work.

    He talked about the burgeoning population increase and without saying it in blunt terms, thinks that the Catholic Church’s influence is responsible. He suggests that people should think also with their heart, i.e., that having so many children is alright if they can afford it but otherwise, families should refrain from “rerproducing” at such an alarming rate.

Vic, I think that’s more or less how appointment to the Supreme Court here is done in France as well – there are always a few civilians (from private practice) who are picked or appointed from the Barreau (Bar Association) (private practicioners) recommended by the Garde de Sceau (Keeper of the Seal, of Minister of Justice)after thorough scrutiny both by the members of the State judiciary and the private practicioners association.

    I believe that prior to being appointed to the supreme court here, most chief justices will have written books and will have published vastly on legal or justice procedural matters in official legal journals; their work will have been used and disected in law schools.

    There is no doubt that in almost all civilized countries, the members of the SC are supposed to be the best of the best of the legal minds in the country with the most impeccable or spotless moral credentials; moreover, their political affiliations are almost never ever known to the public.

Most often, but not always at the recommendation of the legal bodies or based on the qualifications of the appointee. Sometimes, it could be a patronage appointment, less often nowadays, because of the voters desdain for such process. But as I have observed all through the years, as soon as those officials took their oath of office, their loyalty is to the Crown and to the public. For the first time ever, now there is some kind of confirmation hearing in parliament for SC justice appointee. But usually an appointee is vetted well before submitted for the Post.

  83. Great influence on the Bansot administration, Anna? I doubt it. Of course, the US will try to continue to have an influence on the Philippines, but definitely not through the Bansot.

    I am informed that the Amboy, FVR, is in fact just playing tricks, but as far as US favoring the Bansot, I doubt.

    She is able to stay there simply because they have the money to make it look that she is in control. It is not even favoritism, mind you. It is plain and simple expediency as far as this claim of US patronage is all about.

    It is all part and parcel of some covert operation if I may say so, especially with the Bansot’s deals with the Chinese that I bet you is not being watched with favor by the wary Americans. Believe you me!

    Take the case of the horny Americans being charged with rape at the Philippine court. Saan ka nakakita na ang prosecutor kumakampi sa mga accused, at iyong victim ang parang siyang criminal who is being charged and tried in court. If that is not colonial mentality, what is?

    Over here, the victim is the one protected by all means by the court, not the other way around. I have actually interpreted for American servicemen who have committed crimes in Japan. I don’t see the courts here giving them any preferential treatment at all especially a very cooperative US embassy and US military authorities here. Alam kasi nilang hindi pauuto ang mga hapon kahit na tingin mo mukhang uto-uto.

    Dapat ganyan ang mga pilipino. Sobra lang ang colonial mentality nitong si Gonggonzales, et al, who are products of this so-called “US brainwashing,” etc. that my classmates in UP hated and defied.

    Miriam to undergo psychiatric exam for CJ post

    Sen. Miriam Defensor-Santiago will have to undergo psychiatric and psychological tests for her nomination as chief justice of the Supreme Court as required by the Judicial and Bar Council.

    Justice Secretary Raul Gonzalez, an ex-officio member of the JBC, said the senator and five of the Court’s magistrates who were also nominated will be required to submit themselves to professional evaluations.

    “If [it is] required for one, you [should] require it for all,” Gonzalez said.

    The justice chief added that opposition Sen. Francis Pangilinan wants a public interview for Santiago. Pangilinan, chairman of the Senate justice committee, is the chamber’s representative to the JBC.

    Gonzalez said Santiago’s life is an “open book” though Pangilinan wants her to be subjected to an interview anyway.

    Santiago was nominated for the post by the Young Lawyers’ Association of the Philippines. Her nomination raised the number of contenders to six.

    Aside from the senator, other contenders for the post to be vacated by the retiring Chief Justice Artemio Panganiban are Associate Justices Reynato Puno, Leonardo Quisumbing, Consuelo Ynares-Santiago, Angelina Sandoval-Gutierrrez and Antonio Carpio.

    The five magistrates were automatically included on the list of nominees, being the most senior members of the Court after Panganiban.

    Gonzalez said the number of nominees would not pose a problem since President Arroyo will choose among the contenders.

    Panganiban will retire next month upon reaching his 70th birthday.

    DOJ Sec’s suggestion that Miriam undergoes psychiatrict test was quite serious coming from one of Gloria’s most trust and loyal dogs. It was an expression of disagreement over her appointment to SC. Miriam herself admitted she suffers from severe depression and is on medication. With this admission, why still push her to be the SC Chief? There’s no need for any test. There was already an admission. Depression if this is in serious state affects one’s decisions. Perhaps Raul was hinting that he should be the one to be the SC Chief. But, he’s over the age limit. He’s no better than Miriam. Shits like these people don’t deserve to be in any government or judiciary position.
