House OKs con-ass resolution

What can I say, but pray that this unconciousnable rape of democracy will finally wake the Filipino nation up.

On Monday, Dec. 12 at 10 a.m. Congress sitting as a joint assembly
would convene at the plenary hall of the House of Representatives to start the process of proposing amendments to the 1987 Constitution.

Cha-cha advocates hail this as their best Christmas gift to Gloria Arroyo.

Knowing that she is behind this assault on the Constitution (son Mikey and brother-in law Iggy are part of the gang) what comes to mind is a Filipino saying, “Kumuha ng bato, pamukpok sa ulo” (Got a stone to bang her head with). That’s more like it to me.

Here’s ABS-CBN’s update:

The House of Representatives on Thursday adopted House Resolution 1450 convening Congress into a constituent assembly to propose amendments to or revision of the 1987 Constitution by a three-fourths vote of its members.

The resolution, sponsored by Camarines Sur Rep. Luis Villafuerte, was passed before 6 a.m. Thursday.

At least 14 congressmen questioned Villafuerte about the resolution, which proposes constitutional amendments or revisions including a shift to a parliamentary-unicameral system. The resolution also seeks to postpone next year’s polls to pave the way for the election of an interim parliament in November 2007.

Administration allies in the Hose earlier voted 161-25 to amend Section 105, Rule 15 of the House rules, paving the way for the speedy approval of Charter change resolutions.

The amendment deletes the line: “The adoption of resolutions proposing amendments to or revision of the constitution shall follow the procedure for the enactment of bills.”

    During the interpellation, I pointed out that Sec. 1, Article 17 of the Constitution clearly states that any amendment to, or revision of the Constitution may be proposed by THE CONGRESS.

    Thus the body that shall meet on Dec. 11 must be THE CONGRESS for it to validly propose amendments.

    For that body to qualify as THE CONGRESS, both the House and the Senate must be there in session assembled without the Senate, and there are only a sprinkling of senators, then that would not be THE CONGRESS and would have no power to propose amendments.

    Having painted himself into a corner, Villafuerte made an absurd and tacitly wrong statement that “the House alone can convene Congress.”

    What a fatally flawed statement coming from a lawyer!

    I categorically state that that assembly of legislators who will meet starting on Dec. 11 is a non-Congress and therefore has no business proposing Constitutional amendments.

    Even Lito Lapid has joined the ConAss oppositors in the Senate, and thirty-plus congressmen who were expected to sign the resolution did not do so despite the ongoing bribery of SAROs or pork barrel.

    NEWS:Arroyo, senators meet at Makati party

    President Arroyo and several senators met at a birthday party in Makati City while members of the House of Representatives were debating upon a controversial resolution that would want the Senate bypassed on Charter change, ABS-CBN News reported.

    It was not immediately ascertained whose birthday party the President attended at a restaurant along Pasay Road past 10 p.m.

    She, however, was seen with Senators Lito Lapid, Richard Gordon, Ramon Revilla Jr., Juan Ponce Enrile, Edgardo Angara, Juan Flavier, Francis Pangilinan and Ralph Recto.

    Vice-President Noli de Castro also attended the party.

  16. Over in our church, when a member commits a crime as these crooks are doing, they are put on trial in some church court, and if they are found culpable, they are excommunicated, and return to the fold will be rather difficult.

  17. Violation of the Constitution that is still in use is a crime. Railroading the ChaCha without abiding by the provisions of the Constitution still supposed to be in use despite its being trashed by EDSA 2 is a crime. This should be put in the head of Filipinos, many of whom have not mattered I guess to read, even just scan, their Constitution. Too bad!

    I cant imagine, why the heck the president has to be chosen among them (in case the parliamentary system gets through), kung ngayon nga e hindi na magakaintindihan sa pagpili nag pangulo yun pa kayang sila ang mamimili. I dont want to give away my right, as a voter, to choose who I want to become the president.

    WHy the CBCP are calling for a nationwide action/s on Friday, 15 December 2006, why not make it coincide with the ASEAN summit in Cebu??? anyway bastusan na rin naman ang labanan, why not show to the international community attending the ASEAn summit how this administration makes a mockery of the democratic principle in our country, why not make the protest right now until the illegitmate and rapists of the constitution is removed from power??? I say we should force these TONGressmen out of office.

    I’m wondering what is the VERY HONORABLE??? de castro is doing nowadays, no words from him, his friends from the senate are already sending the signal that they are dancing to the tune of cha-cha, but he, who is the vice president is acting un vice-presidential. what is he doing now??? gosh de castro is the only vice president who doesn’t follow the voice of the people, if he keeps on going quietly on the issue of cha-cha, i dont what will happen next.

Our Japanese networks have a complete list with pictures supplied by people who have monitored these killings. But why should we be the one to post them.     To follow on Acpiccio’s post, want to let him know that my brother from whom I’ve just received an e-mail and a his friends and supporters are planning a rally. It is the same brother who staged the first Filipino rally against Marcos in Paris when Aquino was assasinated.

    I’ve this instant called a couple of friends in the military (active service) to ensure that no harm befalls them by detailing plain clothes military elements in their midst who could be trusted. The military friends I called are worthy of trust who ensured it would be done.

    I cannot divulge their plans for fear that Gloria’s goddamn supporters, pimping and whoring ass lickers lurking in this blog would stymy their efforts.

  54. Meanwhile, I will be joining a rally in Brussels in front of the Philippine Embassy on Monday at 6:30 PM in a torch vigil which will be attended by Europeans and some members of the press to denoucne Gloria Macapagal Arroyo’s extra-judicial killings.

    For those Filipinos who are in Brussels or thereabouts, I suggest that they join too. The burden of making known to the world that sinister things are happening in the must not always fall on the shoulders of foreign nationals.

    It behooves Filipinos abroad (although much has been asked of them when they stepped out of Pinas to work for their families and loved ones) to show a minimum of sympathy for victims of Gloria Arroyo’s unspoken policy of political killings and to denounce the misrule in the country.

    Evil triumphs when good people do nothing!

    Today I am turning over this space to a Fil-Am reader of this column, Alberto Peronilla, who describes himself as “a nobody who wants to help the Philippines.” He has some legitimate complaints against the Philippine postal system, as well as against the Deutsche Bank. Hear him out.:

    Why the Philippine Government Should Allow Thefts in the Postal System to Continue

    I recently (November, 2006) sent a $100.00 check to an individual in the Philippines for the benefit of the children at Gawad Kalinga Paradise Heights. It should have been delivered by the Las Piñas Post Office, but somewhere along the way in the postal system in the Philippines, the check was stolen and cashed at Deutsche Bank Trust Company Americas for the Bank of the Philippine Islands. a/c no. 04-002-070 CARMEN ROSALES branch. Ref. No. 063-X06-0365.

    The one who cashed the check either had a dollar account with the bank and in this case the bank knows who the individual is, or the bank simply cashed the dollar check for anyone who walks into the bank. (I wonder what the Bangko Sentral ng Pilipinas, which supervises all banks in the Philippines, has to say about that.)

    The crime happened in at least two places, the postal system and the bank. By tracing who cashed the check, an investigation may lead to which point in the postal system the theft occurred.

    So I faxed/emailed my complaint with photocopy of the evidence to the Branch Manager of Deutsche Bank in Manila, to the Main Office of the bank in Germany and, on the government side, to GMA’s office, to senators, to the office of the Ombudsman, and to the Office of the Chairman of Governors of the Bangko Sentral ng Pilipinas. Since he is my favorite political pundit, also to Tony C. Abaya. The fax machines of the Postmaster General and the Regional Director in Manila were off the hook but I will mail them a copy of this.

    I have not heard back from anyone, which I expected, and the Ombudsman will only entertain a complaint if I give the name of at least one respondent, his location and his salary grade. This is just the filing. If they decide to entertain my complaint, I have to appear in the Ombudsman’s office with my evidence.

    In the meantime, President Arroyo approves the proposal of a PHP 5.7 billion modernization project for the postal system which states that the new system will be operated by the same postal managers and employees, thereby guaranteeing no dislocation of any employees (including the thieves.)

    Then the government issues a report consistent with the conclusion of private and international bodies that the Philippines has enjoyed quarter-by-quarter economic growth during the term of GMA.

    Based on the above, I have changed my mind and now support and understand the decision of everyone who I corresponded with on why the thefts in the Postal System in the Philippines should continue; and to make sure that they not waste any more time to entertain my complaint, I am sending all of them a copy of this document. I wonder if some media will be interested in this document, but I will try.

    By the way, if your bank is inconveniencing you by requiring positive identification when cashing a check, try Deutsche Bank.

    Why this decision? First, by allowing some thieves in the postal system to steal, they are making sure that they do not fall below the poverty line, thus affecting the report of economic growth in the Philippines.

    Second, since they are most probably stealing from people who are better of than they are economically, this is one way to promote the equalization of wealth.

    And third, the honest postal employees should be thankful to the thieves among them that they too benefit from their being rewarded for their thievery to continue to operate the modern system. With the new system operated by the same thieves, thefts will now occur more efficiently and FASTER!

    I understand your sense of frustration. The moral climate in this country is abyssmally bleak. Everyone who can seems to be trying to steal from everyone else. Your experience with the Post Office and Deutsche Bank is not unique.

    Two relatives of mine who had accounts with a major American bank inexplicably stopped receiving their monthly bank statements. Only by chance did they discover, months later, that their bank statements were being mailed by the US bank to another address in Metro Manila, without their knowledge and authorization.

    And after they had sorted that out, they discovered that their bank balances were short by several thousand dollars each.

    Their cases indicate that crooks in the American bank’s Manila and/or San Francisco office were in cahoots with crooks in the postal system in Manila and/or San Francisco. There are many Filipino employees in both the banks and the post offices in San Francisco. With computers and instant communication, it is now so easy for crooks on both sides of the Pacific Ocean to coordinate and synchronize their moves. This is the globalization of thievery.

    In your case, crooks in the postal system – in the Pasay City airmail distribution center, or in the receiving post office in Las Pinas – were clearly in connivance with crooks in the banking system, who facilitated the encashment of the check in Carmen, Rosales (Pangasinan?) It is even possible that the initial tip-off about your check came from a mole in the issuing bank in the US.

    I had a similar, though more modest, brush with thievery in the postal system last October. And I was not even trying to help the Philippines, only a young boy – the son of my driver – who is enrolled in a small Protestant school in Bacolod. I airmailed a check, payable to the school, for his October tuition.

    How naïve of me, however, to enclose with the check an ATM card for the use of his mother so that they can access the weekly stipend that the father – my driver – sends to them, without having to pay the P100 that banks charge for transferring money, any amount, from Metro Manila to Bacolod. With an ATM card to a Metro Manila account, I thought, they can access the weekly ‘padala’ without having to pay the onerous fee.

    Alas, I did not reckon on postal thieves in either the sending post office in Paranaque or the receiving post office in Bacolod, who apparently “feel” the contents of each letter that passes their way and judge if there is anything worth stealing in it, such as an ATM card. Needless to say, that letter never reached the addressee.

    Fortunately, the check can be cashed only by the school, and I specifically refrained from enclosing the PIN with the ATM card. So, nothing was lost except time and some anger and despair that this country has come to such a pass.

    Despite occasional good news about an honest taxi driver, or airport security guard, or even an exceptionally incorruptible policemen, the prevailing portrait of the Filipino as social animal is one who has lost his moral moorings and is drifting towards the cataracts of moral decay.

    It is easy to blame the Roman Catholic Church and its hierarchy for this failure, since they are the supposed moral and spiritual guardians of most Filipinos. But organized religions have long been marginalized by secularism, at least in the Christian world. While they still retain some influence in matters affecting rituals and dogma, they have lost gravitas in the matter of ethical behavior.

    This is more the failure of the political leadership and the media, who, unwittingly acting together, have created a society devoid of moral values, or whose moral values have been corrupted by unfettered self-gratification and insatiable materialism. Only a moral revolution under a morally upright leader, it seems, is capable of righting this monumental wrong. *****

    This is off topic but there’s another typhoon heading for the central Philippines.

    MANILA (AP) – A new storm approaching the central Philippines is on track to become the second typhoon in 10 days to batter the archipelago, forecasters said Thursday, as the country struggled to recover from typhoon-triggered rains and mudslides that left more than 1,000 people dead or missing.

    The tropical depression, locally named Seniang, was about 1,000 kilometers (600 miles) east of Leyte island and was forecast to make landfall on Saturday, before moving in the direction of the central city of Cebu, where Asian leaders are gathering for a three-day summit starting Monday, according to weather projections.

    There’s enough warning because landfall won’t be happening till Saturday, enough time to prepare the poor people who are found in the areas targetted by the storm to the right things.

    Let’s see how this failed government reacts.

    These disasters are oftentimes signs from up above that God is not pleased, but the Devil Woman thinks this is good omen because it brings her government big monies that she cannot produce actually. It justifies the doctoring of figures her minions do to show that she is succeeding even if she is not. ‘Tado? You bet, she is! Diyan sila yumayaman sa mga abuloy especially from overseas!

    Another storm? Sana mawasak ang mga properties ng mga magnanakaw na ito. Let the wrath of God be upon them! Baka matauhan although the way I see it, we are dreaming an impossible dream.     A just concluded press conference by Ambassador Paynor & Gov. Garcia from Cebu International Convention Center announcing the postponement of the 12th ASEAN Convention which is scheduled to be held there next week.

    The main reason is the forthcoming storm as posted above by Anna. Methinks it is a very shallow alibi. The events in the House of Representaives last Tuesday & Wednesday which will eventually okayed the con-ass. Expectation of rallies in various cities and municipalities in the Philippines as a protest to this mockery of changing the House rules is a violation and consequently adoptation of a house bill in haste. The leaders of the ASEAN will be witnessing this rallies and the Tiyanak’s administration and her minions would not like this to happen.

    So be it, they are sweeping the dirt under rag. Hypocrites!

    Japanese NGOs call on Arroyo gov’t to stop political killings

    Six non-government organizations (NGOs) from Japan yesterday called on the Arroyo government to put an end to the spate of extra-judicial killings in the country.

    The Japanese NGOs visited the Philippine Embassy in Japan and submitted petitions asking President Arroyo to take immediate measures to stop political killings in the Philippines.

    In a meeting with First Secretary and Consul Sulpicio Confiado, the NGOs expressed “grave concern” over the increasing number of political killings in the country targeting mostly members of leftist

    organizations, church workers, journalists, lawyers and other social activists.

    Makato Teranaka, secretary general of Amnesty International (AI) Japan chapter said the Arroyo administration must implement measures to put an end to the murders.

    “Concrete measures to prevent such killings must be implemented as soon as possible,” Teranaka said.

    Michinori Mano, executive secretary of the National Christian Council in Japan, noted that churches in Japan are engaged in this campaign based on close links with churches in the Philippines, established over the last 30 years.

    Mano said he does not understand why the Philippine military, which is accused of having a hand in the killings, could be linked to the issue, when its duty is to protect the lives of civilians.

    “It is hard to understand how such policy can be conducted by a democratic country,” he added.

    Like Mano and Teranaka, Naomi Kanzaki, development finance and environment program officer of Friends of the Earth Japan, cited a case in Pangasinan where a certain Jose Doton, chairman of a local farmers’ organization opposed to the Japanese-funded San Roque Multi-purpose Dam Project was shot dead on May 16.

    The case has yet to be solved even with the establishment of Task Force Usig and the Independent Melo Commission tasked to investigate the extra-judicial killings.

    While the Japanese NGOs recognized the efforts of the Arroyo government to solve the killings, they expressed belief that such efforts are insufficient as “(the) killings continue unabated and there is no positive sign that those responsible will be brought to justice.”

    “We Japanese NGOs are particularly worried that the declaration of an “all-out war” on communists and the labeling of those critical of the government as “enemies of the State” by the government have increased extrajudicial killings,” Kanzaki noted.

    In its petition, the NGOs namely AI, Japan Campaign for Future of Filipino Children (CFFC,) Philippines and Japan Friendship, Friends of the Earth Japan, National Christian Council in Japan and Wayawaya condemned the political killings.

    The groups also demanded the disbandment of death squads, private armies, vigilante groups and paramilitary forces and proposed that all reports of political killings be investigated and given due process. They also said it should be ensured that all those found guilty of committing the crimes be brought to justice in accordance with international standards.

    After the visit, the NGOs also gathered signatures for a petition to be submitted to the Japanese government.
