Statement of House Speaker Jose de Venecia and the Majority Coalition, House of Representatives

Speaker Jose de Venecia and we, the leaders of the majority coalition, met in a caucus yesterday, to consider alternatives or variations to the existing “Constituent Assembly” scenario that the Senate has resolved to boycott – irresponsibly, in our view – despite the formal letters of invitation that the House Secretary-General has caused to be issued to all the 23 Senators and the 232 Congressmen.

We agreed to firm up our collective decision to hold national and local elections on May 10, 2007, and not o consider other proposals to hold the election son Nov. 10, 2007. or a technical extension of six months, to enable the Commission on Elections to computerize the elections and prevent any recurrence of dagdag -bawas.

The House has undertaken difficult but legitimate steps, in accordance with its rules and its Constitutional mandate, to convene the Constituent Assembly beginning on 12 December 2006. The caucus confirmed that the majority coalition has the 195 votes – three fourths of all the members of Congress – sufficient to propose constitutional change.

The Senate has closed its doors on this mode of amending the 1987 Constitution- even while it claims that it is not against charter change.

Modernization of the Political System Our Overall Aim

We in the House majority coalition regard the modernization of the political system as the urgent effort to which we, the country’s political leaders, must all dedicate ourselves.

We see the work of modernizing the political system as encompassing the following key tasks:

1) Strengthening our political parties and raising the electoral process beyond the reach of partisan politics.

2) Moving from the protectionist to the open economy, as the only way of competing in the global market and of growing at a rate high enough to reduce poverty progressively.

3) Professionalizing the civil service.

We believe that these priority tasks are best accomplished through a structural shift from the presidential to a unicameral parliamentary, which will produce more efficient, more accountable and much less expensive government.

Specifically, by these shifts, we wanted to put an end to our democracy of deadlock, continued fighting between Malacañang and the Senate, continuing conflict between the Senate and the House, repeated impeachment, coup and destabilization attempts, poisonous and destructive politics that have kept our economy lagging behind the Eat Asian economic tigers.

Our Challenge to the Senate

On behalf of the House and the Filipino People who clamor for constitutional reforms to provide the lasting structures for political stability and economic growth, we challenge the Senate to muster immediately the constitutional requirement of two-thirds vote of its members to call for the election of a Constitutional Convention (Con-Con).

With the same consensus and determination by which the House has geared itself for a Constituent Assembly, after winning two decisive votes in 48 hours last Wednesday and Thursday, we are now immediately prepared to give our nation at least a 2/3 vote of our members in the House to call for an election for a Constitutional Convention, to be held simultaneously with the may 14, 2007 elections.

While awaiting the Senate’s response to our challenge to a ConstitutionalConvention, WE ARE WILLING TO POSTPONE CONVENING THE CONSTITUENT ASSEMBLY BY A FEW DAYS. (72 hours after Monday)
The simultaneous selection of members of Congress, governors, mayors and other local officials with the candidates for delegates to the Constitutional Convention, at two per congressional district, or 426 delegates to be elected, will save a considerable sum, since the election of delegates separately will cost at least P3 billion, which is badly needed for the building of damaged infrastructure in the wake of the Bicol typhoon destruction and many other requirements of the nation.

Appeal to Civil Society

Today, we appeal to civil society – to the churches, to non-Government organizations, and to professional and business groups – to pressure the Senate to vote where its mouth is: to produce the two-thirds vote for a Constitutional Convention that will enable Charter Change to begin in earnest.

We Must Send Out a Message of Hope

Over the next 10 years, our country must complete its modernization – or forever remain a backwater of East Asia.

The struggle will be hard, but we cannot slacken. For we must give back the future to our young men and women. We must restore to them the hope that tomorrow will be better, and that the hope is to be found – not in foreign lands – but here at home, in the land of our forefathers.

    The new Chief Justice (CJ) of the Supreme Court, Reynato Puno, is correct in saying that comparing the people’s initiative (PI) to the House of Representatives’ Constituent Assembly (Con-ass) is no different from comparing apples to oranges, since the two moves to change the Charter by the Gloria government certainly hold different constitutional issues that must be resolved.

    Still, apples and oranges can be compared, if the comparison would be pegged merely on price. The price of apples and oranges in the country, both being imported fruits, can have the same cost.

    And if price is to be the gauge in both the PI and the Con-ass, in so far as the Palace price tag goes vis a vis the administration allies for their all-out support to push through changes in the Constitution, the apple that is the PI and the orange that is the Con-ass, can certainly make it on the comparative grade.

    Already, reports are out that two Negros mayors had admitted having been given by Gloria a “cash gift” of P20 thousand each, which is supposed to be in exchange for their support for Charter change (Cha-cha). No doubt, the congressmen, 165 of them in attendance for two sessions running, were also recipients of an even bigger cash gift from Gloria. Would they have stayed two nights till early morning in a row in plenary without any sweetener that tastes like cash?

    But constitutionally, both the apple and the orange are constitutionally infirm, even if the new CJ insists that his stand on the PI has been steadfast, which makes one speculate whether he, being the CJ, would now allow the prohibited second motion for reconsideration on the PI, thus paving the way for a plebiscite anyway.

    Still, it would be better for Puno to leave the dead alone, as doing a Lazarus on the PI would merely blacken the high court under his leadership and generate the impression that indeed, the Puno Court is a certified Malacañang rubber stamp.

    In the case of the constitutionality or the constitutional infirmity of the House’s unilateral Con-ass dancing to the tune of Cha-cha, it would be extremely difficult for the high court to declare this House move as constitutional, without coming off as Gloria’s lapdogs, for the simple reason that there is already an existing doctrine that the Congress is made up of two houses, and one chamber certainly can’t pull off a Con-ass even if it garners 195 House votes arithmetically, and even if one Gloria senator participates, since a senator does not a Senate make. There could be an overturning of this high court doctrine, if the Puno Court chooses to do so, but, as pointed out earlier, for the court to do so would cement the public perception that Puno’s appointment was a deal forged in exchange for him to rally the court in upholding Speaker Jose de Venecia’s unconstitutional Cha-cha through the Con-ass since there can be no logic in a court ruling that upholds a one-House Con-ass and rule this as a constitutional congressional act. To do so would be to effectively abolish the Senate, making it an adjunct of the House.

    What the House allies of Malacañang and Gloria herself should fear is the gathering of people who are done with their unconstitutional acts and who protest the House Con-ass, as well as the coming polls, where they who railroaded the Con-ass and showed their disregard for the people’s voice and their constituents, as well as that of their constituents, will feel the wrath of the voters, as this issue, as well as their murder of the impeachment complaint against Gloria Arroyo will be the main campaign issues, not to mention the unbelievable plunder of the national coffers under the Arroyo regime.

    That a gathering political storm is on its way is evident. All sectors against Cha-cha through the House Con-ass are bent on showing their rejection of this new fraud. The bishops are united in making their opposition against this loud and clear, with their announcement of holding a massive rally at the Luneta, followed by yet another massive rally staged by the El Shaddai. And there is the detained leader, Joseph Estrada, threatening to call on the people to mass up in the streets and condemn this rape of the Constitution. His call can never be underestimated. The coming together of all these forces can certainly pose a nightmare of great proportions to Gloria and even her loyal military and police, as the people can hardly be stopped, if they come in the hundreds of thousands — unless of course, Gloria’s goons want, at the least, rioting if the police insist on a violent dispersal, and at the most, blood in their hands, which would make the indignation rallies even worse than the prayer rallies.

    Always, Gloria and her allies have been in fear of massive rallies, as these could lead to her being toppled but as long as the groups were not united behind a cause, she was safe. Besides, the Catholic church bishops have been largely in support of her then, but are now clearly against her and her plan to reign long after 2010.

    The bishops’ stand can only translate to their having withdrawn support from Gloria and she is now left with only the military and her police, which are divided.

    But can her military and police still support her when the nation is against her?

    2 venture funds offer P25B for 7% gov’t stake in PLDT

    Two investment funds submitted offers of up to P25 billion for the government’s seven percent stake in Philippine Long Distance Telephone Co. (PLDT) that the court recently awarded, according to the Department of Finance (DoF).

    The DoF, which oversaw the sale, said Parallax Venture Fund XXVII offered P25.2 billion while Pan-Asia Presidio Capital offered the minimum price of P24.9 billion for the stake but PLDT parent, First Pacific Co. Ltd., which owns 24 percent in PLDT, has a right of first refusal over the shares.

    The government has reclaimed the shares as part of a long-running legal battle to recover wealth illegally amassed by late former dictator Ferdinand Marcos, who was ousted in 1986.

    PLDT chairman Manuel Pangilinan, who is also the chief executive of First Pacific, said First Pacific would not participate in the bidding but would exercise its right to match the highest offer for the shares.

    The Finance Department said the process can take up to 90 days at most.

    Japan’s NTT said earlier this year it wants to raise its stake in PLDT to 20 percent from about 14 percent now held through its units NTT Docomo Inc and NTT Communications.

    As I read the speech in fact, I felt my blood pressure rise up. Good thing, I have taken my medicine so there is no worry of getting a stroke.

    A non-partisan con-con for real reform

    In order to have his cha-cha, JdV is now doing the zarzuela. He has offered to backtrack on the con-ass if the Senate accedes to a constitutional convention.

    JdV has in effect conceded that while he has the tyranny of numbers in the parliament of the trapos, a solid majority in the parliament of the streets is adamantly against con-ass.

    However hypocritical is JdV’s shift to a con-con, it is a temporary and partial victory for groups opposed to the trapos’ cha-cha and con-ass.

    But the fight continues. A business-as-usual con-con will not be an independent body and will not lead to real reform. Such a trapo con-con will be packed by the wives, sons and daughters of de Venecia, Nograles and Villafuerte.

    The workers want a non-partisan constitutional convention to be a vehicle for social reform and social change.

    JdV’s one step backward should now be an opportunity for the people to have their two steps forward. To be non-partisan, the con-con must provide for proportional representation to the masses whose voice is not heard in the present political system.

    The workers and farmers and their sons and daughters must be the majority in the non-partisan con-con. Else we will just have a con-con that is a caricature of JdV’s House of Representatives. ###

    What’s going on? First, the People’s Initiative was rejected by the Supreme Court. Then, the Con-Ass was met with very strong protest by many groups including powerful religious groups. Now, JDV and his gang tries the Con-Con. Con-Ass or Con-Con, it’s all the same. People don’t know what it is. Changing and amending the constitution was not clearly explained to the people. Many believe that what’s needed is not a change in government, but change in the people running it. And the only way to replace these incompetent and corrupt politicians is election. Election in 2007 is what the people want and needed.

    If Con-Con, electing delegates, was possible, why didn’t they just pick this from the very beginning? So much time and money was wasted to push the Cha-Cha and then Con-Ass. Malacanang is playing the game only to its advantage. It has fooled the people and still keeps fooling us.

    Many agree that amending the constitution is not wrong per se. What’s wrong is the manner Malacanang and the House do.
    They just have too many tricks in their bags. People no longer believe in what they say and do…

    The house of “Representatives” state that the reason for Charter Change is to reform the governance, and the overall system of public administration to eliminate or minimize the ‘plaque’ that besiege the present system, and that is a shallow excuse. They Congress as a whole could start by reforming themselves. Changing a charter or amending it which we already done quite a few times has not reformed anything, but instead made it worse. What assurance can these bearers of Good Governance can give the people that Cha-Cha is nothing but a Rumba with a little quicker close, open steps? A charter is not like your Underwear, that you just change it anytime you want, before somebody tells you. It is there to be the basis of behavior of all its subject, but take a look as whose the very first people who twist and bogie and waltz around the Charter and now they want to Cha-Cha (meaning double steps on it). If your really want a charter change, do it the proper way. Consult the public, the voters, all parties of interest and build a consensus of what need to be done, how to go about it, instead of ramming it from PI to con-ass and now con-con. And if you still can’t figure how to start, ask permission from our
    Queen and copy our Charter of Rights with little modifications and start from there. You just can’t go wrong…

So JDV and arroyo’s allies are looking for somebody to bail them out. And that somebody is the Senate, the one co-equal body they’ve been trying to ignore all along and want to abolish.

    What the Speaker did was not quite throw in the towel or adopt a proposal for a Constitutional Convention completely. They’ve only provisionally done so (the House leadership). In truth, nothing has changed from their position from last Thursday: they said they’d give the Senate three days to participate or not, in a Constituent Assembly. Now, they’re trying to deflect attention by calling what the think is the Senate’s bluff, by saying Senate should now move on a Constitutional Convention. But -and this is how we see the House leadership’s true colors- if the Senate does not do what the House leadership wants, within the House’s deadline, then the House will go ahead and do what it wanted to do -go it alone….

    The political gamble here seems simple enough: deflect public outrage by trying to pin the problem created by the House, on the Senate; try to deflate gathering public opposition not just in Metro Manila but the provinces (I’ve just returned from Bacolod and was amazed by the ferocity of outrage over what the House has been doing); prevent the House being besieged by protesters on Monday or Tuesday and Luneta and public plazas in Visayas and Mindanao being filled with indignant people next Friday; divide public opinion by dangling a reformist statement while hoping no one notices they haven’t really changed their minds or intentions.

    JDV tries to act tough and threaten to pursue CON ASS if their demands were not met within the deadline by the Senate, but he knows things can go from bad to worse if he goes unilateral with this.

    So I say, screw JDV and Arroyo and all tongressmen allies. I hope the Senate doesn’t bail them out of their foolish UNILATERAL CON ASS.

    Nothing is more illigitimate than interpreting the constitution to advance personal interests at the expence of the FIlipino people. Majority of the people do not like changes to the charter, marunong ba silang umintindi. O talagang, nasira na ulo nitong mga buwayang ito (my apologies to the real crocodiles). They speak of constitutional mandate, hindi ba mandated din silang respetuhin at igalang ang batas? Something is really wrong, really wrong!!!

    The plan of JDV is to let members of the senate to participate and join them in tackling the issue of cha-cha thru CON-CON. If a significant number of senators would join in, then the whole “process” would have some semblance of legitimacy.

    Remember that they desperately need the senators to join in to “legalize” their con-ass which fortunately they don’t have.

    At the beginning, Gloria Arroyo’s Charter Change has no solid foundation; it’s filled with deceit and greedy intentions. The legitimacy of GMA presidency keeps on haunting her. These shameless pigs are trapped in a quicksand. There’s no way-out and no rescue on the way. Every move from fake People’s Initiative to fraudulent Constituent Assembly and renamed CON-CON and it seems that they are sinking to their grave pit. They’re not stupid enough not to know whether ConAss or ConCon, the Gloria group is in desperation mode and would stop at nothing to push their sinister plans.

    The Legions are not as wise anymore as we thought them to be. They’ve put themselves in a position where they can’t win anything anymore. The 72-hour deadline would pass without getting any quarters from the senators. Only blokes would heed their challenge, who would want to be a witness to your his own murder.

    So ConAss it is, and another false move by Gloria’s camp only further emboldened more groups into joining in the massive rallies. This is the final push. No more compromises, no more negotiations. We will be making our move. God help us all.

I just received this forwarded text from my friend (who blogs at MLQ3’s at this time) that says the Friday morning tension will be such that before the rallies begin, Gloria will announce that she is disowning JDV and the whole Lakas party and that Kampi is nominating a new Speaker in the House. This will be folowed by the crossing of many Lakas members over to Kampi who will stand down the chacha train. This might still be part of the scenario that Vic blogged yesterday. I don’t buy it.

    There’s no logic for supporting JDV Con-ass and at same time they want May 2007 push thru. It had been decided by the majority members the postponement of May 2007. They are just fooling their constituents. Sinong maniniwala sa kanila? Matagal na tayong binababoy.

    It is also evident that GMA and Speaker Joe, along with their congressman-allies, fear the backlash of the voters come May 2007, which is why Metro Manila congressmen announced their opposition to the postponement of elections.

    Yet this is pure bull, coming from them. If they were truly against the No-el, why then, during the railroaded plenary, did they not register their opposition to this, especially during interpellation of the resolution? It was evident that No-el was in the works under the House Con-ass, as Gloria’s loyal lapdog, Rep. Luis Villafuerte, was hardly vague about No-el.

    Besides, who are these Metro congressmen trying to fool? They claimed they were still for Con-ass, and only against No-el, yet they certainly know that if Con-ass pushed through, there is nothing they can do by way of plenary discussions, even if, assuming they truly were against No-el.

    The time to have objected to No-el was during the railroaded plenary sessions. They did nothing by way of objecting to this postponement of elections. Only when the people’s wrath was felt did they do so.

  78. If the House Speaker is JDV or Pichay whats the difference. There are so many problems that will be sorted if this Palace is vacated of these liars & thieves, JDV is but only one problem and quickly replaced by another problem. I just hope that the masses will seize this opportunity of demonstrating their anger and not wait for the church leaders, some of whom are ready to listen to a liar and a thief according to the reports of the Four Officials from the INC “secret” meeting with GMA arranged by Mike Defensor.
