Etta writes Noynoy on Hacienda Luisita

Five years ago, at this time, tension filled the air at the Cojuangco family-owned Hacienda Luisita in Tarlac as workers staged a strike against the Stock Distribution Option that the Cojuangcos implemented to evade the Comprehensive Agrarian Reform Program, which was supposedly the centerpiece of the People Power-propelled Cory Aquino government.

Aquino promised to put Hacienda Luisita under the land reform, but in 1989, instead of having the land distributed, Aquino implemented the Stock Distribution Option (SDO) program under which the 5,000 farm workers were given shares of stock in the company instead of individual titles to the hacienda land.

On the second week of November 2004, Hacienda Luisita sought the help of the Arroyo government, which gladly sent members of the Philippine national Police complete with armored vehicle carrier. Hostilities between the strikers and the police escalated. On November 16, the police fired at the strikers. Seven were killed on the spot , 72 were badly injured, 27 sustained gun shot wounds, and 110 were arrested by the police. That became known as the Hacienda Luisita massacre.

Seven more persons involved in the Hacienda Luisita case were later killed in separate incidents.
Last Sunday, Former Sectoral Representative Loretta Ann Rosales, Akbayan chair emeritus, wrote Senator Benigno “Noynoy” Aquino, III, the Liberal Party presidential candidate on the Hacienda Luisita issue.

Here’s Etta’s letter:

Dear Noynoy,

I write you as friend and former colleague in Congress re Hacienda Luisita, an issue that involves not just your family and the farmers of Tarlac but, of larger import, the issue of land and the crisis of food production threatened by climate change. I make this an open letter to include in our conversation the people who have clamored for you to run for president.
“November 16 marks the day when seven farmers of Tarlac were killed initially and scores injured by security forces that attacked protesting farmers pressing to open the gates of the Hacienda. It is therefore no surprise that the issue has surfaced in a broadsheet and will continue to be the subject of media reports to get your position on the matter.

The following points may be helpful for us to consider.

We are all committed to seeking a peaceful and just solution to the issue of Hacienda Luisita farmers. This is in line with the spirit of social justice defined by international law on human rights, the 1987 Charter and tenets of the newly passed CARPER law (although some of its provisions remain controversial, as they represent views from recalcitrant landed interests).

Perhaps we can address specific issues on the ground and resolve them from a rights-based perspective, the underpinnings of governance that ensures government for all and not just for a few.

One, while you may not have been aware, it is true that Hacienda Luisita Inc. issued a letter stating that all occupants must vacate the land end-October. This triggered strong emotions from farmers who had occupied the land as a matter of survival, which occupation followed the paralysis of organized production with the tragic killings of November 16 and shortly after (a total of fourteen farm workers were killed).

Two, it is equally true that some of the occupying farm workers did rent out the land they occupied to those who were financially capable of using the land for crops they wanted to plant. It must have been a matter of survival – they had nothing to eat, they had zero income, they had no capital for production. Renting out was a way of making both ends meet while the land reform question remains pending. One can readily conclude that it mattered less to the farmers that the renters were insiders or outsiders, farm workers or not. To provide food and shelter for the family was paramount.

Three, the issue of Stock Distribution Option (SDO) as an agrarian reform scheme precedes CARPER; it was in Section 31 of the original CARP. We now have to deal with the new law.

Four, SDO likewise preceded your run for the presidency; you inherited a problem that needs to be resolved peacefully but with dispatch for the common good. This is especially urgent in the light of the emerging food crisis where climate change has affected not just Philippine rice fields but also fields from Vietnam and Taiwan, traditional sources of imported rice.

Five, when farmers lack capital to produce crops, they will not hesitate to reach out to outsiders to rent their lands. Sending notices to the farmers to rid them of non-SDO members does not alleviate the hardship. It merely exposes the problem of the dearth of capital and support services.

Six, the only guarantee that support services can be provided the farm workers is after the land has been fully and completely awarded to them by the DAR. And this is at least a possibility under the CARPER framework.

Seven, AKBAYAN is committed to the call for land redistribution in Hacienda Luisita and we hope that our current alliance with the Liberal Party will hasten and facilitate the enforcement of this call. We look forward to a meaningful and long-term solution to Hacienda Luisita anchored on social justice, human rights and an ecology-based system for sustainable development.

    Be reminded that the Cojuangco Family applied for a TRO to stop the land distribution in Hacienda Luisita to the “Stockholders” under the now-revoked Stock Distribution Option which exempted the Hacienda from Cory’s much-vaunted centerpiece legislation, land reform.

    Several farmer’s lives and some years later, the issue remains unsolved.

    Noynoy does not need to be president FIRST before he resolves the crisis. All he has to do is to withdraw the case lodged at the Supreme Court.

    That is his moral obligation to his workers. He has to do it now. If he loses his bid because of this issue, no future remedies can undo the damage to his political career, nor to the ambitions of his handlers.

    Meron sagot dyan si Ate Ballsy na minority raw sila sa Hacienda Luisita, and if it’s only them (the siblings), they can easily decide on that problem…to that effect.

    On this issue, I’d like to hear Noynoy’s categorical answer. I’m not black and white on this particular issue because I don’t understand HL’s setup, but for the sake of the workers he better define himself on this.

  9. NoyNoy has also shown instances of how he makes decisions when faced with problems that also affect his relatives and business partners. Farmers’ issues is secondary. Blood is thicker than water as he protects the interest of his sisters, then his relatives, then his business partners.

    For all the vaunted “pro-poor” PR hype, it’s about time somebody raised and forced the issue of Hacienda Luisita back into center court.

    In the end, Noynoy winds up as the oligarch classes’ version of Erap.

    I’m puzzled why Etta Rosales wrote this letter. Akbayan is allied with Liberal Party. In fact, Akbayan sectoral rep Rissa Hontiveros-Baraquel is in the LP senatorial ticket.

    That’s also the reason why Bayan (Satur Ocampo and company) is not allied with LP.

    After Cory called for Gloria’s resignation one year later, the SDO was revoked by Putot’s gov’t.

    Unang una hindi labag sa batas ang SDO. Isa yan option na binibigay ng Carp. The terms and conditions of the SDO are subject to mutual agreement between the corporate owner and the farmer. It is not something imposed by the corporate landowner .

    Ikalawa, Cory Aquino did not implement the SDO on Hacienda Luisita. Nasa batas na yun at ang hacienda at ang mga farmers ang nagdecision na pumasok sa SDO. Kapansinpansin din na yun SDO nagumpisa nung 1989 at ang gulo ay nangyari lang noong 2004. Ano ang nangyari nung 2004 at nagstrike ang nga farmers?

    Ikatlo, humingi na tulong ang mga Cojuangco sa gobyerno kasi nagkakagulo sa hacienda. Nagpadala ang gobyerno ng pulis to maintain peace and order. Nagkabarilan, maraming namatay at nasaktan. Dapat imbestigahan ang pulis kung bakit nagkaputukan. Bakit sisisihin ang mga Cojuangco, si Cory at ngayon si Noynoy dahil namaril ang mga pulis? Sila ba ang nagbibigay ng order na pagbabarilin ang mga strikers? Bakit ilalagay ang baril sa kamay ng Cojuangco, ni Cory at ni Noynoy?

    The CARP passed by Congress and signed into law by Aquino was not perfect. Many landowners took advantage of the law to avoid actual land redistribution. But they did not go outside the law. So the solution is to amend the law to make it more effective.

    There was a chance to do that when Congress was debating the extension of the CARP law. Party list representatives could have gotten the support of the public for amendments to the law, But nothing happened. party list amendments didn’t pass, the public didn’t care, and CARP was extended. Kasalanan ba din yan ni Cory at ni Noynoy?

    I think AKBAYAN Etta P. Rosales letter to Noynoy Aquino, although with basis is reasonably unfair. In my view, one cannot look at the farmer’s side alone without consideration to the landowner (investor) side if one is to promote social justice as defined by international law on human rights, as stated in the letter. One cannot take one’s property and hand it to another without just compensation or force someone to sell if one does not want too in the spirit of social justice, human rights and an ecology-based system for sustainable development; however you want to call it, especially in the case of Noynoy who doesn’t own it 100%.

    The concept of land redistribution related to land reform law when thought out before was good but not anymore and cannot easily be implemented at this time because it promotes CLASS WAR, as an example. If to be implemented, as defined by our law, it has to be across-the-board without exception to include the government and church lands. It’s a bad law in my opinion because it’s not supported by meaningful growth and development for both sides, other than farmers on the receiving end. Currently, at this stage most landowners do not want to invest in their own lands and farmers keeps leaving on it waiting, a status quo we cannot afford to maintain. In addition, landowners are not just the rich but also common people and farmers affected by the same land reform law we have now. AKBAYAN needs to consider looking at this issue in a different way in a spirit of reality. In my opinion, we need to find a solution wherein both farmers and land owners can benefit from the land they share common interest with, wherein everyone share everything at times of prosperity and at times of lost and not just landowners shouldering everything simply because they are the landowners or farmers earning pittance for their labor.

    The relationship between farmers and landowners need to be revisited in such a way that compensation for farmer labor or investment by landowner is clearly defined with both side consulted and agreed on. It can be in the form of farmers compensated as an employee of landowners if they so wish, farmers forming cooperative and arranging a contract with landowners to till their lands, and/or farmers thru their cooperative investing or borrowing to buy their own land to farm, depending on how they want to set it up, as a few suggestions. Government needs to step-in by assisting and promoting education and technology transfer for both farmers and landowners alike, to include promotion of competition and growth in the agricultural sector to create jobs and market. Government subsidy to this sector may be required until such time it can stand on its own. With over 80 million people in our country, we have a market.

    At this time, instead of focusing on one person or issue, we should focus more on how to collectively get rid of thieves and corrupt in our government and structurally fix while were at it. Our government, military, and our justice system need a major overhaul so that it will function properly when dispensing services and justice. It will be very hard to implement all the laws of the land if we don’t have a credible government accountable to the very people they serve top with a very slow justice system, causing most of the failures of implementation and loss of resources affecting everyone. The issue of the redistribution of land and wealth is achievable without forcing others to give up what they own. It has to be based on justice, free market system and growth with farmers justly compensated for their labor with opportunity to become future landowners and landowners have descent returns from their investment and from what they own.

    fact is, hacienda luisita will either be noynoys buckingham palace or his waterloo. he better come up with a clear and good explanation because of the barrage of negative attacks on him.

    he should be ok at the moment given the sympathy he’s riding on, but if he lose this, it’s on him.

    do we really want this kind of campaining??? sabi nga dun sa taas “dog eat dog”? i thought in the beginning were’ all in here to serve as check on corruption. moral ek ek sum’tin sum’tin should we also not put a check on dirty politicking? or same same? or worse of the same?

    We can best serve the interest of the farmers by giving them an opportunity to earn a descent living instead of having them force themselves in picket lines and ask for the land that nobody wants to give, except for the very few who is willing to share. We cannot have the farmer’s sabotage once living either by having them block one’s property and use them as pawns for tragedies that may follow. Not all landlords are evil and not all farmers are saints either. In reality, we are in a revolution, armed and ideological, with one taking advantage of another, of any circumstances that may arise from any tragedy, us caught in between.
    What we really need is a progressive formula that both landowners and farmers can benefit collectively from the same land they live on for progress. A credible Government and Justice System that balance each side instead of forcing us to pick one side, between the rich and poor, that nobody fully understand.

Expect the Chiz bashers to make this a campaign issue especially so that he comes from Bicol, the hotbed of communist insurgency. . .maybe some of his pork barrel went to. . .oh man, I’m beginning to like this. . .

    That’s why, I think, we need to have an effective leadership to address the plight of poor farmers, or the poor in general. An empty stomach knows no laws. The wanton disregard of human rights by “some” abusive people in government must also be addressed. Pag desperado na ang isang tao, kakapit na yan sa patalim, at madali silang ma-recruit ng mga makakaliwa. They will easily be exploited by the left.

    Matagal ko ng hinihintay ang sagot ni Noynoy tungkol dito sa Hacienda Luisita. Nakakainis kasi eh, lahat nalang ng sagot niya malabo. Categorical statement kaya ang gusto ng mga tao. Pag ipinagpatuloy ni Noynoy ang pagpapasafe, malamang malaki ang epekto nun sa kandidatura niya.

    To those who are crying unfair; (re: Etta’s letter) should accept that all is fair in love and war. Politics is war, even more brutal to say the least. And besides issues that needs resolution usually surface during election time. The reason is to force the hand of the one involved, as in this case Noynoy.

    SDO is not illegal but murder is murder. For whatever reason there’s no justification for murder.

    Even hardcore criminals doesn’t deserve to be murdered just like that, much more these poor farm workers of Hacienda Luisita who were just exercising their right to air their grievances and their right to be heard. Pagkatapos pagpapatayin na lang sila, Yan ang matatawag na pangaabuso, pangaapi at pagpatay sa mga mahihirap. At sa mga nakapatay mayroon bang naparusahan? Of course nobody, nasa teritoryo ng mga Aquino at Cojuangco yata at mga untouchables yan. They are above the law at doon sa kanila sila ang batas. Pasensiya na lang yong mga namatay dahil kahit kailan walang hustisya silang mahihintay sa mga Aquino.

    It’s not to disrespect Cory but sometimes I wonder how she and her family can sleep soundly at night without being bothered or haunted by those people killed inside their property. Did they really live and now living in peace with themselves? Just curious because by just hurting the feelings of somebody worries me, how much more if you are instrument in a murder?

    It’s true to every candidate not only to Noynoy. More of these things will come out in the open. What do we expect, it’s election time. Whether it true or not, it’s just a matter of how a candidate defends and extricates himself out from every attack.

    Now how can Noynoy justify these murders? Self-defense, self preservation or just a simple massacre, anyway it’s only 14 lives were lost.

    The question is, who ordered them killed? Cory? Noynoy? Murder? Premeditated? Think again! It was a set-up job by the left who knew that PO1s from the police and private kamotes of the army will be made to man the barricades by inept commanders. When agitators from the ranks started to rain pillboxes and stones on the hapless rookies, many of whom were injured seriously, in case u would care to know, how do u think these guys would have reacted?     To my knowledge the police line of work is not to shoot and kill. They are for peacekeeping and not to kill unless it’s extremely necessary. And what then necessitate them to kill?
    And the killing who knows if it’s premeditated or not. They were there and the main reason was to silence and to stop the strike, so how many options do they have to do it? Just one and that was what happened.

    So if it’s not murder, what is it? Just plain killing, that’s it? Debatable or not, it’s still killing and lives were lost and it happened inside Hacienda Luisita and the responsibility lies with the owner – the Aquinos.

    Anyway what’s the difference between murder and killing? Maybe in a court case, but in this case, nothing because whatever it means, lives were lost.

    Reason why case didn’t stick?

    They are above the law and they are the law and who dares to fight them? The farm workers, namatayan na nga sila baka ikulong pa sila. Lalo naman silang ka awa awa.

    Malaki ang pagkakaiba sa hacienda na palay ang tanim. Ang palay mahigit 3 to 5 months lang pwedeng anihin. Madaling iutang at madaling mabayaran pagkatapos ng 5 buwan. Hindi kumplikado ang pag mill ng palay para maging bigas. Kaya mas viable ang agrarian reform sa mga lupaing palay ang tinatanim.

    Skeletons in the Aquino-Cojuangco families’ closet are beginning to rattle.

    Sen. Benigno “Noynoy” Aquino and the Cojuangco family were direct beneficiaries of the P170-million private road interchange in Hacienda Luisita as well as a P80 million for the right of way (RoW), it was bared yesterday.

    This is said to explain why Senator Aquino refuses to dip into the P200-million double insertion allegation against his colleague Sen. Manuel “Manny” Villar on the C-5 road project which Villar’s accusers alleged benefited his real estate firm.

    It appears that the family of the Liberal Party (LP) 2010 presidential bet also had its share of blessings from the P33-billion Subic-Clark-Tarlac Expressway (SCTEX), having been gifted with a P170-million private road interchange built exclusively for Hacienda Luisita Inc. (HLI), on top of the P80 million paid to HLI as remuneration for the 83 hectares of HLI-owned land used for the road project.

    Wow. Aside from the massacre, it seems Noynoy also has his own “C5 scandal.”

    The article from tribune is very accusatory.

    I had used the entire expanse of SCTEX from Tipo to Tarlac Exit. Before Tarlac Exit is the San Miguel Exit which leads to Luisita Industrial Park and Hacienda Luisita. The Luisita Park (not Hacienda Luisita) portion of Tarlac is the biggest industrial/commercial area in the province. It is just logical that there is an exit leading to this area.

    To say that the San Miguel, Tarlac City exit was constructed “for the amount of P170 million and exclusively” for the benefit of Hacienda Luisita is misleading. And the title of the article which insinuates that Noynoy and family benefited P33B from SCTEX is malicious.

    As for the P80 million paid to Hacienda Luisita for the 83 hectares, the amount is the just compensation.

    Assuming that the 4% Noynoy was referring to was his share in the Hacienda (and not 4% of his family share in the Hacienda) he is richer by P3.2M. For the stature of the Aquino family, Noynoy getting that amount in exchange for the portion of the Hacienda is hardly scandalous.

It’s ironic that the woman who claimed to be the restorer of democracy, allowed the murder of poor farmers and injuring several others who were just exercising their right.The sad part, all the killers (hired killers ba, kasi their line of work is to shoot and kill) never been jailed, and the victims never tasted justice up to now.

    I find this disturbing if military people think this is right. By putting themselves in the same level of the NPA, they are demeaning their role as protector of the people.

    Extrajudicial killing has no place in a civilized society. Especially in a democracy that this country is supposed to be.

    If they were killed in an encounter, that’s understandable but testimonies on the disappearance of those activists say they were picked up (Burgos was in a shopping mall while the two students were in their boarding house.)

    If the military has proof that those people violated the law, which is the basis of order in our society, and which members of the military are sworn to uphold, they should have arrested them and charge them in court.

    Valid issues are not black propaganda. The one involved should be the one who will stand and defend himself and not to depend on others to do the job. Being the case Noy can hardly say anything except to say that it’s black propaganda. It’s easy to say it’s all mud-slinging but to prove that you are clean and honest is a different thing when evidence are there to refute otherwise.

    By the way, who is Roxas? Understandably being the running mate of Noynoy will stand up in defense because Noynoy has his mouth taped or maybe he doesn’t know how to address the issue, but, for all his good intentions and purposes he is in no way in a position to refute the charges.     The increase in the value of Hacienda Luisita area purchased for the Subic-Clark-Tarlac Expressway project was caused by the global economy, Sen. Benigno Aquino 3rd said Thursday.

    He was reacting to the charge of Rep. Crispin Remulla of Cavite that his family was paid P100 per square meter for the Hacienda Luisita portion of the project when the current market price for a sugar land is between P6 and P8 per square meter.

    Aquino said China was moving at 10 percent per annum and was making extraordinary demand on resources of the world. “(We became a collateral victim of the high price),” he said in the vernacular.

    He added the Bases Conversion Development Authority is in a better position to justify the prices as it has supervision over SCTex project.

    Aquino said the locators at the Hacienda Luisita were victims of lahar flows, and they were the ones who lobbied with the Japanese government because many of the locators were Japanese firms.

    “I did not lobby with Japan. President [Joseph] Estrada was the one who told me he was pushing for this road [Hacienda Luisita interchange] so I need not lobby for it,” he added.

    Aquino said his family wants to give Hacienda Luisita to the farmers. “But we want to leave only when we have formulated the plan on how they could pay the debts of the corporate farm. When that has been cleared, then we could bid goodbye [to Luisita management],” he said.

    With regards to the price and this is just my opinion..
    We trade internally using our currency the Philippine peso. Other countries have their own currencies as well China has the Yuan and US has the Dollar for example. Our currency is peg to the dollar as well as china. When you say peg it means it’s free floating. The currency dollar has equivalent value against various commodities such as gold, silver, oil, land, coffee, pork,etc. If the value of dollar goes down, the value of the commodities goes up and vice versa. Commodities is traded using the dollar because it’s very liquid although some countries trade with other currencies as well at a smaller scale In addition, currencies peg to the dollar is valued via exchange rate or forex. The exchange rate of our peso to the dollar is based on our GDP, employment, and overall business acitvity. Currently the exchange rate is approx. 1USD = 46+Peso. China is peg to almost over eight yuan to a dollar. The yuan should have been more valuable now (say 1 is to 5 as an exaggerated example) against the dollar because of its tremendous economic growth the last 10 years (at a rate of 9 to 10% growth annually). There is a big issue here with China because it’s government does not want to make the yuan reflect it’s true value even though it is peg to the dollar affecting it’s export abilities (in real terms revenue). US against China currency is another story. Let live it at that.

    Going back to peso…

    If the value of Hacienda Luisita per square is 6 or 8 pesos several years ago it may not be the same now if you are measure it with the land true worth. It will be higher now considering the US at that time has a surplus and the Philippine economy has been stagnant for quite sometime now at the same time China is growing..thats why our peso exhange against the dollar is as high as 46+ to 1 USD …if not for the OFW we are in big trouble now.

    100 peso per square meter is cheap (about $2.00 or Y16.00) if you are to consider the value of our currency peso (malalaman mo yan kasi ang pera katulad ng barya ay gawa sa metal ..nuong una ay silver ngayon tingnan mo tanso..at tska kapag nagkakaroon ng malalaking buo papel katulad ng 500 at 1000 pesos).

    Buying power of peso now is low isang daan parang piso unless we have a major economic activity to exchange it with.

    Hindi kumita ng malaki ang pamilyang Cojuanco dito. Tamang presyo lang ito.

    Kung government ang nag expropriate, susundin yung zonal value or market value or assessed value whichever is lower. Sa government kapag bibili, laging whichever is lower pero kapag sila ang kukubra, whichever is higher.

    Ang rule na yan ay hindi applicable sa SCTEX dahil ang SCTEX joint project ng private corporations. Isa itong pribadong venture. In this case, magkakaroon ng negotiated contract pagdating sa mga lupang maapektuhan. Ang pinakaimportante dito ay nagkasundo ang mga partido. Kahit pa x1000 ang value ng property, kung okay sa bibili, walang problema. Kung ako may ari ng lupa at negotiated contract, syempre gusto ko sa mataas ng value.

    Ang tanging exposure ng gobyerno ay yung guarantee nito na mababayaran ang pinautang ng mga hapon.

    Uulitin ko lang, hindi ito expropriation na ginawa ng gobyerno. Ito ay consensual contract sa pagitan ng mga partidos.
