IMPSA again

The Ombudsman may have thought that with their filing of graft and bribery charges against former Justice Secretary Hernando Perez in connection with his $2 million Swiss deposit, they were able to shoot two birds with one stone: They gave Gloria Arroyo something to impress the Swiss government with when she goes to Davos next week, and they protected Perez from the non-bailable crimes of plunder and money laundering.

That, they thought, closes the $2 million episode.

The Ombudsman action against Perez, however, revived the $14 million alleged bribe, through then Manila Rep. Mark Jimenez, of the Argentine power firm IMPSA (Industrias Metalurgicas Pescarmona Sociedad Anonima) for a guarantee clause they had assiduously sought but didn’t get from the Estrada administration.

Senator Ping Lacson has asked for a revival of the investigation of the alleged $14 million bribe with the question, “If Perez got $2 million, who got the $12 million?

Last Friday, Ilocos Sur Gov. Luis “Chavit’ Singson, Arroyo’s patron and Jimenez’ best friend, was on TV showing video clips and documents of IMPSA documents signed by Estrada. No doubt it was Malacañang’s attempt to muddle the issue.

The document signed during the Estrada administration did not contain government guarantee to the $340 million loans that IMPSA needed to get from international financial institutions because Estrada had adopted a policy of not giving government guarantee to private companies doing government projects, having seen how the loans guaranteed by the Marcos government have brought suffering to the Filipino people. (Almost half of the Philippine budget goes to debt payment.)

That guarantee was given by Perez on Jan. 21, 2001, four days after Edsa Dos and he was just two days in the DOJ.

Luz Rimban who first exposed the IMPSA-Perez-Jimenez connection in an article for the Philippine Center for Investigative Journalism, said that after Perez issued the ruling that “the Republic of the Philippines has validly and effectively consented to the transfer and assignment to the Lenders of all of CBK’s rights under the Government Undertaking,” 19 banks led by BNP Paribas, the Dai-ichi Kangyo Bank, the Industrial Bank of Japan and Societe Generale agreed to put their money into the CBK project.

CBK stands for Caliraya-Botocan-Kalayaan hydroelectric plant.

In December 2002, I ran the explanation of Estrada’s finance secretary Jose T. Pardo on that controversial guarantee clause. Since Malacañang is again trying to spin more lies, we are again reproducing here Pardo’s letter:

IMPSA was invited to undertake the Kalayaan project in 1993. Three years later, the Napocor approved the final terms of IMPSA’s proposal and the Terms of Reference (TOR).

Prior to the assumption of office of President Estrada, the NPC Board had already approved and confirmed the BROT (Build-Rehabilitate-Operate-Transfer) agreement with IMPSA. The Estrada administration, as it assumed office in 1998, had the contract restudied and reviewed.

It was only during the year 2000 when negotiations with IMPSA were resumed upon instructions of the President. On December 18, 2000, we were directed by the President under the full powers authority, to sign the Government Acknowledgment and Consent Agreement (GACA).

Despite objections from proponents, I insisted that the following provision be included in the GACA because it became apparent that a direct government sovereign guarantee was needed for IMPSA to obtain financing from its creditor banks: ‘For the avoidance of doubt, it is understood that nothing in this letter agreement shall be construed so as to convert the Government Undertaking to a direct guarantee by the Government of the Obligation of CBK to the lenders of the Omnibus Agreement. Neither shall this letter of agreement be construes to increase or expand the obligations of the Republic of the Philippines under the Government Undertaking dated July 12, 1999.’

The said Government Undertaking was signed by my predecessor, then Secretary Edgardo Espiritu who, during his time, also blocked any effort to commit the government to any contract involving sovereign guarantees.

To underscore the sensitivity of the IMPSA project, the GACA was not the ‘usual’ tenor. It was specifically and prudently crafted to ensure that the government’s interest will be fully protected. Moreover, we sought further the opinion of the Department of Justice that all provisions in the GACA were consistent with the provisions of the Philippine Constitution which recognizes no law impairing the obligations of the contracts. We likewise called the attention of the DOJ to the need for NEDA-ICC clearances.

But further noting my serious reservations on the GACA, President Estrada agreed to hold action on the project and on January 18, instructed then Executive Secretary Edgardo Angara to order Justice Artemio Tuquero to indefinitely put on hold the issuance of the DOJ opinion.

When I eventually left the DOF, IMPSA was among the pending matters which I turned over to my successor, Secretary Alberto Romulo. This was the subject of an internal memorandum submitted by then Usec Gruba and Asec Rodom Fetiza dated January 30, 2001 emphasizing the instructions of the President to indefinitely hold actions on IMPSA.

Then DOJ Secretary Tuquero never really got to opine on IMPSA with finality. Simply put, the document dated Jan. 24, 2001 that the Department of Justice issued was what IMPSA had long been waiting for, something which they tried to get but failed to get from then Secretary Tuquero.

The IMPSA project was not made ‘perfect’ and therefore not binding and enforceable, alluded to in recent news reports, during the time I was at the DOF and during President Estrada’s tenure.

This was how my role in the IMPSA project ended and I hope this statement puts to rest further allegations to the contrary.

    Kailan lang naitanong ko sa ibang thread kung ano ang kinalaman ni Sec. Tuquero, ang dating DOJ Secretary sa IMPSA. Now, it’s clear that he didn’t have the chance to opine the deal. After Erap’s ouster, Nani Perez immediately signed it. Kaya paano sasabihin nila na may kinalaman si Erap sa IMPSA. Kung niluto man iyan sa panahon ni Erap, ang final decision at pirmahan ay nangyari sa pag-upo ni Arroyo. Case closed. Perez is the culprit. And those responsible go up much higher. Huwag natin bitiwan itong kaso at baka mawala na naman parang bula gaya ng maraming iba pa.

    I agree with you mandirigma, at this point, people are only given an option of choosing a person less evil. Akala ko ba ang sabi dito, kahit sino mapaalis lang si Glue? It has been my point, if we keep on choosing same bad banana, the cycle of ousting leaders would not end. The only way we can overcome this is by strengthening some systems in govt. In other countries they have this shadow government. For each department headed by a cabinet member, there is a corresponding member from the opposition that shadows or make sure that the department is run well. Maybe, this can make our politicians better. Ang hirap kasi, kahit very clean kang pumasok sa politics, madudungisan ka once you’re in.

    Our foreign minister declined going there, and I’m not sure if Abe is stopping over for that summit with all the kabulastugan of the Great Switik. Even if our PM does, I bet you, he will make sure the unano who can lie big will not be able to take advantage of him nor his visit there. Thus, the early announcement about sweeter ties with China and invitation to the Chinese Premier to Japan in April.

    In other words, sira na si Switik. It is just a matter of time that she is going to be kicked out even with outside help especially from the US. I bet you the Malacanang squatters are now busy calling on their friends and fellow Ateneans boasting of being malakas to the Democrats to help them. I know one in fact from SFO, who boasts of being their bosom friend, and he introduces himself as a Democrat representing Filipinos in California. Kapareho nilang kapampangan!

    US has repeatedly sent out advisory travel to its citizens against going to Pinas. No one from the US administration wants to go there these days. I guess they’re treating Glueria as a virus, ayaw mahawa.

    Glueria’s worst record on human rights abuse is definitely not acceptable to democrats, and these Pinoys in the US claiming to be friends of the Great Switik are just dreaming if they think they could get democrats support for the bansot.

    It is so clear that foreign leaders are avoiding her like a plague. If there were those who paid her short attention during the Asean summit, it was just because of the event.

    Asean is in danger of being irrelevant.

    Just can’t imagine gloria telling Myanmar to release Aung San Suu Kyi from House arrest, she who is not releasing erap from his house arrest. How can she say that if her government is not doing anything.

    Phil, I asked Perez about this in a lunch meeting with women columnists when he was still at the DOJ. He said he had not time to read the documents because yun nga he was just two days in the job.

    I asked, if you had not read the documents, why did you sign it? He said He said the document was merely a transmittal letter.

  49. I just read Tribune, and was shocked to hear of how the Great Switik has turned out to be the Great Burot, too, with the appointment of Davide to the UN as a thank you gesture no doubt sans the approval and confirmation of the CA.

    Now, what sane and law-abiding Filipinos can do is sign a petition to ask for the UN not to honor the appointment of Davide. It can be done, you know, for appointments to the UN is not the prerogative especially of a bogus president, who needs to be exposed even worldwide as being fake and fraud!

    Was what Gloria did – swearing in Davide to be envoy to UN – legal?

    Davide is the worst judicial scam, heister, crook this country has ever known!

    Gosh, now he’s gonna go scot free (if he’s in the States and as an envoy, he’s untouchable!) even if Gloria one day faces the docks for crimes against the nation and the people with the complicity of Davide and the military!

    I despise Davide! May he and his family, with his two children involved in the SC funds shenanigans rot and rot alive!

    The recent ASEAN Summit had no new thing to offer. Tama po kayo Ka Ellen, they have been talking about it for 30 years. The groups just wants to have some leverage with the West. Gusto nilang ipakita na malakas ang grupo at kailangan malaman ito ng Amerika at Europa. Nothing significant came out of it as far as cooperation as a group was concerned.     As reported today by a newspaper: “Assistant Ombudsman Mark Jalandoni was quoted However, “plunder may still be filed vs Nani if there’s new evidence.”

    Actually, new evidence may not be necessary. All that may be needed is a correct reading and
    enforcement of the Plunder Law, not its “misquotation” tantamount to “unilateral legislation”
    of an additional requirement –that is, at least two illegal “transactions”–that is nowhere provided in the law.

    Ombudsman official Jose de Jesus in the ANC TV interview by Ricky Carandang said the reason is that the case did not meet the supposed other requisite for plunder: series or combination of at least two “transactions” that produced the ill-gotten wealth.

    It seems the Office of the Ombudsman “misquoted” RA No. 7080 and introduced a word–“transactions”–that is not mentioned at all in the law. For, the alluded Section 2 of the Plunder
    Law clearly speaks not of combination or series of transactions but of f “criminal acts as described in Section 1 (d)” of the law.

    What then are the described criminal ACTS? If we will look in turn at Section 1 (d), the ACTS
    referred to are again NOT TRANSACTIONS but combination or series of the MEANS or SCHEMES employed in acquiring the ill-gotten wealth. In fact, the law leaves no room for guessing or speculation—its Section 1 (d) specifically enumerated the SIX MEANS or similar SCHEMES which, if committed in series or in combination with each other, will constitute plunder if the ill-gotten wealth is at least P50 million as quantified in Section 2.

    If we will proceed further and examine the six MEANS or SCHEMES described under Section 1 (d), we
    will find that two of them seem to have been perpetrated by ex-Secretary Perez, as follows:
    first, the alleged RECEIVING, indirectly and by virtue of his position, of $2 million from Mark Jimenez,
    which act falls under Section 1 (d) (2) of the law and forms part of the bases for the Ombudsman’s finding of
    probable cause; and, second, the alleged taking undue advantage of his position to unjustly enrich himself
    covered under Section 1 (d) (6) and is an integral part of the alleged conspiracy with Ernest Escaler,
    Romeo Arceo, and Rosario Perez that the Ombudsman found as reported by media.
