Tension ran high yesterday as Senate President Juan Ponce Enrile reported out to the plenary Committee Report 780 censuring Sen. Manuel Villar Jr. for allegedly using his position to realign the C-5 road extension project that will benefit his and his family’s real estate firms.
Villar, who never showed up at any of the committee’s deliberations to answer the accusations against him, was a virtual no-show, arriving at the session hall only after the session was adjourned.
Senate minority leader Aquilino Pimentel Jr. tried to delay the sponsorship speech of Enrile by questioning the Senate procedure on treating committee reports and resolutions.
Pimentel wanted Senate Resolution 1472 discussed first since it was filed ahead of the Committee Report of the Senate Committee of the Whole. The resolution, seeking to exonerate Villar and signed by 12 senators, was filed Nov. 16, 2009.
The Enrile report, on the other hand, was filed January 18.
“I’d like to specifically object to the taking up of this Senate committee report as the first item of the agenda. I’m not against taking it up at some point but I object to having this issue taken at this particular moment considering that it violates our previous agreement,’ Pimentel said.
“Our implicit rule in this chamber is first filed, first tackled. A resolution that’s filed first must be tackled first…,” he said.
But the senator was interrupted when he noted that the presiding officer, Senate Pro-Tempore Jose “Jinggoy” Estrada, was holding the gavel.
“Please don’t bang your gavel. Are you threatening to silence me, Mr. President?” asked Pimentel to which Estrada answered, “I’m not banging the gavel. Mr. Minority.”
“Because if you do, we can go all the way and make a mockery of this proceeding,” Pimentel added.
But Enrile, chairman of the Senate committee of the whole that made the report, explained that under the rules, a committee report “is always in order at any time when it’s already presented.”
But Senate majority leader Juan Miguel Zubiri said it was agreed upon last week that the committee report would be discussed side by side with the resolution, prompting Pimentel to accede to Enrile.
The 84-page committee report, prepared by the Office of the Senate President, recommended that Villar be censured after he was found guilty of allegedly engaging in improper and unethical conduct in connection with the C5 road extension project.
The report also asked Villar to return to the public coffers the total amount of P6.22 billion that “he has or his companies have illegally gained or obtained as a result of unlawful acts and improper and unethical conduct.”
The report said Villar’s involvement in the C5 project in Parañaque and Las Piñas “made the Filipino suffer in the total amount of P6.22 billion.’’
This came from the cost for the realigned P4.28 billion for the extension project, the P1.8 billion spent for the original project but was wasted due to the realignment, and the P141.1 million in allegedly overpriced right-of way-payments for Villar’s real estate.
Enrile recommended that Villar be censured for violating the provisions of the Constitution and the Code of Conduct of Ethical Standards for Public Officials and Employees, and for engaging in improper and unethical conduct that damaged the integrity of the Senate.
Enrile said Villar violated the Constitution by intervening in the project of the Department of Public Works and Highways (DPWH) “for his benefit.”
It said Villar further violated the Constitution by failing to notify the Senate of a “potential conflict of interest’’ when he proposed an amendment to the 2008 national budget by appropriating P400 million… for a project that would benefit his corporations and which amount may be used to pay the claims of his corporations for unpaid road right-of-way compensation.’’
Enrile admitted though that there was no direct evidence that Villar participated in the overpricing of his properties.
Villar was investigated by the committee in June 2009 based on the complaint filed by Sen. Ma. Ana Consuelo Madrigal that that he was behind the double funding of the P200-million extension project in the 2008 national budget and the diversion of the road so as to benefit his real estate business.
Enrile also scored Villar for refusing to appear in 12 Senate adjudicatory hearings to investigate allegations that his real estate companies benefited from government road projects in Parañaque and Las Piñas.
Villar allies defended him, saying the senator could not get justice from a biased and partisan panel.
Minority Report
After Enrile delivered his speech, Pimentel took the floor and informed the Senate that the minority would deliver their sponsorship, as agreed upon, before the interpellations.
Pimentel said Senators Alan Peter Cayetano, Miriam Defensor Santiago and Joker Arroyo, in that order, would deliver sponsorship speeches of the Senate Resolution 1472 dismissing the charges against Villar.
However, Madrigal stood up and asked why there were three senators who would sponsor the resolution. She said it was a dilatory tactic of the minority to delay interpellations on the Enrile report.
Madrigal also called Villar a “coward” for not attending the session once more to participate in the discussion. She also called Villar’s allies in the minority bloc, specifically the counsel in the group, as his “choo-choo train” of lawyers.
Madrigal’s tirade did not sit well with Pimentel, who in turn, insinuated that she is an “abused child.”
He said that it was unparliamentary conduct on her part to call Villar a coward. “There are a thousand and one reasons why a person may not want to submit himself to a proceeding which he questioned from the very beginning,” Pimentel said.
To which Madrigal retorted: “I don’t think it is unethical. It’s a mere judgment for a person who is the main subject of this investigation. I still submit that Mr. Villar is making a mockery of these proceedings by not appearing and let his choo-choo train of laywers defend him.”
Pimentel answered: “For her even to villify us who are standing up for the right of a colleague to be heard, to explain his side, even he is not here, what does that make of us? Choo-choo train? At least, I’m not an abused child,” he added.
In Villar’s defense, Cayetano said the report failed to consider that Villar’s real estate firm was just one of the developers who benefited from road right-of-way projects.
He cited a 1999 opinion of former Justice Secretary Serafin Cuevas that there is no impropriety when government decides to enter into contract with a real estate firm owned by a member of Congress.
“He (Cuevas) said if the government wants to take over your property, there is no conflict of interest because the government has a project. The government is taking over your property. If Villar’s companies had not dealt with government, the properties would have been expropriated. It would be a forced purchase. The difference is that in expropriation, the owner could contest the fair market value of the price. Villar could have earned more through expropriation,” he said.
Cayetano also chastised senators for accusing Villar of cowardice when he refused to appear before the Senate Committee of the Whole inquiry.
“It is not true that a person is a coward just because he chooses the venue where he will defend himself. It means he has the qualities of a true president. It means he will not drag down his office because one senator or a couple of senators believe that they will win the election by throwing the C-5 issue and wanting the debate here on the floor,” he said.
“Why so much interest on Villar?” Cayetano asked, noting that those who signed the report are Villar’s presidential rivals or allied with the parties supporting other presidential candidates.
Villar is Nacionalista Party’s standard bearer. Other presidential candidates are Liberal Party’s Sen. Benigno Aquino III, independent Jamby Madrigal and Sen. Richard Gordon of Bagumbayan.
Sen. Maneul Roxas II, deviating from an earlier agreement, interpellated Cayetano. Roxas said he was prompted to stand on the floor after his name was mentioned by Cayetano.
He said he has not been dragged in any anomalies in government and that he has no insertions in the national budget.
But Pimentel, out of nowhere and in jest, said: “After your marriage, you have insertions.”
Roxas flared up and in high voice, said: “That’s an affront to my wife.” Pimentel then asked that his remarks be removed from the journal.
Madrigal also went high pitch when Cayetano resented Madrigal joining the fray when she was not even mentioned in his speech.
“Ang hirap, Mr. President, ang saling-pusa, sali ng sali,” Cayetano said, to which Madrigal retorted: “Corruption, corruption, corruption!”
She was prevailed upon by Estrada, who in turn interpellated Cayetano.
He said his father, former President Joseph Estrada, faced all the accusations against him. He said Villar should do the same since “gaya naman siya ng gaya . Yung orange (Villar’s campaign color theme) ginaya niya sa tatay. Sana harapin din niya ang mga akusasyon sa kanya dito sa Senado.”
The tension was abated only after Arroyo stood on the floor to defend Villar.
Arroyo said that there is no cowardice when Villar feels that he could not get justice from a partisan panel.
Arroyo said this was done by then Sen. Benigno Aquino Jr. when he was charged before Court Martial No. 2 during the Marcos administration.
The deliberation on the committee report was suspended and will resume today, with Santiago delivering her sponsorship speech defending Villar.
Why doesn’t Villar face his accusers squarely instead of hiding behind his colleagues.

Yun nga ang nakapagtataka e, bakit ayaw nyang harapin sa komite sa senado ang mga akusasyon sa kanya? palagi na lang sa publiko!!!! ano ba ang alam nya sigurado na syang mananalo?
Nakakatakot kung sya ang manalo, ngayon pa lang ipinakikita na nya kung anong klase sya pag nahalal na presidente, baka? baka lang maas malala pa sya kay TONGPATS nyan e.
Isa pa palagi nya sinasabi na may napapuwi syang mga Pilipino sa ibat-ibang sulok ng mundo (meron naman kahit pano), ngunit karamihan ay hindi sya ang nagpauwi. Paki silip lang po sa DFA kasi lahat ng mga napapauwing mga Pilipino ay DFA ang nag papauwi at hindi sya. Ang siste e, may lalapit sa kanyang tanggapan tapos ito naman ay iindorso sa DFA. Ang masakit pa nito, ni singkong duling wala syang binibigay.
Ito namang si cayetano magaling sana kaya lang walang direksyon na ang pananalita, maipagtanggol lang ang kanyang amo. Guilty! That’s the reason why Villar keeps on ducking the issue of C5. Saksakan ng duwag humarap sa accusers to clear his name, indefensible kasi ang kaso sa kanya.
If Villar becomes president (God forbid), he will surely use the strategy of Gloria by issuing executive orders such as EO 464 to avoid being questioned or investigated. Yan ba ang guto nating maging pangulo? Yucks!

The senate is not a court of law and all the senators can do is to censure him. They can’t even declare him guilty of a crime. All they can is find him guilty of ethical misconduct and conflict of interest. With 6 billion in people’s money allegedly gone into his pocket, it’s insane to just censure him. Charge him with plunder and let him stay in jail. Give him the benefit of doubt about his innocence unless proven otherwise. Censure is not the answer and unacceptable. Let justice be done and takes its course.

According to an online journal, the Bulatlat.com, a land use plan (LUP) was prepared in 1996 outlining the planned comprehensive land conversion of the entire Hacienda Luisita into a commercial and industrial complex, which reveals that the family of Senator Aquino plans to convert all its agricultural lands in Tarlac into commercial, industrial, residential and recreational parks.
Around 3,000 hectares have already been converted from agricultural to other uses.”

Napakaganda ng paliwanag ni Mar Roxas tungkol sa ethics case ni Villar. May ebidensiya at testimonies na nagpapatunay na ginamit ni Villar ang kanyang position sa kamara para magkaroon ng pecuniary benefit mula sa gobyerno ang mga companies niya. Paano idedepensa yan ni Manggogoyo Cayetano?
Pinaligoy ligoy niya na napunta pa sa mga kayamanan ng mga Roxases at Madrigals na hindi naman relevant sa issue. Successful lamang siya na humaba at magwaste ng time.
Si Tandang Pimentel naman, naku, gustong magpa impress kay Villar na sulit ang bayad ng huli sa kanay. Sa galit niya kay Jamby, akala ko aatakihin siya sa puso.
Bakit nga ayaw siputin at harapin ni Villar ang ipinaparatang sa kanya? Hmmmpp!!

And the Senators are proving to be more flavorful than a box of Congressmen this time.

No matter what Villar, Cayetano, Pimentel and their choo-choos say, the logical thing to do is attend the hearing and defend yourself.
Not attending the hearing will set a bad precedent. Any senator can now use the excuse “I will not get a fair hearing.” And if Villar gets to be President, he will tell his Cabinet members not to attend Senate hearings for the same reason he gave.
Even for this incident alone, this man does not deserve to be President…in fact he does not deserve to be a government official at all.

Hangga’t hindi itinataas ni Trillanes ang kamay ni Manevillar ay ayos sa akin. Ang kasalan ay personal ng kapatid ni Sonny kaya hanggang dyan ay wala akong pakialam, hindi kasi affected ang kapinuyan. Kung baga ay sosyalan yan at pareho naman silang senador kaya dapat lang na mag-usap sila at magtawanan.
Kung apektado ang publiko sa kanilang serbisyo bilang elected senators, dyan ako bubuga. 🙂
