Padaca will not be tie-breaker in Akbayan case

Newly-appointed Comelec Commissioner Grace Padaca wrote to correct what I said in my column in Abante last Sunday that she would be the tie-breaker in the case of Akbayan as partylist.

I wrote: “Hati raw ang Comelec sa isyu ng Akbayan at ang boto ni Grace Padaca, ang bagong Comelec commissioner, ang magdedesisyon kung lusot o tanggal ang Akbayan. Naloko na. (It has been reported that Comelec is deadlocked on the issue of Akbayan and the vote of Grace Padaca, the new commissioner, will decide whether Akbayan would be disqualified or not. Oh my God.)”

I made the comment based on at least three news reports quoting Comelec Chair Sixto Brillantes Jr. : “Pinass on ko na lahat ng cases kay Padaca… We’re sending her the folders to break the tie.”

Nabastos talaga ng husto ang partylist system.

Ang layunin ng batas ay matino: mabigyan ng representasyon ang mga naapi at mga walang boses. Kasi nga sa gastos ng ating klaseng pulitika, ang mga mahihirap ay wala talagang pag-asang magkaroon ng representasyon sa Kongreso.

Ayon sa ating saligang batas, “The party-list representatives shall constitute twenty percentum of the total number of representatives….from labor, peasant, urban poor, indigenous cultural communities, women, youth” at iba pang sector ayun sa batas maliban lamang sa religious sector.

Ngunit tingnan mo naman itong Buhay, isa sa mga nanalo. Isa sa kanilang nominee ay si Mike Velarde ng El Shaddai. At halata namang partido ito ng El Shaddai na alam naman natin ay religious kuno.

Parañaque Rep. Roilo Golez sees conflict of interest in the membership of Energy Secretary Angelo Reyes in 1-Utak (United Transport Koalisyun), a partylist group.

Golez said in the hearing of the House Energy Committee last Monday, Reyes admitted that he was offered a slot in the 1-Utak party list and in a TV interview, he said he is considering it.

His nomination indicates that he has been a member of the past three months because the law states that a nominee should be “A bona fide member of the party he seeks to represent for at least ninety (90) days preceding election day.”

Partylist naman ang pasok ni Mikey Arroyo

Hindi talaga humihinto itong mga Arroyo sa pambababoy ng batas para lang manatili sa kapangyarihan.

Dahil nawalan siya ng kaharian sa pagtakbo ng nanay niya bilang congressman ng pangalawang distrito ng Pampanga, nakahanap siya ngayon ng paraan na mananatili sa Kongreso sa pamamagitan ng partylist, na linagay sa Constitution para mabigyan ng representasyon ang mga grupo ng mga mahihirap at mahihina sa lipunan. Kasi naman hindi sila maaring makipaglaban sa mga tradisyunal na pulitiko sa eleksyun.

Nominado si Mikey bilang unang kinatawan ng Ang Galing Pinoy (AGP) na ang nirepresenta daw ay transport drivers at security guards. Kasama niya ang outgoing mayor ng Lubao na si Dennis Pineda.

Ang kapal talaga at ang kapal din ng Comelec kung aprubahan ito.

Mga api ba talaga ang pinuprotektahan ng partylist?

Sa isyu ng mga taong malapit sa mga Arroyo na nakasama sa bagong sectoral representatives katulod ni Maria Lourdes Arroyo at retired Gen. Jovito Palparan, sabi ni Press Undersecretary Anthony Golez na kahit ano pang ngak-gnak ng mga kritiko, yun ay batas at wala na silang magagawa.

Oo nga naman, ano naman ang magagawa ng mga tao kahit alam nilang binabastos na ang diwa ng batas nitong batas sa partylist.

Noong Martes nadagdagan ng 55 ang 22 na partylist representatives sa Kongreso ng inutusan ng Supreme Court and Commission on Elections na sundin ang bagong formula sa pagsunod ng batas para sa partylist.
