Wala na. Sira na talaga itong Korte Suprema.

Kahapon, nagdesisyun sila na maari daw mag-appoint si Gloria Arroyo ng kapalit ni Chief Justice Reynato Puno na magre-retiro sa Mayo 17.

Siyempre, sigurado yan i-appoint ni Arroyo ang kanyang paboritong Supreme Court justice na si Renato Corona. Kaya sigurado yan, kahit wala na sa Malacañang si Arroyo, protektado siya sa mga kaso niya.

Nandiyan si Merceditas Gutierrez na protektor ni Arroyo at ng kanyang pamilya sa Ombudsman. Ngayon nandyan si Corona ang magiging hepe ng Korte Suprema. Ayos ang sambayanang Pilipino.

Tandaan nyo itong siyam na mga pangalan ng Supreme Court justices na kasama sa pagbabastos ng demokrasya at ng taumbayan: Roberto Abad, Lucas Bersamin,Arturo Brion, Teresita De Castro,Mariano Del Castillo, Jose Mendoza, ,Diosdado Peralta, Jose Perez,at Martin Villarama Jr.

The Supreme Court on Wednesday gave President Gloria Macapagal Arroyo a go signal to appoint the replacement of retiring Chief Justice Reynato Puno.

A radio dzMM report said that SC magistrates ruled that President Arroyo can appoint any vacant positions in the judiciary until her term ends in June 30. The decision came after an hour of closed door deliberations by the Court en banc.

The voting:

Nine justices said ‘yes” (Roberto Abad, Lucas Bersamin,Arturo Brion, Teresita De Castro,Mariano Del Castillo, Jose Mendoza, ,Diosdado Peralta, Jose Perez,and Martin Villarama Jr,)

One dissented (Conchita J Carpio-Morales);

Three inhibited (Chief Justice Reynato Puno, Antonio Carpio, Renato Corona);

Two said case is premature as there is no justiciable controversy (Presbitero Velasco and Antonio Eduardo Nachura).

The justices also ordered the Judicial Bar and Council to submit to President Arroyo its shortlist of possible nominees for Chief Justice. Puno, the incumbent Chief Justice, is retiring on May 17.

The Judicial and Bar Council should stop outright the obviously Palace-hatched proposal of Rep. Matias Defensor to name the successor of Chief Justice Reynato Puno before the ban on appointments starts on March 22 or even during period when the ban itself is in effect.

The JBC has reportedly calendared Defensor’s proposal that the council names nominees to the post to be vacated by Puno upon reaching the mandatory of 70 on May 17. Since Matias is an ex-officio member of the JBC, the council certainly cannot ignore his letter of December 22 outlining his proposal. The JBC must take it up, but it can, just as promptly, send it to the trashcan.

The JBC meeting is scheduled on Monday. Insiders said the issue the members will deliberate on is whether there is a precedent for naming nominees to a position which is not vacant. There is nothing in the records of the JBC that shows it has named nominees before an actual vacancy has occurred. So, definitely, there is no precedent.

The JBC should not allow itself to be used as a tool in Gloria Arroyo’s desire to install her own man as the chief justice.

A dangerous, unconstitutional decision

Just pray that with the retirement of Associate Justice Minita Chico-Nazario today, the voting on the motion for reconsideration that the Commission on Elections would be filing on the deplorable Nachura Dec. 1 decision would change.

The vote on the Supreme Court decision penned by Associate Justice Eduardo Nachura declaring as unconstitutional the provisions in the election laws that consider appointed officials resigned once they filed their certificates of candidacy was 8-6.

Those who concurred with Nachura,were Justices Nazario, Renato Corona, Presbitero Velasco, Teresita de Castro, Arturo Brion, Lucas Bersamin, and Mariano del Castillo,

Now that it’s becoming clear that the Memorandum of Agreement on Ancestral Domain between the government and the Moro Islamic Liberation Front is unconstitutional and could be grounds for the impeachment of the one who authorized it, Gloria Arroyo’s minions are scrambling to protect her saying she never saw the document that has now claimed more than 200 lives and rendered homeless more than 250,000 people.

At the final hearing of the Supreme Court on the MOA-AD, Solicitor General Agnes Devanadera said “The panel conveyed to me that the MOA was not submitted to the Office of the President..She never saw it, she was never shown a copy.”
