Absurdities in Magdalo case

After four years in jail, Army 2Lts Ceasar Daen nd Percival Alcanar, walked free this morning and returned to regular duties after the court martial admitted that the evidence against the two young officers was “manifestly weak.”

The panel hearing the case on the Oakwood mutiny said “it is with deep sense of justice” that they were dropping charges against Daen and Alcanar, who were never near Oakwood on July 27, 2003.

Why it took them almost four years to find that out reflects the inhumanity and stupidity of the military under the Arroyo administration.

It was also revealed in this morning’s hearing that Ensigns Ronald Paras and Cesar Pangan Jr. were moved two months ago from Fort San Felipe in Cavite to the naval Intelligence Unit in Fort Bonifacio in Rizal. The reason cited was “confidential”.

When their lawyer, Edgardo Abaya, asked for the reason, Trial Judge Advocate Pedro Davila said the two offered to be state witness. All the accused officers didn’t believe Davila. They said how can Paras and Pangan be state witness when they were never in Oakwood? “What will you tell them about us?” the other officers kidded Paras and Pangan, who just smiled.

The other officers suspect the miltiary leadership will work on Paras and Pangan to turn against colleagues like resigned Ltsg Antonio Trillanes IV, who is running for senator under the Genuine Opposition.

Fifty-four officers struck a plea bargain with the court. They pleaded guilty to the lesser crime of “conduct prejudicial to good order and military discipline” in exchange for the dropping of foru serious charges of mutiny and others. The young oficers, who have been in detension for almost foru years, will serve for another 10 months. They are expected to be freed jan. 27, 2008.

A MILITARY tribunal yesterday ordered the dishonorable discharge of 54 junior officers involved in the short-lived Oakwood mutiny and their continued detention up to January 2008 after a plea bargain agreement.

The court ruled unanimously that the 54 members of the so-called Magdalo group were guilty beyond reasonable doubt and imposed on them a prison term of seven years and six months. Since they have been detained since July 28, 2003, the accused would just have to serve an additional three years and some eight months.

But the court also granted the defense request to reduce the sentence by another three years, or by one year for every mitigating circumstance to wit: the surrender of the accused, the change in their plea to guilty, and their long years in detention.

The mutineers claimed they went to Oakwood to protest corruption in government.

The 54 officers pleaded guilty yesterday to violation of the Articles of War 97 (conduct prejudicial to good order and military discipline) in exchange for the dropping of four more serious offenses against them.

The four offenses dropped during plea bargaining were AW 67 (mutiny), AW 96 (conduct unbecoming), AW 63 (disrespect to the President, Vice President and Defense Secretary) and AW 64 (disrespect towards superior officers).

Lt. Col. Ana Escarlan, in reading the verdict, said the sentence reflected the “seriousness” of the officers’ offense. The court said the 54, mostly first and second lieutenants, “brought great dishonor to the noble profession of arms to which we belong and to the Armed Forces establishment as a whole.”

The 54, who showed no obvious reaction to the verdict, will be formally discharged after completing their sentence and upon the approval of President Arroyo as AFP commander-in-chief. The court said the question of whether the convicted officers will continue to draw salaries until they are formally discharged will depend on the President.

The court said the accused will serve their remaining prison terms in their previous places of confinement – at the Marine brig in Fort Bonifacio, at the Army headquarters also in Fort Bonifacio, and in Fort San Felipe in Cavite City.

An officer who is dishonorably discharged is not entitled to benefits, except the cash equivalent of his unused leaves and the refund of the contributions made to military financial institutions.

Five other Magdalo officers – 2Lt. Junebert Tubo, 2Lt. Edwin Tuwitao, 2Lt. Jason Panaligan, 2Lt. Christopher Orongan and 2Lt. Alcuin Canson – did not join the plea bargaining agreement.

Ensigns Ronald Paras and Cesar Pangan deferred their decision on the plea bargain since they had signified their wish to turn state witness.

The court earlier cleared four other junior officers – 2Lts. Percival Acanar, Gerald Daen, 1Lt. Edmun Bandilla, and 1Lt. Marcelino Mendoza – on the recommendation of the military leadership which cited the Special Adjudication Board finding of lack of probable cause. The four will be restored to full duty status after some administrative matters are ironed out and after counseling.

The request of a fifth officer – Capt. Francis Balan – to be absolved by the Special Adjudication Board was denied by the military body because he had committed a new offense – went absent without official leave. Defense lawyer Trixie Angeles said the accused entered into the plea bargaining agreement “because they are already tired” and that “their career may not be as promising as before.”

She added that while the 54 decided to plea bargain, “there is no surrender of their ideals.”

The plea bargain does not cover the 29 mutiny leaders, including resigned Lt. Antonio Trillanes IV who is facing a coup d’etat case before a Makati City court. Trillanes’ group is facing a single charge of violation of AW 96 before the military court. –

  9. The purpose of this plea bargaining BS is merely for publicity in an attempt in fact to discourage and lower the morale of the accused soldiers, their families and their supporters. At least, with you, Ellen, clarifying rumours, we get to the truth and pepped up somehow.

    I’m not even bothered for example by the publicity oion the Pulse Asia or SWS surveys done in February that were published only a day or two ago. In February, we were not even sure if Sonny would run or not. It was firmed up only after he was granted permit to submit his application to the Comelec.

    I don’t believe these surveys. I would rather pulse the voters’ response, and I see that Trillanes is popular to those who share his dreams, and they are now in the majority.

    Please don’t interpret the plea bargain of the 50 this morning as betrayal of the cause. It’s just for “conduct prejudicial to public order and military discipline.” They are not admitting to mutiny or conspiracy. I know a number of these people. Their idealim is alive as ever.

    They have been four years in detention. They want to move on with their lives.

    Intimidation clearly played a very central role in this events, the way they function is not very flattering to the standard of judicial integrity. The case was greatly seen as having a great political interest, but that is no excuse in incarcerating this officers in long years before they are acquitted. The human right of these soldiers were not honored, their rights could be easily be found out on the basis of intimidation.

    The prosecutor in the case had so gravely misled them about the amount and quality of evidence against the two soldiers, it is no wonder that the acquittal brought about a very angry reaction from the sympathizer because they were not even present in the vicinity and their names were included in the charge chart. The prosecutor must also be strongly criticize on doing a lousy job, and the fact that the two soldiers were acquitted was said to be a denial of justice for incarcerating them for long time.

    Maybe, the two can turn the table around and file a civil case, seeking compensation for moral damage, trauma, emotional distress, pain and suffering and so on to bring the culprit on the grind of justice for their miseries while incarcerated.

    After four years of detention, Assperon and Tianak weren’t able to break the spirit of these soldiers. Iyan ang kahanga-hanga!

    What is deplorable is that these bright idealistic young soldiers are put in detention to serve the political ends of their poser commander-in-chief. Sige at patuloy na ikulong ang may pananagutan, pero iyong mga minor participants, ayon sa rules of military conduct, ay palayain at i-assign sa field. E kung sila ba naman ay gamitin laban sa mga tunay na kaaway ng bansa, disin sana ay makakatulog pa tayo ng mahimbing.

    Kaya bilib ako sa hakbang ni Trillanes na labanan sila sa larangan ng pulitika. Kesa nga naman nakapiit lang siya na naghihintay ng kahihinatnan ng kanilang kaso ay mas maigi ang labanan na lang niya ang mga kababuyan sa militar sa larangan na gusto ng pekeng kumander-in-cheat! Kaya takot si Tianak sa hakbang na ito ng bata at matapang na Trillanes. Mukhang palaban ang isang ito kahit saan dalhin ang laban!

Problema ngayon, malapit na ang pagsa-submit ng mga boto ng mga OFW, pero wala pa akong naririnig kung ipinadala na ang mga balots.     These acts of the military court reflect the panic-stricken leadership’s succumbing to the pressures against the AFP by the international community. The international human rights watchdogs, including whole governments, are ganging up on both our civilian and military leaders and their stubborn denials are not helping them any. Worse, it brings us nearer to sanctions that would put us a notch closer to those countries considered as “rogue states”.

    The military cannot risk more flak, especially at this time when report after report confirm its incompetence in fighting insurgencies which their commander-in-chief has declared many times in the past as already “defeated”.

    Not when ASG and JI leaders slip past 5,000 troops closing in on their positions. Not when you shoot a 9-year-old girl point blank then plant an armalite near her corpse then declare she is a child warrior. Not when a trooper shoots 9 of his own inside a camp.

    Most especially, not when a general gets appointed to Chief of Staff by helping a presidential candidate steal the votes of the people!

    A senatorial win by LtSG Antonio Trillanes IV will spell doom for the whole AFP leadership. Not because he as senator can singlehandedly clean the mess this crappy Gen. Esperon creates when he spills his shit all around the camps.

    But a Trillanes win simply means people are validating how corrupt and incompetent the military as an institution has become and how the executive continues to condone, no, make that promote, such corruption and incompetence.

    These, everybody knows, are the reasons for Oakwood. These, everybody knows, are the reasons why soldiers risked their careers, families, and lives in that August day and will continue to attempt the same until the twin monsters of corruption and incompetence are finally slain.

    These, everybody knows, are the reasons why Trillanes should win.

    We see Garcillano being made to run in Bukidnon, but I doubt that he will be concentrated on his candidacy. By now, he must be in conference with his chairman on what they need to do to thwart the will of the people the way they did in 2004. Iyan si Garcillano, pagnanalo, talagang kababalaghan na!

    So, what is needed now is prayer for some Act of God to make the GO candidates win, and thwart whatever evil plans Tiyanak and her loonies have. I doubt if she and her loonies can go against God’s Will especially with the power behind her now 50-50 if we believe their own publicity to get sympathy for their fellow crooks and kin running for office in this midterm election.

    They should actually stop playing with fate, that is, stop pretending that the Fatso or the Tiyanak are seriously ill and making a lot of people to think evil and sin for wishing, “Matuluyan na sana!”

    Palagay ko para maalis ang mga daang-daang milyones na ginagastos ng mga kakandidato para sa senador,gawin na lang natin bawat probinsya na lang.Isang Tongressman at isang Senatong kada probinsya ng sa ganoon ay magkaroon ng balance,Presidente at Vice president na lang ang iboto nationwide.Ilan ba ang probinsya sa Pilipinas?sabihin na nating 200 ang probinsya,di bali magiging 200 ang senatong at 240 ang Tongressman,samakatuwid mayroon tayong about 450 mga kurakot.Gagastos ng 3 milyon ang bawat isa sa probinsyang nasasakupan nila tuwing election ay makakatipid pa kumpara sa ginagastos ng mga kakandidato sa nationwide election ng mga senador.Mababawasan ang kurakutan dahil ang mga tao sa probinsya ay may participation.Maaalis na iyang mga trapong Senatong na iyan,Mahihirapan ng manuhol ang Presidente dahil sa halip na 24 senatong lang ang lalagayan niya ay magiging 200.Sa 200 na senatong na iyan ay siguro maraming mga “Black Horses” magkakaroon ngayon ng balance ang Lower at Upper House.—-Okey ba ang suggestion ko mga Pare ko.–Isipin ninyong mabuti.
