Gross,clear, grave injustice

The case of 2nd Lts. Caesar Daen and Percival Alcanar, who were unjustly accused of participating in the Oakwood mutiny and imprisoned for four years, only for the military to admit last Wednesday that their evidence is weak, shows the stupidity and inhumanity of this administration.

Last Wednesday, the military court presided by Brig. Gen. Nathaniel Legazpi which is trying the case of the Magdalo soldiers in connection with what is called the Oakwood mutiny on July 27, 2003, said it was “with a deep sense of justice” that they were dismissing charges against Daen and Alcanar because the “evidence is manifestly weak.”

“Manifestly weak”, my foot! Daen and Alcanar were nowhere near Oakwood when some 300 soldiers led by a group of young officers, among them Navy Lt. (s.g.) Antonio Trillanes, now a senatorial candidate for the Genuine Opposition, declared withdrawal of support from Gloria Macapagal-Arroyo.

They robbed the young officers four precious years of their lives and they had the gall to say it is their “deep sense of justice” that the men are now allowed to go back to their respective assignments before they were imprisoned. Where is justice there?

That’s the same injustice that Frank Chavez, lawyer of Maj. Gen. Renato Miranda and Maj. Jason Aquino, protested before he walked out of the court martial hearing in Camp Capinpin, Tanay last Tuesday.

Chavez said that the special general court martial (SGCM) trying the 28 officers in connection with the alleged foiled coup against Arroyo in February 2006, is illegal because under the Articles of War and in the Manual for Courts Martial, there are only three kinds of courts martial : general, special and summary. The chief of staff can only create a general court martial but not a special court martial. But AFP chief Hermogenes Esperon created a special general court martial. Chavez said, “He (Esperon) cannot create a special court. It can only be a general court martial. It cannot be a chop suey.”

Chavez also quoted from the Articles of War that says “when any such commander is the accuser or the prosecutor of the person or persons to be tried, the court shall be appointed by superior competent authority.”

Esperon clearly is the accuser. He has jurisdiction over the trial judge advocate which is prosecuting the case. Not only that, Esperon has said he would be a witness and as chief of staff, he will review the decision of the panel.

Chavez, always brutally and endearingly frank, added, in this case, Esperon’s superior authority is, “Gloria Arroyo whom I do not recognize as president.”

Chavez pointed out that a special court martial cannot try lieutenants and six of the accused have the rank of lieutenants.

Also, Chavez said, officers facing charges under a special court martial cannot be confined for more than six months. The accused have been in detention for more than year.

Chavez said it is easy for the panel to set decision in future hearings because they continue live their life day by day. “But not these officers when the rhythm of their lives has been broken.”

Chavez called the attention of the panel to the recommendations of the pre-trial investigation report which was for the dismissal of the charge of mutiny “for lack of factual and legal bases.”

Chavez said Presidential Decree 77 amended by PD 911 lays down the procedure of preliminary investigation that is followed in military pre-trial investigation. “If there is no probable cause, the charges are dismissed.”

Yet Esperon overruled the PTI recommendation and ordered the filing of mutiny charges against the respondents. “There is no provision in the Manual for Court Martial that gives Esperon the power to overturn the recommendation of the pre-trial investigators,” Chavez said.

“It is gross, clear, glaring and grave abuse of discretion,” Chavez said.

Chavez and the other lawyers asked the panel headed by Lt. Gen. Alexander Yano to wait for the decision of the Supreme Court on the petition filed by at least five officers for a temporary restraining order on the SGCM and their release from detention.

Not surprisingly for an Esperon-convened body, the Yano panel rejected the respondents’ lawyers motion. That’s when Chavez walked out.

Chavez said he now doubts if they can get justice from the Yano court. “This is a kangaroo court,” he said. “They are just waiting for a place and time for conviction.”

Chavez, who is also the lawyer of Maj. Jason Aquino, is hoping that they can get a fairer deal from the Supreme Court.

  1. Kudos to the wives, children and families of these brave young soldiers! My heart goes to the wives who are holding it out in full support of their husbands despite the temptations around them. It was different during the time of my Mom when wives were supposed to just stay at home and tend the home and children. Now, these women are even now forced to be both wife and mother amidst the temptations, even temptation to agree to be paid big sum of money from the national coffers to persuade their husbands no doubtto stand as state witnesses against their fellow warriors for truth and right since the only enemy that they can now consider are the crooks oppressing them and their fellow countrymen.

    Mabuhay kayong mga soldiers and wives!!!

    Apparently, there still remains in the AFP a few decent men like this BGen. Legaspi, but let’s say how the Burot in the palace by the murky river and her Cheat-of-Staff will treat him after this.

    In this case, Esperon is guilty of “Unlawful Command Influence”UCI, because he wittingly acted upon to influence court members, witnesses, or others participating in military justice cases against these soldiers. Such unlawful influence of his not only jeopardized the validity of the judicial process, it undermines the moral of the military members, their respect for the chain of command, and public confidence in the military.

    Esperon, the idiot four star general can not order his subordinate to dispose a case in a certain way. He will be the one to face a court martial for his unlawful action. Then, Punggok will turn state witness to prosecute him. What do you think? Fernando and BenignO!……

    And it took Esperon and effing Gloria Tiyanak FOUR BLOODY YEARS to find that out?

    How on earth do they propose to wipe a 60 year old insurgency when they couldn’t even get their intel right? Was it so difficult that it should take Esperon and his bleeding mongrel followers to ASK if those two were ANYWHERE NEAR OAKWOOD on July 27, 2003?

    Yet when it comes to finding skeletons and graveyards of supposedly NPA killed guerillas (following Alston’s report), it took this unbelievable shitheads less than ONE MONTH to determine that the skeletons found in the graveyard were victims of NPA purges.

    Extraordinary.

    Esperon is one shithead.

    But I don’t want to be harsh on Esperon’s star-ranking subaltern, Brig. Gen. Nathaniel Legazpi. He tried to save face with for a stupid mea culpa jargon: ““with a deep sense of justice”.

    Legazpi could have redeemed some lost honour, if not for the AFP, at least for himself had he been MORE FORTHCOMING: “With a deep sense of justice, this office would like to inform you that Daen and Alcanar where NOWHERE NEAR THE SCENE OF THE PURPORTED REVOLT.” End of story.

    Going around in riddles doesn’t buy the AFP brownie points. A FRIGGING WRONG was committed so goddammit, have the effing balls to admit it.

    If Esperon and Legazpi cannot do it, they should be RELIEVED; I have no doubt there are a few more honourable officers in this blasted AFP who are worthy to replace them.

    We all know of the gross injustice done these gallant men in uniform who stand firm to their oath of allegiance to the Philippine flag, country and people, and refuse to go along with the wiles and whims of a bogus president,for which they are now being unjustly punished. We know of how ranking officials like Gudani, et al, are even being deprived of their due pensions and other fringe benefits for staking their lives, even the welfare and interests of their children in battlefields fighting with their own fellow Filipinos even when their prime responsibilities in fact is to defend the country from foreign invaders, not try to liquidate criminal gangs and hoodlums in the country who should in fact be the prime concern of policemen, not soldiers.

    Now, we even see members of the AFP fighting among themselves and all for the share of the loots from the national coffers that the bogus president thinks she and her tabatsoy of a husband alone have the right to own and dispose of!!!

  8. Clarification. Yuko,and to everybody, the pictures above are soldiers accused of participating in the Feb. 2006 foiled coup. They are not Magdalo soldiers. I just use the story of the two Magdalo soldiers to point out the thoughtless and heartless way this administration is treating the armed forces.

    The hearing in Tanay for the 28 accused in the Feb 2006 incident (Gen. Miranda, Gen. Lim et al) was last Tuesday, April. 10. The Magdalo hearing in Camp Aguinaldo was last Wednesday, April. 11.

    Nakakainis itong Legazpi panel, it is taking us for a ride na naman. Manifestly weak daw, e wala nga doon sa Oakwood sina Daen and Alcanar ano ba naman ‘yan?! Nagpapalusot pa e inamin na nga nila na nowhere near Oakwood ang dalawa. So, ibig sabihin ay physically absent ang mga akusado at walang perception or recognition of their presence. Manifestly weak daw, tumigil na nga kayo! Basta walang kaso ang dalawa. Why is it so difficult for the Legazpi panel to admit their mistake? Makakabawas ba iyan sa pagka-macho ng mga miembro? Dapat ay compensate nila ang dalawa para sa apat na taong perwisyo bukod sa balik trabaho!

    The one trying the magdalo case (which happened in July 27, 2003)is the Legazpi panel.

    I know it’s easy to get confused.

    With all these hearings going on, medyo ako rin and others in media following the cases are being kept busy. Okay lang. What is that compared to the sufferings of the soldiers and their families. Next week, Frank Chavez will go to the Supreme Court for Maj. Aquino. We should be covering that too.

    It certainly has become the trademark of this administration: STUPIDITY and INHUMANITY. The case of Lts. Daen and Alcanar, falsely charged and put behind bars for four years and dismissed because the evidence is “manifestly weak” is one glaring example of such stupidity and inhumanity.

    The humiliation and mental anguish they suffered during those years cannot be restituted by just declaring SORRY boys, manipis pala at mahina ang aming ebidensya. I think they have enough grounds to get back and file charges against the government, particularly the AFP, for such “manifestly strong” human rights violation.

    But of course, no way it can materialize as long as Mrs. Arroyo is in power with a cowtowing AFP leadership. There must be a change in the political atmosphere. That’s why the coming elections is far too important for the people to register their abomination on the surreptitious activities of the present dispensation. That is to support those who are GO-ing against the candidates of Mrs. Arroyo. Now is the time to get everything Go-ing!

  20. So, the two soldiers are found not liable to any of the charges against their fellow soldiers, and they are being released. Are they going to be paid, too, for the damages to their state of mind, health, etc. by the incompetent AFP and the government? I wonder. Dito iyan mayaman na sila!

    Like some of us here, I did try to answer one of your posts yesterday but when I submitted my comment, “server cannot be found” flashed. Unfortunately, I didn’t have the time anymore to compose another one that I logged out. 🙁

    On the issue if we can file moral and civil damages against Esperon after all these abuses, I think we can. (Sorry, under bar ako kaya we might as well ask somebody with the title “atty” to confirm this. 🙂 ) And we have every intention to do that. The life inside is a real hell that kids get sick. I just got back from the hospital with my kid because she had a viral infection after our visit in Tanay. The doctor said it is acquired airborne. You can just imagine how it is like being locked up inside with your kids. Sabi na lang namin na schooling ang daddy nila pero ng nagtanong bakit nakakando kami lahat sa loob ng conjugal area pagsapit ng alas otso ng gabi, di ko na maalala ano sinagot ko dahil ibinaling ko sa iba ang topic pero alam ko gaya ng ibang nanay dun, mahirap sagutin na tanong yun lalo na’t walang kasalanan ang mga ama nila. Sobrang paranoid naman sila na ikandado pa kami sa loob despite all the guards and the multi-level cyclone wires around the whole detention area.

  23. Yes, the living conditions in the detention center are really inhuman.

    Bandila (ABS-CBN late night news) showed a video of the living quarters showing some soldiers and their families living in tents during the Holy Week, We learned Lt. Baccarro, the AFP spokesman, was angry because cameras and cellphones are not supposed to be allowed inside the detention quarters. I was told the AFP is investigating.

    One thing I have observed is that this blog usually disappears or becomes difficult to access between 10 am to 3 pm Philippine time because I experience the same thing.

    It also makes a disappearing when it’s morning in the US. I am told that this happens only on this and MLQ’s blogs.

    I wanna say now that HE SHOULD TAKE HIS EFFING BALLS IN HIS HANDS AND ADMIT that Esperon’s military had committed a case of monumental injustice by locking up two junior officers WHO WERE NOWHERE NEAR OAKWOOD on July 27, 2003.

    Could you imagine that? It took a military entity FOUR BLOODY YEARS TO FIND OUT THAT two junior officers weren’t anywhere near Oakwood.

    When Legazpi deemed that the physical “evidence was manifestly weak”, why didn’t he just say that the junior officers weren’t there at all instead of going around with his mumbo jumbo “Deep or great sense of justice, etc.”

    And to think it took him FOUR FRIGGING YEARS TO DETERMINE THAT his physical evidences were weak. It’s their brains that are weak.

    Absolute pillocks Esperon and the rest of his mongrel followers are.

    Completely ignorant un-military like peasants.

    It is so effing easy for any military (am sure even the Bangla Deshi military could have fared much much better) to CHECK presence and absence. How could they have been so effing idiots and not done this most basic military routine?

  30. It is very unfortunate but as I’ve said in my own blog, military leadership can only be as good (and effective) as the civilian government under which it serves.

    Gloria Tiyanak’s government is morally and legally corrupt, downright ineffecient and completely volatile, hence the military military leadership that serves under her frigging immoral and decaying government is the same.

  31. The so-called rebel military group led by Maj Gen R Miranda and Brig Gen D Lim, Philippine Marines and Scout Rangers respectively, is the only worthy component that could lead this self-imploding Esperon-led AFP.

    Ellen, medyo nalilito nga ako sa dami ng military courts na itinatag para bastusin ang magigiting kong heroes! Kahit ano pa, kitang-kita ang kawalang-pantao na pagtrato nina Esperon sa mga sundalo at pamilya. Itong si Esperon ay dapat masunod kay Fartso, pronto! O kaya ay merong biglang mag-tsaaakkkk!!!

  34. This is the situation in the detention quarters of the 28 officers in Camp Capinpin. Families of the soldiers may correct or add to this.

    Generals Miranda and Lim are in separate quarters. Quite far from the 26 officers who are confined barracks style. One big room, double deck beds. There are no private rooms.
    Visitors are not allowed in that area.

    The detention compound is a prison camp, surrounded by high concrete walls and barbed wires.

    There’s another building in the compound which they call “conjugal area”. That’s where they stay when their families visit. Visits are allowed only on weekends.

    There’s one reception area (as big as an ordinary classroom) and 8 small private rooms ( enough for a double deck bed)

    Eight private rooms for conjugal visits for 26 officers! The officers and their wives made an arrangement to take turns with conjugal visits. Like the eight families who visit first week of the month, can’t visit the next week.

    How about the children? Most of the time, they all sleep on the floor in the reception area. It can be fun but at the same time heartbreaking.

    Because of the long vacation last Holy Week, many of the families took advantage of it. Since there were not enough private rooms, they put up temporary partitions out of blankets in the reception area. Some of them brought tents.

    Marami pang kwento which Esperon would not want the public to know.

    The most imortant thing here is, these officers have not been charged yet. The court martial trial has not officially started.

    Am appalled that a valorous warriors as those show in the pics, particularly brave and bemedalled Col Ariel Querubin should be reduced to inaction and frustration by this supot Esperon.

    While I believe they know how to keep physically fit, it is the mental torture on their family that must really be weighing down on their minds.

    Di bale, the time will come when they can hang Esperon and Gloria Tiyanak from the highest lampost for all the kababuyans they’ve done and continuing to do.

    A friend described to me some time back about the living conditions of these soldiers. It broke my heart just listening to the story. I donated what I could to at least improve their living conditions. Of course, I begged that my name be w/held, after all, I don’t need any adulation or praises from this gesture.     How can one not help these soldiers ? For every single day they are incarcerated, is a day they sacrifice themselves for truth & justice. That is difficult to do. But not for heroes.

    The treatment to the jailed soldiers is really atrocious, criminal and most of all INHUMAN.

    It took me quite a while to be in my usual self upon reading the accounts of their inhuman treatment to include their families who took the opportunity to visit them in their cells.

    The input of Military Wife is an eye opener and should be given the widest publicity if possible. For people (we know who are they probably laughing at the moment on the misfortunes of the soldiers) who don’t care to shut up for once. Be attuned to the topic.

    In the PTI (pre-trial investigation), it was recommended that charges of both mutiny and conduct unbecoming of an officer and gentleman against 20 officers be dismissed.Meaning, No charges should be filed against them. One of those 20 is Lt. Cordero. Still, he and other officers are in jail!

  65. If the living conditions in the detention quarters have improved a little, that’s no thanks to the military etablishment. The officers, themselves, being soldiers were the ones who improved them. They fixed the water system, they put up a basketball court (rather ring).

    The inhumanity of Arroyo and Esperon can’t quell people’s appeciation and adherence to what is right and good.The detained officers have not been lacking in support from those who believe in their stand for truth and justice. Someone sent refrigerator. Before there was only one small refrigerator. When families bring food, it’s good only for one day. Dahil masisira. At least now, they can store more food.

Brig Gen Lim went up to him to inform him that there was restiveness in the military but instead of tackling Gen Lim’s report head on, he evaded it and passed the buck on to Esperon who declared that he ruled over the “life and death” military fate of Gen Lim and the other officers. But Esperon WAS WRONG. He’s forgetting that there are military laws and the laws are clear, no charges (as the PTI later confirmed, AFP’s case against the officers had no legal leg to stand on), THEN BY GOLLY, FREE THE OFFICERS.

    Senga didn’t have clout but Esperon, one of Gloria’s Hello Garci military stooges had clout, that I admit but both generals were moral cowards. Col Querubin stood down – he went back to barracks with the troops so clearly, even a 12-year old Boy Scout would understand that THERE COULD NOT BE ANY CASE OF MUTINY, attempted or not. The worst charge that could be levied against Col Querubin and the Philippine Marines was (as the February thinggy event proved) ATTEMPTED INSUBORDINATION – laughable in the extreme.

    In other words, those two idiots, Senga and Esperon, were weak, Senga being the CSAFP that he was should have held his ground by standing up to Esperon and should have said, “Lim is assigned to his quarters, no charge because he DID NOT COMMIT MUTINY WHEN HE TALKED TO ME.”

    Idiots, Lim committing mutiny? A mutiny cannot be committed by only 1 MAN and particularly NO MUTINY AT ALL if that would-be effing 1-man mutineer did not threaten violence?

But I think the more Esperon and by command responsibility, Mrs. Arroyo give hard time to these men, it will not break their spirit and their idealism will carry them to the very end.

    They did not commit any acts of violence or otherwise act in a manner that would diminish or to be destructive to their primary goal. Senga and Esperon reacted immediately with severe counter measures, with arresting them and each of the soldiers conduct themselves in such a manner as not to create a distasteful situation. They were determine to display strict discipline among there ranks and prevent any undesirable events from occurring. Now, Where is the mutinous act?

    Classmates, officer friends and soldiers of the incarcerated officers in Tanay were prohibited to visit them. They sent books, foodstuffs, and the like instead. This simple act of support from fellow officers and soldiers infuriated some loyal dogs of esperon. They started opening the detainees’ mails both incoming and outgoing.They harassed helpful officers by ‘inviting’ them for an inquiry and/or by surveillance to discourage them from giving any assistance to the detainees.
    Yes, the AFP is really making life harder for the detainees and had done a grave injustice from the very start.

    Sorry for the late reply. Yes, my kid is still sick and I have heard that more kids are getting sick there now. I have learned of the statement of Bacaro about the wives getting emotional and distorting the truth. That is very pathetic of him. Why don’t they let the kids of Esperon and all the other officers, who have been condemning these soldiers to sleep on that same place and we will see if they will not complain of the same injustice? After all, the soldiers there have been declared innocent with the PTI for attempting to create a mutiny. Why the delay and the dirty tricks to detain them further. Are they (those in power) that if these soldiers are released before the May election, the administration’s party will topple down and so will the demi-gods? Another case in point is that the enlisted personnel should be released already. More than a year had passed and there are still no charges against them and yet they are also incarcerated in Camp Capinpin. What is their sin? They remain silent because they are afraid that if they complain, they might be charged. For whatever charges, only they (Esperon and his people) know. Putting the lives of these soldiers in their hands is very dangerous…. extremely dangerous.

    The Holy Week was very meaningul for all of us despite all the difficulties we encountered. It made us stronger in our belief and conviction, as well as developed closer relationships with the rest of the families of the detained soldiers.

    Our heads may be bloody but unbowed. The administration failed to break our hearts and spirits as we continue to fight what is right and just.

He got his combat assignment as a comfortable field commander. He served as defense attache abroad–pure comfort. His second wife is a doctor at VLuna hospital.
    Romeo Tolentino did not serve in combat. When his elder brother died in an encounter in Jolo, he was given a liaison duty–comfortable indeed. He is fond of combat shooting and accidentally hit his foot. He is an Armor officer. When he was a LtCol, Tolentino fashioned himself as a member of RAM and borrowed P2M from the RAM foundation to put up a business in Laguna. He did not pay his dues. He just claimed that his business bungled. He never have any significant accomplishment in combat but he delivered much during the last Presidential elections.
    Other mentioned officers spent their careers as Comptrollers/Finance/Logistics officers. None can be considered as combat officers which a is must in the AFP.

    There are professional generals that deserved and worthy to lead the afp but professionalism, competence and experience are no longer the parameters for such positions. Ingratiation, ass-licking and padrino system have become a norm in the AFP.

    I love the first-hand input from the wives of these brave men of the AFP now in incarceration. They should be encouraged to blog here, and let us know the truth, and then, we stand by their testimonies. Patibayin natin ang mga loob nila.

    In fact, they should learn from the women of Israel who are defying their government’s order to wipe out the Palestinians. At least, over there they have recognized the incredible things women can do, even stop some madness that can even cause the prophesied end of this world in the not so distant future.

    The panel being created by Assperon is not just a Kangaroo court, it is a Kangkong court! I am praying so hard that the brilliant lawyers of these brave soldiers will keep the AFP from convening this Tiyanak and Assperon court. Judging from the most recent hearing in Tanay, the “prosecutors” do not even know the cases they were citing and they do not even know the importance of correspondence. The documents they do do not wish to share with the soldiers’ lawyers are called “strictly confidential” and are therefore internally circulated to themselves only. Mga ampaw talaga! How can the soldiers defend themselves from these cheats( acting like their cheating and lying masters)without any bases?

    PMA class 74 stands for Makatarungan? What an irony! To think that almost all the above mentioned “officers” in this class were not combat exposed, they do not even deserve commanding the incarcerated battle tested officers! The incarcerated officers must be amused by these non-deserving officers! They may be succesfull in putting the honorable men behind bars but they have underestimated their strong spirits! These men may be behind bars but they are revered by their peers. Whereas, the corrupt officers may be in command but their spirits are imprisoned in their own dirty world. They can not get the respect from their men. It will just be a matter of time and the truth will come out. These “tuta” generals will be out of their positions one day soon. They should think more of what lies ahead in the future, when all their “guards” are gone. You reap what you sow, IDIOTS!

    Very nicely put Magno! I also like the “cockroach court”. Mas madaling tiristirisin! Assperon is no better than a security guard. Maybe the security guard has more honor than he does.

    Just read that Honasan will be out on bail. The courts( not the cockroach court of Assperon) are redeeming themselves. Sana naman, the supreme court will vindicate Miranda et al as well. If they do, I will believe in our judiciary system again. For now, I doubt their fairness.
