MAYOR Jesse Robredo of Naga City, a 2000 Ramon Magsaysay Awardee for Government Service, was disqualified yesterday by the Commission on Elections (Comelec) on the ground of his citizenship.
Comelec ordered Vice Mayor Gabriel Bornado to assume the mayoralty post as mandated by the Local Government Code.
In a resolution by the First Division, Robredo, son of a Chinese, failed to “perform any act showing his intention to elect Filipino citizenship” despite reaching legal age 31 years ago.
The complainant is Jojo Villafuerte, Robredo’s opponent in this month’s election and a nephew of Camarines Rep. Luis Villafuerte.
Tracing his family roots, Robredo’s father, Jose, was a son of Chinese citizens who failed to establish residency in the country at the time of the adoption of the Philippine Organic Act of 1902, which clearly defines who are considered as Filipino citizens.
Under the 1935 Constitution, children who have foreign fathers and Filipina mothers are required to elect Philippine citizenship “under oath” in front of an authorized administrator.

Kumulo ang dugo talaga! This is becoming a ridiculous, preposterous modus operandi of the Pidals—question the citizenship of people who are running against their bets. Bakit hindi na lang nila na ideklarang walang pilipino dahil halos naman lahat ng mga pilipino may kung anu-anong lahi and I doubt if they bothered to register as Filipinos at the granting of Philippine Independence by the US in 1946 when they out randomly registered Filipinos especially those whose birth records were destroyed during the bombings of city halls in Manila and the provinces.

i know they are brothers and just shared my knowledge about the brawners’ citizenship. matagal ko nang kilala si bgen felix brawner, jr (ret), mula pa noong company grade officer siya hanggang sa maging kaunaunahang commanding general siya ng first scout ranger regiment kung saan namatay ang kanyang anak na tinyente (forgot his first name) sa test mission nila somewhere in bicol.
Re Nationality Law of the Philippines, I understand that the 1902 and 1935 rulings were more to curb the influx of Japanese migrants to the Philippines and not the Chinese, many of whom in fact fought with the guerrillas in WWII. Likewise, the nationality law considers all born in the Philippines as natural-born nationals unless they choose to be otherwise.
It’s a ruling similar to the one they have in the US where children even of foreigners are considered natural-born US citizens when born in the US until recently when the US has seen the wisdom of some Japanese ruling on children born in Japan of foreign parents, and they adopt the nationality of their parents and long before the US crackdown on illegal aliens.
So what’s this stupidity of running after these natural-born Filipinos and banning them from running for office because they had foreign ancestors as in the case of FPJ, who was more Filipino than the idiot criminal calling herself “President of the Philippines.” Ang bobo naman!
