Suspension deferred; bank freeze lifted

THE government today backtracked on its offensives against re-electionist Makati City Mayor Jejomar Binay, leader of the United Opposition.
The Bureau of Internal Revenue lifted the garnishment order on banks where the Makati government holds accounts, except in the Philippine Veterans’ Bank.
The BIR said the move was meant to prevent a collapse in the delivery of basic services to city residents, which Binay warned of when the garnishment orders were issued on May 2.
The Department of Interior and Local Government deferred the implementation of an Ombudsman order preventively suspending Binay on a graft charge.
The DILG served the suspension order on the evening May 4.
Interior Secretary Ronaldo Puno said he was deferring the implementation “in the interest of fair play.”
The deferment would be “for the duration of the election period,” Puno said as he asked the Office of the Solicitor General to re-study the suspension order.
Binay dismissed the BIR and DILG moves as “face-saving” measures.
“Mrs. Arroyo’s order to the BIR to lift the garnishment of the Makati city government’s bank accounts and the deferment of implementation of the Ombudsman suspension order are clearly a case of `too little too late.’ It will not change the fact that this regime has again misused the powers of government for political ends at the expense of public welfare. The Filipino people, not just in Makati, all know that their sole objective is to achieve their political ends without regard to public interest.
Binay was also suspended in October last year on graft charges filed by his erstwhile ally, former city councilor and vice mayor Roberto Brillante in connection with alleged “ghost employees” at the city hall. The Court of Appeals stopped authorities from carrying out the suspension order and eventually dismissed the charge for lack of evidence.
Executive Secretary Eduardo Ermita said Interior Secretary Ronaldo Puno was acting on his own.
“I didn’t know about it. It was not an initiative of the Palace,” he said, adding Puno might have been advised by his lawyers regarding the repercussions of serving the preventive suspension order.
Asked whether the deferment was because of fears of a possible backlash against administration bets, he said: “I don’t want to put any political interpretation, they might think that Malacañang was behind it.”
The BIR garnishment orders effectively freezing the accounts of the city government and the personal accounts of Binay and Vice Mayor Ernesto Mercado were meant to compel them to settle the alleged unpaid withholding taxes from 1999 to 2002, amounting to P1.1 billion.
The new suspension order stemmed from charges filed by former Makati councilor Oscar Ibay in December last year, which also alleged Binay was maintaining ghost employees.
The Commission on Elections said the suspension is not a violation of the Omnibus Election Code.
“It is prohibited to suspend officials during election period but the law states that an exception to the rule is that if the case involves violations of the anti-graft law,” said Comelec spokesman James Jimenez.
Comelec Chairman Benjamin Abalos distanced himself from the issue.
“I don’t want to comment on the issue. Pero kung totoong galing ang case either sa Sandiganbayan or Ombudsman, wala kaming jurisdiction diyan,” he said.
Garnishment Limit
BIR Commissioner Jose Mario Buñag said in a statement: “I wish to announce that to enable the uninterrupted delivery of basic services to the residents of Makati and the payment of salaries of city employees, I have been instructed by the President to take the necessary steps to limit the writ of garnishment issued by the Bureau against the city of Makati to the amount of unpaid taxes and increments being claimed by the BIR.”
Buñag ordered Nelson Aspe, BIR regional director for Makati, to instruct Baquiran to “immediately” act on the latest order.
The BIR also said the city government owes only P600 to P700 million in unpaid taxes from 1999 to 2001. The 2002 assessment was not included.
The “lifting and canceling” of the freeze order covered the accounts at the Equitable PCI Bank, Philippine National Bank, Allied Bank, Metropolitan Bank and Trust Co., Banco De Oro Universal Bank, China Bank, Asia Trust Development Bank, LBC Development Bank, Planters Development Bank, Rizal Commercial Bank and Trust;
Security Bank Corporation, Union Bank, Asia United Bank, United Coconut Planters Bank, Bank of Commerce, BDO Private Bank, East West Banking Corporation, Export Industry Bank, International Exchange Bank, Philippine Bank of Communications, Philippine Trust Company, Land Bank of the Philippines, Development Bank of the Philippines and Banco Filipino.
In the order to the PVB, Baquiran said garnishment is limited to the money claimed by the BIR as unremitted taxes. Makati City reportedly has a P3 billion account in that bank.
Binay said the city government will exhaust all legal remedies to recover its money.
No Liabilities
Charges will also be filed against Baquiran. Binay said there is no law that authorizes the revenue district officer to issue the warrant of garnishment.
“Government funds are not subject to garnishment because it is used for public services. Garnishing them would impair the delivery of these services,” he said.
Binay insisted the city government has no liabilities with the BIR and said the latter acted in bad faith when it issued the freeze order despite the fact that negotiations are ongoing to settle the conflicting figures presented by the city government and the BIR.
“We maintain that we do not have any liabilities with the BIR. We paid P200 million, and we were made to believe that the matter was closed. When we were told that we still had obligations, we asked for a meeting to resolve the matter. Had the discussions with Finance Secretary Margarito Teves and Commissioner Buñag been allowed to continue, Malacañang would not find itself in another fine mess,” he said.
He said President Arroyo should resign if she is still concerned with public welfare.
Grave Abuse
On the suspension deferment, Binay said Puno’s earlier decision to implement the Ombudsman order “clearly shows grave abuse of discretion.”
“Despite their earlier claims that they had no choice but to execute a court order, there was no valid reason for them to rush the serving of the suspension order last Friday evening. The overkill that attended the serving of the order smacks of Gestapo-like tactics reminiscent of martial law and is clearly an act of provocation and intimidation. It belies their claim that they want to prevent violence and keep the situation peaceful,” he said.
On Friday evening, operatives of the elite PNP-Special Action Force swooped down at the Makati City Hall, forcing city hall guards to lock the building. The policemen were left with no choice but to leave.
Followers of Binay and some personalities from the political opposition went to the city hall to show their support.
Puno, shortly after receipt of the Ombudsman order, directed Interior Undersecretary for Public Safety Marius Corpus to serve it.
He was accompanied by SAF policemen.
Mistake
The Ombudsman has set a hearing on his graft case on Tuesday.
Corpus said they received a copy of the Ombudsman order late afternoon of Friday. He immediately contacted Binay to inform him of the matter, he said.
The opposition said Puno’s decision only shows the suspension order was a mistake.
Genuine Opposition senatorial candidates said government agencies which enforced the suspension order failed to “calibrate” the consequences of the order.
“Siguro nakita nila ang pinakamalaking mali nila, kung sino ang sinususpend nila,” GO senatorial candidate John Osmeña said.
“That is an indication of their realizing of their mistake. ang tanong ko, sino ba ang nag-decision? Kung ang sabi nila wala silang pakialam doon sa decision, na decision iyon ng Ombudsman, eh paano ngayon na hindi na nila itutuloy? Ibig ba sabihin ang Ombudsman hawak nila sa ilong? Kaliwa’t kanan puwede nilang baligtarin? Mabigat ang implication na iyan,” Osmeña said.
Another GO candidate, Loren Legarda, said the attempt to suspend Binay, a member of GO executive committee, as the election campaign period is drawing to a close “is a glaring example of political harassment.”
“Mayor Binay can overcome this latest attempt to derail his re-election bid. Justice will prevail and I believe this incident will even strengthen the resolve of Mayor Binay’s constituents to deliver him that landslide victory come May 14,” she said.
Senate minority leader Aquilino Pimentel Jr. said Binay’s hasty suspension was a Palace act.
Pimentel said the order was illegal because the law does not allow the suspension of government officials facing administrative charges during election period.
He said the law is very clear that no local government official should be suspended on account of an administrative case during the election campaign. He also assailed the use by the administration of excessive force in serving the suspension order. – With Regina Bengco, Gerard Naval and JP Lopez

Sorry not been regular in here but been busy on the election front in France.
Have cast my ballot in the French presidential election today – voted for Sarkozy.
Enormous voters turnout estimated and expected to hit almost 86% of the 44.5 million voters. Voting closes at 20h00 (8PM) and we will know by then who will succeed Jacques Chirac at the Elysée.
Incredible, isn’t it? And to think that voting in France is not all electronic – mostly manual. Minister of Interior, who by the way belongs to the current party in power, UMP, is the trusted delegate of the state to announce the name of the new president.
Recent opinion polls predict a Sarkozy win – he’s been attributed an almost 10 point lead over rival Ségolène Royal, the Socialist Party standard bearer.
Met some Pinoys in the street by the way near my vote precinct – and the good news in their direction is that they have organized to start of integration courses, i.e., learning of French language, immigration procedures seminar (by a French lawyer who will lecture), French culture courses that they will hold in the Philippine embassy premises after a committee of Pinoy organizations led by my friend lobbied with ambassador to allow them use of embassy premises.
Things seem to be looking bright for the Pinoys who, finally, have decided to band together to do something for themselves in France.
They will be holding a July 8th festivity to formalize their year round agenda when they plan to invite political personalities in the Philippines as well as Philippine journalists. I have promised to help them – they will set up a web site. They have asked me to relay the invitation to you Ellen personally, which they will formalize in a letter to you.
I have advised them not to invite cabinet members of Gloria’s cabinet and to stick to inviting elected officials, who in principle, represent being their elected officials.

I think that the inner circle of GMA Cabinet maybe calling the shots in repressive and urong-sulong policies. They are exploiting the legitimacy of Gloria Arroyo’s presidency as a bargaining chip for their vested interests. GMA has a skeleton in the closet. Not only am I a card-bearing member of his party UMP), I also campaigned for him by helping my son organize student supporters’ activities – my son happens to be the president of the student council of his grande école (higher institute of learning)and a president of one of the federations of Student Councils in Paris. So, if DILG Puno asked the Office of the Solicitor General to re-study the suspension order, it only meant that they didn’t have understanding of the case they threw at Mayor Binay.
