Army division hails Trillanes victory

Bacolod City — The Army’s 3rd Infantry Division with troops stationed in Negros, Panay, Cebu and Bohol on Monday congratulated mutiny leader and Antonio Trillanes IV on his election as senator.

“The 3rd Infantry (Spearhead) Division, Philippine Army under the command of Maj. Gen. Jovenal D. Narcise pass on good wishes to Senator-elect Antonio Trillanes IV (for his) proclamation. We … are hopeful that the AFP bills unrealized in the 13th Congress will be studied for his and other senators’ consideration,” Lt. Col. David Tan, spokesman of the 3rd ID, said in a statement titled “3ID, cheerful for Trillanes victory.”

Tan said the statement reflected Narcise’s sentiment.

Lt. Col. Bartolome Bacarro, chief of the AFP public information office, said: “This is only an indication that the soldiers would be respecting the mandate given to Senator Trillanes, the mandate given to him to become a senator.”

“And on the other side, it is the call of the soldiers that hopefully the bills beneficial to the Armed Forces that have been sidelined would be pursued by Senator Trillanes… this greeting is on the spirit that Senator Trillanes would be a champion of the cause of the AFP,” Bacarro added.

Asked if it was not awkward for the 3rd ID to welcome the victory of a rebel officer, Bacarro said: “The greetings given by the 3rd Infantry Division is in the context of showing that the soldiers of the 3rd Infantry Division are respecting the mandate given to Senator Trillanes. Like the (entire) AFP, we are respecting the mandate given by more or less 12 million who voted for him. We’re respecting that mandate.”

Trillanes, a Navy lieutenant when he led the Oakwood mutiny in July 2003, is facing charges before a military and a civilian court.

While he was deemed separated from service when he filed his candidacy last February, the military retained jurisdiction over Trillanes because his offense % violation of Article of War 96 or conduct unbecoming an officer and a gentleman % was committed while he was in the active service.

AFP chief Gen. Hermogenes Esperon has said Trillanes’ election will not affect the charges against him.

Tan welcomed Trillanes’ statement that he will investigate forced disappearances of activists and the existence of “death squads” in the Armed Forces, which are said to be behind the killings of militants.

“We are open to it just like the Melo Commission,” Tan said referring to the panel created by President Arroyo last year to look into the extrajudicial killings.

“We just hope that it will be done impartially and objectively and not merely as concession to militant groups which reportedly campaigned for him (Trillanes). We hope his advocacy will include the soldiers and policemen who were murdered by the NPAs (New People’s Army rebels),” Tan said.

Discussions are on-going on how Trillanes could perform his job as senator, particularly on whether he could be allowed to leave detention to attend Senate sessions.

Trillanes is detained at the Marines headquarters in Fort Bonifacio, Taguig City.

Bacarro said Esperon might be held liable under the military law if he allows Trillanes to go out of his detention cell.

“This is the first time this happened wherein an elective official is expected to perform his mandate but he is subject to some restriction because there is still military jurisdiction over his person,” Bacarro said.

He said the custodians of Trillanes cannot violate provisions cited in the Articles of War on the custody of detainees. Otherwise, they themselves could be subjected to general court martial proceedings.

“If this will be done by our chief of staff, he might be also liable for some violations of the Articles of War,” he said.

However, Bacarro said there was still nothing definite on whether Trillanes would be allowed by the military to leave his cell.

Trillanes was thrice allowed to leave his cell % when he filed his certificate of candidacy at the office of the Commission on Elections in Intramuros, when he voted on May 14, and for his proclamation last Friday.

Asked earlier why Trillanes was allowed to leave detention, Bacarro said the military leadership yielded to the clearance issued by the Makati City court where Trillanes is facing a coup d’état case.

On why the military is not yielding to the civilian court this time around, he said it is the call of the military.

A military lawyer on Sunday the AFP could prevent Trillanes from attending Senate sessions, citing the case of former Rep. Romeo Jalosjos.

Jalosjos was not able to attend congressional sessions because he was not allowed to post bail for his then pending rape case. A Makati court has denied Trillanes’ petition for bail more than two years ago.

    Una nang nalathala na 2 military general on active duty ang ngpahayag ng kanilang suporta kay Sen. Trillanes sa gagawin nitong imbestigasyon sa Hello Garci at extra judicial killings at nakahanda silang magbigay ng sapat na ebidensiya. Nayanig si Gloria at Esperon sa balitang ito.

    Sa pagpapahayag ng Army 3rd Infantry Division ng kanilang pagbati sa panalo ni Sen. Trillanes, muli na namang mayayanig si Gloria at Esperon. Kunyari ay OK lang ang reaction sa AFP pero halata ang pagkatuliro ni Bacarro. Panic, paranoid at praning na sila. Sapagkat sa basa natin sa pangyayari, hindi lang ang Army 3rd Infantry ang nagsusumigaw ng kanilang katuwaan sa pagkapanalo ni Sen. Trillanes. Alamin natin, bihira ang walang cellphones sa mga kasundaluhan at tiyak na sa texting nila pinadadaan ang kanilang mensahe sa isa’t isa. Mula Aparri hanggang Jolo, mula Batanes hanggang Spratly, tuluyan nang mayayanig si Gloria at Esperon. Abangan!

    I have had the priviledge of serving under real ‘hard bastards’ who you knew had already done everything before that he expected from you, would pull you to one side with a ‘private word’ in your ear and defended his officers and men rank & file without a hint of corruption – you did what he told you out of total respect of the man first and his position second.
    The rank & file have no respect for this corrupt bigoted Haemorrhoid Assperon’s prejudice and intolerance.
    The people have spoken and now the rank & file have spoken, unless Haemorrhoid Assperon does an immediate about turn by releasing the Gallant Officers in custody and respecting the election of Trillanes by the people, he’s doomed

    Apprehensive of the published message of the Army 3rd ID will caught fire and spread throughout all military commands, it is not surprising anynore if Esperon will come out with an order prohibiting anything that will enhance the image of Sen. Trillanes. Or it is not farfetched if there’s already an instruction from Gloria for Esperon to quell any form of communications to avoid being replicated. But with the text power, huli po na ang lahat. Unless ipagbawal na rin ang paggamit ng celphones. Umiikot na sa po buong kasundaluhan, sa buong kapuluan ang kanilang pakikiisa sa pagbati kay Sen. Trillanes.

    Sa palagay ko, lalong nagpapanik na ang mga praning at matamang pinagiisipan na kung anong hakbang ang gagawin upang mapigilan ang Trillanes Tsunami.

  5. This piece of news actually proves to us that not all soldiers of the Philippines are under the spell of the unano squatting at the palace by the murky river. It is just that they needed someone like Trillanes to make them braver now to say “No!” to the beck and calls, whiles and whims of the criminals at the palace by the murky river.

    Maybe, that’s the reason why Assperon uttered those words, “subukan nila!” The guy must be peeing in his pants now.

    Ito naman si Bakayaroo palusot pa. What they say now are even in violation of the Constitution that specifies that civil laws have more bearing than what they call as Articles of War.

    With Trillanes now a civilian, he can also be now removed from military custody as a matter of fact and turned over to the civilian court mainly to judge on his case that in turn has already been judged by the people as a default, or tried and judged by the people who have given him mandate to serve them as their senator versus graft and corruption gripping the country today because of the unano and her band of kuratongs.

    The people not Assperon, et al have the right to pass judgment on Trillanes. In principle, it is still the people’s court that should prevail.

Inilapit niya sa bayan sa pamamagitan ng pagkandidato ang kanyang kaso. Ang hatol ng bayan, naniniwala sila sa kanyang ipinaglalaban. Ibinoto siya ng mahigit na labing isang milyon. Siya ang good guy. Siya ang bida.

    Ang bad guys at mga kontrabida, ayan napa-praning na. Hindi na kailangan pang isa-isahin. Araw-araw ay sila ang tampulan ng naguumapaw na galit ng sambayanan. Lahat na kilos nila ngayon ay minamanmanan. Kung maaari lamang, tamaan na sila ng ipo-ipo at ilipad sa timbuktu.

    Sa bandang huli, ang good guys ang magwawagi!

    Subject: Query on the Election of Senators Trillanes, Honasan and Estrada

    Your Honors:

    I write as a lawyer and citizen with the duty to uphold the Rule of Law under the 1987 Philippine Constitution.

    The undisputed election of Senators Trillanes, Honasan and Estrada appears to raise an important legal question, that is:

    WHEN THE PEOPLE OF THE PHILIPPINES ELECT A SENATORIAL CANDIDATE WITH PENDING CRIMINAL AND/OR ADMINISTRATIVE CASES, DO THE PUBLIC OFFICES HEARING OR PROSECUTING THOSE CASES CONTINUE TO HAVE JURISDICTION OVER THE SAME?

    It is respectfully submitted the said public offices are ipso facto OUSTED OF THEIR JURISDICTION over the pending cases. Why?

    1. No public office has authority to defeat the sovereign will. Sovereignty resides in the people and all government authority emanates from them (Section 1, Article 2, Philippine Constitution). Therefore, the derivative authority of government must necessarily yield to the original authority of the people. It would be absurd to allow the will of the servant to rule over the will of his master.

    2. The subject senators are presumed innocent until the contrary is proved (Section 14, paragraph 2, Article III, ibid.). They have not yet been proved guilty. Therefore, they must be presumed innocent. The issue of whether they are criminally or administratively liable had been brought to the attention of the national electorate during their respective election campaigns, and that, notwithstanding the widely-publicized claim of government prosecutors that the subject senators are probably guilty of the charges against them, the voters went to the polls and gave them an undisputed majority of votes over the losing candidates. Due regard for the sovereign will, thus so unmistakably and clearly manifested, would seem to dictate that, in the consideration of the legal issue arising from their election, all possible doubts should be resolved in favor of their unhampered ability TO SERVE AS DULY ELECTED SENATORS OF THE FILIPINO PEOPLE. To do otherwise would inevitably lead to a vicious and unpardonable frustration of the verdict of the people.

    The subject criminal and administrative cases, being official acts of the executive and judicial departments of the Philippines, are matters within the mandatory judicial notice of the Honorable Court (Section 1, Rule 129, Rules of Court).

    Under the law, Supreme Court justices, in the performance of their duties, must: act with justice, give everyone his due, and observe honesty and good faith (Article 19, Civil Code).

    May I kindly be informed what action, if any, shall be taken by your good offices to do justice to and render what is due the subject senators and the Filipino people under the foregoing premises?

    Like what we wrote, the very first in this thread, it’s confirmed that it’s not only the Army 3rd ID who are celebrating Sen. Trillanes victory. It’s all over because they really voted for Sen. Trillanes pinning their hopes of meaningful reform of the AFP in him.

    “Malacañang yesterday appeared alarmed over the information that a lot of officers and enlisted men in the AFP have secretly supported Trillanes. What bothers the Palace, an executive said, is whether the military will stay loyal to the chain of command, headed by Mrs. Arroyo.”

    With this kind of news, talagang praning na si Esperon that sooner or later, Sen. Trillanes will subpoena him to a Senate hearing. But Esperon was quick in saying that he will snub such call and will invoke EO 464 thereby defying the Supreme Court ruling of its unconstitutionality.

    May karapatan ba bang manatili ang isang nakakulong na wala pang hatol kung siya ay inihalal ng bayan? This is the legal question raised by Atty. Paguia which need immediate answer from the magistrates.

    Good job, Sampot. What (ex-)Atty. Paguia is clarifying from the SC is congruent to what I have been saying all along: that the single complainant in the case People of the Philippines versus Antonio Trillanes IV has, by direct action, dropped its case against the soldier and no longer holds him liable for any wrongdoing, whether civil or military.

    The ELEVEN MILLION PLUS votes was in effect, an affidavit of desistance signed by the complainants for immediate implementation of the civilian and military courts.

    Sira na rin ang ulo nitong si Esperon! Sabihin ba namang “civilian authority is not supreme over the military at all times”? At ang civilian authority lang na susundin niya ay ang Commander-in-Chief! He has totally gone nuts.

    He has also said he will not be attending congressional investigations and will invoke EO 464 which he said, “is still in effect”.

    Bakit hindi i-court martial iyan? Blatant disregard of the Constitution, laws and statutes. Tapos si Trillanes nakakulong dahil sa “Conduct unbecoming an officer and a gentleman”?

    Akala kasi ni Esperon ay nasa Martial Law tayo ngayon dahil sa pwestong (Cheat of Staff) binigay ni Gloria sa kanya bilang pabuya sa kanyang papel sa pandaraya nuong 2004 election. Wala naman talagang laman ang kukote nito kundi pulbura at hangin. At DUWAG pa! Lalo na ngayon na NANGINGINIG SA TAKOT kay Senator Trillanes! Malamang pag nagharap silang dalawa ni hindi kayang tumingin sa mata ni TRillanes itong si Esperon kaya lahat ng paraan ay gagawin para hindi sila magharap sa mga Senate hearings.     Even long before election day, COMELEC ordered the removal of election materials posted out of bounds on pain of disqualification but only fell on deaf ears. Deadmahan! Yesterday morning I noted that the Trillanes strip I glued on my front glass window pane the only one in my street is gone. Its along the fenceline. Must be too revolting for a certain quarters for they picked clean the Trillanes poster only but didn’t bother the Chiz posters alongside it. Reason enough to print another one this time it will read SENATOR TRILLANES FOR DEFENSE SECRETARY. That will get into their nerves.

    By the way, Esperon is taking now the mellowed path with regards to the menace of his life. He would like to transfer his ward to the civilian authority.

    Theoretically, the Chain of Command does not stop at the President but up to the people that “appoint” or empower him/her.

    But then again, Assperon may be right when recognizing that the Chain of Command do stop at the President for this one is not really elected, thereby NOT EMPOWERED by the people.
