Original contracts for $365M telecom deal with Sino firm stolen, says DOTC exec

A ranking official of the Department of Transportation and Communications yesterday said that the original contracts to set up a national broadband infrastructure between the Philippine government and the Chinese government corporation, ZTE for $365 million were lost in Hainan the night after it was signed last April 20 in the presence of President Arroyo.

DOTC Assistant Secretary Lorenzo Formoso, who was one of the two Filipino signatories of the contract (the other was DOTC Secretary Leandro Mendoza), said the theft was reported by Emmanuel Ang, DTI commercial attaché, who said the papers were stolen from the hotel where the DTI personnel were billeted.

Formoso disclosed the loss of the contact while explaining the lack of transparency in the multi-billion-peso broadband contract in a forum sponsored by Action for Economic Reform at the Ateneo Professional School in Rockwell. “It’s a national shame,” he said, adding the NBI had to be brought in to investigate the incident.

Formoso declined to reveal the NBI’s finding except to say, “It’s the handiwork of forces who want to derail the contract.” He said the controversial contract was reconstituted last May 30.

Participants to the forum were aghast at Formoso’s disclosure.

Former Finance Secretary Ernest Leung said: “It’s incredible knowing how the public sector handles contract documents signed by government officials and witnessed by the President.”

Former Transportation and Communications Secretary Josie Lichauco said: “Actually, Assistant Secretary Formoso is a hero for exposing the theft of the government contract with ZTE as a national shame. In my 19 years in government, I have never heard of contract papers being stolen.”

Lichauco underscored the importance of the contract recalling that the President had to leave her ailing husband to make an 18-hour visit to Hainan to speak at the Boao Forum and to witness the signing of the contract.

Formoso said after the signing, the contacts were turned over to Ang for protocular documentation.

Lack of transparency has haunted the $365 million ZTE contract for a project that would facilitate connection among local government units down to the barangay level. It is estimated that it will save the government P3.4 billion yearly in telephone bills.

Since its signing last April, DOTC has not disclosed the details of the contact. Formoso said only Secretary Mendoza can give a copy of the reconstituted contract, upon written request.

Asked if the contract can be downloaded on the Internet, Formoso said, “I doubt it. People there don’t even know how to email.”

Two American companies are protesting the awarding of the contact to ZTE without bidding.

Arescom claims ZTE’s cost of $365 million is more than double the $135 million it is offering. Amsterdam Holdings Inc. (AHI) also said it filed an unsolicited proposal in December 2006 for a BOT scheme for $240 million.

Funding under the contact with ZTE would come from a 15-year loan from a Chinese state-owned bank with a five-year grace period.

    Oy, baka naman talagang gusto ni Formoso na ipahiya ang administrasyon kaya humarap siya sa isang forum na laway lang ang dala. At doon mismo, ipinagwagwagan na nawawala ang dokumento. Parang si Lintang Bedol a, masyadong increbedol. Kung ako kay Gloria, sisibakin itong isang ito. Ay, huwag na. baka gawin pang ambassador sa Neverland.

    I heard it first from Amb. Ernie Maceda. He said P3B will be lining up the greedy backpockets of our marauding officials.

    For such a huge contract, it is simply stupid for anyone to even think of stealing the signed docs. No one will benefit from stealing it since pre-signing copies are always forwarded to all signatories for review of their corresponding lawyers. It is standard for any contract participant to precheck the legal, technical, and financial stipulations, some contracts even have to be rewritten several times until parties are finally in agreement. Lichauco’s commenting on the Undersec’s “heroic act” was more of an insult, I’m sure.

    I CAN BET WITH MY MOTHER-IN-LAW, THERE ARE MANY COPIES OF THE CONTRACT, SIGNED OR UNSIGNED, IN DOTC, MALACAÑANG, GOV’T CORPORATE COUNSEL, NTC, AND DOST. The announcement of the loss is stupid in itself because of this. Who needs the NBI to investigate the supposed theft? It will not benefit anyone, even the country’s private carriers (PLDT, Glose, Digitel, Bayantel, etc.) who stand to lose billions in revenues from the goverment’s switch from analog system to VOIP. A copy of the signed contract can also be secured from the Chinese counterpart.

    It will, however, benefit the crooks who stand to gain P3B in grease, for it seems that all concerned gov’t offices have been told not to provide anyone any copy of the contract text as it may reach the media and the American suppliers who are complaining of non-transparency.

    When something is hidden by this regime, you can bet something is terribly wrong.

    Actually, the alleged theft is simply a defense mechanism. Kasi pag may nagreklamo, hahanapan ng proof na iyun nga ang nasa kontrata. Pag may ipinakita, sasabihing “hindi iyan yung pinirmahan”.

    Sa pagkahulog ko sa pagkakaupo, hindi ko nabasa na reconstituted na pala ang contract noong May 30 kaya hindi na dapat sundin ang payo ko na bumalik sila sa China at magpirmahan uli. Ngunit hindi ko na pwedeng bawiin pagka tanga-tanga nila dahil hindi ko naman sinabi yon.

    Pero ang maliwanag dito at tama ang nabasa kong news report noon, hindi naman daw kailangang pumunta si Gloria sa China kasama ang sangkaterbang alalay, mga 100 sila. Hindi rin ito state visit dahil walang official na pagsalubong na ginawa ang Chinese government na nauukol sa isang panggulo. Panggulo nga pala kaya hindi man lamang pinasalubungan ng palakpakan. It was a businss contract, not even Gloria was a signatory. Mas tama raw na sa Pilipinas ginawa abg pirmahan dahil pera ni Gloria ang ibabayad, I mean, pera ng bayan ang ibabayad.

    Di ba naman? Sila ang gustong makipag-business sa atin, sila ang dapat pumarito. Pero gustong maglamierda ni Gloria labandera, ayun, gumastos ng milyon-milyon, karag-karag ang mga taipan dahil binubulungan noon na suportahan ang TU candidates sa May 14 elections.

    Sa pagkawala ng dokumento, magiging pamoso itong si Formoso sa pagsasaad ng ganito:

    1. It’s a national shame.
    2. I doubt it. People there don’t even know how to email. (This is an affront to the Chinese government when asked if the contract can be downloaded on the internet.)
    3. Only Secretary Mendoza can give a copy of the reconstituted contract, upon written request.

    I am sure this $365M telecom deal will be up for investigation by Congress for many questionable items. It will make the signatories to the contract liable that’s why Formoso is distancing himself this early by calling the lost original contracts as a national shame. Some of my thoughts on this questionable transaction:

    1. It’s a Double Kill contract. First, the $365M is overpriced. Second, the amount is sourced from 15-year loan from a Chinese state-owned bank. With a 5-year grace on 15-year loan, the original $365M might reach more than $500M. Overpriced na, inutang pa.
    2. Two American companies who vehemently protested the transaction divulge that they can do the same project for very much lower price. Arescom, for $135M and Amsterdam Holdings, for $240M.
    3. There’s no bidding made and the transactions were made in shroud secrecy.

    Take note that Gloria had to leave her hospitalized husband just to witness the signing and back to the Philippines within 18 hours. The haste and secrecy of the CASHUNDUAN sa CHINA was resorted to because it’s 3 weeks away from elections and her Tus candidates were badly trailing in the surveys. Ang bulong bulungan noon, PAGCOR and PCSO are drying up and they need more money to buy votes. A portion of that money could be the missing P650M campaign kitty which didn’t reached the locals, the reason why Gov. Evardone was spitting fire in the direction of Ronaldo Puno and Gabby Claudio.

    The Blue Ribbon Committee or Senate Committee on Accountability of Public Officers and Investigations should look deeper onto the China’s ZTE Corp. P16 billion broadband project deals with the Philippine government. It appears to be over-priced by P10 billion.

    According to insiders ZTE’s real price is $132 million. Why NEDA and DOTC approved the ZTE jack-up price at $329.5 million? A US firm, Arescom using the same broadband technology cost $135 million and submitted its proposal ahead of ZTE. There’s something wrong in the ballooned contract. ZTE Corp. is notorious worldwide in under the table deals. Happy GO hunting!

    BANGKOK, Thailand — Thai prosecutors filed corruption charges against ousted Prime Minister Thaksin Shinawatra in the Supreme Court on Thursday, in the first formal charges lodged against the exiled former premier.

    Thaksin’s wife was also named in the case, which involves allegations of wrongdoing in a land deal.

    The attorney general’s office also recommended that officials seize the 33 rai (5.16 hectares or 13.2 acres) plot of land, valued at 772 million baht.

    The Supreme Court said they would decide on July 10 if they would hear the case.

    Thaksin has been living overseas since he was overthrown in a military coup in September while he was abroad.

    i tend to agree with Tongue-Twisted assessment: those documents were deliberately made to disappear before the critical and vigilant segment of the media could lay its hands on them.

    there is no other explanation, for why would it disappear apparently without any trace less than 24 hours after contract signing, and twin copies, at that? a very crude way indeed of preempting, and of parrying, the prying eyes of media and the public at large as well .

It’s about the resignation letter of Customs Commissioner Napoleon Morales reaching media which he denied he signed or he already tendered his resignation.

    I don’t think China will make a fuss about the stolen documents being bruited about by Formoso on the $365M dollar telecom deal. Because in the first place, it will be an insult to the Chinese communist government kung totoong ninakaw ang dokumento within its territory where a panggulo ng Pilipinas mismo was there to witness its signing. I suspect, wala talagang nakawan. The reconstituted contract might have been revised to do away some onerous provisions. Kung magkaroon ng investigation which I am sure there will be, they already inputed some escape clauses.

    Further, I doubt if the Chinese government will allow NBI investigators to do their sleuthing in their soil without it’s investigating arm, whatever it is. spearheading it or doing it by themselves. Remember, wala silang maipakitang result of investigation. Well, we know they can manufacture results of investigation, it’s their forte, which we know all along. Only themselves will believe it.

    Aside from the case of the stolen documents, I would like to draw your attention on what this project is all about.

    As written in the thread: Lack of transparency has haunted the $365 million ZTE contract for a project that would facilitate connection among local government units down to the barangay level. It is estimated that it will save the government P3.4 billion yearly in telephone bills.

    To my reading, it is telecommunication project and the beneficiaries are supposed to be the local govcrnment units (LGU) including the barangays. It’s justification: Makakatipid daw ang gobyerno ng P3.4 billion yearly!

    I understand that local telecom firms like PLDT, Bayantel, Globe and Digitel are experienced and efficient enough to cover the LGUs and barangays, why the need to enter into a contract with an outsider? If an ordinary citizen like me will cast doubt on the propriety of this project, how much more the experts who were questioning why the need for this project and why the haste and secrecy? To my simple mind, the present cellphones in almost all nook and corner of the Philippines will suffice, why spend billions more?

    Capped with the gargantuan cost of the contract which is obviously overpriced and tainted with graft, this contract must be stopped once and for all. We don’t want to be burdened with this another anomaly which to our computation, including interests, may reach up to $500M.

    One thing sure is that there lots of robbers and thieves in China dating back to the time of Alladin! Even my Chinese friends in Tokyo are afraid of their fellow Chinese. Presently, there are several Chinese in our own death row for committing robbery resulting in murder.

    Now, knowing this fact, these crooks in the Philippines must have thought of making a scapegoats of the robbers and thieves in China by blaming them for the loss of this Chinese contract that the crooks would not like to show the taxpayers in the Philippines.

    Rose is right. If there is truth in the allegation that the document was stolen in China, then it should have been reported there and let the Chinese police do their investigation.

    Ang problema baka hindi Chinese ang nagnakaw, kundi pilipino. Iyan ang mas nakakahiya!!! Actually, I don’t think the Chinese government would be embarrassed if they are told of the allegation that the said contract was stolen in Hainan. Ang problema lang ay baka tanungin ng mga intsik kung bakit naman pag-iinteresan ng mga kapwa nila intsik iyon na papeles lang naman.

    I think this a sloppy cover-up job by former PNP chief and DOTC Sec. Leonadro Mendoza. Maybe he wants to hide the details of the signed contract because Senator Panfilo Lacson is eyeing Senate Blue Ribbon Committee and might be interested to investigate deeper in the anomalous ZTI broadband deal. Sec. Mendoza was General Lacson’s deputy during the 2001 Edsa Dos power grab. Mendoza played a key role by isolating and neutralizing Lacson inside Camp Crame. Gloria Arroyo rewarded him the PNP top post and later the DOTC job.

    Looking deeper into details raises several pertinent questions, how could the new broadband system integrate in a public leased-line voice/data system when operators are required, FIRST: to secure a franchise from congress before any work is commenced. The NTC, with its stringent requirements, has not approved nor has Congress granted anyone a franchise to operate a public utility system. ZTE is merely supplying the backbone for the system, who will operate it, government?

    SECOND: If its purpose is solely to serve the voice and data requirements of the gov’t “from Malacañang down to the barangays”, will gov’t now be competing with private carriers Smart/PLDT, Globe, Bayantel, Digitel, Islacom who also offer the same services? This move will jolt the whole telecoms industry, not only because of the revenues it stands to lose but also from huge payments it will have to make to access the backbone system.

    THIRD: Will gov’t operate the system by creating a new GOCC? This is where the signed documents should be scrutinized. Does it carry stipulations of a BOT project, if so, ZTE has really short-circuited the franchise requirements and also the law which prohibits foreigners owning more than 40% of public utilities. The project may be constitutionally infirm. If Gloria says the gov’t owns it, then there goes privatization, in REVERSE!

    FOURTH: Since the telecoms companies are quiet (no one is complaining), will gov’t be funding the infrastructure with OUR money and only be used later for the interests of private enterprises, saving them billions had they been required to construct it themselves? If this is the case, then how many shares of stock in these corporations have been assigned by Deeds to the Pidals?

    FIFTH: What does the US Ambassador now have to say regarding the theft, after her complaint of non-transparency and of the lack of public bidding was made on behalf of the angry American proponents whose offers were cheaper and technically superior? We all know the Americans will take no bullshit from Gloria. How will Gloria react?

    I guess these questions can only be answered by the docs. And Formoso has already said copies can be provided ONLY by Sec. Mendoza upon writing a request.

    You get the drift.

    With the results of the mid-term elections, which favored the opposition bloc as far as the senatorial line-up is concerned, the Filipino people have high hopes of getting results with the Blue Ribbon Committee inquiry and investigations.

    We will expect and get results with the replacement of the chairmanship from Senator Joker Arroyo to Senator Ping Lacson.

    Methinks at this early stage, those who are involved in this anomalous deal are claiming that the contract papers were stolen.

    But going back to the basics, any new player who seeks active participation in providing telecommunication services in the country must secure a francise from the congress and at the same time the National Telecommunication Commisssion will provide the concession where the services are deemed necessary and the provision for inter-connection to the existing dominant carrier.

    But – this administration thinks they can do whatever they want and forget about the existing rules and regulations as promulgated by the law.
