CAMP CAPINPIN, Tanay, Rizal – Former Marine commandant Maj. Gen. Renato Miranda’s lawyer yesterday caused the expulsion of Lt. Gen. Alexander Yano by exercising peremptory challenge against the president of the general court martial that has been trying Miranda and 27 other military officers in the last eight months for last year’s failed power grab.
Under the military justice system, all accused in a court martial have the right to peremptorily challenge any member of the tribunal without cause, a move that automatically disqualifies the challenged member.
Yano, who is the head of the Southern Luzon Command, was forced to inhibit himself. He designated Maj. Gen. Raul Caballes to take over but Caballes was himself peremptorily challenged by another accused, former Scout Ranger Regiment commander Brig. Gen. Danilo Lim.
An alternate member of the court, Maj. Gen Serrano Austria, took over as acting president but members of the defense panel questioned his right to hold the post, noting that he is junior to Miranda, and court martial rules require that the court’s president be senior to the highest ranking of the accused.
Although a major general like Miranda, Miranda outranks Austria in the military’s seniority lineal list.
With no one among the remaining members of the military tribunal or among the reserved court members being more senior than Miranda, the court had to reschedule the proceedings on July 27.
Another strategy employed by defense counsels to suspend yesterday’s proceedings was by citing that only 11 of the 27 accused – including Medal of Valor awardees Col. Ariel Querubin and Lt. Col. Custodio Parcon – were represented by their civilian counsel of choice. Most of the accused were not present during the proceedings because of the hasty scheduling of the hearings.
The court denied the motion and the corresponding motion for reconsideration of the defense panel and appointed the two military lawyers to represent all the accused who were without civilian lawyers.
Prosecution lawyer Lt. Col. Jose Feliciano Loi, who earlier said the absent defense lawyers had abandoned the cause and those that were present were trying to delay the proceedings so that the case would prescribe in February 2008, was confronted by one of the accused, Capt. Ruben Guinolbay who told him they were not “enjoying our lives as prisoners here.”
Three accused were absent in yesterday’s hearing: Maj. Leomar Doctolero (on emergency leave); 1Lt. Ervin Divinagracia (surgery for an unknown ailment), and Capt. Allan Cornejo (difficulty in walking).
Col. Januario Caringal appeared for the first in the proceedings which began late last year. He had been confined at a Navy hospital for hepatitis. – Victor Reyes

Must confess I was overwhelmed.
Veneracion said the enemy forces numbered 500 against a split Marine unit of about a hundred. Difficult to really put a number to the attacking party (MILF or other forces of beheaders, mutilators or plain ambushers) in the heat of battle – they may be 500 or less but even if for the sake of argument there were only 200, the fact that the ambushers were on higher ground gave them an enormous tactical advantage over less than a hundred or more troops exposed in open battlefield.
The media men were very lucky to have come out of it alive!
We need answers to 2 questions that I’ve been asking since the news broke into the blogging world:
What happened to back up support either by air or land? WHAT BLOODY HAPPENED?
Why aren’t military commanders’ heads rolling yet?
After reading the accoutn, I am a bit perplexed: Why was the Marine unit split, i.e., one that lagged behind while the other with whom the media team found thelselves split, separated from their mother unit? What happened?

The lady commander who survived the ambush might be the best person to give us answers to your legitimate questions. Nasaan ba s’ya, she should be interrogated in public so we will know what really happened in Tipo-tipo.

I like the peremptory challenge employed by the defense lawyers of the accused officers, walang laban sina Yano.

Esperon’s Kangaroo Court is going no where. It should be dissolved ASAP because alleged mutiny charges against Major General Miranda , et al. It’s a product of Assperon’s wild wet dream and fantasy. The defense counsels have a brilliant strategy- perpetual expulsion until thy kingdom come. In a game of chess, perpetual check will end up in a draw. Eventually General Esperon is the ultimate loser. Anyways, Gloria Arroyo and Esperon are guilty for robbing the true peoples’ mandate in 2004 presidential election.

I heard quite a while back that Col Querubin used to play chess with his dad when he was only 3 yrs old. His dad was a chess champ as well!

Hosanan was taken off the hook by the lower courts and the Batasan 5 were found not guilty by no other than the Supreme Court. All of the above were already set free. Eh, ano pa ang kaso nitong mga officers na ito? Dahil lang siguro hindi nila mapaluhod kay tiyanak. Knowing these brave men, they would be happier fighting the rotten system than joining the tiyanak’s Enchanted Kingdom even if all the perks( high position, money to buy a ranch in Australia or a villa in Europe and money flowing like water) were given to them. Kaya assperon, mabibigo ka! Bad deeds like your election rigging, insensitivity to the needs of your soldiers, and openly licking the ass of your commander in cheat will never be forgiven by these brave men! In behalf of the incarcerated officers I would say to assperon, MANIGAS KA!

Chess player pala si Col. Querubin. Magaling nga siyang magpatumba ng kaaway. Too bad, nakakulong siya ngayon, but I salute him kasi hindi niya kayang magpa-under sa isang kriminal. In short, walang kaso! When these gallant soldiers refused to serve a criminal acting like a president, they were justified. Golly, kung totoo iyong sinabi ni Col. Querubin when he was interviewed nang magwala siya bago siya kinulong (I had the impression that they were not going to incarcerate but allow him to just cool off when they tried to pacify him) na pinipilit silang sumama kuno sa mga rally para iligaw ang mga protesters doon sa bombang pinatatanim sa kanila ng mga hepe nilang walanghiya, pero ayaw niya dahil ang trabaho niya ay pangalagaan ang kapakanan at buhay ng mga kababayan niya, at hindi sila berdugo na gaya ng gustong ipagawa sa kanila ng kriminal, dapat lang na iyong Poohtah ang makulong at hindi sila!

You know in Tanay, may 40 na enlisted men na nakakulong doon. Walang mga kasalanan itong mga ito. Karamihan sa kanila ay rangers. The only fault they had was, noong supposed marching day (February 2006), hindi lang nakapasok itong mga ito. Pagbalik nila the next day, sa kulungan ang tuloy nila. Hanggang ngayon nakakulong pa rin itong mga ito na wala namang maisampang kasalanan sa kanila. Most of them have not seen their families yet for almost a year and a half na. Ang panakot ni Assperon sa kanila, tatanggalan sila ng sahod at benefits. So, yun nagtitiis na lang sila kasama ng mga incarcerated officers. If you see most of them, mukha na silang mga ermitanyo!
