THE GRP-MILF ceasefire committee has found lapses on the part of the military that it said led to the encounter with MILF forces last July 10 in Al-Barka town, Basilan.

Fourteen Marines were killed. Ten were found beheaded the day after the encounter.

“It appeared there were lapses in coordination when the Marines conducted operations in Ginanta and other neighboring barangays in search for Fr. (Giancarlo) Bossi pursuant to the established mechanisms with the general cease-fire agreement entered into the by GRP and the MILF,” said a source quoting the findings of the investigation.

Bossi was released by his captors last July 18 in Karumatan town in Lanao del Sur.

The source’s statement was confirmed by JCCCH co-chair Von Al-Haq of the MILF. “That is one of our findings. If there was coordination, there would have been no encounter.”

Al-Haq added: “It was not an ambush. The Marines were in position and the MILF misconstrued it as assaulting.”

MILF chief negotiator Mohaqer Iqbal echoed Al-Haq’s statement. “It was a legitimate encounter. This is in keeping with our findings but I cannot disclose the entire findings.”

National security adviser and acting defense secretary Norberto Gonzales last Thursday said while the involvement of the MILF forces in the fighting was established, they were not behind the beheadings.

Gonzales said the investigators found that four Abu Sayyaf men, Umair Indama, Nurhasan and Buhari Jamiri and Suaib Kalibon, beheaded four of the soldiers. It was not known who beheaded the six others.

The source said investigators failed to establish who killed and tortured Imam Alkanul, an MILF religious leader who MILF officials said was killed by the Marines before the encounter.

The military denied the allegations, saying Alkanul was on its side.

The Basilan police have begun serving warrants for the arrest of 130 personalities, including some MILF members, in connection with the beheading of the soldiers.

Iqbal said he cannot ascertain the number of MILF members or their names because the MILF leadership was not furnished them with the charge sheet. He said the MILF was not even consulted before the charges were filed.

Asked if the MILF would be willing to surrender its men, he said: “That (case) was a unilateral decision on the side of the government. As far as the MILF is concerned, that is not binding on us.”

Defense undersecretary for reservists and retirees affairs Ernesto Carolina and National Disaster Coordinating Council executive officer and concurrent Office of the Civil Defense administrator Glenn Rabonza will supervise the coordinating meetings in Zamboanga City today for the possible influx of evacuees from Basilan due to the punitive actions of the military on perpetrators of the beheading.

“This is part of our preparations in case of problems that may arise because of the police action that the government is undertaking,” said Rabonza.

Rabonza said at least 3,000 families or 12,000 persons have been displaced. The residents started to flee when the military announced it would launch punitive actions days after the incident.

Rabonza said officials from the provincial disaster coordinating councils of Basilan, Sulu and Zamboanga, and other NDCC-attached agencies like the Philippine National Red Cross, DILG, DSWD and DOH will attend the meeting.

Caloocan Bishop Deogracias Iñiguez called on the government to reflect on its military option.

“I am sure there are other ways to resolve this matter… hopefully in a peaceful way,” said Iñiguez, who heads the Catholic Bishops Conference of the Philippines public affairs committee.

Iñiguez said government should keep in mind and always consider the ongoing peace negotiations with the MILF.

“I don’t believe that fighting tooth-for-a-tooth is the best option right now,” he said. – With Gerard Naval

    A military Leadership who can not win the war against a rag-tag seccesionists and the youngsters who lead the insurrection is what the country has. And if we start to enumerate the reasons why, it will take forever. But in short, it is led by leaders, the Generals who plan and stay awake all night figuring out how to deal with enemies for profit, not to defeat them and they are very good at that, just like their Chief in Command. Or simply to retire as Multimillionaires anywhere in the world…

    Very true, Vic. As you can see, it’s the junior officers who are more idealistic and patriotic. Many of the higher ranks, the Generals, started out just like these young officers but eventually fell into temptation…eaten by the corrupt system.
    Few are able to hang on with their dreams and vision. There are not too many like Trillanes and company today.

    Well, they could have allowed themselves to get devoured but sometimes they don’t have much choice, Vic. They are within the military circle whose structure is deeply surrounded by secrecy and code of silence. How can junior officers disobey their superiors? They are compelled to look the other way. It’s a gradual process and development until they wake up to find themselves thrown into the dirty system of corruption. Some keep silent while others become part of the corrupt establishment.

    National security adviser and acting defense secretary Nob-end Gonzales is a liar and has no credibility what-so-ever. Let’s not forget the Lies he told at the Senate inquiry that he had a ‘Serious Heart Condition’ that required consultations with a Swiss doctor who said he required urgent surgery. If the doctor said he needed his head examined I’d go along with that diagnosis. He was found out to be a Liar to escape Justice being done.

Point is how long will Filipinos tolerate these lapses that are in fact signs of incompetence, impotence, inadequacy, incapability, incapacity, ineptitude, and even perhaps powerlessness on the part of the criminal who is apparently being held by the neck by the crooks in the military who have helped her sit at Malacanang so that they can loot the treasury themselves even at the expense of the Moslems who are likewise being used as scapegoats by these crooks who are themselves criminals for having trampled upon the Constitution and laws of the land.

    Jamby files command responsibility bill

    An opposition senator filed Monday a bill that seeks to punish ranking government and military officials for crimes or offenses committed by their subordinates under the principle of command responsibility.

    Sen. Maria Consuelo “Jamby” Madrigal said Senate Bill No. 1427 or the Command Responsibility Act seeks to hold President Arroyo liable for crimes committed by the military and other agencies under her authority due to command responsibility.

    Madrigal said that the country’s president, being the commander-in-chief of the military, should be held liable for hundreds of extrajudicial killings in the country.

    The bill proposes a maximum prison term of not less than 30 years and a lifetime ban from holding public office for the violators.

    Activist groups have consistently linked the military in at least 800 cases of political killings. The military is also being held responsible for the abduction of 182 cases of enforced disappearances, including that of Jonas Joseph Burgos.

    Madrigal said she authored the bill in response to the two-day assembly organized by the Supreme Court to find a solution to the country’s problem in extrajudicial killings.

    The senator said Mrs. Arroyo should support the bill if she is really sincere in solving the killings.

    Last June, the Bagong Alyansang Makabayan scored Executive Secretary Eduardo Ermita for saying that Mrs. Arroyo should not be held liable for the killings under the principle of command responsibility.

    Ermita explained that command responsibility can only be applied to officials who are two ranks higher than the offender.

    “This interpretation is an invention of Ermita and runs contrary to accepted principles of international law wherein even heads of state can be tried for crimes involving human rights abuses,” the activist group said.

    “Arroyo cannot wiggle herself out of her clear liability in the killings especially since the deaths and abductions have not stopped despite the so-called measures being taken by her regime,” the group added.
