A destabilizer not entitled to executive checkup: Esperon

Maj. Gen. Renato Miranda, former Marines commandant who is detained for allegedly leading a failed power grab last year, is not entitled to an executive checkup because he is a destabilizer, AFP chief Gen. Hermogenes Esperon said yesterday.

“If they are asking for an executive check, what I know is that an executive checkup is a privilege for those who are not resorting to violence,” Esperon said.

“For example, if you are not doing something illegal, you can have an executive checkup. But if you are a destabilizer, you are detained, why then are you asking for an executive checkup? We (military leadership) are not the ones who are at fault why you are being detained,” Esperon also said.

It was unclear why Esperon was talking of an executive checkup when what Miranda’s co-detainees at Camp Capinpin in Tanay, Rizal were asking for is only that he be brought to a hospital outside the camp.

Miranda is said to be suffering from hypertension, high blood sugar count, vertigo, and ear infection.

His medical condition was brought to the attention of the AFP leadership by his co-accused, Brig. Gen. Danilo Lim, during court martial proceedings in Camp Capinpin Friday last week.

Lim, former commander of the Army Scout Rangers and another alleged coup leader, said Miranda has been seriously ill for the past two weeks and once collapsed in the bathroom of the detention room they are sharing. He said the camp’s hospital, without the necessary equipment, could do only so much. He expressed fears Miranda might collapse again and could go into coma because of low blood sugar.

Lim said the head of the camp’s hospital has requested that Miranda be given medical attention in a hospital outside Camp Capinpin. The request was turned down by the commander of the camp’s detention facility on the ground that Miranda is a “security risk,” he said.

Esperon said when he learned of Miranda’s condition, he ordered that his mistah be sent to a “local hospital” where he said Miranda was “given medication.”

“And they say that he doesn’t have to be confined. So it’s the doctor talking. We had examined (Miranda) again last September 28 and they (doctors) said he can be administered to as an outpatient. So we are taking care of him,” Esperon said.

He did not say to which hospital he sent Miranda, his classmate at the Philippine Military Academy Class ‘74.

Esperon and Miranda were roommates or bunkmates at the PMA.

Miranda is due for retirement this December and Esperon in February.

Aside from Miranda and Lim, 26 other Army and Marine officers are detained in Camp Capinpin for the failed coup plot in February last year.

Col. Ariel Querubin, another accused in the plot, has told the military court he was due for a blood test two weeks ago but authorities have not brought him to the AFP Medical Center. Querubin has been diagnosed by military physicians as afflicted with malaria.

Col. Januario Caringal, also a co-accused, is confined for hepatitis at the AFP Medical Center in Quezon City.

    Unbelievable! Miranda is complaining of vertigo in parallel to all the ill symptoms he’s feeling. Let’s not call the medical check up an executive check up but there’s a need to do brain scan too, which is a part of the executive check up. Extraordinary… I don’t believe how dumb Esperon is! I knew he was dumb but THAT dumb?

    There is nothing in military laws that say that an accused military officer is not entitled to a complete medical exam when that officer is ILL! NOTHING AT ALL, Ellen, nothing.

    Esperon is re-writing military laws and the military manual and the AFP code of ethics!

Depriving an individual the basic rights is a violation of his fundamental rights and doing so Esperon has just violated the most cherished provision of the Constitution. But that General won’t even know, the difference between night and day, so it is just a waste of time to even tell him that you are nothing but a “sucker”…

    since gen Miranda suffers now from ear infection, vertigo is just one of the manifestation or signs and symptoms ng ear infection, it really needs medical treatment and medications, kasi yung infection pwede kumalat papunta sa brain. Re his hypertension and highblood glucose( he may have diabetes) then he really needs prompt medical treatment, he could reAlly go into coma kapag hindi naagapan yon.

    I’m sending you a copy of the newly revised international convention on the treatment of prisoners, military and civilian prisoners for your perusal. Magandang basahin.

    Apparently, the AFP now under Esperon is not following any of these international conventions for the protection of human rights. A petition to try this animal court should be submitted. This can be done in fact by a group of lawyers in the Philippines. There is actually no harm in trying what one is dictated upon by his conscience especially if he is capable of doing so.

    Even prisoners, convicted and otherwise, are allowed by law to seek medication care and attention when the are sick. A violation of such convention is considered a violation of human rights, and is made punishable everywhere, the Philippines included. Question is why is this general (daw) being allowed too many freedoms to defy the law, and worse the law of decency? Unbelievable! It should be stopped by all means!!!

There are more high ranking officers who disdain his ways but are afraid to make a move because they know how vicious this ass is. But given the right moment, these brave men will move.     I’m told that a son is studying in Kyushu, Japan as a scholar, but someone in our UPAA said that he is not in good terms with his own father. Oh well!

    The new wife is a doctor at the VM Hospital. With her Hippocratic Oath, she should be the ones telling him to be generous to help Miranda get proper medical care. The doctor in Camp Capinpin should be able to give him proper diagnosis. Why should the doctor there be suspected of conniving with these few brave men for the idiot Esperon to make such inhumane orders.

    This cruelty should be condemned as a matter of fact. It cannot be kindness at all but torture.

Pasalamat sila na talagang nature na ng mga pilipino ang maging docile, at umalis na lang ng bansa kung kaya nila kesa makigulo pa.     Ang alam ko iyan din ang frustration ni Rizal noong panahon nila. Kaniya-kaniya din sila ng pakulo. At least, now, we have the blog to try to bring fighters against oppression, etc. together.     To me, Esperon wants to train a new outfit to reinforce his own garrison and not because he needs them.

    The AFP as it stands today, I do understand, is small but I doubt very much that Esperon’s request for funding to hire 8,400 people to form militia groups is the real answer. To me, this tactic is purely self-serving. Esperon is afraid of the restiveness in his otherwise semi-professional armies. To limit the risk of a possible implosion within the army, he believes that a militia (in military parlance, they are quasi mercenaries) what better way than to inject Army paid groups to report on the regulars?

    Havent the armies already streamlined the agcfu ranks? So why re-invent it? If someone else other than Esperon were to raise the necessity of hiring militias, then I might consider the Army’s new manpower doctrine but heck, Esperon’s moves and decisions will always be suspect!

    I asked my husband the same thing. He said, in theory, a detained officer or NCO who believes that his human rights are being violated can sue the service. But it has to be the individual himself filing the suit through his lawyer.

    AdeBrux, the same here, an inmate can sue the correctional service if he also believes his charter rights are violated. the latest decision by the court that even inmates can now vote as they have rights same or equal to others except of course they have to repay their debts to society by serving their sentences. use to be that anyone serving more than 2 years can not vote or run, now it was unconstitutional.. considering that the General Miranda is not even convicted of anything, then under the law of the Philippines, he Has the same privileges and rights as that of General Esperon. I think that is just commons sense if the AFP chief has still on ounce of Common Sense…

  82. Just read in Malaya that 4 members of the Navy’s special operatiosn group were killed in a pre-dawn firefight in Lanhil island.

    This is my favourite group in the armed forces of the Philippines. I am saddened whenever I read that there’s casualties in a firefight with the bandits.

    The group is a very tiny one compared to all other special warfare groups in the AFP.

    This is just absurd. Gen. Miranda is doing his duty as a law abiding citizen, and this is how he is treated? He is in the military to serve, protect and defend the land, and this soldier who was in pain was not only denied medical service, Armed Forces should consider treating their military personnel as necessary, rather than neglecting their needs and bullying them around. When soldiers experience this too often, they start to rebel. That would not make for a good situation, considering what the original mission is. The maltreatment of this principled general is a reflection of the political Zionist, cruel, inhumane psyche!     It’s a shame that Gen. Miranda’s own ‘mistah’ or brother is the one who will also put him down in this trying times and to think that Gen. Miranda and Esperon are bunkmates way back in the Academy where they have gone through a lot of ups and downs. Esperon was only able to get the stars in his
    shoulders because his a kiss-ass and top puppet of Mrs. Arroyo. He’s not worthy to be called General because the term is reserved only for the finest gentlemen in the ranks. No wonder why his ‘mistahs’ in ’74 are cold to him. He thinks he is God because Commanding Generals (CG) of different major branches of the Armed Forces of the Philippines (AFP)(Air Force, Navy, Army) are all his ‘mistah’ including the newly-appointed Philippine National Police (PNP) Director-General Avelino Razon. He not even fit to be called MARANGAL to think that he came from that class.

    Heck, he should be the one charged violating the Articles of War (AW) specifically AW 96 which is CONDUCT UNBECOMING AN OFFICER AND A GENTLEMAN. The article reads, “The conduct contemplated (AW 96) is any action or behavior in an official capacity which, in dishonoring or disgracing the individual as an officer, seriously compromises his character and standing as a gentleman; or action or
    behavior in an official or private capacity which, is dishonoring or disgracing the individual personally as a gentleman, seriously compromising his position as an officer and exhibits him as morally unworthy to remain a member of the honorable profession of arms. (Winhrop)” Instances of violation of this article are: .. CRUEL TREATMENT OF SOLDIER.

    Mr. Esperon, may I remind you that denying someone to seek medical treatment is not only a cruelty to a soldier but as a person and a clear violation of basic human rights as also stated in the 1987 Philippine Constitution’s Bill of Rights (Article III Section 1) which is “No person shall be deprived of life, liberty, or property..” Even during the war, medic officers gave the most basic medical treatment to the opponent because what is at stake are human lives. Maybe you should have a refresher course in ethics, history and most especially, humanity.

    Mr. Esperon’s inhumane acts are clearly self-serving and maybe his “silent revenge” to his ‘mistahs’.

    Lastly, why do you refer to General Miranda as a “destabilizer”? Do you have any solid proof that could justify your accusations? Isn’t it stated in the constitution (Article III – Bill of Rights Section 14 Paragraph 2) that “in all criminal prosecutions, the accused shall be presumed innocent until the contrary is proved..” Your actions leads to the violation of AW 88-A which is
    UNLAWFULLY INFLUENCING ACTIONS of COURT which leads us again to conclude that the court-martial proceedings are considered moot because you, as their CS or Chief of Staff, has the power over the subordinates who also happened to be
    members of the Court-Martial.

    Please don’t reason with us that Military law is different with the common laws of the land. All of us know that Military laws are formed under the principles of the constitution, that you have also taken oath to be its prime
    defenders. The military justice system maybe different with the common justice system because unlike the normal justice/court proceedings, your “system” is to have somebody else impose judgment which are clearly rendered since the very start of the so-called “trial.” All right, sir?

    i think mrs. miranda’s concern for now is his husband’s health, and the well being of thier son’s, daughter at mga apo, of course she is very much willing to press charges, pero malamang wala din mangyari, sila ASSPERON ang nakaupo, gagawin nila lahat para mahirapan ang kanilang pamilya at kalooban.
