Esperon unremorseful of his illegal detention of 40 soldiers:On Thursday, Armed Forces Chief Gen. Hermogenes Esperon Jr. indicated that the fate of the 40 enlisted men would depend on the outcome of the case against the 28 officers.

“Do you discharge the enlisted personnel when the officers have not yet even been arraigned? A good timing would be to arraign the officers first and decide what punishment would be fit for the offenses committed by the enlisted personnel, because they were simply led to doing it by some officers,” Esperon told reporters. click here for full story

I’m glad that the existence of the 40 soldiers in the detention center in Camp Capinpin has been exposed. I knew about this for a long time but I was asked not to write about it by the members of the family of the soldiers because they said they were told that the salaries of the soldiers would be cut off if it’s exposed in media.

I couldn’t bear it in my conscience to have the 40 families going hungry so I gave in to their request and prayed that some day, God will find a way to bring out the truth.

I was told that AFP Chief of Staff Hermogenes Esperon and his cohorts are pressuring these soldiers to testify against Brig. Gen. Danny Lim and the other officers.The problem is, these soldiers really know nothing.

40 soldiers secretly detained in Tanay?

Forty Army soldiers accused of involvement in the failed Feb. 24, 2006 coup have been secretly detained in a military stockade in Tanay, Rizal without charges for more than a year now.

The discovery was made by Sen. Rodolfo Biazon, a retired Armed Forces chief, when he visited 28 detained military officers on Monday to check on the physical and health conditions of former Marine commandant Maj. Gen. Renato Miranda, who was reportedly seriously ill.

Army spokesman Lt. Col. Ernesto Torres said the 40 soldiers were detained upon recommendation of the Army inspector general, pending the filing of appropriate cases against them.

Majority of the soldiers were taken to Tanay on July 24 last year, while the rest were brought there on August 1 and in October last year, he added.

The soldiers, who belong to the Army Special Forces and Scout Rangers, were arrested and detained for alleged unauthorized movement to Manila on the eve of the 20th anniversary of the EDSA I People Power uprising.

A court martial is yet to be convened to try the detained soldiers as the Army Judge Advocate General’s Office (JAGO) is still studying whether to file administrative or criminal cases against the soldiers.

    The enlisted men have not been charged. The lawyers are aware of this but have not filed petitions for habeas corpus. This is because any legal action that will bring light to their cases will force the hand of JAGO into filing charges against them. If or when that happens, forty soldiers and their families will go hungry. Unlike officers whose salaries are not cut off while undergoing court martial, the opposite is true for enlisted men. Once they are served charges, no more pay.
    If I read it correctly, the lawyers are waiting out the prescription period which ends in February, for any lesser charge. Then a petition can be filed, even if they are subsequently charged with mutiny because other offenses cannot be compounded.

Nakakaawa ang mga sundalong wala namng kasalanan at pinapahirapapan… talagang justifiable king magrebelde ang mga sundalo dahil ang mga nasa may kapangyarihan ang mga tiwali. Dapat sa mga mang-aabuso na to ay parusahan. Kulang pa siguro ang tadtarin sila ng pinung-pino upang kabayaran sa kanilang mga kasalanan. Sana unahin ang gagang si gloria.

  3. Klingon, oh so that’s why when I told one of the lawyers that I wanted to write about the plight of the enlisted men, he replied, “pag-usapan muna natin yan”. We never got to talk about it again because of so many issues that we had to deal with.

  5. It is infinitely wrong to incarcerate these soldiers for one year their plight unknown, their families starving, without any legal charges against them.

    This is a brazen violation of their human rights Ellen! Esperon has no right to wear those stars and to call himself general. No general in any civilized army in the world will do that to his troops.

  6. Kawawa talaga itong mga enlisted men kasi mahirap lang talaga ang mga ito. Many of them have not seen their families for more than a year since their incarceration because they have no money for fare and they have no place to stay in Tanay.

    One of the wives, who was pregnant, rented a room in a house outside the camp to be able to visit her husband frequently. One time on her way out, there was no available vehicle to hitch a ride on, she walked.it’s quite a distance from the detention quarters to the gate. It’s no less than five kilometers.

    It was a good thing she was already nearing the gate when she delivered her baby.

  8. Pati pala sa sa military may enforced disappearance and illegal detention. Aber sige nga, ngayon niyo sabihin sa taong bayan kung hindi kayo ang pasimuno sa mga extra-judicial killings and abductions. If the military can do this to their own men, what more with the ordinary Filipinos?

    Dasal ko lang na ngayong binisto na ni Senator Biazon ay makagawa siya ng paraan na palayain ang 40 enlisted men. Nakakadugo ng puso ang kalagayan nilang lahat pati ng mga mahal sa buhay.

    Sana ay hindi tigilan ng media ang follow up stories tungkol sa kanila.

    Si Ellen ay tiyak na hindi ito titigilan, sana ganun din iyong ibang journalists, tutukan ang kaso ng lahat ng “few good men”

    the soldiers detained should file suits against people. bahala na kung manalo or hinde, just keep on filing and just keep the cases coming. that way, people like esperon will be compelled to prove his worth and abide by the rules. lest he’d want to be shamed in the media. this esperon is a prestige hungry freak, he deserves all the shame he could get.

    Mali iyong mentality, Rose, na kapag nakaupo at dahil sundalo,hindi puedeng hulihin dahil iyon ang patakaran ng military. I think it is bullshit! Kaya may batas ay para tumino ang lahat, including those in the military dahil ang totoo ay tao din sila, and should be subject to the laws of the land and in all progressive countries, a crime is a crime and a criminal has to be made legally responsible for it, meaning, puedeng dakpin, imbestigahan, i-indict at litisin sa isang korteng matino at parusahan kung kinakailangan.

    Tama iyong mga Magdalo soldiers na lumapit doon sa kriminal sa Malacanang pero hindi pinansin na ipatawag ang ungas even though everybody knows walang gagawin ang ungas kundi magsinungaling, pumayag o hindi man siyang humarap sa korte.

    I don’t know why they have not thought of antidotes to laws that are likely to have loopholes that they have in the Philippines that they cannot prosecute a criminal just because she has managed to get to where she is now, and have all her protectors in agencies responsible for prosecuting and putting criminals like her in jail.

    Ang kailangan lang naman sa totoo lang ay mga concerned and conscientious lawyers who will have the guts to try to have the creep and her minions prosecuted by taking the pains of researching for existing laws and precedents even in the US perhaps since anyway Philippines laws are basically based on US laws.

    OK iyong initiative na ginagawa halimbawa nina Atty. Roque and now this Atty. Avisado. God bless you people!

  18. Doon sa tanong kung puedeng i-convict si GLORC? Bakit hindi kung totoo namang gumagawa siya ng kalokohan?

    Palagay ko naman may mga unwritten laws ang Pilipinas na puedeng gamitin kung nakalimutan ng mga gumawa ng batas after 1986 na puedeng hulihin ang kahit na sinong gagawa ng krimen, including the president of the Philippines, kung may valid ground/suspicion dahil hindi naman siya/sila supposedly to be above the law!!!

    Over where I am based, there are unwritten laws that can be basis for such action in case the lawmakers have neglected to set things right with some laws that they should have passed and implemented. Ang main objective is to prevent people from abusing and going above the law.

    MISSING IN ACTION, if there is one group that had been unusually quiet and seems to be condoning all the illegal acts of this illegitimate government, it is the Bishops. How I wish Cardinal Sin would have been still alive today.     OJAG has lost all moral ground to say the least for convening a court martial to try the case of the ordinary troops.

    They should release them.

Funny how people there in the Philippines can still say that they need to accord GLORC some courtesy even when they know for a fact that she has violated not just one but many of prime provisions of the Election Code, huwag na ang Constitution that she and her cahoots trampled upon when they removed a duly elected president? If they are incarcerating innocent soldiers for not just months but years, why can they not just arrest the criminal squatting at the palace by the murky river without a useless impeachment that her own people even have the nerve to make fun of.

    Pmabihira! Onli in da Pilipinas. Puro kagaguhan. Pero sila-sila rin ang nalilito ng mga kalokohan nila. Enough of the kid gloves given to the GLORC! Nakakasuka!

    my heart is really trembling when i was reading this post…honestly i am scared now what the evil esperon will do to them, he can just charge them and create story like what he is actually doing to the officers….now there will be pressure on esperons part kasi alam na ng taong bayan na he’s literally secretly detaining these enlisted men, he might file a case instead to justify the issue….if that will happen kawawa ang mga taong to, ung iba malapit na mag retire, if ganun bka wala na sila ma tangap na retirement. abot hangang langit ang dasal ko ngayon na sana naman wag mangyari, cguro 30 among 40 ang mga hindi pa nadalaw ng mga families nila for barely 2yrs… i always wanted to seek help kahit man lang sana sa fare ng mga families. its in my dream though, sana ma materialize na:)

    Let’s pray that the ‘good senators’ will make a firm stand side by side with these “few good men”!

    Let’s also pray that media will give more focus on their case to balance whatever is Asspweron’s evil plan about them.

    Thanks God that finally the incarceration of the 40 Scout Ranger Enlisted personnel is now out in the open…

    Like Ellen, I really wanted to inform the world that there are people in Tanay who are in prison just because Esperon wants them inside… but I was advised not to mention anything..

    The 40 EPs were restricted to Barracks in Fort Bonifacio from Feb to July 2006 before they were incarcerated inside a high detention cell in Camp Capinpin Tanay on July 25 2006 up to the present…

    What is unbelievable is that Major Pancog, the Commanding Officer of these 40 EPs, was released last November 20, 2006. But his men are still inside without any charges, with no case at all.

    These 40 enlisted personnel were never represented by counsel since they were restricted to barracks or even when they were incarcerated.

    If only you could interview the men inside. There is one soldier who saw his wife and children last December of 2005 yet. So it will be two years on Dec 2007. Because of financial constrainst, the family can not visit the prisoner.

    Most of the families of the detainees are in the Visayas and Mindanao areas.

    If not for the constant counselling and guidance of the detained officers, these men would run amock..

    With regards to Mr Esperon’s field assignments, I heard that the time spent by the detained officers in prison is longer than his stint in the field. Of about 35 years in the military service,Mr Esperon spent less than two years in the battlefield…

    Most of his years, he was in Malacañang as PSG or with NICA or abroad as Military Attache’.

    He has only one Gold Cross Medal but even that was doubtful becasue he got it when he was assigned in NICA.

    I heard from our intel sources that Mr Esperon is the type of officer that makes a situation to earn credit. Like for instance, if the president is arriving in his field of assignment, he will make a scenario where there is an encounter and his command will retrieve fire arms that were already in his possession or it was previously retrieved in a previous encounter. He is so used to making up intel reports that even when he is in the field he would still make it up.

    Who is Mister Esperon?

    Mister Esperon graduated from the PMA in 1974. He joined the Philippine Army as a Platoon leader of Bravo Company, 23rd infantry battalion. After only five (5) months in the field, Esperon made his way out and underwent various “gentleman’s courses” like PsyOps Course, Officer Basic Course, Home Defense Orientation course in Fort Bonifacio; Contrary to the exaggerated self-projection of Mister Esperon, his exposure to the rigors of repeated and almost a routine affairs with dangers and the fear-inducing hostile situation was not enough to mold him the “basics”. It requires time, a reasonable length of time for one to get the best teacher there is – experience and exposure. The law of the farm candidly exemplifies this. There is required number of days to hatch the eggs! At the height of Muslim rebellion in the mid 1970’s, he was at the sideline of various schoolings and after which he was assigned to 36IB as company commander from April 1975 to June 1976 (months short of a two (2) year requirement as company commander.) Simple perusal gives us Mister Esperon’s total time in the field as junior officer to only one (1) yr and 7months! After his stint as company commander, he held office/desk jobs in various AFP units like NISA, investigation officer, Military police Battalion.

    For 17 years, Esperon stayed in air-conditioned office until he was given a battalion command in 1994. He had no COMBAT awards since 1974. Esperon was fraudly awarded a Gold Cross Medal in 1981 while he was the executive assistant of the NISA Director General. Such medal can only be awarded while displaying gallantry in battle NOT while working in an air-conditioned office!

    Undoubtedly, he mastered the art of timing as he ingratiate himself to get always the best and timely schoolings, juicy and relaxing positions so he could always use the “principle of visibility” with the top brass, a corrupted and abused self-serving maneuvers of the ambitious in the AFP; After his stint as battalion commander, Mister Esperon went back to desk assignments from 1994 to 2000; He served as 602 Brigade Commander in Sarangani province (where the area is generally peaceful) for a year and as 103 Brigade Commander in Basilan for six (6) months; He assumed as PSG Commander in January 2002.

    Total Number of years served in the field: four (4) years and eight (8) months ONLY.
    As junior officer – 1 yr and 7 months
    As Battalion Cmdr – 1 yr and 4 months
    As Bde Comdr – 1 yr and 9 months

    Army officers are required to serve at least five (5) consecutive years in combat after their commissionhip as junior officers and must hold positions of a platoon leader, company executive officer and company commander during their junior officer years.

    Esperon’s total stint in the field is way below standard of any Army officer!!

    Paano naman, they want to railroad the proceedings. Imagine in the beginning, the first months of the trial, the discussion revolved on the PTIR. Prosecution wants to proceed without giving the defense a copy of the PTIR. The defense said, the PTIR is the basis of the charges and you want to keep it a secret from us? It took five months before they were given a copy of the PTIR which showed that it recommended dismissal of charges against all the officers on the crime of mutiny. It recommended that some officers be tried for “conduct unbecoming of an officer and gentleman.”

    It also recommended dismissal of all charges against a number of officers.

    Then again, it took the prosecution another four months to give the defense a copy of the Pre-trial advice (PTA) that was supposed to have reversed the PTIR. Unsigned by Esperon naman!

    Dilatory? “Dilatory” is not a defense strategy, rather, it appears to be an AFP policy. Who was it, anyway who waited five months before serving charges on the Army Scout Rangers? Who waited four months to serve a copy of the pre-trial investigation report and another two months to show a pre-trial advice (PTA)? Who, to this date, has not signed the PTA? Who then caused the bungled serivce of charges? Who put in more junior officers to pass judgment on Gen. Miranda in contravention of Sec. 4 of the Manual on Courts Martial requiring senior officers to sit in the panel? Who continues to make prejudicial statements intended to taint the panel and anyone who sits there, thus necessitating the lawyers to challenge them to ensure a fair trial? Who continues to insist that the defense of the rights of the accused be thwarted at every turn?

    Even worse, who chose to wait for public outrage before he allowed Gen. Miranda to be hospitalized? Remember, sir, that human life, no matter whose it is, is not subject to your — or anyone’s– discretion.

    The Constitution guarantees rights of individuals against the massive power of the State. The defense of the freedom of expression and the right not to be detained without due process is never dilatory in nature. Because of the constitutional guarantee, we must take up their defense. If anyone is to blame, it is the person who violated those rights who has caused us to rise in their defense and necessitated proceedings to address them. That violator is the cause of your perceived delay, Gen. Esperon. And you know who that is.

    A reformist group within the Armed Forces of the Philippines and Philippine National Police yesterday warned AFP Chief of Staff Hermogenes Esperon Jr. that he could be charged on illegal detention for continually keeping in jail 40 enlisted men suspected of involvement in the botched February 2006 plot to overthrow the Arroyo government, as it urged the Senate to investigate the matter, which according to the group is basically denying the soldiers due process of law.

    During a phone interview, Young Enlisted Soldiers Active and Retired Military-Police for Solidarity (YesArms) spokesman retired Commodore Ismael Aparri, said if Esperon continues with his practice of denying justice to the soldiers, he could be charged with illegal detention as they have been behind bars for over a year now without being charged.

  82. Tirad Pass Brigade denounces secret and illegal detention of soldiers

    The Tirad Pass Brigade (TPB) strongly denounces the Philippine Army’s secret and illegal detention of 40 soldiers, all enlisted men of the Army’s Special Forces and Scout Rangers arrested for allegedly unauthorized movement on the eve of the 20th anniversary of the EDSA I People Power uprising.

    We denounce the AFP leadership for placing these soldiers under conditions very much like the dreaded US Guantanamo prison. Moved from one secret detention camp to another, majority of them were brought to the military stockade at Camp Capinpin in Tanay, Rizal on July 24 last year, while a few more were brought there on August 1, and the rest just recently.

    These soldiers are already being severely and inhumanly punished even as charges have yet to be filed against them. The Army’s Judge Advocate General’s Office remains at a loss on what actual charges to file against them.

    For past 20 months, these soldiers have remained in secret and illegal detention, deprived of the right of access by their families, friends and legal counsel. The TPB demands that these soldiers, who have long been detained without charges, be immediately freed. At the very least, they should be accorded their fundamental rights and allowed to confer with their families and lawyers.

    What kind of justice is there in our armed forces and under the present government that indefinitely and secretly detains soldiers and citizens even without charges? What kind of concern, if any, does our armed forces’ top generals, government officials have for its foot soldiers and people?

    It is such glaring injustice, cruelty and indifference to the plight of the rank-and-file soldiers and the common folk that are pushing those of us, who can no longer stomach what we see in the service, to rebel and seek to radically change the armed forces and government.

    Such dastardly acts of the armed forces and the government only steel our determination to fight for a system of government that truly values, promotes and safeguards patriotism, justice, democracy and the interest and welfare of the foot soldier and the common citizen.

    GEN. ESPERON RISK ILLEGAL DETENTION CHARGES

    Forty enlisted men suspected of involvement in the February 2006 plot to overthrow the Arroyo government, are continually kept in jail by Gen. Hermogenes Esperon Jr. for over a year now without being charged. With this action, Gen. Esperon is basically denying the soldiers due process of law.

    Justice delayed is justice denied considering that no cases have been filed
    against these soldiers for twenty months to date. An injustice is already being committed and although there is no physical torture, our men in uniform have already suffered mental torture while in detention. Depriving them of their rights to visit their families, the torture of not knowing when they would get justice, or when they would be investigated and released from jail, are all forms of mental torture.

    Gen. Esperon has no right to have the soldiers held incommunicado. They should be accorded a speedy trial.

    Former Judge Advocate General’s Office deputy chairman Col. Al Perreras’ pre-trial investigation report had already recommended the dismissal of the charges under Articles of War 67 (Mutiny or Sedition) filed against the soldiers.

    If the court finds them innocent, these solders should be freed immediately and at least duly compensated.

    YES-ARMS’ reiterates its warning that the victory of former Lt. SG Antonio Trillanes IV in the May 14 polls overwhelmingly shows the public’s support for reformists soldiers, and their “disgust” for Mrs. Arroyo’s leadership.

    Mrs. Arroyo should have thanked then Navy officer Trillanes for pursuing a talk with her before the July 27, 2003 mutiny happened. They wanted her to address badly needed reforms in our Armed Forces but she did not listen. In fact, she even wanted to have Trillanes arrested, the reason the Oakwood mutiny subsequently followed. Until now, she refuses to listen to the grievances of our men in uniform. Worse, she continues to abuse them to the extent of barring Senator Trillanes from fulfilling his duties as an elected senator.

    Mrs. Arroyo, as the AFP’s Commander in Chief, knows the abuses Gen. Esperon is committing, but she allows them for fear that the current military leadership would engage in destabilization and cut short her term.

    This government’s insecurities are dangerous to the extent of denying our soldiers their rights under the democratic system. She has the prerogative to authorize a speedy investigation and if found innocent, order the release the men from detention, but she would not do that out of fear that it could cause her ouster.

    YES-ARMS continues to stand by our soldiers. We are prepared to defend their rights, no matter what it takes.
