Captive but not inactive

Friday last week, Marine Commandant Benjamin Dolorfino was at the Sierra Madre building in Camp Capinpin in Tanay where the court martial trial of the 28 officers accused of attempting to withdraw support from Gloria Arroyo was being held.

Dolorfino stayed behind the courtroom waiting for his turn to be called to sit as member of the court in case any one of the sitting members would be ejected by peremptory challenge of one of the accused.

We got a chance to talk with him about the new restrictions imposed on Sen. Antonio Trillanes IV, who is detained at the Marine Brig with 29 other junior officers involved in the 2003 Oakwood mutiny. We asked why he barred Sen. Rodolfo Biazon, Civil Service Commission Chairman Karina David and others who were to attend the hearing convened by the detained senator.

Dolorfino said Trillanes has to get permission from the court. We asked why, when the court had issued no prohibition for him to conduct hearings. Judge Oscar Pimentel of the Makati Regional Trial Court disallowed only three things: for Trillanes to attend sessions at the Senate, for him to set up office at his detention quarters, and to be allowed media access.

He stuck to his answer that Trillanes should go to court. That was strange to me. Why would you ask permission from the court to do your job? I realized it was hopeless talking to someone who is willing to be a tool to the suppression of people’s rights to get ahead in his career.

Trillanes has decided to skip the Court of Appeals and went straight to the Supreme Court last Wednesday to appeal his case. He asked that a writ of preliminary mandatory injunction and/or temporary restraining order be issued to allow him to attend Senate sessions, set up office in his detention quarters and be allowed media access.

Named respondents are Judge Oscar Pimentel, Sr.of the Makati Regional Trial Court,AFP Chief Gen. Hermogenes Esperon, Vice Admiral Rogelio Calunsag, Dolorfino, and Lt. Col.Luciardo Obeña, commanding officer of the Marine Barracks Manila.

In the petition, Trillanes’ lawyer Reynaldo Robles mentioned unusual restrictions at the Marine Brig since Sept. 27 when Biazon, David and others were not allowed in.

But the restrictions do not apply to allies of Malacañang. Robles related that in the afternoon of the day Biazon and David were turned away, Dolorfino’s men allowed the Oliver Mendoza and Grace Castillo, members of the staff of Rep. Raul Gonzales, Jr.,chairman of the House committee on civil service.

As everybody knows, Congressman Raul Gonzales, jr. is the son of Gloria Arroyo loyalist Raul Gonzales Sr., justice secretary.

In his petition, Robles cited the need for his client to perform his duties as senator having been elected senator “by the grace of God and with the help of countless individuals, with a total of 11,189,671 votes despite of the fact that he had very limited resources and was not permitted to campaign outside his place of detention and was not permitted access to the media until about merely a month before the elections.”

Robles said, there are enough precedents to allow liberal treatment of detention prisoners who are held without bail as in the case of former President Joseph “Erap” Estrada and former ARMM Gov. Nur Misuari.

“To hold otherwise would clearly be tantamount to upholding the obvious and apparent different standards or double standards being applied by the authorities to herein Petitioner and to the accused in the other cases. Not only is this tantamount to double standards, the same also clearly violates the Equal Protection Clause of the 1987 Constitution.”

We pray that the enlightened minds prevail over Gloria Arroyo’s stooges in the Supreme Court.

    Kung papalpakin ng mga unenlightened Gloria’s stooges sa Supreme Court ang appeal ng kaso ni Trillanes ay mabuti pa na hintayin ko na lang na matisod sa bato at mabagok sa semento ang ulo ni Gloria hanggang sa mailibing. Saka ako pupunta sa opisina ni Senator Sonny sa Senado. Sigurado, nandun na s’ya nun!

    Lately, iyong nadaling computer ko, kapag hindi ko nilinis ng spyware, nagka-crush. Mino-monitor ko nga e.

    Better get Lavasoft’s Adware, and be sure you have AVG virus buster. Last time na pagpunta ko sa Fry’s libre na nga after rebates. Sayang nga nang binili ko ang virus buster ko noong winter 99 dollars pa ang ibinayad ko. Noong summer, naging libre pa after rebates.

    Mabuti pa si Sen. Trillanes nagtratrabaho kahit nakakulong. Si Honasan? Lapid? Revilla? Angara? Enrile? what have they done so far? Mga inutil..Anong klaseng senadors? Hindi ko na itatanong kung ano ang ginagawa ni Brenda..other than ngawa ng ngawa. It is pathetic that those who would like to serve the Philippines are in prison while those who only serve themselves are set loose..but God will set us all free. He rules the earth with justice..
    Darating din ang araw that the Death of Justice Secretary will be gone…76 years old? how long will he still be around?

    Pero balita namin, ibinenta na ni Pandak ang residence ng ambassador kundi ba naman ganid. Kailangan ng ambassador ng magandang residence para naman mukhang may dignity ang mga pilipino at hindi mukhang pataygutom na gaya ng gustong mangyari ni Donya Unana Pidal. Iyong bentahan daw without a bidding pa sa Maynila daw niluto. I am not sure of this dahil nagmamaang-maangan naman ang mga tinatanong namin sa embassy.

    Any information on this, Ellen? At least, dito sa Japan, may laban pa rin ang mga pilipino pagdating sa mga patrimonies ng Pilipinas sa Japan. Maraming abogado ang gustong humawak ng claims ng mga concerned Filipinos as a matter of fact. Gusto nila ang mga ganitong kaso as a matter of fact. Pag-aaralan nila ng husto, you bet.

    Meanwhile, itatayo muna namin ang “Trillanes Paglingkurin Movement.” Magandang battlecry ito for a better Philippines, no doubt about that.

    I was able to access AT4’s website from a different computer. Ang ganda. I like the simple layout and the colors, kaaya-aya sa mata. Malaki ang nagawa ng pictures.

    Dolorfino’s sudden cancellation of the hearings at the marine brig was nothing but a pure harassment. Inggit lang ang mga ayup na toh! Nagtatrabaho namang matino si Senator Sonny a!

    Ellen, is the office of Senator Trillanes in the Senate occupied by his staff? (Paki delete yung mga reklamo ko sa taas about virus, thanks)

  12. I notice this bill that Senator Trillanes has filed: S. Bill No. 1419—An Act Transferring the Philippine Coast Guard to the Department of Transportation and Communications as a Separate and Distinct Armed Uniform Commissioned Service, Further Amending Republic Act no. 7153, As Amended, and For Other Purposes.

    I would like to suggest that he tries to file a bill likewise to make the police an independent agency and not under the AFP nor Malacanang so that policemen there can conduct independent investigations of anomalies, scams, etc. committed by the poliiticians and bureaucrats.

    He should also include to have the police in the provinces be free of any meddling by the military there, and that all should have a uniform system, set-up, etc. as the former Manila’s Finest, but should not be under the control of any politician and made as their personal army as what happens in the provinces. I suggest that the Senator studies the police system in UK (Scotland Yard) and the Japanese police (the National Police Agency and the Tokyo Metropolitan Police Department).

    We pledge support for all the bills that the Senator has filed so far. At least, alam niya ang ginagawa niya. Hindi katulad noong mga bobo dela yuca na karamihan sa mga bills na pina-file nila ay mga pakulo ng mga patron nila!

    I read the enumerated 10 bills filed by Senator Trillanes and I say I’m very happy that he’s being true to his words.

    If the bills on the soldiery get priority, there’s a good chance the military will heal itself when Kwin Korap and Mister Ass are gone. Bakit nga ba hindi na lang biglang mamatay ang dalawang ‘yan?!

  18. Nope, Anna, the way I see it is that it under the control of the Commander in Cheat via the AFP which has control of the PNP. Remember how the idiot went around precincts in Manila and tried to sack those police chiefs still displaying the picture of Erap? I read about that in Manila newspapers, and I thought, having worked at the Tokyo Metropolitan Police Department as a contractual civilian interpreter/translator, that was foul! How could they investigate the criminal in the palace by the murky river with her being the Over-All Chief of the Police? I definitely thought it was stupid!!!

  19. Over here, the Chief of Police does not come from the Ministry of Defense, but from the ranks of policemen who get to the Police Agency/Department via civil service exam. The police, likewise, has its own academy where policemen learn the basics of police works.

    We also have a DEA that is under the Ministry of Health assigned to make sure that the law on controlling drugs are properly supervised. The different agencies may cooperate on cases but never allow one agency to meddle in the affairs of the other.

    Pero sa Pilipinas, palibhasa, masama ang layunin kaya hindi inaayos ang mga dapat gawin ng bawat agency ng gobyerno lalo na nang pumasok iyong kriminal na akala mo naman tunay na parang “Jack of all trades but master of none!” Yuck!

  20. Kaya malaki ang pag-asang maayos ang bansa kung paglilingkurin si Senator Trillanes. He knows the problems, he should know the solutions!!!

  21. Taragis iyong mga pulis sa probinsiya. Para lang huwag maalis sa trabaho, kung magpauto sa mga may kaya doon, parang mga private army. Kung ginagalang ang civil service sana, pihado magkakaroon ng mga lakas ng loob ang mga iyan na lumaban sa magtatakang magpaalis sa kanila.

    Sana maging successful iyong mga lawyers na nagpulong para itayo iyong association nila to help the poorest of the inaapi in the Philippines, para iyong mga mahirap na matino puede nang lumaban, at iyong mga may civil service eligibility, hindi na puedeng gawing tau-tauhan, at nang mabigyan naman nila ng dignidad ang mga profession nila. Golly, ngayon kasi basta may kapit, kahit walang alam, nakapuwesto! O di palpak!
