Capt. Nick Faeldon disallowed medical treatment

Statement from Atty. Trixie Angeles, counsel for Capt. Nick Faeldon

faeldon.jpgOn 19 September 2007, Capt. Nicanor Faeldon, who is currently detained at the Marine Brig in Fort Bonifacio, was examined by doctors from the Manila Naval Hospital, within the Marine compound two blocks away from the detention facility.

He was initially diagnosed with Adhesive capsulitis and recommended to undergo physio-therapy. The therapy, which was required to be undertaken continuously for six days, was scheduled for 24 to 28 September.

On the 24th, however, as he was about to leave the detention facility, he was informed by an emissary from the Battalion Headquarters Commander that he was not to be allowed to leave the detention facility without approval from the Commandant. Gen. Dolorfino was newly installed at the time.
Capt. Faeldon sought clarification on the alleged order with Battalion Headquarters Commander Col. Luciardo Obeña, but the latter would not see nor speak to him. Through his lawyer, he wrote several times asking to be allowed to go to the hospital for treatment, as his condition appears to be debilitating. Col. Obena did not forward the request to Marine Commandant until 10 October 2007, and only after the service of a final demand letter on him by Cpt. Faeldon’s lawyer.

After over a month of waiting and in constant increasing pain, Capt. Faeldon was informed verbally on Friday, 19 October 2007 that he would be allowed to go to the hospital today, However, just as he was prepared to leave, the new Battalion headquarters Comander informed him that he would not be allowed to go to the hospital, as the Commandant had not yet given him permission to do so.

It is the height of cruelty to have allowed Capt. Faeldon to seek diagnosis, and then be prevented from being treated. It is also the height of arrogance to presume that medical treatment is subject to the discretion of any man, Commander or Commandant or even Chief of Staff. While we will concede that such treatment would be subject to administrative concerns by the custodians, a denial of treatment, in the face of possible permanent damage violates the requisites of humane treatment for any and all detainees.

Capt. Faeldon is bringing the matter to court on Wed 24 October 2007, at the Regional Trial Court of Makati Branch 148.

This can also results in upper extremities radiculaphaties,pain from the shoulders generates to both arms,hands and fingers.I am suffering the same and more worse because I also have 5 cervical spine raptured disc. I have undergone epidural corticosteroid injection 3 times a year and on continuous pain medication such as Darvocet, Vicodine and Naprozyn. Daily physical home therapy with TEENS and traction. I refused the doctors recommendation of surgery. It is really a debilitating pain. It’s been 5 years now and I am on a disability retirement. This is no joke and I shared the same agonizing pain with Capt. Faeldon, The difference between both of us, I am being taken good care by my orthopedic doctors and chiropractors at Beverly Hills,In Faeldon case he’s not because of stupid bureaucracy in the military under punggok and Esperon. Without proper medical attention and care he could be paralyzed.

    maybe someone should prosecute the admin generals civilly for qasi delict. for the manner they deprived detainees proper medical treatment. that way, their liability is made personal and they cannot hide under the cloak of AFP officialdom. maybe the will be less inclined to be so arrogant if the stakes are personal and will hit them through their bank accounts.

    Ang sa Pilipinas ay Inhuman Rights Commission. I notice that the Commission is more interested in looking into human rights abuse against Communists and leftists; but not on other groups of people including the aggrieved soldiers. Kung minsan kasi ang hinala ko front lang nga Communists or rebelde ang mga ganyang Commission. Even the Amnesty International…I have some doubts. They’re rather selective.

    That’s what can happen. If GMA decides not to pardon Sabit, then talagang ubod ng lakas si Maton ng Ilocos Sur. But, the religious group that’s working on Erap’s pardon is a lot more powerful and influential. Sa tingin ko, mapa-pardon si Erap baka bago ang All Saints Day or the latest before Christmas.

    pedrocarpio: if you are referring to Gov. Salvacion Zaldivar Perez..she is the governor of Antique. I read in a news item that she admitted receiving money three times from Malacanang. But it did not surprise me that she would be a recipient..Sally’s father ex SC Justice Calixto Zaldivar was Diosdado Macapagal’s Executive Secretary. I am not political when it comes to politics in Antique Sally and I were contemporaries and we both worked at Insular Life..I have nothing against her..and I don’t have personal knowledge that she is corrupt..In the same token, though I have not heard, I would not be surprised if Boy Ex congressman of Antique received money as well..He and Mike Arroyo were classmates

I say sayang because he would have been a good presidential timber. I said sayang because he died at age 44 and call it what it may..he was a victim of politics..and you would know this since you are from Hamtic.     Possibility of banding together? Who knows? Anything can happen in goria’s mad, mad, mad enchanted kingdom.

    In a news item today, Sally Perez, gov. of Antique and vice president of League of Governors, said that the money bags given to the gov. of Bulacan and Pampanga were from their association. Nagtataka lang ako how do they raise funds for their association to have so much? Do they have membership fees…di galing din sa taxes ng provincia.     The US will always try to avert civil war due to GMA’s unpopularity, to protect their own interests in this country. Ang pilipinas ay nakadesinyo lang upang maging supplier ng raw materials at slave labor.

    Kaya kailangan na kung papalitan man ang leadership, dapat tayo mismo ang gagawa noon, at piliin ang taong karapatdapat.

    pedro c: the principal you are referring must be Blesilda J. Evelio’s aunt. Tia Loda is from Culasi. Andresito..was he the one who was “salvaged” during Marcos time? They were much younger than I am, but I knew them when “sip-unon pa sanda.”
    ..going back to the “bag money” given by the “bag lady” hindi daw si Poblador..if they were from the League..kahit ano pang sabihin “suhol” din or maybe it is “seed money” for corruption..a project of GMA. I remember going home to Antique after an election..and along the way ang dami billboards with GMA’S picture and her projects..ngayon ang kanyang billboards should say in bold letters..ang mga ginawa ni Gloria..nagnakaw, nangdaya, nagsinungaling, maraming ipinapatay, maraming nawawala, at may bomba pa (I don’t mean an xrated picture niya..)
