Biruin mo hanggang ngayon, magdadalawang taon na, naghahagilap pa lang ang mga bata ni AFP Chief of Staff Hermogenes Esperon ng ebidensya laban sa 28 na opisyal at 40 na enlisted personnel o sundalo na kanyang ipinakulong dahil sa plano raw na magwithdraw ng support kay Gloria Arroyo noong February 2006.
Kaya ngayon, pinipiga nila ang siyam na sundalo sa Intelligence Security Group para makakuha sila ng impormasyon na maa-aring gamitin laban mismo sa kanila at sa ibang mga opisyal na nakakulong.
Ang siyam ay ibinaba noong Miyerkoles mula Camp Capinpin sa Tanay. Sila ay kasama sa 40 na sundalo na halos magdadalawang taon nakakulong kahit walang kasong isinampa.
Ngunit tuliro ngayon ang military kung paano pagtakpan ang malaki nilang kasalanan sa pagkulong ng 40 na sundalo. Ang kanilang pagka-tuliro ay dahilan sa “writ of amparo” , ang batas na pinapaiiral ngayon ng Korte Suprema para mabigyan lunas ang laganap na paglabag sa karapatang pantao nitong administrasyon ni Gloria Arroyo.
Ang implementeng rules o palatuntunin ng writ of amparo ay naging epektibo noong Oct. 24, at mula noon sunod-sunod na ang nagsampa ng petition sa ilalim ng writ of amparo para mabigyan ng katarungan. Sa writ of amparo, hindi basta-basta sabihin lang ng military na confidential o wala sa kanilang jurisdiction. Kailangan ipaliwanag nila ang kanilang aksyon ayon sa batas.
Ang problema ngayon ng military ay klarong-klaro ang paglabag ng karapatang pantao ng 40 na sundalo na kabilang sa Army Rangers na kanilang ikinulong para magamit laban sa 28 na opisyal na kanilang inuusig.
Nagtiis ang mga sundalo ng sobra isang taon na nakakulong sa Camp Capinpin kahit wala silang kaso. Nabulgar lamang ang kanilang ilegal na pagkakulong dahil bumisita si Sen. Rodolfo Biazon noong isang buwan sa Camp Capinpin para tingnan ang kalagayan ng mga nakakulong doon na mga opisyal sa pangunguna ni Maj. Gen. Renato Miranda, Brig. Gen. Danilo Lim, Col. Ariel Querubin at 25 pang opisyal.
Tamang-tama naman, naging epektibo na ang writ of amparo at maa-aring kasuhan ang mga opisyal na lumalabag sa batas. Biglang nag-aksyon si Esperon. Kaso lang, ang kanyang aksyon ay para matakpan ang kanilang naunang kasalanan ng panibagong kasalanan.
Noong Oktubre 25, biglang na lang binigyan ang 26 na sundalo ng discharge order. Ang masakit pa, “without honor” pa ang linagay sa discharge order. Ibig sabihin noon wala silang matanggap na retirement benefits sa military. Binigyan lang sila ng P1,000 pamasahe at P4,000 na “tulong” raw.
Ang sama-sama ng loob ng 26 na sundalo. Sabi nila, “wala kaming kasalanan . Kinulong kami ng sobra isang taon na walang kaso, tapos i-discharge kami “without honor”?”
Noong Miyerkules naman, may pumunta naman na mga tauhan ni Esperon doon sa Tanay at ililipat daw ang siyam sa natirang 14 na sundalo sa Fort Bonifacio. Ang siyam ay sina Ssg Reynaldo Bala, Ssg Marciano Saraspi, Ssg Alexander Verzon, Ssg Ronnie Dizon, Ssg Rodelio Tuazon, Ssg Nelson Alquiza, Ssg Rodelio Tuazon, Sgt Arthur Arienda, Sgt Pastor de Guzman, Sgt Richard Javier.
Pinapapirma sila ng affidavit na maayos raw ang trato sa kanila at hindi sila pinilit o nilabag ang kanilang mga karapatan. Hindi pumirma ang mga sundalo dahil ano ba ang ginawang pagkakulong sa kanila ng sobrang taon? Siyempre sapilitan yun. Hindi naman sila nagboluntaryo magpakulong.
Dahil hindi maganda ang dating sa publiko at sa ibang sundalo ang ginawa nilang “dishonorable discharge” sa 26, hindi raw sila idi-discharge. Idi-demote na lang raw.
Sabi ng ng isang abogado ng mga sundalo, “Bakit idi-demote? Ano ba ang mga kasalanan nila?” Wala namang maipakita na kaso ang Trial Judge Adocate. Bakit sila ide-demote at sila na nga ang naperwisyo? Ang pumalpak ay ang military. Dapat i-promote sila bilang kabayaran sa perwisyo sa kanila.
Kung hindi marunong magbigay ng hustisya ang military sa kanilang mga sundalo, may proteksyun na binibigay ang Constitution. Dito papasok ang Supreme Court. Sabit dito sina Esperon kasama na ang mga opisyal niyang sumali sa paglabag ng karapatang nitong mga sundalo.
As it is the habit of this evil woman to buy off anyone she wants to, the only men she is truely afaid of is this Lim and his fellow officers, Trillanes and the enlisted personnel who cannot be bought at any price. Because of this fear of their honesty is why she and Arseperon have them illegally detained.
Every effort should be made to free these men to enable them to speak the truth and obtain justice for the benefit of everyone.
It is my belief that eventually history will reveal that it will be this weak, unworthy Chief of Staff to be the one guilty of being “without honor”. He is such a disgrace.
Patong patong na pagdurusa ang dinaranas ng mga kawawang sundalo. Patong patong na paghihirap ang dinaranas ng kanilang pamilya. Patong patong na kawalanghiyaan ang ipinaiiral ng pamunuan ng AFP at ni goria walang dangal.
Kung hindi sila mapurasahan dito sa ibabaw ng lupa sa kanilang patong patong na pagkakasala, patong patong silang babagsak sa impierno at walang katapusang paghihirap ang kanilang daranasin habang nakalutang sa dagat dagatang apoy.
Sobra sobra talaga ang kasalanan ni tiyanak at ni asspweron sa mga nakakulong na sundalo. I feel so sorry for Yano for being the hatchetman of asspweron. Ang original pala na dapat ginawa nila asspweron ay ang i-reprimand lang sila. Ikinulong sila instead. Tapos ngayon ididischarge pa sila “without honor”. Sobra ang pagmamalupit ni asspweron sa mga sundalong ito!
I hope that when everything is said and done that real justice be done on who erred in putting these soldiers in jail. Asspweron will surely have his days (plural as he will have a lot of these appearances)in court. Katulad ng kanyang demonyang midget na illegal na presidente, siya rin ay huhusgahan sa kanyang mga kalabisan!

Ang kinakatakutan ko ay kung i akyat ng mga sundalo ang kanilang kaso sa Supreme Court at ang mga naka upo ay galamay ni Gloria at bale wala-in ang kanilang hinaing at sabihin na tama si Assperon ay dobleng pagdudurusa ang sasapitin ng mga sundalo natin. Kahit isang bobo ay alam na mali ang pagpapakulong sa isang tao / sundalo lalo na walang silang mapakitang pagkakasalang ginawa. Almost 2 years sila kinulong at masakit pa ay without honor pa ang tatak ng release paper nila. Ika nga “ONLY IN THE PHILIPPINES” lang itong nangyayari na ang LAW ay baluktot. Ang Mali ay tama at ang Tama ay mali.

I share the same fear you have that if the Supreme Court will hear these soldiers’ cases, the tiyanak will prevail. I just read that the two justices who convicted Erap are now on the short list of nominees for the Supreme Court. Imagine what will become of us. Kanya na ang mga tongressmen, ang mga senatong naman tameme lang sa mga nangyayari. Si Lacson lang ang nagiingay kaya lang hanggang ingay lang naman. Tapos ang judiciary pa ay halos lahat appointees niya. Ano na lang talaga ang mangyayari sa atin? Sa ngayon 8 ang kontra sa kanya sa Supreme Court at ang 7 ay pro tiyanak. Sa mababakantehang dalawang pwesto sa isang taon, mapapalitan ito ng dalawang tauhan niya. Imagine what will happen to our highest justice system. Alam ng lahat na wala ng hustisya sa mga mababang korte dahil halos lahat eh gustong makarating sa korte suprema. Tapos sa Supreme Court din pala wala na ring hustisya. Saan pa tayo aasa? Ganito na lang ba talaga ang buhay ng Filipino? Weder weder na lang palagi? Hindi na natin alam kung sino talaga ang makakatulong sa atin? How sad talaga…
Kailangan mahinto ang pagpipiga sa siyam na nasa ilalim ngayon ng ISG.
Mga mahal namin na sundalo, magpakatatag kayo. Utang na loob ng bayan sa inyong mga natitirang marangal sa military ang kalayaan natin na ngayon ay pinipilit alisin ni Gloria Arroyo at ng kanyang mga galamay na katulad ni Esperon.
At bakit nga sila-ide demote. Sila pa ang ang naperwisyo, sila pa ang parusahan? Dapat ang parusahan ay ang lumabag ng kanilang karapatan pantao.
Tama, dapat bayaran sila sa sa perwisyong ginawa sa kanila.
Hindi baluktot ang LAW sa Pinas. Ang baluktot ay ang mga tagapagpatupad ng LAW.
Yaong mga nadischarge “without honor” ay dapat magfile ng kaso ng unlawful dismissal, kaya lang hindi ko alam kung saang korte nila ito dapat i-file. Marami naman sanang mga magagaling na abogado sa atin, bakit wala yatang nagbu-volunteer na hawakan ang kasong ito? Duwag ba silang lahat?
Ato, there are volunteer lawyers from Ateneo, led by Atty. Vicente Verdadero, who are helping the discharged soldiers.
The cases against the erring military officers are being prepared. They won’t get away with what they did just like that.
For that matter, most of the lawyers handling the cases of the 28 officers are on pro-bono basis.
That’s why I’m inspired covering the court martial hearing of the 28 officers in Camp Capinpin because you see there that principles and idealism are still very much alive. Not only among the officers but also among the defense lawyers and relatives of the detained officers.
With men and women like them, there is great hope for this country.
You are an inspiration Ellen! I salute your dedication to covering the plight of these principled men in uniform. You keep their idealism alive! Without the pro bono services of the topnotch lawyers, the incarcerated officers would have no chance to get the best representation. They simply can not afford it! To those who stand by these men of honor, THANKS A MILLION. One day, may these men find their way in responsible positions and may they shape up the country the best they can so the future generation will not go through the oppression and injustices that they have gone through.

Grabe na mga ito, ito ba ang pagtrato nila sa kasundaluan sa pilipinas? First, dishonorable disharge and now demotion ang solution nila sa mga walang charges na sundalo? This is so ridiculous. These enlisted personnel should be promoted to how many testing cycles for their rank they missed because of being detained illegally. They should be reimbursed and then some. While Asspweron and company should be punished and detained for every day every soldier have spent in jail with zero charges. Asswperon and gang should be put into hard labor camps. Deservedly so…
