Trillanes, 35 others face rebellion charges

The Department of Justice (DoJ) has approved the filing of a rebellion case against Senator Antonio Trillanes and 35 other civilian and military officers over the siege at the Manila Peninsula Hotel in Makati City last week.

In a 10-page resolution, the four-man panel of prosecutors, led by
Senior State Prosecutor Emmanuel Velasco, said that aside from Trillanes, the violation of Article 134 of the Revised Penal Code for Rebellion has been filed against former vice-president Teofisto Guingona Jr., Brigadier General Danilo Lim, Bishop Julio Labayen, Reverend Father Robert Reyes, Captain Gary Alejano, Captain Segundino Orfiano Jr., Lieutenant Senior Grades Manuel Cabochan and James Layug, Lieutenant Junior Grade Arturo Pascua Jr., 1st Lieutenant Eugene Peralta;

Lieutenant Andy Torrato, 1st Lieutenant Billy Pasua, 1st Lieutenant
Jonel Sangalan, ENS Armand Pontejos, lawyers J.V. Bautista and Yassir Gonzales, CPL Clecarde Dahan, Private First Class Juanito Jilbury, PFC Emmanuel Tirador;

PFC German Linde, Antonio Trillanes III, Myrna Buendia,
Dominador Rull Jr., Romeo Solis, Roel Gadon, Rommel Loreto, Julian
Advincula, Francisco Bosi;

Leodor Dela Cruz, Sonny Madarang, Elizabeth Siguion-Reyna, Francisco Penaflor, and several John and Jane Does.

On the other hand, lawyer El Cid Fajardo, Herman Laurel, Leonido Toledo Jr., Evangeline Mendoza, Jose Albert, Eduardo Castro, Ferdinand Sandoval, Julio Ancheta, Stella Guingona, Maamor Lanto, Romeo Dacles, Ryan Custodio, Edgardo Viana, a certain Tulalay and Ray Linaac were released for further preliminary investigation.

Another preliminary investigation will also be conducted against
Captain Nicanor Faeldon who escaped during the siege.

The complaint will be filed before the Makati City regional trial court.

Other members of the government panel are State Prosecutors Philip dela Cruz and Aristotle Reyes and Prosecuting Attorney II Alvin Navarro.

  7. I heard the wife of Col. Querubin for the first time on radio as I am tuned in via Internet to the radios in Manila. She was talking of the inhumane treatments they have been receiving from the crooks in the AFP.

    What a nerve indeed! They should not be talking and claiming about implementing the rule of law if these idiots would not even know what it is all about!

    Something is definitely wrong, but where can Filipinos go to lodge their complaints? Their own representatives cannot even help them with majority beholden to the criminal who has been given full control and privilege even to deprive provinces with officials deemed not friendly to the criminal of their right to ask for fundings for provincial needs.

    Sino bang mga gunggong ang gumawa ng batas ng Pilipinas giving a criminal full control even of the Philippine treasury. Ang bobo naman!

    It wouldn’t be a case of double jeopardy because the cases, which may be violations of the same law, are separate events. Kung rebellion, siguro magiging two counts of rebellion ‘yan.

    What I don’t get is Aling Miriam’s resolution calling for Senator Trillanes’ suspension or expulsion.

    Senator Trillanes’, even before the Manila Pen standoff, had been effectively (if not technically) suspended.

    If she insists on having him expelled for his acts and pronouncements last Thursday, shouldn’t she be expelled first on account of her acts and pronouncements on May 1, 2001?

    In fairness, if there is such a thing, “what is good for the goose is also good for the gander”, I suppose. Rebellion charges should be also applied to group of corrupt shameless: Madam Whore Gloria Arroyo, Hubby Arroyo, Fidel Ramos, Cory Aquino, treasonous Angelo Reyes, and others. It was well documented with very strong evidences in tapes and witnesses, these group of shameles corrupt people, in 2001, plotted, planned, rebelled, and overthrow a legitimate govt. What whore Gloria did and cronies of her were far worse thann Trillanes, Lim and the others. If any should be charged with rebellion it’s whore Gloria and the rest of the corrupt shameless that help her to the whore house (formerly Malacanang Palace), were brown bags given out in order to seduce the 190 congressmen, governors and mayors to perform an oral act in congress, in which they did. Surely, the 2001 rebellion by Madam Whore Gloria and company has been shoved under the rug, only because the institution is owned by the whore Gloria. Hence, the only way to demand whore Gloria’s accountability to such rebellion is to the people, no less than “one million warm bodies” march to the whore house and demand that whore Gloria, as a start, to answer for the crimes against the people and the rule of law. In addition, lets the people be vigilant and have a public trial in Luneta (forget the congress -nothing but an empty building), bring back Hello Garci, Assperon and others to stand for people’s trial to answer on the charges of election cheating in 2004. As they say, if you want something done right, you got to do it yourself, and the people must do it. Can’t rely on the judicial, they’re nothing but pawns of Madam Whore Gloria Arroyo.

    Madam Whore Gloria Arroyo is the biggest problem which is why we’re having of these rebellion. She should be accountable, but she’s getting away which is why all the frustration. Also, Whore Gloria got all the resources at her disposal to feed the hungry wolves that has been surrounding her so she can stay illegally in the whore house. As records will show, we can forget Congress and the other corrupt branch of govt (Judicial) they’re far worse than whore Gloria’s administration, because they’re supposedly educated and can distinguish the right from wrong. Yet, they choice to be on the side of evil, in exchange to Madam Whore Gloria’s brown bags. So, what’s should be done to make Whore Gloria accountable? We all know the answer, no less than “One Million Warm Bodies”, to clog the arteries leading to the Whore House (formerly Malacanang Palace).

    Nick Joaquin’s account of the interview he had with Mike Arroyo after EDSA Dos would be a good evidence.

    Hindi raw pwedeng sampahan ng kaso si Aling Gloria because of “presidential” immunity. I wonder if lawyers can explore the possibility of suing “private citizen” Mike Arroyo, Angelo Reyes and Fidel Ramos for rebellion, just like they’re charging civilians involved in the Manila Pen standoff.

    I may be too naive to believe that Aling Cory did nothing beyond her rights, as a citizen, to express her sentiments then. I don’t think she had knowledge of the plot so cunningly crafted and so arrogantly disclosed by Mike Arroyo and his coohorts, including Aling Gloria.

    I am sorry to dash your hopes out guys… but GMA is one step ahead of you… by making even the Supreme Court ( that infamous Davide court )a party to her deeds, what chance would the charges prosper?

    Remember, how they handled the Erap case? Now way in hell will the court find him innocent, because no matter how flimsy the evidence against Erap were, finding him innocent, will make them accountable for treason for removing him in 2001. So they have to give a guilty verdict… but to avoid the revolt of the masses, presidential pardon was given. That was a master stroke! It solved several problems for GMA… Also, GMA didn’t pardon Erap out of compassion, she did it to set a precedent … for her in the future… in case it is her turn to be charged with plunder… in the end, pansarili pa rin ang motibo nang lahat…

    You have seen how GMA manipulated the system to avoid impeachments… were those moves legal? But why was she able to get away with it? Does the rule of law has anything to do with this?

    I have no illusions about the current situation;

    1. GMA will not step down peacefully. One has to drag her down.
    2. GMA needs to be in power beyond 2010… otherwise, it will be a day of reckoning for her and her family… for all those actions committed…
    3. People Power is a myth! People Power 1 and People Power 2 will not succeed had the military didn’t act. It is the military that topples gov’t not people power. Maybe that is why it seemed that Trillanes and Lim are basically calling their comrade in arms rather than the people per se…
    4. Nobody was killed outright in Manila Pen because the world was watching… not because the authorities care about the lives of the people in there… Kung walang cameras doon, sigurado ubos lahat ang nasa loob…

    Kaya lang, last touch si Sec Raul of the DOJ. He can overturn any finding of probable cause, just like what he did with the charges against Gringo.

    Are they safe? Well, hanggang 2010 yes. After June 30, 2010, it’s anybody’s guess.

    1) Not even his mother joined them
    2) Oakwood had a better lobby
    3) CNN was not there to cover it
    4) The hotel had run out of ice cubes
    5) The APC’s were parked in the lobby and not the parking lot
    6) Trillanes realized being teargassed was not part of his mandate as senator.
    7) Guingona thought it was an anti-erap, or pro-erap pardon rally, whatever…
    8) Surrender was better than the company of Father Robert Reyes.
    9) Trillanes noticed people were crying not because of the tear gas but because of him
    10) Even GMA was beginning to look better the longer they stayed

Hindi magiging double jeopardy.Two counts of rebellion in two separate incidents.Ngayon pag guilty sila sa dalawang charges at mahatulan sila ng firing squad,ang mangyayari ay babarilin sila tapos babangunin uli at isasalang na naman sa firing squad.It doesn’t matter now,kung sampung rebellion case pa ang isasamapa sa kanila,huwag lang silang sumalang sa firing squad.Malaki ang chances nila na mamuhay muli ng normal dahil pagdating nila ng 70 years old ay pardonado na sila kahit sampung beses pa ng bitay ang hatol sa kanila.Ang problema nina Trillanes and company ay ang civil cases na isasampa sa kanila ng PEN.Umabot na raw ng 25 million ang nagastos sa repair.Mamumulubi sila.Someone has to pay.The PEN management doesn’t care where the money come from as long as the can get reimbursement for all the damages.I think the court will make Trillanes and his group pay for the table napkins,renovation,broken glasses including the emotional trauma of the bartenter.But, if they have a law in the Philippines of chapter 7,8,9,10 and paragraph 12(b)-Joc-Joc Bolante.They can file bankcruptcy.Katulad ng ginagawa ng mga pinoy turista dito na mahilig magkaskas ng plastik sa Boracay at mamili ng mga mamahaling gamit,pag-uwi nila ng America,the first thing they do,They call Atty;Agaton to file necessary papers in court.Kaya yumaman si Attorni sa mga bankcruptcy cases.
