Concerned voices from Tanay

The following statement was issued by lawyers of officers detained in Camp Capinpin,Tanay,Rizal implicated in the alleged February 2006 plan to withdraw support from Gloria Arroyo. The 28 detained officers include Maj.Gen.Renato Miranda, Brig. Gen. Danilo Lim (detained in Camp Crame with Sen. Antonio Trillanes Iv and other Magdalo officers), Col. Ariel Querubin, Col. Custodio Parcon :

Another suspicious order concerning the Tanay detainees led by Maj. Gen. Renato Miranda, has been issued and is danger of being implemented to the detriment of the said detainees.
Such is yet another oppressive act committed against the same men who have submitted themselves to the legal processes of a military establishment that seems intent on depriving them of their rights.

At the last hearing, both the defense counsels and the prosecution were directed by the court martial panel to make proposals (defense counsels) and counter-proposals (prosecution) on ways to efficiently conduct the proceedings. The meeting between prosecution and defense was conducted yesterday in Camp Aguinaldo. The proposals were as follows:

1. The venue of the court martial hearings will be in Camp Capinpin, Tanay, Rizal

2. All the accused shall be allowed to participate and be present at every stage of the proceedings with thteir counsels. “Proceedings” include arraignment and challenges stages. There will be no arraignment, challenge or trial by batches, groups or on an individual basis.

3. The accused shall not be handcuffed during trial or while being transported to or on the way to the venue of the trial/hearing.

4. The replacement of Gen. Ubungen should be immediately named.

5. The 7 remaining accused should be allowed to exercise their right to peremptory challenge.

6. The media should be allowed to take video footage of the proceedings.

The counter proposals of the prosecution were as follows:
1. The accused shall all be brought down from Tanay, placed in a holding facility in Camp Aguinaldo but still arraigned by groups.
2. Agree to proposals numbers 3 and 4.

3. Modify proposal 6, by allowing the AFP PIO to take video footage of the proceedings that may be made available to the media persons.

The defense lawyers further proposed that under no circumstances should the detainees be held in the ISAFP or ISG compounds in Camp Aguinaldo or Fort Bonifacio respectively. And in the event of the transfer, prosecution agrees to put up the Army detainees in the Custodial Management Unit of Fort Bonifacio and the Marines in the Marine Brig also in Fort Bonifacio. Finally, the defense lawyers also asked that in such a transfer, notice be given at least one week before such transfer and that the AFP should make an announcement to that effect, to prevent suspicions of harassment of the detainees.

During the same meeting the defense lawyers were informed by the prosecution that the detainees were to be brought down in accordance with his counter-proposal.

Today, the defense lawyers were informed that the court martial panel will take up the proposals and counter proposals in a meeting to be held tonight. However, reports reaching the defense counsels indicate that the detainees have already been advised to pack up belongings for transport to Manila tomorrow. They have been informed that they will be held in Camp Aguinaldo.

Such an act speaks of bad faith. Since the talks are ongoing, none of the activities should be executed because they are still subject to the directives of the court martial and to whatever further talks the defense and the prosecution will be holding. It is clear that there is no intention to take the defense lawyers’ proposals into consideration.

The fiction that the JAGO attempts to perpetrate is that the change of venue is being done at the behest of the defense. This is a blatant lie. It must be recalled that most of the defense lawyers did not move for a change of venue. The few defense lawyers who did make such a motion, were informed that the venue was set by the convening authority and thus their motions were DENIED.

The detainees resist transfer because they are aware of the moves to link them to alleged destabilization efforts of “shadowy groups.” Bringing them down to Manila makes the said link appear more tenable to the accusers.

The order to bring down the detainees now is clearly suspicious, coming at a time when the custodial arrangements and trial proceedings are still being discussed. The move is obviously intended to subvert the processes of the court martial and deprive the accused of their rights. This is beyond bad faith. This is illegal.

    The situation is very volatile, really. Obviously there is yet again another plot asspweron is cooking to implicate these men of honor. They can use all the dirty politikos but not these men of honor! They are being used as pawns! I wonder what this asspweron is apt to. Martial law perhaps? And he will again use the convenient”alignment of the left to the right with the backing of some politicians and businessmen”!
    It looks like item 5 is not even addressed. How could they have sworn themselves(the panel) in and had been so gungho in arraigning all these officers when not all of them had excercised their right to a preremptory challenge?
    From the very beginning, the legal counsels wanted the hearings either in Camp Aguinaldo or in Fort Bonifacio for convenience but they denied all those requests. Why move the hearings now to Camp Aguinaldo? Something is terribly fishy, really.
    In the spirit of fairness, while the negotiations are being settled on how to conduct the hearings, the least asspweron and his minions can do is agree on a common ground and hold their horses. But obviously, the AFP is once again acting like they have all the POWER and MIGHT and they can do anything as they please.
    UNLESS of course there is a “coup in progress” and these men of honor will once again be used as the “fall” guys. How convenient it is. They can be fooled once but not twice! THESE MEN OF HONOR CAN SMELL THE ENEMY CLOSING IN ON THEM! These are battle tested, remember? Asspweron may have the power now but wait until he becomes another JDV! Wake up asspweron before you find yourself down the gutter like JDV and the Tabako(who is your Ninong). But then again, in politics, being a godparent does not count. Look at the two kid DOROBOs, they ousted their Ninong. Of course with the blessings of the two parent DOROBOS! Kapag wala ka ng silbi asspweron sa mga DOROBOS, OUT ka na rin. So, you have a little over three months to DO THE RIGHT THING! Tignan mo nga si JDV, he is now trying to do the right thing by telling on the DOROBOS but it is a LITTLE TOO LATE! For you asspweron, you have three more months! Huwag mo ng antayin na sipain ka kapag wala ng pakinabang sa iyo. THINK ABOUT THE FAMILIES OF THESE OFFICERS WHO HAD SACRIFICED ALREADY FOR TWO YEARS FOR YOUR AMBITION TO BE THE “CHEAT OF STAFF”. NOW GIVE THEM A BREAK! Sige ka kapag kumanta na si JDV at si Gina, lagot ka. So, avoid the inevitable. LET GO OF THESE MEN NOW!!!!!

By now, Filipinos should start getting worried especially with a Congress now under the complete control of the dorobo who must be smirking her lips as usual, and feeling really powerful especially with the table completely turned upside down on her patrons, JdV and FVR.

    PSB, forget about JdV and his wife getting an edge over the ingrate. They are in fact doomed regardless of whether or not they spill the beans. Wala na silang perang. Naisahan sila ni Gloria Dorobo. Kaya wala nang kumampi sa kaniya.

    For once, puede ba umamin na lang sila how they helped the idiot cheat in the last election and they all take legal responsibility for the crimes they have committed against the people of the Philippines.

    Yuko, I know that it is a catch 22 for JDV. He was a partner in crime with the DOROBOS! Unless of course he becomes a state witness like Sabit Swingson. The number one corrupt Sabit was able to bring down Erap! Maybe JDV can do the same thing. But who would protect him? the PNP and the AFP? They were plotting to even kill him!

    Meanwhile tuloy ang batikos sa mga gunggong sa AFP/PNP. Ang daming duwag apparently kaya malakas ang loob ng mga intsik na. Tignan mo naman ang provocation noong Taiwanese president. Golly, walang humihirit sa ginagawang pambabastos sa Spratlys! Ayaw kasi ni Gloria Dorobo to rock the boat at baka pauwiin ang mga OFWs na ibinugaw sa Taiwan.

    Kawawang Pilipinas! Pag nilusob ng mga kaaway pihado talo. Daming collaborators ang labas! Heaven forbid!

    FYI…Lozada has arrived but nowhere to be found. Many people including the media were at the airport to meet him but he could not be found. Was he kidnapped by Malacanang? The airport personnel were similarly accountable because they should have made sure he was physically there when he arrived. The airport personnel are controlled by Malacanang. Itatago na naman nila si Lozada sa malayo o ilabas uli ng bansa tulad ng ginawa nila sa mga iba noon. His recent trip was ordered by his boss, Sec. Lito Atienza. Atienza must produce Lozada!

    Senate President Manuel Villar on Tuesday said he wanted airport and immigration officials to account for the whereabouts of the witness of Senator Panfilo Lacson on the cancelled $329-million contract with China’s ZTE Corp.

    “We demand from the Ninoy Aquino International Airport and Immigration officials a full account of Mr. Lozada’s arrival in the airport where he was reportedly kidnapped,” he said in a statement.

    “If it is true that Lozada is being detained against his will, then we urge whoever is keeping Lozada to produce him and turn him over to the Senate where he is called to appear as a witness on the NBN-ZTE deal,” he added.

    Villar issued the demand after receiving a call at around 7:40 p.m. from Lozada’s wife, Violeta, who sought the Senate’s help in trying to locate her husband.

    “She is really worried,” he said.

    Yes, this General is closely identified with Malacanang. In a way, may kaunting negligence din ang Senado at mga taong dapat na sumabaybay sa kanya. The Senate should have their trusted men posted at the airport regularly to monitor the wanted person’s arrival and movement. This was not possible because the Airport is controlled by Malacanang. Ilabas nila si Lozada kundi dadanak ang dugo! Palaban ang pamilya ni Lozada.

    well well, as i mentioned before – you reap what you sow. if there is one thing sacred in the armed forces – it is the chain of command. break it and you end up in deep sh_t – which is precisely where those detained in tanay are.

    might i ask – where are the civilian backers of these imprisoned soldiers? where are the power players that put these soldiers in harms way then left them in mid air? i wonder….

    the military court should not, and cannot be compared to a civilian court. its like comparing apples to oranges. both are fruits but are entirely different altogether.

    And who says there were civilian backers here? This is just the pronouncements of the DOROBO and her ambitious “Cheat of staff”! Asspweron was only an army chief then but he saw the opportunity in these men of honor’s rambling! He then concocted the “LEFT ALIGNING WITH THE RIGHT” scenario and bingo, HE GOT THE JOB! He deceived his own men. Senga knew what happened and he sent General Lim and Col Querubin home! It took them weeks, immediately after asspweron got the promotion when asspweron started to give hell to these officers! Kung talagang may “coup” then, Senga would have arrested Lim and Querubin on the spot! But why did he not? Because there was no reason to.
    The DOROBO used these officers to justify her 1017 decree. She wanted to arrest all the opposition leaders. What a way to pay back what you owe to those who fought for you. When the DOROBO was ousting Erap, Beltran, Satur and all those she wanted put away supported her. But she wanted them in jail! Thus, these men of honor in Tanay came to life. They are just made pawns for the DOROBOS’ and asspweron’s whims. But hey wait, maybe now they can be the Tabako’s pawns as well. With the dumping of JDV as Speaker of the house, Tabako must be cooking something now too. Ngayon gusto na naman nilang gamitin ang mga nakakulong. TAMA NA! These soldiers know very well who their enemies are. They may not have the forum to tell it now but HISTORY has already designated a special place for them. Believe me, this place is far superior to where the DOROBOS are going!

    A woman president? Not again! If I would vote for Hillary though it would be because she is going to push for universal health plan. That was her “baby” even during Bill’s presidency. Lobbbyists from insurance companies do not like her plan but a universal plan is best to cover all citizens. The cost may be hefty to those who will be paying the premiums. They will be higher premiums for sure but in the long run it will be beneficial to the country as a whole. Right now illegal aliens and uninsured citizens rake billions of dollars in expenses not covered by any insurance company. If everyone is insured, the drain from the federal and state reserves would be diminished. Just for this I may vote for Hillary. It would be cool to have Obama and Hillary in the same ticket. Then that would be incredibly powerful!

    PARASABAYAN – yes, there are civilian backers – they come from the business sector , disgruntled retired officials (meaning kulang pa ang kinita nila), disgruntled politicians (meaning gusto pang kumita) at simbahan (misguided people since their main concern should be saving souls and not participate in partisan politics). all movements weather military or civilian requires logistics = supplies = MONEY. walang pera ang mga sundalong nakulong (kaya nga sila nakulong sa tanay – kung may pera ang mga yan – sa veterans or v luna sila ma-detain). so besides their idealism – how are they to carry out their mission if they have no money? dyan pumapasok ang lahat ng parties na i mentioned above. parang laban yan ni Pacman – pupusta ka kay Pacman pero tataya ka din sa kalaban para siguradong whoever wins, panalo ka din.
