Officers face new raps for resisting transfer

Military officers accused of attempting to overthrow government two years ago were transferred yesterday to the Intelligence Service of the AFP in Camp Aguinaldo from the detention facility in Camp Capinpin in Tanay, Rizal.

The transfer of 24 of the 28 accused was ordered by AFP chief Gen. Hermogenes Esperon to facilitate court martial proceedings which had been held in Camp Capinpin since December 2005. The military announced about two weeks ago that the proceedings will be transferred to Camp Aguinaldo.

A commotion erupted in Camp Capinpin as the accused were being prepared for transfer, according to Ma. Flor Querubin, wife of accused Col. Ariel Querubin.

She said the accused resisted attempts by the custodians to handcuff them. The custodians subdued the accused officers.

“The agreement is that no one will be handcuffed while they are brought down. He has no balls. There is no gentleman’s agreement to them,” she said.

She said the wife of Scout Ranger Lt. Col. Edmundo Malabanjot passed out during the commotion which started around 4:30 p.m. She was taken to a hospital.

The wife of another accused Scout Ranger officer, Capt. Montano Almodovar, almost passed out.

Mrs. Querubin said Almodovar’s wife and children saw how the officer was carried to a military truck by eight soldiers “as if he is an animal.”

Mrs. Querubin lashed at Col. Arnulfo Marcos, chief of the AFP custodial center.

“They were willing to go down (to Camp Aguinaldo), why the need to handcuff them….I pity Col. Marcos. What kind of Ranger is he? Maybe he wants to be promoted, he wants to be a general,” she said.

Colonel Querubin’s blood pressure also shot up.

“You have no word of honor, we had an agreement and you are going to do this,” Mrs. Querubin quoted her husband as telling Marcos.

All the accused used to be held in Camp Capinpin. Last November, Brig. Gen. Danilo Lim, former Scout Ranger commander, was detained at the PNP custodial center in Camp Crame after the standoff at the Manila Peninsula. Capt. Dante Langkit has been transferred to the custodial management center at the Army headquarters in Fort Bonifacio. Colonels Januario Caringal and Armando Bañez are confined in a military hospital.

Esperon said the transfer of the accused to Camp Aguinaldo would facilitate the court proceedings “because some of the accused are here in Metro Manila.”

“It will also be good if they are here in Manila because if any of them gets sick, they can be readily rushed to the hospital,” said Esperon.

Maj. Gen. Renato Miranda, former Marines commandant, has diabetes and vertigo. Lim has hypertension.

The accused, escorted by around 100 soldiers and tanks, were in transit to Camp Aguinaldo as of press time.

Defense lawyer Vicente Verdadero said he was in favor of the transfer of the accused to another jail – either the Marine Brig in Fort Bonifacio or the Army’s Custodial Management Unit.

“Isafp is not a custodial (center). It is not a detention center for people awaiting trial on pending charges. You are brought to Isafp to break you down, break you up physically and break you down emotionally and mentally, psychologically. It’s (Isafp cell) more of a torture chamber, I think,” Verdadero said.

Another defense lawyer, Trixie Angeles, said the transfer was done in “bad faith” because the defense and the prosecution have yet to agree on measures to expedite the proceedings.

“Since we have not come to an agreement yet (with the prosecution) and in fact the court martial has not yet directed us by compelling the detainees to come down right now, it’s already in bad faith,” she said.

Defense lawyers have proposed that the accused be tried inside Camp Capinpin, and not inside Camp Aguinaldo, and all the accused must be all present during proceedings. The court has been trying to arraign the accused in batches for the past weeks.

Angeles said the transfer was also illegal, noting the court’s intention of arraigning the accused despite the unsettled issue on the arraignment in batches and the exercise of some of the accused officers’ right to peremptory challenge.

The Armed Forces yesterday said additional charges are being studied against officers implicated in the alleged attempt to overthrow the Arroyo government in February 2006 for resisting their transfer from an Army camp in Tanay, Rizal to Camp Aguinaldo last Friday.

Col. Bartolome Bacarro, AFP information chief, said the officers have been classified by their custodians as “high security risk” after their “misconduct.”

Bacarro said their behavior appears to be another violation of the Articles of War.

“Likewise, a review is being made for a possible curtailment of their privileges to prevent these officers from repeating the same misconduct,” he said.

Bacarro said during the transfer some officers hit Col. Arnulfo Marcos of the AFP Custodial Center.

Bacarro singled out Col. Ariel Querubin and Col. Orlando de Leon who he said displayed “ungentlemanly, impolite and offensive behavior” toward their custodians.” He said this manifests “worsening discipline” among the accused.

Bacarro said Marcos detailed in a report how former Marine commandant Maj. Gen. Renato Miranda, Querubin and De Leon refused to attend the court martial proceedings scheduled for that day “claiming that they were sick and that they have their rights.”

“The incident report also recounted how co-accused Lt. Col. Archilles Segumalian, Capt. Montano Almodovar and Capt. Frederick Sales prevented the senior officers from being brought out of the detention center,” Bacarro said.

Bacarro said a doctor sent to check on the condition of Querubin found that Querubin was fit to travel and “was issued the appropriate medical certificate.”

“However, he (Querubin) still resisted to be brought out of the main detention facility, punching Col. Marcos several times on the left hand, abdomen and chest areas,” said Bacarro.

Bacarro said Almodovar, who was also present during the incident, started smashing plastic chairs on the floor while shouting profanities and threats at the security escorts. He said Sales joined in the verbal abuse.

Bacarro said De Leon also resisted being taken out of the detention facility in Camp Capinpin.

“He held onto a roughly-made wooden table, leaving minor bruises on his arms. This time, Capt. Sales kicked one of the guards and again shouted profane language and threatening words at the security escorts, prompting the latter to vacate the main detention facility,” said Bacarro.

The hearing scheduled yesterday was postponed because of the absence of some of the accused. – Victor Reyes

No matter what Esperon and his fellow crooks do, I doubt if he can manage to break down the spirit of these gallant soldiers, a lot many of whom have received medals because of their capacity to endure and persevere. But then, of course, we all know that Esperon will not be able to understand that because this guy has never fought as gallantly as these soldiers, who have had enough of Gloria Dorobo.

    In a way, magaling iyang lalong nahahasa itong mga sundalong nakakulong. Pag nakalabas ang mga iyan siguradong mas magaling ang AFP dahil subok na di lang katapangan nila kundi pati na ang capacity nilang magtiis, etc. The more they hurt these men, the stronger everyone’s resolve to pull down these idiots from their high horses. I wonder too if the asspweron masterminded the abduction of Lozada. Utak ampaw talaga siya if he did because pinakawalan pa niya eh di ngayon kakanta na si Loozada. It is so easy to know if the affidavits they prepared for Lozada to sign were all written in the same ink and kind of paper.     Where are the socially & politically concerned Filipinos of EDSA revolution that brought down the country’s tyrants in the past?!! I see a lot of scandals going on & on in this Arroyo regime but nothing is happening. I really don’t understand why we Filipinos are tolerating all these. These people are trampling on our rights and dignity. I know if Filipinos will unite, the Arroyo government will be ousted soon. It’s really sad that the FEW GOOD MEN are treated like criminals when the TRUE CRIMINALS are enjoying the fruits of labor that these noble men worked hard for!

    that is why i leave the battling with them. as for me and Kgg . Balweg, mag negosyo na lang kami. wala sa gubyerno ang pag asang umasenso ang buhay ng bawat pilipino, ang pag asa ay nasa ating pagsusumikap sa buhay.

    I hope that Esperon thinks of how he wants to be treated once he is out of power or simply when the table turns around. Justice is when he experiences the very same things that he imposed on these men who happen to have more credibility than him… being the most prominent GARCI general…

    Start listing his abuses and let him suffer the same things later on from the hands of the very same men that he is persecuting.

Justice is when those accused are proven guilty or innocent in the appropriate court. then laws / regulations have to be formulated and implemented so that such things never happen again. only then will true Justice be served.

The CBCP has not yet declared her position regarding Lozada’s plight and how the church could help a member who’s under threat.

    BB, do not expect any reaction from the CDCP. They look at this opportunity(Lozada’s expose) as a chance to collect more money from the DOROBOS! I do not really know what will wake them up! The Philippines has become waht it is right now because the CHURCH had done most of the damage. I am a Catholic and I practice my religion but I do not approve of the CDCP’s stand on the DOROBOS’! I wish another Cardinal Sin(although he made poor choices himself)would emerge from them, to support the ousting of these DOROBOS! My GOD, the sins of these DOROBOS are so overwhelming yet the CDCP DOES NOT RAISE A FINGER TO STOP THEM!

Di bale na si Imelda na kumare na ngayon ni GMA, pero sina Cory at Susan nananatili pa rin pipi. Lozada could be the rallying point…he could lead the people in finally ousting GMA. Payag ba siya?

    I was quite late a while ago for work that’s why i can not answer happy gilmore’s comment eventhough i was tempted to linger and say something. You know what, if the majority of the people in the Phils. thinks like you, i think politicians like GMA et al are just so happy & free to thread on our basic rights and dignity. I have some mental vision seeing you crashed by them with eyes wide awake because only then that you realized your getting involved would have mattered. Right now you think that you live comfortably and you don’t need a change in government that is devoid of moral values. Were you saying that we don’t need another “paghihimagsik” dahil you’re skeptical on how the next leader will plan on managing the economy, military & bureaucracy? THAT IS TOTALLY AN INSULT on the brilliant Filipinos who i firmly believe are capable of leading this country efficiently and once again will bring us in touch with our moral values!
    I admire Mrs. Quirubin’s dedication on her husband and the values he stands for. MABUHAY PO KAYO!
    I think the families of these FEW GOOD MEN and the rest of their supporters should be more vocal like her so people will know more how unjust this regime is!

    I can’t help feeling worried, too, about the condition of Mrs. Querubin. Baka lamutakin iyan ng mga malilibog na tauhan ni Esperon. Naaalala ko tuloy iyong isang pinay na nagsabi sa akin na mas gusto daw niyang sa Japan na lang makulong kesa daw pauwiin siya at doon ikulong sa Pilipinas. Takot daw siyang ma-rape ng mga pulis doon. Unthinkable na mangyari iyan dito, at kung may gagawa ng ganyang kahayupan pihadong kulong at hidi na makakabalik sa trabaho.

    Ellen pls. write more articles regularly, daily updates regarding the plights of these FEW GOOD MEN, especially that they are being subjected to unjust treatment in ISAFP now, that way the people, their families and their supporters are aware of all the injustices done to them. It’s a pity that the PRINCIPLES THEY ARE FIGHTING FOR are being outshadowed by the news on CORRUPTION of GMA & her COHORTS.
