Palace offensive fails to convince senators

lozadafeb11.jpgGovernment and police officials yesterday failed to convince senators that ZTE witness Rodolfo Noel Lozada Jr. was not abducted as the lawmakers saw a clear effort by the executive branch to prevent him from testifying.

Environment Secretary Lito Atienza, PNP chief Avelino Razon and Alfonso Cusi, general manager of the Manila International Airport Authority, said Lozada was not kidnapped to prevent him from testifying.

Senate President Manny Villar said he took exception to testimonies of the law enforcement and airport officials that they were securing Lozada from possible harm.

Villar said the government acted as if a Senate appearance would bring havoc or that Lozada’s life would be in danger while under Senate custody.

“Gusto ko lamang liwanagin, iyong mga parang ililigtas ninyo si Mr. Lozada, from whom? From the Senate?” an irate Villar asked.

Villar said the actuations of the government officials created the impression that testifying before the Senate is something to be feared.

Razon, Cusi and retired Gen. Angel Atutubo, NAIA security chief, maintained that Lozada was not forced to go with his escorts from the Police Security Protection Office upon his arrival last February 5 from Hong Kong.

Senior Supt. Paul Mascariñas, who headed the PSPO team, said when they escorted Lozada to the third floor of the dormitory at La Salle Greenhills after their dinner at a Quezon City restaurant, he discovered there were three armed men acting as Lozada’s private security men posted in the area.

“Carmen, the sister of Jun (Lozada), told me that they were Jun’s private bodyguards who were retired military personnel,” Mascariñas said.

Michael Defensor, former Palace chief of staff, said Lozada assured him at the dormitory of La Salle Greenhills that he was not being held against his will.

Defensor said that when he told Lozada that he would help him escape if he was indeed being kept against his will, the latter assured him he had not been kidnapped and that, “OK naman ako dito.”

Atienza said he felt misled by Lozada, who had made it appear that he was seeking help only regarding his possible arrest by the Senate.

Atienza said Lozada’s move to testify might have been influenced by some senators with whom he was able to communicate in the past weeks.

Atienza’s statement was bolstered by the testimony of lawyer Antonio Bautista that Lozada had confided to him during their first meeting on February 5 that his brother had been talking with opposition Sen. Panfilo Lacson.

Lacson, in a jest, said: “Mr. Chairman, since my name was mentioned, mas masipag lang siguro ako sa iba.”

Revisions

Bautista said Lozada was not forced to sign an affidavit prepared for him on February 6. Lozada later repudiated the affidavit, saying he was under duress.

He said Lozada even made corrections on the document.

To prove his point, Bautista submitted to the Senate the original draft containing Lozada’s corrections on his affidavit.

Razon said Lozada was free to use his mobile phone and to communicate with whoever he wanted to during the time he was being escorted by the PSPO team.

“We only kept silent about Mr. Lozada’s whereabouts due to security reasons,” Razon said. “The PNP had accomplished its mission (of securing Lozada). He is alive and well.”

Cusi said Lozada was allowed to use his phone following his arrival and even spent 10 minutes at the airport restroom.

Adamant

Lozada maintained he did not ask for a protection, he did not know who were the people who fetched him, and that instead of bringing him home, he was brought to Los Baños without his “escorts” telling him where they were going, among others.

He said he was also prevented from sending text messages while in transit.

He also maintained it was Atienza who asked him to go abroad and that his travel papers were antedated.

He said Bautista was not his lawyer and was sent to him by Malacañang to prepare an affidavit.

He said he was initially hesitant to sign the affidavit but Bautista prodded him to do so to comfort “Ma’am,” apparently referring to President Arroyo.

Acted in good faith

Press Secretary Ignacio Bunye said based on their initial observations of the proceedings, the officials who testified only showed that they “acted in good faith, (were) after the safety of witness and took action accordingly.”

He said their testimonies also showed that Lozada’s previous statements were “full of inconsistencies” and refuted his claim that there was an abduction or kidnapping.

“It appears also that the witness, Mr. Jun Lozada, had every opportunity to call. He was not restricted. There was a time when he was alone in the rest room, he was there for 10 minutes. He had his cell phone all the time. If he had any concern, he could have called some relatives, as in fact he did call some outside parties,” he said.

Bad faith

Bunye said the testimonies also showed there was some “bad faith” on the part of Lozada and his family after they filed petition for writs for habeas corpus and amparo despite knowledge that he was safe and was even in the custody of the La Salle Brothers in Greenhills.

Asked if Malacañang would allow First Gentleman Jose Miguel Arroyo to attend the Senate hearing as a further sign of good faith from the Palace after it allowed the Cabinet, airport, and police officials to testify, Bunye said the President’s husband is not a member of the Cabinet.

Bunye said in the case of acting Higher Education chairman Romulo Neri, he still needs to await the decision from the Supreme Court if he can invoke executive privilege in not testifying. – With Jocelyn Montemayor

    On Friday, as Jun Lozada told the truth about the “dysfunctional procurement system” in a government where policy and programs are tailored to fit the greed of the politically powerful, I thought – what a great difference God indeed could make.

    Had we succeeded in escorting Jun Lozada back home from Hong Kong, the circumstances of his appearance before the Senate would not have had the kind of impact this testimony had. That image of him before the Senate, with nuns as his bodyguards, would hopefully make the people of this benighted land realize that this is a fight between the excessively greedy and those who would not surrender their human dignity, their self-respect, and the decency in their souls.

    Magandang example ang ipinakikita ni Lozada. Reminds me of the song, “If I get to heaven and you’re not there, I’ll paint your name on the golden stairs.”

    Siguro naman nagawa na iyon ng Panginoon para kay Lozada. Mabuhay ka Jun! May your tribe increase!

    It’s crystal clear that Rodolfo Lozada was arbitrary detained upon arrival at NAIA by Malacanang Gestapo agents to prevent him from testifying at the Senate. Lozada’s whereabouts was concealed from his family for about 6 hours. Airport officials and police escorts may be liable for obstruction of justice and arbitrary arrest and detention if not, its government-sanctioned kidnapping.

Napanganga nga ako sa narinig ko na sinabi noong isang gunggong, “We do not know from whom, but maybe the administration or the NPA!” nang tanungin kung kanino nila pino-protect si Lozada. Sa amin niya, on the spot, ipapahuli iyan ng head ng Diet. Sasabihan ang prosecutor na i-prepare ang kaso sa kanila obstruction of duty lalo na galing naman sa autoridad ang summon kay Lozada—galing sa Senado with the approval of the SC. Ang linaw-linaw!

    Who was orchestrating the Lozada tour of Southern Luzon from 5pm to 10:30pm? From the horse’s mouth…

    Mike Defensor mentioned that when he was trying to locate Lozada, calling his contacts, he was passed around from one person to another, until he managed to talked to Ronnie Puno who gave him the cell phone number of Macarinas who was at that time in the convoy holding Lozada.

    Macarinas mentioned that he was informing his immediate superior about their whereabout … His immediate superior happened to be talking with Cayetano at that time telling the senator that he has no idea where Lozada was at that time…

    Go figure… who is orchestrating the tour and to whom Mascarinas is reporting to at that time?

    There are 2 points that I would like to raise. These are just personal views.

    1. About the claim of the government officials that everything was normal when they
    fetched Lozada from the airport.

    – How could the “men/escorts” behave suspiciously while they are still inside the airport premises? Siyempre alam naman nila na merong mga CCTVs don ano. Kumbaga sa showbiz, dumaan sila sa acting workshop. Ang tanong sino ang acting coach at director?
    2. About the opportunity for Lozada to call up any member of his family while in the rest room.

    – Hindi ba maliwanag sa sinabi ni Lozada na noong sinundo siya from the airport at nong time na papunta na sila somewhere sa Los Baños ay sinabi ng mga “escorts” niya na nakukuha din lang yong mga messages niya kaya inutusan ang kanyang kapatid na i-triangulate ang CP or something? Eh kung nong nasa CR siya ng aiport at nagkataong tumawag to any of his relatives, sigurado naka-wire tap siya at maririnig conversations niya. Mabuti na rin yong nakipag-cooperate muna siya at di siya nasaktan ng mga me hawak sa kanya kundi wala tayong isa pang credible witness na napapakinggan nayon sa TV at radyo.

    The palace tried its might but failed miserably. However that little triumph the senate inquiry achieved is not a reason to celebrate. The inquiry is but a futile exercise. It cannot take back what were lost in terms of money, honor and boiling veins. Its not surprising also if it cannot stop all. Its not even a forum that can call out to the people to go to the streets. Big sister is very well entrenched.

Mas delikado ang lagay niya kung nagpumilit siyang gumamit ng celfone para itawag ang nangyayari sa kanya. Medyo natakot na nga lang ang mga pasimuno ng pandurukot ng maingay na ang pamilya at media na nalaman tuloy na hawak ng gobyerno si Lozada, na nuong una ay tinatanggi nila.     Ayun nahuli ni Roxas si Bingot na may kidnapping na naganap dahil sumagot ng OO.Ngayon sabihin nilang walang kidnapping ay samantalang umamin si Bingot dahil sa galak niya na naibalik sa kanya ang 50 T, na-distract siya sa script niya kaya NABINGO ang kidnaping sa Senate Hearing.Hindi na kailangan si Bingot sa senado dahil napaamin na at wala ng dapat itanong sa kanya sa kidnaping.

    while I would like to think that GMA&Co. will not kill or do harm kay Lozada at this time..at the back of my mind I am a bit apprehensive..kasi ang isang daga daw when cornered will go for broke and shoot to kill..ang isang tao pagnapasukan ng demonyo o nakainom ng agua de pataranta na marca demonyo could snap!     Ako ay maghapon na nanood ng Senate Hearing on the alleged “detention” (abduction, kidnapping, illegal touring of Lozada sa SLEX?). Karamihan sa mga wetnesses, este, witnesses (or illegal tourist guides?)ay mukhang hindi nagsasabi ng tutoo. Sabi nga ni Anthony Taberna, the more they talk para bang nasa kumonoy sila na palalim-na-palalim ang pagkakalubog. Shall we say sa umaapaw na kasinungalingan?

    What is the real story behind the Lozada Abduction? What is the real reason behind it? Certainly not the death threats that Lozada received from Abalos’ group… Malacanang could simply tell Abalos to “back off” from his threat to Lozada… if Malacanang is serious about Lozada’s safety… but…

    If you simply make a hypothesis that the Lozada abduction is to prevent him from testifying at the Senate or at least to secure affidavits to discredit him in the Senate hearing… then everything else will fall into its proper places…

    Malacanang finger prints are all over the incident… from the attempt to send Lozada out of the country to the “confusions” of the “security arrangements” upon Lozada’s arrival, to the affidavits being forced on Lozada including the written requests for “protection” from Lozada and his sister Carmen…

    Ricardo Puno, DILG secretary, is the one who ordered Mascarinas to pick up Lozada at the airport to whisk him away from the Senate hearing… perhaps silence him forever, if Lozada is not missed by a lot of people… This is important since Lozada said that he cannot lie about the anomalous deal at the Senate hearing which will be very damaging to Malacanang… yes! That is certain! Since if the ball stops with Abalos, they won’t have to break all the security protocols of the airport and the PNP if the testimonies will not be damaging enough for them…

    Puno, short circuited the operation by not informing Gen Razon and the PSPO chief about the intention to whisk Lozada away… That is why he has the cell phone of Mascarinas to direct him what to do with Lozada at that time…

    But since the media and a lot of people are looking for Lozada and the men and the vehicle plate numbers were already made public, they cannot silence Lozada permanently and not getting blamed for the deed…

    So alternate plan B is to secure the affidavits to discredit Lozada in the Senate hearing… they had to get Atty Bautista make the affidavits and ask Lozada to sign them… plus the request letters for security has to be signed by Lozano and her sister to let the gov’t men off the hook for their attempts to kidnap or silence him… but since these were done in a hurry… a lot of details were left hanging… open for cross examination…

    Who has the means to undertake such operations ? Malacanang! We had seen these things before in the case of Udong Mahusay! PSG personnels and helicopters were used to “rescue” Udong from the Senate hearing… after holding on to his family, Udong made a 180 degree turn on his testimonies… Udong, simply a messenger of FG, was considered a vital witness against the guy… and the forces used to secure Udong… is, shall we say, an overkill, or a serious misallocation of gov’t resources…

    So what’s a better proof that Lozada is telling the truth? Malacanang’s actions speaks for itself!

    Akala ko, applicable lang kay Apostol (the always wet) yung sinabi ko sa isang thread. Applicable din pala sa mga humarap sa hearing kahapon lalo na kay Atutubo at sa mga senador na di mo mawari kung paano naging senador.
    Ganito yun eh! Gagawin ko na lang para sa mga humarap sa hearing at mga senador-senadoran at mga tangang ungas gaya ni Abalos at Mike Arroyo:

    “Looking at the right and left parts of their brains, you will notice something very unusual. On the left part of their brains, ther is nothing right. And on the right part of their brains, there is nothing left.”

    Ang mga script writers talaga oo!!! Si Bunyeta deny to the bone pa rin. Sinabi pang may inconsistencies sa mga salaysay ni Lozada, eh consistent nga! Ituloy mo lang Lozada. Tama yang ginagawa mo. Si Judas Machabee hindi natakot humarap sa mga kalaban. Ngayon nasa langit na. Bawal po kasi ang duwag doon.

    Ang mga sinungaling, minsan man sa hinagap ng kanilang buhay di magsasabi ng katotohanan yan, NEVER them to talk the truth kasi WALA tayong aasahan?

    Dapat kumilos na ang taong-Bayan at lahat ng OFWs with migrant Pinoys para matapos na ang problemang ito. Grabe na ang kahihiyan at pahirap sa bayan.

    Ang nakakainis pa eh itong si Guitterez eh kunyari pa na iimbistigahan daw itong ZTE at Kidnapping of Hon. Lozada, ang kapal ng apog eh moro-moro lang ang gagawin niyan, di ba ang Sandigan (Bayan) ni GMA eh rubber stamp yan ng Pidalismo regime.

    Wala nang naniniwala sa inyo except yong mga Kapangpangan na kunsintidor sa kanilang Presidente, pero tingnan nýo ang kanilang mga buhay puro reklamo sa gobyerno na di raw sila umuunlad.

    Magising na kayo sa katotohanan mga kababayang Kapangpangan, ang labang ito eh para sa buong bansa at di lamang sa inyo na nakikinamang sa inyong Presidente na isinusuka na ng Masang Pilipino.

    Wag kayong pasaway at makasarili?

    No way, Rose. Kailangan pa siya ng Panginoon na mabuhay para matapos na si Gloria Dorobo and Company at turuan na rin ang mga pilipinong lumaban.

    Ako kasi naniniwala na kung hindi pa panahon, kahit barilin ka ng sampung beses ang isang nilalang, hindi puedeng mamamatay lalo na kung may purpose pa siya o may dapat pa siyang gawin. I am pretty sure marami pang dapat gawin si Lozada kahit man lang iyong paghahanap ng katarungan para sa pagkamatay ng kapatid niya kaya hindi pa iyan mamamatay. May purpose ang Panginoon sa kaniya.

    Kaya ang dasal ko ay maisatupad niya lahat ang ibig ipagawa sa kaniya ng Panginoon. Magandang pagkakataon din ito na makita niya ang lahat ng pagkakamaling nagawa niya at ituwid iyon kahit na sa pamamagitan ng pagtutuwid ng mga kamalian sa paligid niya.

    God bless his soul. At siyempre kahit na alam kong hindi siya pababayaan ng Panginoon, dasal ko pa rin na iligtas siya. Basta tayo, tuloy lang ang dasal.

    The picture of Lozada shows how confused he is. I still have a bid doubt about his testimonies. As the Bible says: If he cannot be trusted with small things (his ‘mia culpa’ anomalies) he cannot be trusted with big things (his revelation of other people’s sins). Small or big, it’s still stealing or corruption….

    We always sympathize with the underdog like Lozada, BUT do we not deserve the kind of politicians we have voted? There will never be change in Filipino corrupt politics if we voters or if each Filipino does not start the change within himself/herself. This is the challenge of Lenten season.

    At saan naman nandoon iyan quote na iyan about big and small sin? Never heard! Sin is sin, no matter how you look at it, big and small. Ang importante, ang pagsisisi!

    Lozada has not even tried to justify his action. He was being truthful even when Brenda Santiago tried to taunt him over his own supposed “sins.” Kaya bakit hindi natin siya paniniwalaan? He has done what exactly is the definition of the mea culpa that Catholics love to talk about, the very essence of the principle of the Gospel of Jesus Christ as a matter of fact—repentance by confessing his sins, and promise never to do the same mistakes again, leaving in fact no stone unturned, sabi nga.

Funny but I was listening to a discussion on radio re the legality/illegality of the abduction of Lozada, and I realized that there actually are not much difference between our laws in Japan and the laws of the Philippines especially considering the fact that Philippine laws are mostly based on US laws, and the post-war laws of Japan, despite the incorporation of pre-war laws and what we call as unwritten or customary laws, are in fact made by Americans for post WWII Japan. I guess the only difference is that the laws here are implemented and followed to the letter because the enforcers of the law are more sincere in wanting to keep the peace and order here intact, and the laws are religiously abided by.

    In fact, with the confession of Lozada, if he were Japanese and if his abduction was proven as admitted by his abductors himself that it was meant to prevent him from appearing in the Senate, the head of the police will surely be told to resign immediately together with his deputies and all those heads of agencies like Atienza involved in the abduction. Defensor for instance can also be arrested on the spot for even admitting offering Lozada money no matter how noble he claimed his intention was.

    Apparently, there are laws in the Philippines that define such acts committed by Razon, et al at the order of the illegitimate president they try to protect via her deputies exactly for the intention of possible evasion of responsibility should the operation fails and is exposed for what it was intended in the first place as illegal, criminal and punishable as it was meant to obstruct the function of the Senate in the interest of the law, welfare and interest of the nation. Bakit mahirap intindihan iyan?

    Sa amin iyan, pihado magtatawag na ng meeting with the parliamentarians ang Japan Federation of Bar Associations that acts likewise as defender of the rights, welfare and interest of the people of Japan. At saka kahit anong grupo like the BnW, puedeng humingi ng meeting with our parliamentarians to discuss on this kind of violation of human rights as what Lozada has been subjected to.

    Bakit hindi iyan magawa sa Pilipinas? Pambihira talaga. BTW, iyong puedeng sumali sa sinasabing balak na magrally sa Pilipinas sa biyernes, please pumunta kayo.
