The ‘liberation’ of Romy Neri

I talked with Romy Neri, one of the main characters in the scandalously overpriced NBN/ZTE deal Monday night at a US Embassy reception.

The affair was to welcome the new faces in the embassy public affairs section namely Martha Buckley, cultural attaché; Rebecca Thompson, press attaché, and Karen Schinerer, deputy press attaché.

I asked Neri, former director general of National Economic and Development Authority and now chairman of the Commission on Higher Education, about the notes of his friend Rodolfo Noel “Jun” Lozada written October last year on “What is Neri afraid to say and why?” after his Senate testimony last year where he clammed up when the involvement of Gloria Arroyo in the $329 million telecommunications contract was asked. I carried Lozada’s notes in my column last Monday.

Neri said he hasn’t read the article by Lozada. I recalled for him the contents of the article especially this portion: “What is Neri afraid to tell the public? He is afraid to tell the public that after he reported the Abalos P200 million peso bribe offer, Arroyo casually told him to ignore it and work for its recommendation for approval anyway. That when he protested that it is too controversial and may attract the wrong kind of attention from media, Arroyo retorted back ‘Pakulo lang ni Joey yan and his father.’

“When he tried to reason that it may not be accommodated in the Chinese ODA package because it has been filled up with a list of projects already, Arroyo again ordered him to remove the low cost housing project and some water project to accommodate the ZTE-NBN deal in the ODA loan.

“That when he attempted to reason that it may not be approved in time for the Boao Forum which was only two days to go from that fateful April day, Arroyo with raised voice told him to include the ZTE-NBN project in the agenda of the following day’s meeting of a combined NEDA Board and Cabinet Committee, who as expected promptly approved the project paving the way for the contract signing between ZTE and DOTC in China the next day.”

I also recalled to him this part: “Neri is afraid to tell the public that this conversation took place between him and Arroyo because it might spark another impeachment complaint against Arroyo. He is afraid that another impeachment will simply result to more expenses of public funds similar to the Hyatt 10 impeachment crisis, because as DBM secretary who replaced Boncodin, he was entrusted with the large scale DBM payola operation of Arroyo to Congressmen, Senators and Governors not quite similar to the crude Panlilio incident that the public is witnessing now. He is afraid with a more partisan Andaya at the helm of DBM, more public funds will be spent to buy the silence and favor of these greedy legislators and local executives.”

Neri simply said, “Why are they speaking for me? Why are they putting words in my mouth?”

I told him that Lozada, who has resigned as president of Philippine Forest Corporation, has said that he feels “liberated” after he decided to come out with the whole truth about what he knows about the NBN/ZTE deal. I asked, “Do you also feel liberated?”

Neri replied, “I feel liberated from the Senate sergeant-at-arms,” referring to the Supreme Court’s granting of a temporary restraining order to the Senate to execute its warrant of arrest to compel him to appear again in the Blue Ribbon committee investigating the anomalous telecom contract with a Chinese firm.

I asked Neri about Tom Eisaguirre and Roger Estrella who were mentioned by Sen. Jamby Madrigal in the Feb. 8 hearing. Madrigal asked Lozada if his relationship with Neri was the same as that of Eisaguirre and Estrella. Lozada replied, “My relationship with Romy is professional.”

Tom was also the subject of my Feb. 4 column after I got reports that the reason why Neri is vulnerable to Malacañang pressure is because they have documents about alleged involvement of Tom in some projects that passed through NEDA.

Neri’s reply was, “They have nothing to do with the ZTE project.”

I asked him about Malacañang using information gathered about Tom to pressure him from telling the Senate all that he knows about the NBN/ZTE deal. He denied there is any pressure.

I did not press him further because I sensed that he was becoming very uncomfortable about our conversation. I was not able to ask him about the opposition of the Organization of NEDA Employees (ONE) to his request to renew the contracts of five consultants to NEDA, one of whom is Tomas Eisaguirre.

In a letter dated Dec. 28, 2007, Neri, who was transferred to CHED August 2007, wrote NEDA director general Augusto Santos “requesting renewal of contracts of … consultants assigned in the office of NEDA director-general” namely Atty. Paul Lantanas, Atty. Herald A. Decayo, Jr., Engr. Arsenio Mesiona, Mr. Tomas Eisaguirre, and Mr. Antonio S. Manalo.

Aside from the consultants, Neri also asked f or the extension of the detail of four NEDA employees to his office at CHED namely Lourdes Reyes, executive assistant; Felino I. Torsar, administrative aide VI; Antonio F. Enriquez, administrative aide III; and Antonio L. Alvarado, close-in-security.

Sources at NEDA said some of those consultants, who are getting at least P20,000 a month, are not qualified. An example, they said, is Eisaguirre who is a high school graduate and is known to them as Neri’s driver and companion but is given the position of “technical consultant.”

NEDA sources said the hiring of unqualified consultants is causing demoralization among employees. The recommendation of NEDA One is “to discontinue the hiring of these consultants and that all NEDA resources assigned at CHED be rightfully returned.”

NEDA sources said despite ONE’s opposition, Neri’s request will likely be approved. The pressure is too strong, they said.

    We should congratulate Ellen for partly succeeding in getting some statement and information from Neri. What other journalists failed, Ellen succeeded. Needless to say, Neri’s accommodation to Ellen was not because Ellen happened to be in that social occasion; but out of respect for Ellen’s character and credibility. I don’t think Neri would even say a word to other journalists. Congrats Ellen!

It could even be beyond the special privilege Neri did to Tom and his other intimate friends. It could be something very private that Malacanang has that might embarrass Neri. Baka may hidden video clip na hawak ang Malacanang sa relationship ni Neri sa kanyang mga poging kaibigan. Ang lahat na ito ay mananatiling speculation at tsismis until Neri speaks and tells the truth. In the meantime, kasing baho din siya ng iba pang mga kasama niya sa Malacanang.

    HS graduate lang si TOM pero technical consultant ng NEDA at may allowance na P20K/month.
    About 40% of government officials are unqualified for posts. Many government departments and agencies have bloated number of assistant secretaries, undersecretaries and consultants. Many of them are political appointees. Retired military and police officials are appointed in GMA Cabinet and juicy govt. posts as reward for their canine loyalty.

    cocoy – my opinion is mine only and I could be wrong or right. That being said, you can expect I will present both sides of the coin.

    Right now, the senate has momentum to break open wide ZTE commission. Too much security thrown on Lozada, discredit effort as witness has failed by Senator Arroyo and Senator Santiago initiated transfer of investigation to the (in) Justice Department for dead-end job. All these, are coordinated efforts for damage control. Senate achieved what it set out to do that government will overplay its hands for cover-up. The weakest link is Romy Neri who has direct instruction from the President. That instruction is protected by the executive privilege recognized by Supreme Court. That instruction is evidence of President’s involvement in the commission. If Neri come out on his own conscience regardless of his life, this can change the political situation tremendously and we will be seeing a different Philippine president in 2008.

    Agents of the National Bureau of Investigation (NBI) on Tuesday swooped down on the former office of Senate star witness Rodolfo “Jun” Lozada Jr. at the Philippine Forest Corp. in Fort Bonifacio in Taguig City.

    “May mga NBI agents doon sa opisina ko at lahat ng cabinet ko, pilit binubuksan (There are NBI agents at my office and they’re using force to open my cabinets),” Lozada told a radio dzMM interview Tuesday afternoon.

    It won’t be a smooth transition of power. Kabayan Noli cannot guarantee full blanket immunity to Gloria Arroyo. No one is above the law. De Castro may influence or pressure the Ombudsman or other courts to take easy on Gloria. He will block the re-investigation of the Hello Garci political scam because he also a direct beneficiary.

    We are outraged that Rodolfo “Jun” Lozada Jr., the emerging star witness in the ZTE scandal, was abducted by the police under the guise of securing him. We reject the explanation by the Chief of the Philippine National Police that it could not have been an abduction since the family had solicited their protection. Mr. Lozada himself and members of his family deny requesting protection.

    We condemn the use of the state security apparatus to suppress the truth. During the period of his unwarranted custody, Mr. Lozada was made to sign affidavits that would compromise his intended testimony on the ZTE deal. Even if he was not threatened with physical harm, he was not free to do otherwise while under the control of unknown security personnel. He was made an offer he could not refuse.

    We are deeply concerned about the continuing deterioration of the human rights record of this Administration. Mr. Lozada is fortunate that he is the focus of intense public attention, unlike many other unheralded victims of rights violations. So revealing what he knows to be true has set him free from fear.

    The Administration believes that the cancellation of the ZTE contract has negated the need to investigate the deal further. They have tried to keep the truth hidden by denying the freedoms of key witnesses. Yet, we all have a stake in knowing the truth. We urge the public to be more vigilant, lest the freedoms denied those few witnesses to the truth are also removed from all of us.

Kung hihintayin pa ang 2010 ay baka matalsik na siya o iba ang umupong Pangulo mula sa opposition. If Noli replaces her, GMA would use all the resources and money to support Noli’s presidential bid in 2010. Kapag manalo si Noli, protected na naman si GMA for another six years hindi pa kasama ang dalawang taon mula ngayon until 2010 which total 8 long years of protection by Noli. Ibibigay lang ni GMA kay Noli ang puwesto basta pumayag si Noli sa mga kasunduan na iyan. Kaya sa mga statement ni Noli ngayon sa media medyo iba na ang tono.     I was watching in my television (TFC) last Monday for the whole duration of the investigation of Mr. Lozada. What caught in my attention was no body from the senators asks about the procedure of detailing of PNP personnel as VIP security.

    I am a Former Police Officer of the PSPO and it’s unusual that a civilian was given outright VIP security more than required by the law except the subject give huge amount of money to the officer in charged or the latter was a political ally of the arroyo administration. There is an off the record tradition of these unit which every end of the month before you can get your salary the PNP personnel from these unit should give at least 10% of the amount received as part of the honorarium given by the VIP. I told you these so that these practice must be stopped.

    Imagine the total strength of the PSPO personnel estimated to more or less 1,500 all these personnel can’t receive their salary at the end of the month if they will not give 1000 pesos as ten percent for the honorarium received from their VIP.meaning every month they have at least 1 million and in one year they have 12 million.

    As a former member of the said unit deploying of our personnel to a civilian VIP was only granted upon the threat assessment was established or their is an eminent threat which was conducted by the Intelligence group of our unit. another thing the personnel deployed should not be more than two personnel and no Senior PNCO (SPO4) or Police Officer Ranking from Police Inspector Allowed to secure the VIP.

    In these case it’s really clear that these PNP personnel involved has something to do with the abduction or kidnapping of Mr. Lozada may be they’re protecting someone that’s very important people or authority from the Aroyo government rather than protecting the life of Mr. Lozada. What I most feared of, if ended the media was not learned about the arrival of the subject then may be Mr. Lozada now is 6 feet below the ground. As I know no one stand against the arroyo allies.

    The usual procedure that was stated by Gen Razon and Col Mascariòas is clearly far from the truth and a cover up of the scenario…the question is, why the subject was given VIP personnel with out proper conducting of treat assessment? 2nd, why a full pledge Colonel or Senior Police Officer of the PSPO is the one who acted as Team leader during the said securing of the VIP?

    One can argue that there are valid concerns – the impoverished are too busy putting food on the table, the middle class are busy applying for work abroad, the business sector worries about rocking an upbeat economy, the alternatives are not clear, etc. And so we settle for what we think is the lesser evil. But look at where this choice has brought us.

    We call on our people. If you still cannot find it in your heart to declare your outrage publicly, can you at least join in praying for Jun Lozada and his family. President Cory Aquino and the La Salle Brothers will be celebrating mass at the La Salle Greenhills grounds on Sunday, Feb. 17, 10 am for that purpose – pray for Jun and his family?

    That means anything the witness Lozada has said or will say is just a matter of perception. That is true.     But here is the huge dilemma for the administration. The final arbiter of perception issue are not the senators or pork-barrel paid congressmen. It is the general public.

    This is where administration is trying to shift the burden of corruption by going full blast at the Venecias in two fronts, (1) unaccounted funds audit, (2) revive the Northrail scam.

    This is what we wanted to happen so the ousted speaker will finally admit wrongdoing and point to the grand manipulator, the first family.

    I can understand your concern, alj. Once the church, church members or anyone and any group starts asking for donations, then we should be cautious. It might get into wrong hands again. Your opinion about Lozada is partly correct. He did admit that he did some mistakes in the past. But that doesn’t erase his credibility and sincere desire to help the country. Remember…it takes a thief to know another thief. In the case of this ZTE scam deal, Lozada is a very credible witness since he was part of it or almost part of it. He did say that he followed Malacanang’s script until the last minute when his conscience started to bother him. He changed his mind and chose the light/truth after he arrived at La Salle sanctuary. Before that, he could be just playing along with those bad guys.

    i know all of us in here are all concern for our beloved country…we all have the same sentiments and hope…that is for a better Philippine Goverment and Leaders.

    credibility is really important in this matter … but having this issue being investigated by the senators, they too must maintain that this on-ging senate inquiry is credible (w/o any political motives … purely for the truth) …. i’m glad some senator’s inhibit themselves from the inquiry because thier involment in some other way..thta’s sign of credibilty (as long as lapid and revilla wont replace them)

    i do believed that something is wrong about this ZTE deal … why? though it hurt, but that is how our goverment is, its a given fact (it goes down all the way to Marcos-the president/goverment i 1st knew of)… that’s the very reason why we have EDSA 1 and 2.
    this senate inquiry must be able to bring out alot of answers that we Filipino deserve to know.

    1. who are all the person involves who would be benifitting from the said commssion? (right now it just Abalos and FG are dragged … maybe there’s some more … GMA, JDV(father & son), NERI or even Lozada’s could be)

    2. is the deal overpriced? – my take here is that the senate should have made their own computation, consult an independent firm, this way they will not just rely from lozada’s claim that it’s over priced since this is being disproved by the ZTE corp and DOTC … having had that study, right there they can say it is over priced or not.

    3. let neri speaks again! … can SC reverse ruling on Executive appearing on the senate?

    4. dont waste time about the kidnapping issue..they wasted about a week on this issue. (they make it so technical, but in lay man’s term – kidnapping is something your grabbed, no communication to your family/friends, or even killed/silenced)…here with all honesty i believed that before lozada’s appearance at mandaluyong, he do really wants protection from not appearing before the senate…(it’s my own opinion..pls).

    5. laid out the plan to uncover other/if not all goverment projects that were over priced and was benifited by individuals.

    this being said, i’m for the completion of this senate inquiry…once done, then they can recommend filing of charges! … but that does not end there … if guilty, let them pay for it (this is were we Filipino is weak .. we easily forget … had there’s no pardon in Esterda’s case, then it will be preceedent to the next .. but it’s the other way around … expect that if GMA would be found guilty, she would be given a pardon too)
